Each of the amici is a U.S.-based peace, social justice, and/or religious non- governmental organizations. Each is committed to justice, equality and human rights of all people, including Palestinians and Israelis. The Amici support the boycott of Israel for the purpose of pressuring Israel to respect the human rights of the Palestinian people. The Amici collectively have thousands of members and supporters, in Arizona and throughout the United States, who participate in the boycott of Israel and who are affiliated with companies that would be directly affected by the enforcement of A.R.S §§ 35-393 et seq., the statute at issue in this case. They have organized or supported scores of different boycott campaigns for Palestinian human rights. All of the Amici seek to communicate to the Court that support for the boycott movement is not discriminatory. Support for the boycott movement is a measure to combat the systematic discriminatory practices of the Israeli government that deny Palestinians justice and equality under the law. Accordingly, the proposed Amici have “. a unique perspective [and] specific information that can assist the Court beyond what the parties can provide.” Voices for Choices v. Ill. Bell Tel. Co., 339 F. 3d 542, 545 (7th Cir. 2003)(Posner, J., in chambers). The proposed Amici seek to appear in support of Plaintiffs-Appellees Mikkel Jordahl and Mikkel (Mik) Jordahl, P.C. and in support of affirmance of the order of the District Court made on September 27, 2018. INTRODUCTION By order dated September 27, 2018, the District Court enjoined enforcement of the Certification Requirement in A.R.S. § 35-393.01(A), which provides that every company contracting with public entities in the State of Arizona must certify that it is not engaged in, and for the duration of the contract promises that it will not engage in, a boycott of Israel. The District Court readily concluded that requiring Plaintiffs-Appellees to 2 Case: 18-16896, 01/22/2019, ID: 11161862, DktEntry: 69, Page 8 of 26 promise not to engage in a boycott of Israel burdened expressive political activity protected under the First Amendment, and that the State had no legitimate countervailing interest in restricting the expressive conduct of Plaintiff-Appellees on a matter of public concern. For centuries, boycotts have been effective mechanisms for political protest; the Boston Tea Party, the Montgomery Bus Boycott, and the global movement to divest from South African businesses, for example, all sought and contributed to desired social change. Boycott and divestment campaigns for Palestinian human rights are no different. In aiming to change the state practices of Israel, boycott campaigns engage in an activity that lies at the heart of the First Amendment in a democracy—people who share common views banding together in expressive activity to achieve a common end. The District Court fulfilled its time-honored role in protecting this expressive activity. Appellants have sought to invoke US laws against discrimination in their effort to justify the Certification Requirement. To do this, they have created a false identity between Jews, on the one hand, and the State of Israel and its policies on the other. They suggest, in other words, that boycotting the State of Israel is the same as boycotting Jews. But the State of Israel is not within any class or category protected by US laws against 3 Case: 18-16896, 01/22/2019, ID: 11161862, DktEntry: 69, Page 9 of 26 discrimination, and the boycott movement for Palestinian rights does not discriminate against Jews or any other group. Companies and institutions are boycotted for complicity in Israel’s human rights abuses, not because of their religious affiliation or national origin. They are boycotted, in other words, because of what they do, and not because of who they are. Boycotts to support Palestinian rights thus are not discriminatory. They are efforts to pressure the government of the state of Israel to end its discrimination against the Palestinian people, by exerting economic pressure on companies and institutions

The evangelical community in the US remains steadfastly Zionist, so overall support for financial aid to Israel remain secure. But the cultural impact of accusations that Israel is a settler colonialist or apartheid regime are nonetheless serious; they are proving sufficient to make support for the Jewish state a political issue for the first time in many decades. Despite a general movement in emphasis from theology to politics in church debate, there remain theological issues at the center of church discussion. The Protestant church with the longest running and most well-funded anti-Zionist constituency is the Presbyterian church in the US. In the last decade, its Israel/Palestine Mission Network (IPMN) has produced several increasingly anti-Zionist books designed to propel divestment resolutions in the church’s annual meeting. The most widely debated of these was 2014’s Zionism Unsettled: A Congregational Study Guide. This essay mounts a detailed analysis and critique of the book which documents the IPMN’s steady movement toward antisemitic positions. Among the theological issues underlying debate in Protestant denominations are the status of the divine covenant with the Jewish people, the role that the gift of land has as part of that covenant, and the nature of the characterization of the Jews as a “chosen people”.

    BDS IS NEITHER “ANTI-ISRAEL” NOR “ANTI-JEWISH” PETITION OF PROTEST AGAINST INDIANA’S ANTI-BDS LEGISLATION We, the undersigned, write with alarm in response to the Indiana General Assembly’s passing of SR 74, the so-called “Boycott Our Enemies not Israel Act.” According to the Israeli newspaper, Ha’aretz, the approval of SR 74, following the Indiana House’s unanimous passing of HR 59, “expresses opposition to the anti-Jewish and anti-Israel” BDS movement. The bill further states that “the global spread of anti- Jewish speech and violence “represents an attack, not only on Jews, but on the fundamental principles of the United States.” Pending Governor Pence’s likely signature, in passing this bill, Indiana will become only the second state in the United States to pass legislation formally opposing the Boycott, Divestment and Sanctions (BDS) movement regarding Israel. We completely reject this characterization of the global BDS movement, as well as of the more focused BDS resolutions of various church denominations (eg. Presbyterian Church USA, United Church of Christ, United Methodist Church) and other organizations. It does not stifle free speech; in fact, it is the essence of the exercise of free speech. BDS is not (the vague) “anti-Israel” and it is certainly not “anti- Jewish.” In fact, BDS policies make it clear that it is a human rights based movement and opposed to racism in all forms, including anti-Semitism. This is one of the reasons why many Nobel Peace Prize laureates and faith groups support BDS, including Archbishop Emeritus Desmond Tutu and Mairead McGuire, The Baptist and Episcopal Peace Fellowships, and the Palestine-Israel Mission Networks of the Presbyterian Church USA, United Church of Christ, and Quakers.

    Promoters of BDS—the movement to boycott, divest from, and bring sanctions against the Jewish state of Israel—are open about their aim of pressuring Israel to relinquish land for a Palestinian state. What they less often share is that a two- state solution—Israel and Palestine living side-by-side in peace—is not their goal. THE ORIGINS OF THE ISRAEL BOYCOTT ven before the State of Israel was officially declared in 1948, with the endorsement of the EUN and backed by the immediate recognition of U.S. President Harry Truman, Arabs in British Mandatory Palestine and throughout the region declared war against the Jews. They sought to kill as many as possible, drive the rest out of the country, and end the Jewish state. That era of belligerency lasted over 30 years before Israel and its chief antagonist, Egypt, signed a peace accord in 1979. When it became clear that war could not defeat Israel, those seeking to bring Israel to its knees shifted tactics, and the Palestinian Intifada was born. It came in two waves of terror, running from 1987 to 1993 and then from 2000 to 2005. These surges were premised on the idea that Jews were foreign colonizers who, like European imperialists in the Third World, could be driven out by making the cost of staying higher than the colonizers could bear. But the Palestinians learned during their terror campaigns that the threat of physical harm would not end the Jewish state, because the Jews knew that they belonged in Israel. Next came the current stage in the long-running campaign against Israel—the movement to boycott, divest from, and bring sanctions against Israel, or “BDS” for short.
