COMMISSION'S FINAL REPORT '

INTRODUCTION

1. On 1 September 1987 we wrote to Oldham Metropolitan Borough Council announcing our intention to undertake a review of Oldham, as part of our review of the Metropolitan County of Greater Manchester and its Metropolitan Districts under section 48(1) of the Local Government Act 1972. Copies of our letter were sent to the adjoining Metropolitan District Councils; to the County and District Councils bordering the Metropolitan County; to Parish Councils in the adjoining districts; to the Local Authority Associations; to Members of Parliament with constituency interests; and to the headquarters of the main political parties. In addition, copies were sent to those government departments, regional health authorities and statutory undertakers which might have an interest, as well as to the English Tourist Board, the local press and the local television and radio stations serving the area.

2. The Metropolitan District Councils were requested, in co- operation as necessary with the other principal authorities, to assist us in publishing the start of the review by inserting a notice for two successive weeks in local newspapers so as to give a wide coverage in the areas concerned. The Councils were also

1 asked to ensure that our consultation letter was drawn to the attention of those involved with services such as the police and the administration of justice.

3. A period of seven months from the date of our letter was allowed for all local authorities, including those in the surrounding districts, and any body or person interested in the review, to send us their views on whether changes to the borough boundary were desirable and, if so, what those changes should be and how they would serve the interests of effective and convenient local government, the criterion laid down in the Act.

THE SUBMISSIONS MADE TO US

4. In response to our letter of 1 September 1987, we received representations from Oldham Borough Council, Manchester City Council, Rochdale Borough Council, Tameside Borough Council and Kirklees Borough Council. We also received representations from the Chief Constable of Greater Manchester, the Greater Manchester Police Authority and a member of the public.

5. We consider that, taken as a whole, the present area of Oldham is apt for securing effective and convenient local government and we have decided to propose no major change to its boundaries. Our proposals relate only to the minor realignments described in this report.

SUGGESTIONS FOR CHANGE AND OUR INITIAL CONCLUSIONS

THE BOUNDARY BETWEEN OLDHAM AND ROCHDALE

(a) A672 Ripponden Road

6. Oldham had suggested a realignment of its boundary along the north west side of that part of the A672 (Ripponden Road) currently within Rochdale, and the transfer of a public house and bungalow from Rochdale. The Council's grounds for the suggestion were that the A672 is a major highway linking Oldham with the M62, and that highway maintenance would be facilitated if it were transferred to Oldham. It was also claimed that the public house and bungalow relate, in community terms, to the of Denshaw in Oldham. Rochdale submitted a similar suggestion, as did the Chief Constable of Greater Manchester.

7. We felt that it would be in the interests of effective and convenient local government to transfer that part of the A672 which passes through Rochdale, and the area to the east of the road, to Oldham, the authority which the A672 primarily serves. We therefore decided to adopt Oldham's suggestion as our draft proposal.

(b) Moorcock Inn

8. Oldham had suggested realigning its boundary with Rochdale in order to transfer the Moorcock Inn from Rochdale to its area, on the grounds that it forms part of the community of Denshaw in Oldham. Rochdale supported Oldham's suggestion.

9. We agreed that the Moorcock Public House was isolated from the rest of Rochdale, and therefore decided to adopt Oldham's suggestion as our draft proposal.

(c) A663 ( Road) in the Jubilee area

10. Oldham had suggested realigning its boundary with Rochdale so as to unite the Jubilee area in Oldham, Rochdale supported the suggestion, commenting that the realignment would correct an historic anomaly. 11. We noted that the existing boundary bisects an industrial complex and felt that, in terms of community of interest, Jubilee seemed to relate to the community of Shaw, in Oldham. We therefore decided to adopt Oldham' s suggestion as our draft proposal, subject to a minor realignment to remove a stretch of defaced boundary.

River Beal,

12. Oldham had suggested the realignment of its boundary with Rochdale to follow the present course of the , adjacent to a sewage works. Rochdale had supported the suggestion.

13. We noted that the existing boundary follows the old course of the River Beal, bisecting the sewage works, and that Oldham 's suggestion would unite the works in its area. We therefore decided to adopt Oldham 's suggestion as our draft proposal.

(e) B6194 (Rochdale Road/Broad Lane)

14. Oldham had suggested amending its boundary with Rochdale in the vicinity of Burnedge, so as to unite in Rochdale properties which are currently divided. Rochdale supported the suggestion.

15. We noted, however, that seven properties, which seemed to form part of the settlement of Burnedge in Rochdale, still appeared to be divided from that settlement by Oldham 's suggestion.

16. We wrote to Oldham and Rochdale seeking their views on the appropriateness of uniting these properties in Burnedge by realigning the boundary along the B61 94 , south west along Pit Lane and then along field boundaries to meet the existing boundary . 17. Rochdale supported our suggested amendment. Oldham, however, preferred its original suggestion and did not want the seven properties to be transferred.

18. We felt that it was in the interests of effective and convenient local government both to unite the divided properties and to unite the seven isolated properties with the remainder of the settlement of Burnedge in Rochdale. We therefore decided to adopt Oldham's suggestion as our draft proposal, subject to a modification to transfer the seven properties to Rochdale.

(f) B6393 (Greengate)

19. - Oldham and Rochdale had jointly suggested realigning their boundary so as to unite the Elf filling station in Rochdale.

20. We noted that the existing boundary bisects the filling station and that the suggested, realignment would rectify the anomaly. We therefore decided to adopt the suggestion as our draft proposal, subject to a minor modification to tie the boundary to firm ground detail.

(g) A671 (Oldham Road/Rochdale Road) Summit

21 . Oldham had suggested a minor realignment of its boundary with Rochdale, to unite two properties in Rochdale and one in Oldham. Rochdale Council had supported the suggestion.

22. We noted that all three properties are currently divided by the existing boundary. However, when considering Oldham1s suggestion for this area, we noted that the settlement of Gravel Hole is also divided by the existing boundary and that the area seemed to look more towards Balderstone than to Royton and Shaw. We wrote to Oldham and Rochdale to enquire about the desirability of uniting the settlement in Rochdale. 23. Oldham strongly opposed the transfer of that part of the settlement in its area to Rochdale, on the grounds that it has a'strong community of interest with Oldham. Rochdale indicated that the current boundary correctly reflects the divide between the two communities.

24. We noted the strong opposition of both Councils to the suggested unification of Gravel Hole in Rochdale. As it appeared that the current boundary in this area had no adverse effect on the provision of services to Gravel Hole, we did not pursue the question of uniting it in one authority. Instead, we decided to adopt Oldham's minor suggestion as our draft proposal, subject to a small modification to the boundary at the eastern end of Thornham Lane, uniting the curtilage of number 196 Castleton Road in Oldham.

THE BOUNDARY BETWEEN OLDHAM AND MANCHESTER

(a) St Margaret's Road/British Aerospace

25. Oldham had suggested the realignment of its boundary so as to unite in Manchester the curtilage of St Margaret Mary's Church School and Convent. Manchester supported the suggestion but submitted an alternative alignment which would follow the line of the proposed M66 extension.

26. When considering the boundary in this area we felt that a better alignment could be found by using the south from the existing boundary to the north of Chadderton, then to the A6164, then west along that road to the B6393 and, finally, north up the B6393 to the existing boundary. We asked the Councils concerned for their views. 27. Oldham and Manchester both opposed our suggested alignment. Oldham pointed out that the Canal was derelict and could not be seen for long stretches. It also claimed that the loss of this area would have major implications for the economic revival of Oldham. Manchester re-iterated its suggestion that the proposed M66 extension should provide the boundary in this area.

28. We agreed that, in the light of the information provided by Oldham, the Canal would not provide a good boundary. However, we also felt that it would not be appropriate to propose as the basis of a realigned boundary a motorway extension which had not yet been constructed, since it could not be followed on the ground. We therefore decided to adopt Oldham's suggestion as our draft proposal.

(b) Moston Brook to A62 (Oldham Road)

29. Oldham had suggested the realignment of its boundary with Manchester so as to unite in its area the whole of an industrial site at Meadow Mill, thereby taking account of redevelopment which had taken place.

30. We agreed that the boundary in this area should reflect the current pattern of development, and that it would be in the interests of effective and convenient local government to unite the site at Meadow Mill in one authority. We therefore decided to adopt Oldham1s suggestion as our draft proposal, subject to minor modifications to remove lengths of defaced boundary.

(c) Brookdale , Failsworth

31. Oldham had suggested the realignment of its boundary with Manchester so as to unite Brookdale Park in Manchester. 32. We noted that Brookdale Park was owned and maintained by Manchester City Council, and felt that it would be in the interests of effective and convenient local government to unite the park in that authority. We therefore decided to adopt Oldham1s suggestion as our draft proposal, subject to a minor modification to rectify a stretch of undefined boundary.

THE BOUNDARY BETWEEN OLDHAM AND TAMESIDE

(a) Clayton Bridge/Medlock Vale

33. Oldham had suggested the realignment of its boundary with Tameside to the mid-course of the and its small tributary between Clayton Bridge, north of the Manchester -Ashton railway line, and Medlock Vale. Tameside had made a similar suggestion.

34. We noted that the course of the river had changed radically with the passage of time and that the existing boundary is now defaced. We concluded that the suggested realignment would rectify this anomaly and tie the boundary to ground detail. We therefore decided to adopt Oldham's suggestion as our draft proposal, subject to a minor modification to remove a section of defaced boundary.

(b) A627 (Oldham Road)

35. Oldham had suggested realigning its boundary with Tameside to conform to the current course of the River Medlock and a bridle-way from Fenny Field bridge along the former Branch Canal; this would unite a chemical works in Tameside. Tameside had supported Oldham's suggestion.

36. We agreed that Oldham's suggestion would provide a good, easily identifiable boundary, as well as uniting the chemical works in one authority. We therefore decided to adopt it as our draft proposal.

8 (c) Under Lane/Lees Road: Grotten

37. Oldham had suggested the realignment of its boundary with Tameside so as to transfer a narrow tongue of land, including a small part of the former Grotten Brickworks and Butt Farm, from Oldham to Tameside. Tameside had supported Oldham's suggestion.

38. We considered that Oldham's suggestion would provide a well- defined boundary, and decided to adopt it as our draft proposal.

(d) A6050 ( Road/Quick Road)

39. Oldham had suggested realigning its boundary with Tameside so as to unite the hamlet of Quick in its area. Tameside had opposed the suggestion on the grounds that it would produce anomalies in terms of access and would hinder service provision.

40. We noted that the existing boundary divides the hamlet of Quick and felt that the question of access put forward by Tameside was not in itself sufficient to 'outweigh the desirability of uniting the hamlet in one authority. We therefore decided to adopt Oldham's suggestion as our draft proposal, subject to a minor modification to rectify a stretch of undefined boundary to detail.

(e) Shadows Lane/Manchester Road/Huddersfield Road

41 . Tameside had suggested realigning its boundary so as to transfer an isolated, triangular-shaped area of land from Oldham to Tameside, Oldham and a resident of the area had objected to the suggestion, on the grounds that the area concerned had always been part of in Oldham, with which it is more closely linked. 42. We felt that Tameside had not advanced any arguments in terms of effective and convenient local government for the transfer of the land in question. We therefore took an interim decision to make no proposal.

THE BOUNDARY BETWEEN OLDHAM AND KIRKLEES

(a) Black Moss Reservoir

43. Kirklees had suggested realigning its boundary with Oldham, so as to unite the Black Moss Reservoir in its area.

44. We agreed that it would be in the interests of effective and convenient local government to unite the reservoir in one authority. We therefore decided to adopt Kirklees1 suggestion as our draft proposal.

(b) Open Moorland - Little Moss

45. Kirklees had suggested realigning its boundary with Oldham in the vicinity of Little Moss, thereby transferring a small parcel of land to its area and rectifying stretches of defaced boundary.

46. We noted that the present boundary in the area of Little Moss straggles over open land and is not tied to physical features. We therefore decided to adopt Kirklees' suggestion as our draft proposal.

ANNOUNCEMENT OF OUR DRAFT PROPOSALS/INTERIM DECISION

47. The letter announcing our draft proposals and interim decision was published on 12 October 1990. Copies were sent to the local authorities concerned and to all those who had made representations to us. The Borough of Oldham, the City of Manchester, and the Boroughs of Rochdale, Tameside and Kirklees were asked to publish a notice giving details of our decisions

10 and to post copies of it at places where public notices are customarily displayed. They were also asked to place copies of our letter on deposit for inspection at their main offices for a period of eight weeks. Comments were invited by 30 November 1990.

RESPONSE TO OUR DRAFT PROPOSALS/INTERIM DECISION

OUR FINAL PROPOSALS AND DECISIONS

48. In response to our letter of 12 October 1990, we received comments from the Metropolitan Borough of Oldham, the City of Manchester, the Metropolitan Boroughs of Rochdale, Tameside and Kirklees, the Chief Constable of Greater Manchester, the Greater Manchester Police Authority, Neighbourhood Council, the Parish Council of Saddleworth and three individual members of the public.

49. As required by section 60(2) of the Local Government Act 1972, we have carefully considered all the representations made to us and set out below our final proposals.

THE BOUNDARY BETWEEN OLDHAM AND ROCHDALE

(a) A672 Ripponden Road

50. Oldham and Rochdale both supported our draft proposal to transfer that part of the A672 currently located within Rochdale to Oldham, together with a public house and a bungalow. Neither the Chief Constable of Greater Manchester nor the Greater Manchester Police Authority raised any objections. We have therefore decided to confirm it as final.

51 . Oldham and Rochdale both supported our draft proposal to transfer the Moorcock Inn to Oldham. We have therefore decided to confirm it as final.

(c) A663 (Milnrow Road) in the Jubilee area

61 . Oldham and Tameside both supported our draft proposal to unite a chemical works in Tameside. We have therefore decided to confirm it as final.

(d) A6050 (Stockport Road/Quick Road)

63. Oldham and two residents of the area supported our draft proposal to unite in Oldham the hamlet of Quick. However, Tameside opposed it and submitted an alternative suggestion which would unite the hamlet in its area. f 64. Tameside argued that our draft proposal did not resolve the question of access to properties at the southern end of Strawberry Lane. Its alternative suggestion was supported by a resident, subject to a minor modification in respect of two fields. Oldham opposed Tameside's alternative suggestion on the grounds that the majority of the dwellings in the hamlet were already in Oldham, and that there were no access problems in relation to the provision of services.

65. We noted that the question of access to Strawberry Lane had been drawn to our attention by Tameside in its original objection to Oldham's suggestion. We also noted that Tameside had originally sought to maintain the existing boundary through the hamlet, which would have perpetuated the access anomaly. We noted that the larger part of the hamlet is already located in Oldham and appears to look more to that Authority; we did not consider that the problem of access was such as to warrant uniting Quick in Tameside. We have therefore decided to confirm our draft proposal as final.

14 (e) Shadows Lane/Manchester Road/Huddersfield Road

66. Oldham, Tameside and Saddleworth Parish Council all supported our interim decision not to propose the transfer of an isolated triangular area of land from Oldham to Tameside. We have therefore decided to confirm it as final.

THE BOUNDARY BETWEEN OLDHAM AND KIRKLEES

(a) Black Moss Reservoir

67. Oldham and Kirklees both supported our draft proposal to unite the Black Moss Reservoir in Kirklees. We have therefore decided to confirm it as final.

(b) Open Moorland at Little Moss

68. Oldham and Kirklees both supported our draft proposal to transfer a small parcel of land to Kirklees and to realign the boundary to physical features. We have therefore decided to confirm it as final.

OLDHAM'S BOUNDARY WITH HIGH PEAK IN THE COUNTY OF DERBYSHIRE

69. We have considered Oldham's boundary with High Peak as part of this review. We had received no suggestions for changes to this boundary in response to our letter of 1 September 1987, and were not ourselves minded to propose any realignments. However, no reference to this boundary was made in our draft proposals letter.

70. We have considered whether the publication of an interim decision to make no proposals to this boundary would be justified, given the stage now reached in our review of Oldham. Having confirmed with the local authorities concerned that they have no wish to submit any suggestions in respect of the Oldham/High Peak boundary, we have concluded that publication of

15 a separate interim decision letter at- this stage would not be justified. We have consequently decided to confirm our (unpublished) interim decision to propose no change to the boundary between Oldham and High Peak. However, we are concerned that no body or person should in consequence be disadvantaged. Copies of this report are therefore being sent to all those who made representations to us and to other interested parties, in addition to the normal publicity given to our reports. We are satisfied that any interested party will thus have the opportunity to comment on the Oldham/High Peak boundary to you direct, if they should so wish.

CONCLUSION x

71 . We believe that our final proposals and decisions, as set out in paragraphs 50-70 above, are in the interests of effective and convenient local government and we commend them to you accordingly.

PUBLICATION

72. A separate letter is being sent to the Metropolitan Borough of Oldham, the City of Manchester, the Metropolitan Boroughs of Rochdale, Tameside and Kirklees, and the Borough of High Peak in Derbyshire, asking them to deposit copies of this report at their main offices for inspection for a period of six months. They are also being asked to put notices to that effect on public notice boards. Arrangements have been made for similar notices to be inserted in the local press. The text of the notice will explain that the Commission has fulfilled its statutory role in this matter and that it now falls to you to make an Order implementing the proposals, if you think fit, though not earlier than a period of six weeks from the date our final proposals are submitted to you. Copies of this report, with the attached maps illustrating the proposed changes, are being sent to all those who received our draft proposal letter of 12 October 1990, to those who made written representations to us, and to other interested parties.
