Jasuta RETURN TO TABLE OF CONTENTS According to figures gleaned from the official website site of the Texas Department of Criminal Justice (“TDCJ”), Texas currently has 114 facilities, some operated by private contractors, but the majority operated by the State (see Table “A” attached hereto), which are capable of housing approximately 164,000 inmates. As the current Texas legislative session winds down, “inquisitive minds” wonder if there will be an effort by the Legislature to cut some long terms costs by closing some of the current units. In an article in the Fort-Worth Star Telegram (“Lawmakers Look to Close Private Prison in Mineral Wells”), writer Dave Montgomery detailed discussions in the Senate Finance Committee on the question of whether the State should close the privately run prison in Mineral Wells.

Washington is a Texas inmate appearing pro se and in forma pauperis. He filed this prisoner civil rights action pursuant to 42 U.S.C. § 1983, asserting claims under the Eighth Amendment, the Americans with Disabilities Act (ADA), 42 U.S.C. § 12112(b)(5)(A), and the Rehabilitation Act (RA), 29 U.S.C. § 794. Plaintiff’s case is subject to screening pursuant to the Prison Litigation Reform Act. See 42 U.S.C. § 1997e(c); 28 U.S.C. §§1915(e)(2), 1915A. For the reasons discussed below, the Texas Department of Criminal Justice (TDCJ) is SUBSTITUTED in place of TDCJ Director Lorie Davis with respect to Plaintiff’s ADA/RA claims. On November 4, 1986, Kartis Ewing (a/k/a K.Artis Ewing) filed a civil suit in the United States District Court for the Southern District of Texas, Houston Division, against Sheriff Jack Heard, Deputy J.H. Murphy, Sgt. J.R. Dixon, Deputy D.L. Jones, Deputy R. Woods and T.C. Wright all of the Harris County Sheriff’s Office for violation of civil rights, specifically physical abuse by brutality and medical neglect while in the Harris County Jail. Pre-trial hearings were held at the Wynne Unit, Texas Department of Corrections, Huntsville, Texas, on October 23, 1987, before Judge James De Anda, and at the Darrington Unit, Rosharon, Texas, on May 31, 1988, before Judge David Hittner. Lisa S. Rice, Assistant County Attorney, acted as lead counsel for Harris County. Judge Hittner dismissed the case on June 8, 1988. An appeal was filed on July 13, 1988, and was denied by Judge Woodrow Seals on November 7, 1988.
