RESOLUTION NO. ______

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN JOSE DESIGNATING CERTAIN AS HERITAGE TREES, PLACING SAID TREES ON THE HERITAGE LIST, AND DELETING CERTAIN TREES THEREFROM, AND REPEALING RESOLUTION NO. 75974

WHEREAS, Sections 13.28.220 and 13.32.140 of the San José Municipal Code provide protective status for trees found by the City Council to have special significance to the community based on history, girth, height, species or unique qualities, and further provide for a Heritage Tree List which shall be adopted by the City Council by resolution; and

WHEREAS, Sections 13.28.220 and 13.32.140 further provide that the Heritage Tree List may be amended from time to time to add or delete certain trees therefrom; and

WHEREAS, since the last such amendment by Resolution No. 75974, adopted by the City Council on August 30, 2011, the City Arborist has identified certain trees recommended for addition to the Heritage Tree List and certain other trees that should be deleted from the Heritage Tree List; and

WHEREAS, the City Council desires to amend the City's Heritage Tree List in accordance with the recommendations of the City Arborist;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SAN JOSE:

SECTION 1. Pursuant to Section 13.28.220 and Section 13.32.140 of the San José Municipal Code, the following trees, as the term "tree" is defined in Section 13.28.105, are hereby found, because of factors including, but not limited to, history, girth, height,
