The mine comprises 4 separate mining areas, including: Bayswater No. 2 Open Cut (extraction complete); Bayswater No. 3 Open Cut; Mt Arthur North Open Cut; and Mt Arthur Underground. The combined operations have approval to extract up to 28 million tonnes of run-of-mine (ROM) coal a year. Mt Arthur Coal proposes to expand its open cut operations and increase the total rate of coal production at the mine complex. The company also proposes to consolidate all of its existing open cut mining approvals into a single, modern approval.

Cumnock is a wholly owned subsidiary of Xstrata Coal (Xstrata). Mining at Cumnock has been ongoing since the 1950s, with the current operations expected to exhaust economic coal reserves by the end of 2008. Closure and decommissioning of the mining operation will commence in early 2009, with the first stage of closure involving the removal of the Cumnock Coal Handling Preparation Plant (CHPP) and rehabilitation of the CHPP site. A small coal reserve has been identified beneath the CHPP site. Cumnock propose to recover this coal reserve as part of the CHPP site rehabilitation process. The mining of the proposed Wash Plant Pit gives Cumnock a unique opportunity to economically access a coal reserve and remediate and rehabilitate the site during the mining process. The proposed Wash Plant Pit will involve mining operations for an approximate one year period, resulting in production of approximately 1 million tonnes (Mt) of run-of-mine (ROM) coal.

    PROPOSED BAYSWATER AND DRAYTON MINES ANTIENE JOINT USER RAIL FACILITY PROJECT, REPORT ON THE ASSESSMENT OF A DEVELOPMENT APPLICATIONS (DA 105-04-2000 AND DA 106-04-2000) PURSUANT TO SECTION 79C OF THE ENVIRONMENTAL PLANNING AND ASSESSMENT ACT, 1979 FILE: N99/00203 PT1 AND S99/01070 PT1 INTRODUCTION AND BACKGROUND The Applicants and Joint Environmental Impact Assessment • Coal Operations Australia Limited (COAL), current owners of Bayswater Colliery. • Drayton Coal Pty Ltd (Drayton), current owners of Drayton mine. Coal Operations Australia Limited (COAL) and Drayton Coal Pty Ltd (Drayton) have prepared a joint environmental impact statement (EIS) for the Antiene Joint User Rail Facility Project. The joint EIS accompanied two separate development applications lodged with the Department on 4th April 2000. The key components to the joint EIS and separate DA’s are as follows: • COAL seeks development consent to: – construct and operate the Bayswater Rail Loading Facility, which includes a balloon rail loop, loading facilities, and connection to the Antiene Rail Spur east of the Drayton Loop; and – transport up to 20 million tonnes per annum (Mtpa) of coal from the Facility using the Antiene Rail Spur to access the Main Northern Railway. • Drayton seeks development consent to: – increase the transportation of coal from an existing 3.3 million tonnes per annum to 7 million tonnes per annum (Mtpa) along the existing Drayton rail loop; and – approve the transportation of upto 20Mtpa of coal along the Antiene Rail Spur (this includes the 20 Mtpa sought by COAL). The joint EIS was prepared by both Applicants under direction from the Department.

    Mt Arthur Coal Open Cut Modification – Environmental Assessment Three bat species were recorded by Niche 4.6.2 Potential Impacts (Appendix 1 of Appendix D) during the current surveys within the Modification area, namely the Potential impacts of the Modification on flora and Eastern False Pipistrelle, Eastern Bentwing-bat and fauna are assessed below. Eastern Cave Bat. These records are shown on Figure 4-7. The Eastern Bentwing-bat has also been Direct Impacts recorded on several occasions surrounding the Vegetation Clearance Modification area (Umwelt, 2003, 2005, 2006a, 2006b, 2007b, 2007c; Cumberland Ecology, 2010a, The Modification would require the removal of 2010b; Dames and Moore, 2000b) (Figure 4-7). 228.9 ha of native vegetation as outlined in The Eastern Bentwing-bat has been recorded within Table 4-6.
