THE FUTURE OF THE ALIEN TORT CLAIMS ACT OF 1789: LESSONS FROM IN RE MARCOS HUMAN RIGHTS LITIGATION JOAN FTZPATRCK* INTRODUCTION On September 24, 1992, a federal civil jury in Honolulu ren- dered a verdict for the plaintiffs in the multidistrict human rights litigation against the estate of Ferdinand Marcos and several of his former associates and family members.' In re Marcos Human Rights Litigation ("Marcos") is a milestone for the Alien Tort Claims Act ("ATCA7)2 for several reasons. First, Marcos was the first human rights case brought under the ATCA to be fully con- tested in a trial on the merits, illustrating the numerous obstacles that plaintiffs must overcome in proving human rights allega- tions. -

Order Code RL31672 CRS Report for Congress Received through the CRS Web Terrorism in Southeast Asia Updated November 18, 2003 Mark Manyin Coordinator Richard Cronin, Larry Niksch, Bruce Vaughn Foreign Affairs, Defense, and Trade Division Congressional Research Service ˜ The Library of Congress Terrorism in Southeast Asia Summary Following the defeat of the Taliban regime in Afghanistan, U.S. attention turned to radical Islamist groups in Southeast Asia, particularly those in the Philippines, Indonesia, Malaysia, and Singapore that are known or alleged to have ties to the Al Qaeda terrorist network. For more than a decade, Al Qaeda has penetrated the region by establishing local cells, training Southeast Asians in its camps in Afghanistan, and by financing and cooperating with indigenous radical Islamist groups. Indonesia and the southern Philippines have been particularly vulnerable to penetration by anti- American Islamic terrorist groups. Members of one indigenous Al Qaeda affiliate, Jemaah Islamiyah, is known to have assisted two of Al Qaeda’s September 11, 2001 hijackers and have confessed to plotting and carrying out attacks against Western targets, including the October 12, 2002 bombing in Bali, Indonesia that killed approximately 200 people, mostly Western tourists. The Bali attack signalled a shift in Jemaah Islamiyah’s tactics, from targeting Western military and government installations to focusing on “softer” targets such as tourist resorts, Western business, and schools serving Westerners. The August 2003 bombing of the J.W. Marriott Hotel in Jakarta, thought to be carried out by Jemaah Islamiyah, appears to fit this pattern. Arrests in Thailand and Cambodia in the spring and summer of 2003 may indicate that the network has established and/or stepped up operations in those countries, as well as Laos and Burma. -

Abinales Shortly after government forces tear-gassed their way into one of Manila’s finest hotels on 29 November 2007 to flush out thirty-odd “rebels” and their civilian supporters, Philippine-focussed e-groups began debating the significance of what became known as the “Makati stand-off”.1 Among the most popular messages was a joke patterned after American late-night host David Letterman’s “Top Ten List”. Purporting to be an “Intel Info” released by the government’s National Intelligence Security Agency, it lists the “Top Ten Reasons Why [Navy Lieutenant Second Grade and Senator Antonio] Trillanes and Company Packed Up” and surrendered: 1. Not even his mother joined them. 2. Oakwood [the plush apartment complex Trillanes and comrades took over in an aborted 2004 coup] had a better lobby. 3. CNN was not there to cover it. 4. The hotel had run out of ice cubes. 5. The APCs [armed personnel carriers] were parked in the lobby, not in the parking lot. 6. Trillanes realized that being tear-gassed was not part of his mandate as senator. 7. [Former Vice-President Teofisto] Guingona [a civilian participant] thought it was an anti-Erap [former President Joseph Estrada], or pro-Erap pardon rally, whatever… 8. -

Ochave Ateneo de Davao University [email protected] Abstract This paper is an attempt to localize Herman and Chomsky’s analysis of the commercial media and use this concept to fit in the Philippine media climate. Through the propaganda model, they introduced the five interrelated media filters which made possible the “manufacture of consent.” By consent, Herman and Chomsky meant that the mass communication media can be a powerful tool to manufacture ideology and to influence a wider public to believe in a capitalistic propaganda. Thus, they call their theory the “propaganda model” referring to the capitalist media structure and its underlying political function. Herman and Chomsky’s analysis has been centered upon the US media, however, they also believed that the model is also true in other parts of the world as the media conglomeration is also found all around the globe. In the Philippines, media conglomeration is not an alien concept especially in the presence of a giant media outlet, such as, ABS-CBN. In this essay, the authors claim that the propaganda model is also observed even in the less obvious corporate media in the country, disguised as an independent media entity but like a chameleon, it © 2018 Menelito P.
