The appellant submitted RTI application dated October 7, 2013 before the Central Public Information Officer (CPIO), Reserve Bank of India, Mumbai seeking inspection of files containing agreements & relevant documents and all correspondence in relation to approval for home loan made by the office of Reserve Bank of India, Mumbai to their staff members to purchase flats or property at Shree Nav Jyotirling Co-operative Society `A', `B', `C', & `D' wings CTS No. 679, Survey No. 255/5 Opp. Riddhi Siddhi Garden, Wagheshwari Mandir, Gen. A K Vaidya, Malad (E), Mumbai etc. 2. The CPIO vide letter dated October 30, 2013 denied the information sought by the appellant on the ground that the information sought was third party information held by them in fiduciary capacity therefore a disclosure of the same was exempt u/s 8(1)(e) & (j) of the RTI Act, 2005. Not satisfied with the reply given by the CPIO concerned, the appellant preferred an appeal dated Nil to the first appellate authority CIC/MP/A/2014/002248 1 (FAA). The FAA vide order dated December 13, 2013 upheld the decision of the CPIO. 3. Dissatisfied with the response of the public authority, the appellant preferred the present appeal before the Commission. 4. The matter was heard by the Commission. The appellant's representative stated that no hearing was given to him for his first appeal. He stated that he had been wrongly denied the information sought by him and the respondents did not allow him the inspection of record. The respondents stated that the appellant was not connected with the matter. He was an Ex- Chief Promoter of the society. The loan was taken by the Reserve Bank of India employees and therefore the information sought by the appellant was third party information and he could not be allowed to inspect the loan documents submitted by others. Therefore information sought by him was denied as per the provisions of the RTI Act, 2005. 5. The Commission accepts the su bmissions of the respondents that the information sought came within the ambit of section 8(1) (e) & (j) of the RTI Act, 2005 and upholds their decision.
