Barton Deakin Brief: Same-Sex Marriage Survey Results 17 November 2017 On Wednesday, November 15, the Australian Bureau of Statistics (ABS) released the result of the Government’s Australian Marriage Law Postal Survey. The survey returned a national result of 61.6 per cent in favour of support of changing the law to allow same-sex couples to marry, and 38.4 per cent against. This Barton Deakin Brief will break down the result of the vote. Background The Same-Sex Marriage Survey was approved by the High Court on 7 September 2017 after a challenge by Australian Marriage Equality and PFLAG Brisbane. The survey was conducted by the ABS via Australia Post from 12 September to 7 November. The question put was: Should the law be changed to allow same-sex couples to marry? The positive result for the ‘Yes’ vote means the Government will facilitate the consideration of a Private Members’ Bill in the final sitting fortnight of the House of Representatives, scheduled to begin on November 27. Senator Dean Smith’s Private Members Bill was introduced with cross-party support to the Senate at 9:30am, 16 November 2017. Senator Smith’s Bill provides religious exemptions for clergy and churches who refuse to conduct same-sex marriages due to their religious beliefs. Attorney General Senator the Hon George Brandis has signalled his intention to amend the Smith bill to provide additional protections for civil marriage celebrants, and protections for people of faith to hold and express their own views on marriage. Various other Parliamentarians have indicated support for further amendments regarding religious protection, free speech and other matters. Prime Minister Malcolm Turnbull has stated he would like to see the bill voted on and legislated by Christmas. Results Nationally • Yes responses – 7,817,247, representing 61.6 per cent of the vote; No responses – 4,873,987 representing 38.4 per cent of the vote. • A further 36,686 responses were unclear. • Total participation was – 12,727,920, representing 79.5 per cent of the eligible voting population. State and Territory Level • Every State and Territory recorded a majority yes result. • Every state and territory recorded a majority yes result over 60 per cent, with the exception of New South Wales which recorded a majority yes result of 57.8 per cent. • The Australian Capital Territory had the highest majority yes, at 74 per cent. • Every state achieved a participation rate of over 75 per cent, except for the Northern Territory, where participation was 58.4 per cent. By Commonwealth Electoral Division • Of the 150 Commonwealth Electorates, a majority yes outcome was recorded for 133 electorates and a majority no outcome was recorded for 17 electorates. • Within those 133 Electorates with a majority yes response, there were 95 Electorates with a majority yes response of over 60 per cent. • Within those 17 Electorates with a majority no response, there were 6 Electorates with a majority no response of over 60 per cent. By Political Party • The Liberal Party of Australia holds 57 seats, of which 53 corresponding electorates returned a majority Yes response. • The Nationals hold 17 seats in the Parliament, of which 16 corresponding electorates returned a majority Yes response. • The Australian Labor Party hold 69 seats, of which 58 corresponding electorates returned a majority Yes response.     Let Her Finish: Gender, Sexism, and Deliberative Participation In Australian Senate Estimates Hearings (2006-2015) Joanna Richards School of Government and Policy Faculty of Business, Government and Law University of Canberra ABSTRACT In 2016, Australia ranks 54th in the world for representation of women in Parliament, with women ​ accounting for only 29% of the House of Representatives, and 39% of the Senate. This inevitably ​ inspires discussion about women in parliament, quotas, and leadership styles. Given the wealth of research which suggests that equal representation does not necessarily guarantee equal treatment, this study focuses on Authoritative representation. That is, the space in between winning a seat and making a difference where components of communication and interaction affect the authority of a speaker.This study combines a Discourse Analysis of the official Hansard transcripts from the Senate Estimates Committee hearings, selected over a 10 year period between 2006 and 2015, with a linguistic ethnography of the Australian Senate to complement results with context. Results show that although female senators and witnesses are certainly in the room, they do not have the same capacity as their male counterparts. Both the access and effectiveness of women in the Senate is limited; not only are they given proportionally less time to speak, but interruption, gate keeping tactics, and the designation of questions significantly different in nature to those directed at men all work to limit female participation in the political domain. As witnesses, empirical measures showed that female testimony was often undermined by senators. Results also showed that female senators and witnesses occasionally adopted masculine styles of communication in an attempt to increase effectiveness in the Senate.

AUSTRALIAN JOCKEY CLUB BILL 2008 Agreement in Principle Debate resumed from 14 May 2008. Mr GEORGE SOURIS (Upper Hunter) [10.04 a.m.]: I have pleasure in leading for the Opposition in the debate on the Australian Jockey Club Bill 2008. I say at the outset that the Opposition will not oppose the bill—in fact, we will take some pleasure in seeing it ultimately change the face of the Australian Jockey Club. The purpose of the bill is to recognise the incorporation of the Australian Jockey Club and to transfer its assets, rights and liabilities to the newly incorporated Australian Jockey Club Limited. The bill will also enable the trustees of Randwick racecourse to grant a lease of the racecourse lands for up to 99 years. The Australian Jockey Club is currently an unincorporated association. In light of recent financial concerns, the chairman and board members, focusing on their potential personal liability and in line with modern business practice, initiated the process to update the current Australian Jockey Club Act, which dates back to 1873. The trustees of Randwick racecourse are limited to granting a 50-year lease under the current Act.

    Biography - David Julian Fawcett, BSc, MBA, MAICD, QTP, psc David is a Senator for South Australia in the Australian Parliament, elected at the Aug 2010 and Jul 2016 Federal Elections. Prior to his role as a Senator, David has been a business owner, an elected Member of the House of Representatives, a professional pilot and a member of the Defence force for over two decades. In the 45th Parliament, David is a Deputy Government Whip in the Senate and is the Chair of the Joint Standing Committee on Foreign Affairs, Defence and Trade. David is also a member of Committees dealing with: Intelligence & Security; Treaties and Legal & Constitutional Affairs. David also Chairs the Government members Policy Committee for Legal Affairs. David writes and advocates extensively on initiatives that would lead to a more effective and efficient national defence force including a sustainable defence industry capability. He has also been active in working for reform in Australia’s aviation policy and approach to aviation safety regulation. David previously served in the 41st Australian Parliament as the Member for Wakefield (South Australia) from 2004 – 2007. An incoming Labor Government led by Bill Shorten will likely feature Richard Marles as Minister for Defence and Mike Kelly as Assisting Minister for Defence Industry and Support. Jason Clare, a former Minister for Defence Matériel, would likely have influence upon the defence industry portfolio in his potential role as Minister for Trade and Investment. Under a Labor Government, it is possible Shorten would appoint a new Minister for Defence Matériel (as has been an established practice for many years) given the magnitude of expenditure and complexity of the portfolio. Shorten and Marles have been associates since university and have been closely aligned during their trade union and political careers. With extensive practical experience of the Australian industry, Shorten and Marles have a record of working constructively with business leadership. Both have a sound understanding of the role and the significance of defence industry in Australia. Marles, in particular, has a greater interest in national security and strategic issues and would likely concentrate on these in the portfolio and delegate aspects of defence industry to a ministerial colleague. Labor’s defence industry policy was reviewed and adopted during the December 2018 Party National Conference. The policy is consistent with Labor’s approach when it was last in government, reiterating support for: • an Australian defence industry that provides the Australian Defence Force with the necessary capabilities; • sovereign industrial capability where required, specifically identifying naval shipbuilding; • an export focus; • the maximisation of the participation of small-to-medium enterprises (SMEs) in defence projects; and • initiatives to develop workforce skills.
