COMPLAINT FOR VIOLATIONS OF THE CAMPAIGN DISCLOSURE ACT

Recent quarterly filings show that Representative Terra Costa Howard and her committee have flagrantly violated campaign finance laws, misreporting hundreds of thousands of dollars in contributions in a manner calculated to deceive the public about her ties to, and level of support from, state committees funded, chaired, and controlled by House Speaker Michael J. Madigan.

On behalf of her committee, Costa Howard verified under oath numerous intentionally false and misleading reports, and entirely refused to report tens of thousands of other contributions required to be reported. Salvatore Falbo, a resident of the 48th District, thus brings this complaint for violations of the Campaign Disclosure Act against Friends to Elect Terra Costa

Howard (ISBE Committee ID 34006), and states in further support as follows:

1. From August 2020 to present, Costa Howard has made repeated statements under oath that her committee was receiving campaign contributions from the federal committee of the

Democratic Party of Illinois (FEC ID C00167015). Costa Howard submitted 6 sworn statements showing a total of $161,085.69 in campaign contributions from DPI-federal.1

2. However, recent filings by other committees have confirmed that Costa Howard’s sworn statements were false. In truth, the contributions were made by the Democratic Party of

Illinois state committee (ISBE Committee ID 6239). The vast sum of DPI-state’s funds are

Madigan, who also chairs and controls the state committee.2 On the contrary, DPI-federal reports show no contributions from House Speaker

Michael J. Madigan or the committees he controls.3

3. Costa Howard’s specific funding by and support from Speaker Madigan is of significant public interest, due to Speaker Madigan being named as “Public Official A,” the subject of a felony bribery conspiracy involving Commonwealth Edison. Costa Howard has repeatedly (falsely) promised the people of the 48th District that she would be “independent” of

Madigan.

4. The DPI-state committee’s recent filings paint a different picture: Costa Howard is still very much on the gravy train, enjoying six-figure support from Madigan and his committees. Members of the press, the public, and the voters of the 48th District who review

Costa Howard’s sworn false filings would be misled about her level of funding from Madigan and his committees, not realizing she has received hundreds of thousands of dollars from him and the committees he tightly controls. By showing her six-figure support as coming from the

DPI-federal committee, instead of the DPI-state committee, Costa Howard deceived the public and attempted to press a narrative of only having minimal ties to Madigan.

5. Even apart from Costa Howard’s deception about her funding by Madigan, she refused to report and entirely concealed the first in-kind contribution DPI-state made to her, for her first mailings, which began to hit in the 48th District in late July.

6. DPI-state reports in its latest D-2 quarterly filing that the first in-kind contribution for Costa Howard’s mail was made on July 15, 2020, in the amount of $18,292.45. The full-color

2 mailers paid for by DPI-state were widely distributed through the 48th District and well-known to Costa Howard, but she entirely flouted the reporting requirement for them.4

7. The requirement of reporting this large contribution from the Madigan-funded

DPI-state committee fell at or about the same time Costa Howard sought media attention to her latest claim of independence from Speaker Madigan. Such a campaign report coming at that precise time would have tainted the media attention she received, by putting the lie to her claims, for she had similarly claimed she would be “independent” of Madigan before her 2018 election campaign, after which she took millions of dollars in support from Madigan-controlled committees.

8. Costa Howard also underreported by at least $500 her second set of mailings by

DPI-state, which the state committee reports as being made on 7/28/2020, in the amount of

$17211.25.5 And she did not report at all a $2,500 direct contribution from Democratic Majority

(ISBE Committee ID 23189), whose chairman is also Speaker Michael J. Madigan. Democratic

Majority reports the contribution as made on August 22, with no report at all on Costa Howard’s end.6

9. Additionally, Costa Howard did not report over $5,000 of in-kind campaign contributions from Planned Parenthood Illinois Action PAC (ISBE Committee ID 16459). That

PAC reported making three expenditures of $2,662.20 each for Costa Howard’s benefit almost

3 one month ago, on September 14, 18, and 22. However, Costa Howard reported only a single

$2,662.60 contribution from the PAC.7

WHEREFORE, Salvatore Falbo petitions that this Honorable Board find Friends to Elect

Terra Costa Howard and Terra Costa Howard guilty of violations of the relevant provisions of the Illinois Campaign Disclosure Act, order them to correct their false representations and conform their reports to the truth, fine them in the maximum amount allowed by law, and for all other relief on the premises to which he is justly entitled.
