Vegans/vegetarians, would they be completely disinterested in the laws of Kashrut, since those in the Written Tradition primarily deal with consuming meat? תלמוד בבלי מסכת סנהדרין דף עא עמוד א דתניא: בן סורר ומורה לא היה ולא עתיד להיות, ולמה נכתב - דרוש וקבל שכר.1 שם דתניא: עיר הנדחת לא היתה ולא עתידה להיות ולמה נכתבה - דרוש וקבל שכר.2 שם דתניא: בית המנוגע לא היה ולא עתיד להיות, ולמה נכתב - דרוש וקבל שכר.3 But what should the quality/ focal point of such Derashot be? A technical understanding of these appears fairly discouraging; granted Tora study LiShma is "ולא עתיד להיות") topics were they to apply a value, but perhaps we should demand a more relevant standard,) or something more pertinent to our present situation? 2. The laws of Kashrut are typically included among those Mitzvot that are presumed either not to have rational explanations, or whose rationales are so esoteric, that average human beings are unable to comprehend them. בראשית פרק כו פסוק ה ֵ֕ ע ֶקב ֲא ֶשר־ ָׁש ַַ֥מע ַא ְב ָׁר ָָׁ֖הם ְבק ִִֹּ֑לי וַיִּ ְשמ ֹ ֙ר ִּמ ְש ַמ ְר ִּ֔ ִּתי ִּמ ְצֹו ַָ֖תי ֻחּקֹו ַ֥תי וְתֹורֹתָׁ ָֽי:4 רש"י חקותי - דברים שיצר הרע ואומות העולם משיבין עליהם כגון אכילת חזיר ולבישת שעטנז שאין טעם בדבר אלא גזירת המלך וחקותיו על עבדיו:5 Yet luminaries like RaMBaM and RaMBaN vociferously argue that all Mitzvot, including Kashrut have reasons of one sort or another: דברים פרק כב )ו( ִִּּ֣כי יִּ ָׁק ִּ֣רא ַקן־ ִּצ ִּ֣פֹור׀ ְל ָׁפ ֶ֡נֶיָך ַב ֶֶּ֜ד ֶרְך ְב ָׁכל־ ִּ֣עץ׀ ִּ֣אֹו ַעל־ ָׁה ָ֗ ָׁא ֶרץ ֶא ְפר ֹ ִּחי ֙ם ִּ֣אֹו בי ִּ֔ ִּצים וְ ָׁה ֵ֤אם ר ֹ ֶ֙ב ֶצ ֙ת ַעל־ ָׁ ָֽה ֶא ְפר ֹ ִּ֔ ִּחים ָ֖אֹו ַעל־ ַה בי ִִּ֑צים ֹלא־ ִּת ַַ֥קח ָׁה ָ֖אם ַעל־ ַה ָׁב ִּנָֽים: 1 It has been taught: There never has been a “stubborn and rebellious son,” and never will be. Why then was the law written? That you may study it and receive reward. 2 It has been taught: There never was a “condemned city,” and never will be. Why then was the law written? That you may study it and receive reward. 3 It has been taught: There never was a “house plagued with Tzora’at,” and never will be. Why then was the law written? That you may study and receive reward. 4 Because that Avraham hearkened to My Voice, and kept My Charge, My Commandments, My Statutes, and My Laws. 5 My Statutes—Things that the evil inclination and the nations of the world challenge us over their observance, like the prohibitions against eating pork and wearing mixtures of linen and wool, for there is no rational explanations for them, but they are decrees of the “King” and His Statutes imposed upon His Servants. 1 )ז( ַש ֵ֤ל ַח ְת ַש ַל ֙ח ֶאת־ ָׁה ִּ֔ אם וְ ֶאת־ ַה ָׁב ִָּ֖נים ִּ ָֽת ַ ָֽקח־ ִָׁ֑לְך ְל ַ֙מ ַע ֙ן ִִּּ֣יי ַטב ִּ֔ ָׁלְך וְ ַה ֲא ַר ְכ ָָׁ֖ת יָׁ ִּ ָֽמים:6 3. How should we approach those areas of Tora that are not readily given over to rational explanation? רמב"ן ...ואמר הרב: ואל תשיב עלי ממאמר החכמים )ברכות לג ב( האומר על קן צפור יגיעו רחמיך, כי זו אחת משתי סברות, סברת מי שיראה כי אין טעם למצות אלא חפץ הבורא, ואנחנו מחזיקים בסברא השניה שיהיה בכל המצות טעם. והוקשה עליו עוד מה שמצא בב"ר )מד א( וכי מה איכפת לו להקב"ה בין שוחט מן הצואר לשוחט מן העורף, הא לא נתנו המצות אלא לצרף בהם את הבריות שנאמר )משלי ל ה( כל אמרת אלוה צרופה: וזה הענין שגזר הרב במצות שיש להם טעם, מבואר הוא מאד כי בכל אחד טעם ותועלת ותקון לאדם, מלבד שכרן מאת המצוה בהן יתברך... I would add that this is true not only when it is possible to perform the Mitzvot, but even when all that one can do is study them. גליונות נחמה ליבוביץ,7 פ' תרומה תשי"ט, עלון הדרכה ... המורה יוכל ללכת כאן )בענין המשכן וכליו( באחת משתי הדרכים: א. יוכל הוא להסתפק בכך שיסביר את העשייה על פי הנאמר בכתוב, לחפש אחר הוראתן של מילים זרות, טכניות, להשתדל להבהיר לעצמו ולתלמידיו את מבנה המשכן ואת מבנה הכלים מבחינת צורתן, גודלן, חומרן, עד כמה שזה מתפרש מתוך הכתוב - מבלי שיחפש אחר טעמים למשכן ולכלים בכלל, או לטעמים לפרטי העשייה )למה מחומר זה? למה בגודל זה? מה מטרת צורה זו, מספרי החלקים, המידות הנדרשות?( ... ב. אם יבחר המורה בדרך השניה - היא דרך הסבר משמעות המצוות האלה בדרך פענוח האלגוריות המשוערות, המונחות ביסודם של פרטי המשכן: האוהל, הכלים ,בגדי הכהנים וכו'... המורה ההולך בדרך הראשונה – בייחוד המורה למבוגרים, אך גם לנוער – ירגיש שחסרה התעניינות בהעדר חומר למחשבה עיונית; המורה ההולך בדרך השניה ירגיש בודאי אי סיפוק בפרשנות אליגורית זו הנראית שרירותית מאוד, נטולת כל הכרח פרשני, בלי כל ראיות מן הכתוב, ובפרט כשההסברים באים לתת משמעות לכל פרט מפרטי הכלים, אפילו למידות לציפוי הכלים, לכל פרטי העשיה... 4. Tiferet Yisrael13 on Mishna Chullin 3:6 82( “HaDoreis” )a predatory bird.) I.e., it raises its prey from the ground between its toes and eats. It is a part of the digestive tract, essentially an enlarged part of the esophagus. (Kedushas Levi, Parshas Noach; Sefer Bereishis 7:1) Parshas Bo Kedushas Ha'Levi'im THE TEFILLIN OF THE MASTER OF THE WORLD You shall say it is a pesach offering to Hashem, who passed over the houses of the children of Israel... (Shemos 12:27) The holy Berditchever asks the following question in Kedushas Levi: Why is it that we call the yom tov that the Torah designated as “Chag HaMatzos,” the Festival of Unleavened Bread, by the name Pesach? Where does the Torah indicate that we might call this yom tov by the name Pesach? Any time the Torah mentions this yom tov, it is called “Chag HaMatzos.” He answered by explaining that it is written elsewhere, “Ani l’dodi v’dodi li — I am my Beloved’s and my Beloved is mine” (Shir HaShirim 6:3). This teaches that we relate the praises of HaKadosh Baruch Hu, and He in turn praises us. So, too, we don tefillin, which contain the praises of HaKadosh Baruch Hu, and HaKadosh Baruch Hu dons His “tefillin,” in which the praise of Klal Yisrael is written. This will help us understand what is written in the Tanna D’Vei Eliyahu [regarding the praises of Klal Yisrael]. The Midrash there says, “It is a mitzvah to speak the praises of Yisrael, and Hashem Yisbarach gets great nachas and pleasure from this praise.” It seems to me, says the Kedushas Levi, that for this reason it says that it is forbidden to break one’s concentration on one’s tefillin while wearing them, that it is a mitzvah for a man to continuously be occupied with the mitzvah of tefillin.

    eSharp Issue 20: New Horizons A Fresh Perspective on the History of Hasidic Judaism Eva van Loenen (University of Southampton) Introduction In this article, I shall examine the history of Hasidic Judaism, a mystical,1 ultra-orthodox2 branch of Judaism, which values joyfully worshipping God’s presence in nature as highly as the strict observance of the laws of Torah3 and Talmud.4 In spite of being understudied, the history of Hasidic Judaism has divided historians until today. Indeed, Hasidic Jewish history is not one monolithic, clear-cut, straightforward chronicle. Rather, each scholar has created his own narrative and each one is as different as its author. While a brief introduction such as this cannot enter into all the myriad divergences and similarities between these stories, what I will attempt to do here is to incorporate and compare an array of different views in order to summarise the history of Hasidism and provide a more objective analysis, which has not yet been undertaken. Furthermore, my historical introduction in Hasidic Judaism will exemplify how mystical branches of mainstream religions might develop and shed light on an under-researched division of Judaism. The main focus of 1 Mystical movements strive for a personal experience of God or of his presence and values intuitive, spiritual insight or revelationary knowledge. The knowledge gained is generally ‘esoteric’ (‘within’ or hidden), leading to the term ‘esotericism’ as opposed to exoteric, based on the external reality which can be attested by anyone. 2 Ultra-orthodox Jews adhere most strictly to Jewish law as the holy word of God, delivered perfectly and completely to Moses on Mount Sinai.

Kedushas Levi, Parshas Noach (Bereishis 7:1) VA’ES CHA NAN _ CHASSIDUS ON THE PARSHA + Dvar Torah Deciphered Messages The Torah tells us ( Shemos 19:19) that when the Jewish people gathered at Mount Sinai to receive the Torah , “Moshe spoke and Hashem answered him with a voice.” The Gemora (Berochos 45a) der ives from this pasuk the principle that that an interpreter should not speak more loudly than the reader whose words he is translating. Tosafos immediately ask the obvious question: from that pasuk we see actually see the opposite: that the reader should n ot speak more loudly than the interpreter. We know, says Rav Levi Yitzchok, that Moshe’s nevua (prophecy) was different from that of the other nevi’im (prophets) in that “the Shechina was speaking through Moshe’s throat”. This means that the interpretation of the nevuos of the other nevi’im is not dependent on the comprehension of the people who hear it. The nevua arrives in this world in the mind of the novi and passes through the filter of his perspectives. The resulting message is the essence of the nevua. When Moshe prophesied, however, it was as if the Shechina spoke from his throat directly to all the people on their particular level of understanding. Consequently, his nevuos were directly accessible to all people. In this sense then, Moshe was the rea der of the nevua , and Hashem was the interpreter.

    An Honest Account of a Contemporary Jewish Publishing Odyssey In Your Anger, Please Mercifully Publish My Work: An Honest Account of a Contemporary Jewish Publishing Odyssey by Dovid Bashevkin[1] My recently published sefer, “Berogez Racheim Tizkor” (trans: “In your anger, you shall remember to have mercy”), whose title is based on the verse in Habbakuk 3:2 and traditionally recited each morning during Tahanun, really began as a tweet. In March 2014, I tweeted, “Considering writing a sefer entitled “Aveiros K’Hilchisa.” Considering writing a sefer entitled “Aveiros K’Hilchisa.” — D Bash (@DBashIdeas) March 5, 2014 The tweet was originally intended as a satire of the many seforim that have been published as halakhic digests of obscure practical issues in Judaism. If there could be an Ittush be-Halakhah (trans: “Sneezing in Jewish Law,” – an actual pamphlet shown to me by my dear friend and devoted consigliere Reb Menachem Butler), why not anAveiros “ K’Hilchisa”?[2] However, as often happens, what began as satire became a very real project. Following the passing of my Zaide, Mr. William Bashevkin, and last living grandparent, I thought it would be a fitting tribute to their memory to publish a work of Torah. Additionally, coupling sorrow with joy, my marriage this past year to Tova (née Flancbaum) gave me the inspiration to begin my relationship with a project of Torah scholarship. Recent theories posit two different understandings of modern democratic systems of law. Austin posits the following: "The existence of law is one thing; its merit or demerit is another. Whether it be or be not is one enquiry; whether it be or be not conformable to an assumed standard, is a different enquiry. A law, which actually exists, is a law, though we happen to dislike it.” This statement is an expression of legal positivism because it asserts the separability of law and morals. Rabbi Lichtenstein has written about the possibility of a disconnect between Halacha and Morality. The second theory critiques this positivism as described by Hart: Laws are coercive orders or commands: That are issued by a sovereign or the sovereign’s authorized subordinates and apply within the sovereign’s territory. That are typically general and standing orders. That are backed by threats of coercion. It is generally believed that these threats are likely to be implemented when disobedience occurs.
