1. Background and Introduction

1.1 Background

1. The ADB financed Guangxi Regional Cooperation and Integration Promotion Investment Program (GRIP) will help the Guangxi Zhuang Autonomous Region (GZAR) of the People’s Republic of China (PRC) implement its strategies and action plans for regional cooperation and integration with countries of the Association of Southeast Asian Nations (ASEAN), with a focus on developing the North–South Economic Corridor under the Greater Mekong Subregion (GMS) Cooperation Program. The geographical areas covered by Tranche 2 of the Investment Program (hereafter referred as the GRIP T2) include: (i) Fangchenggang Municipality and Dongxing City; (ii) Chongzuo Municipality, Pingxiang City, and ; (iii) Baise Municipality and the border towns of Longbang and Yuexu in Jinxi County; and (iv) Qinzhou Municipality.

2. The impacts of the GRIP T2 include:

(i) Economic growth potential for border areas in the PRC and Viet Nam realized; (ii) Efficient transport and trade operations along GMS North South Economic Corridor achieved; and (iii) Economic integration between GZAR and rest of the GMS further strengthened.

3. The outcome of GRIP T2 will be benefits of regional cooperation and integration in border areas of Guangxi and northern Viet Nam captured.

4. The GRIP T2 will cover major investments of the MFF, including investments in border-connectivity and border economic zones (BEZ). In line with the framework financing agreement, those investments strongly support GZAR’s Strategy and Action Plan for participation in the Greater Mekong Subregion (GMS) Program, aiming to deepen economic cooperation and integration with ASEAN member countries.

7. The Tranche 2 Project will also provide technical and institutional support for project management and implementation for the executing agencies (EA), implementing agencies (IAs) and project implementing agencies (PIEs).

1.2 Project Activities and Resettlement impacts

8. Among the 7 subprojects of GRIP T2, 3 ones involve land acquisition and resettlement impacts and have prepared resettlement plan (RPs) in project preparation stage, namely: 1) Chongzuo Sino-Vietnam Border Economic Cooperation Zone Demonstration Project (Phase I), 2) Dongxing Changhu Road East Section Construction Project, and 3) Road Connectivity in Pingxiang (Guangxi) –Lang Son (Viet Nam) Cross- Border Project. See table 1-3 for details.

1.3 Monitoring and Evaluation

9. According to monitoring requirements in RPs of these Sub-projects, the external monitoring agency (EMA) has prepared this external monitoring report (EMR), on basis of the latest implementation status. This EMR covers the LA, HD and resettlement work as of the end of April 2021.

1.3.1 External Monitor

10. M&E on involuntary resettlement is undertaken by the team of Darren Engineering Project Management Co., Ltd., recruited by Guangxi PMO.

11. In April 2021,the EMA conducted the first round of field work for resettlement M&E with the assistance of the GPMO, PIEs and local government agencies concerned, and held focus group discussions (FGDs) and key informant interviews (KIIs) with staff concerned and representatives of AHs to learn about the implementation status of RPs.

1.3.2 Scope

12. This EMR covers 7 sub-projects in 6 cities, among which, the Jiangzhou, Dongxing, and Pingxiang sub-projects involve LAR monitoring and evaluation, while the remaining 4 sub-projects are not involved LAR issues (except the issues to be followed up in accordance with DDRs prepared during project preparation stage).

1.3.3 Contents

13. The main contents of this EMR include:

➢ Changes of LAR impacts; ➢ Progress of LA, compensation payment, actual compensation rates, etc.; ➢ Progress of HD of residential houses, compensation payment, actual compensation rates, relocation and resettlement status, etc.; ➢ Progress of HD of non-residential properties, compensation payment, actual compensation rates, resettlement status, etc.; ➢ Livelihood restoration assistance for affected people, particularly for significantly affected and vulnerable groups; ➢ Relocation or reconstruction of affected infrastructure and public facilities; ➢ Capacity building of implementation organizations and staff; ➢ Public participation and consultation during RP implementation; ➢ Satisfaction levels of affected peoples and their recommendations and concerns on LAR; and ➢ Grievance redress records and results, if any.

1.3.4 Methodologies

14. Literature review: Documents, agreements and statistical forms related to land acquisition and resettlement will be reviewed and verified;

15. Onsite Observation: project sites and resettlement sites (if any) will be visited to verify the progress of land acquisition, relocation and resettlement;

16. Focus Group Discussion (FGD): FGDs will be held with staff of agencies concerned, community/village cadres, and representatives of APs to learn about the implementation information of RPs, e.g., compensation payment status, livelihood restoration, housing resettlement, and satisfaction levels, etc.;

17. Key informant interview (KII): key informants, e.g.,focal persons of GPMO, PIEs, local Natural Resource Bureaus, Town governments, Village Committees, will be interviewed to collect data/information on RP implementation and learn about their comments/suggestions on LAR issues;and

18. Household sampling survey: sampling households will be surveyed and followed up in subsequent monitoring reports, to analyze and evaluate income and livelihood restoration status of affected households1.

2. Project Implementation Progress Monitoring

2.1 Chongzuo Sion-Vietnam Border Economic Cooperation

Zone Demonstration Project (Phase 1)

19. This sub-project had completed its preliminary design approval by February 2, 2018, including following construction activities: (i) Road #1 (Huancheng South Road), (ii) Road #2 (Binjiang Avenue), (iii) Road #3 (Xinde Road), (iv) Road #4 (New Gong Avenue), (v) Road #6 (Xinghe Avenue), (vi) Road #7 (Huaqiao Avenue), and (vii) a new wastewater treatment plant (WWTP). Construction drawings of these roads and the WWTP were approved on June 10, 2018 and December 10, 2019, respectively. There are two contract packages for this subproject’s civil works. Of them, the bidding of package CZ-C1 for 6 roads was opened on June 13, 2019 and the contract was awarded on November 20, 2019, with a contract price of CNY297,002,957; and the bidding of package CZ-C2 for the WWTP was opened on July 2, 2020 and the contract was awarded on October 16, 2020, with a contract price of CNY48,520,020.

20. The civil works of package CZ-C1 started on December 20, 2019. Due to the impact of COVD-19 pandemic, the road network construction was resumed in March 2020 and is progressing smoothly now. This package will be completed by the end of January 2023. See the construction sites in Figure 2-1 and Figure 2-2.

21. The contact of package CZ-C2 (WWTP) was signed on September 23, 2020 and construction started in October 2020. So far, the construction progress is on track and will be completed by the end of January 2023. See the construction site in Figure 2-3.

2.2 Dongxing Changhu Road East Section Construction

Project

22. This subproject is located in the low-slope area of Eastern New District of Dongxing City. As one of the main roads in the east-west corridor of this area, it will connect the Luofu River Bridge in the west and the Industrial Avenue in the east. As an urban main road, the design length is 3,792.085m, with a width of 62m and design speed of 60km/h. The preliminary design was approved on January 9, 2020 and construction drawings was approved on April 3, 2020. This subproject’s biding was opened on October 20, 2020 and the contract was awarded on March 26, 2021. So far, the contractor has been mobilized to start civil works on site. The road foundation excavation, earth and stone backfilling, dredging and other works are in progress. The civil works are expected to be completed by the end of May 2022.

2.3 Road Connectivity in Pingxiang (Guangxi) –Lang Son

(Viet Nam) Cross-Border Project

23. This subproject’s preliminary design was approved on May 23, 2018 and construction drawings were approved on August 29, 2018. The subproject is to build a road connecting to the Nonghuai border point, with a total length of 2.668km. The bid was officially opened on June 4, 2019 and the contract (package PZ-C1) was awarded on December 10, 2019, with a total contract price of CNY50,022,461. The contractor was mobilized in March 2020 due to the impacts of COVID-19 pandemic. As the site area is mostly hillside and the affected high-voltage power poles to be relocated, the construction started only in August 2020. See the construction status in Figure 2-6.

2.4 Qinzhou Bonded Port Cross Border Trade E-commerce

Industrial Park Project

24. This subproject’s main construction contents include 5 buildings with a total construction area of 50,000m2 adjacent to the Qinzhou Free Trade Port Zone, including cross-border commodity display and sales center, office building and auxiliary commercial facilities, cross-border electronic supervision platform and bonded warehouse, etc. This subproject has been delayed due to its pending final design and business model. The implementation status will be followed up in subsequent monitoring reports.

2.5 Qinzhou International Cold-Chain Logistics

Demonstration Project

25. This subproject’s preliminary design was approved on February 7, 2020 and the construction drawings were approved on February 25, 2020. The construction contents include 4 buildings with a total construction area of 35,000 m2 in the Qinzhou Free Trade Port Area, i.e., constant temperature refrigeration and freezing warehouses, offices and cold-chain equipment, etc. The civil works started on July 10, 2020 and will be completed by the end of April 2022.

2.6 China-ASEAN SMEs Synergy Innovative Development

Project

26. This subproject’s will expand the South Campus of the Guilin University of Aerospace Technology, including 3 buildings and supporting facilities with a total construction area of 125,268.25 m2. The subproject has 3 construction modules, namely (i) Aerospace Industry Training Center (CG-C1), (ii) SME Business Development Service Information Center (CG-

C2), and (iii) ASEAN Vocational Education Building (CG-C3). The preliminary designs for Aerospace Industry Training Center, the SME Business Development Service Information Center and ASEAN Vocational Education Building were approved on July 17, 2018, April 22, 2019 and October 9, 2018, respectively. The construction drawings of these three modules were approved on July 26, 2018, May 23, 2019 and October 13, 2018, respectively. The bids were officially opened on March 22, 2019, September 19, 2019, and March 22, 2019, respectively. Contacts were awarded on June 28, 2019, January 13, 2020, and September 12, 2019, respectively, with contract price of CNY4,883,601 for GC-C1, CNY46,148,440 for GC-C2, and CNY45,791,744 for GC-C3. The construction of the three packages started on September 10, 2019, March 31, 2020, and October 12, 2019, respectively. The expected completion dates are the end of July 2021, the end of December 2021, and the end of October 2021, respectively.

27. In addition, as recorded in resettlement DDR of entire new campus, this sub-project also involves delayed house reconstruction for 5 AHs, with a total housing land area of 1,534m2. Meanwhile, 57.8 mu construction land should be returned to the affected village for development of collective economy. These issues were left over from the early stage of campus construction of Guilin University of Aerospace Technology. So far, the construction of resettlement site started in March 2021. However, the foundation treatment process and the construction work have not been completed, as the site is still being backfilled. The "three connections and one leveling" work for resettlement site will be completed in May

2021 and the site construction will be completed in July 2021. It is anticipated that the resettlement housing lots will be allocated to 5 AHs in September 2021. The land return has been completed, as shown in Figure 2-11.

2.7 China-ASEAN Educational Medicare Cooperation

Project

28. This subproject’s preliminary design was approved on January 18, 2018 and the construction drawings were approved in July 2018. The construction content includes the new campus of Youjiang Medical College for Nationalities, with a total construction area of 182,210 m2, including teaching buildings, laboratory buildings, libraries, administrative buildings, offices, halls, student cafeterias and apartments, and staff housing. The biddings of School Gate Area Construction Project (BS-C1) and West District Construction (BS-C2) were opened on June 15, 2019 and the contract were awarded on October 16, 2019. The contract price of BS-C1 is CNY77,504,770 and for BC-C2 it is CNY75,802,335. Civil works for BS-C1 and BS-C2 started on April 18, 2020 and on January 9, 2020, respectively. The subproject will be completed by December 30, 2021.

29. In addition, as recorded in resettlement DDR of entire new campus, the subproject also involved 43.2 mu of construction land to be returned to the affected village for development of collective economy. As of this monitoring period, the land has been returned to the affected village, as shown in the figure2-13.

3. Resettlement Implementation Monitoring

30. This section focuses on the and implementation progress of three subprojects involving additional LAR impacts and resettlement plan (RPs) preparation during project preparation stage, namely: 1) Chongzuo Sino-Vietnam Border Economic Cooperation Zone Demonstration Project (Phase I), 2) Dongxing Changhu Road East Section Construction Project, and 3) Road Connectivity in Pingxiang (Guangxi) –Lang Son (Viet Nam) Cross-Border Project.

3.1 Chongzuo Sino-Vietnam Border Economic Cooperation

Zone Demonstration Project (Phase 1)

3.1.1 Resettlement Impacts

31. According to RP, this subproject only involves LA impacts. See the changes of LA impacts in Table 3-1.

32. According to PP, the Jiangzhou sub-project would acquire 850.09 mu of LA, affecting 28 HHs with 92 persons. According to the detailed measurement survey during RP implementation, this subproject actually acquired 1,017.81 mu of land, including 781.63 mu of cultivated land, 207.77 mu of construction land, and 28.41 mu of unused land, affecting 28 HHs and 83 persons. According to PIE, the main causes for LA area increase are: (i) 137.3 mu land for roadside slops and extension sections connected to existing roads has been acquired additionally for 6 roads; (ii) additional 30.42 mu land has been acquired as reserved land for affiliated facilities and capacity extension in future for the WWTP. See Table 3-2 for details.

34. During RP implementation, the allocation of land compensation fees between the state farm and the worker households has been slightly adjusted after consultation and agreement. The increased part held by the state farm was used for social insurance premium of farm workers. See the consent record of representatives of AHs on adjustment of land compensation allocation in Figure 3-1.

(3) Resettlement and Livelihood Restoration

36. Based on the land loss and income loss rates, following measures were planned to restore livelihood of affected households of this subproject: (1) cash compensation; (2) agriculture structure adjustment to increase agricultural income; (3) job opportunities provided during project implementation and operation stages; (4) tertiary industry opportunities related to project implementation and operation encouraged ; (5) public welfare jobs prioritized for affected persons; (6) skills training; and (7) social security programs. See Table 3-5 for the summary of implementation status of these measures.

3.1.3 Resettlement Progress (1) Resettlement Implementation Timeline

37. All the land acquisition and compensation of the Jiangzhou subproject have been completed before commencement of civil works. The LA work for Road #2, #3, #4 and the WWTP had been completed by September 10, 2017, while the LA of Road #1, #6 and #7 had been completed by February 7, 2018. All LA compensation has been paid in a fully and timely manner. Relevant resettlement due diligence reports (DDRs) have been cleared and disclosed by ADB.

3.2 Dongxing Changhu Road East Section Construction

39. According to the RP, the subproject would involve permanent LA, temporary land occupation, demolition of non-residential buildings and ground attachments. All these impacts are in in Nanmushan Village, Dongxing Town. See Table 3-9.

40. According to the data provided by land acquisition center of Dongxing City, 685.59 mu of land (including 334.266mu collective land and 351.324mu state-owned land acquired from 2013 to 2018) need to be permanently acquired for the subproject, affecting 1,584 households and 2,482 persons in 25 villager groups of Nanmushan Village. Since the compensation is equally distributed among all members, all the population of affected villager groups are identified as affected population. See Table 3-10 for details.

(2) Demolition of non-residential houses

41. According to RP, the project originally needs to demolish non-residential houses with a total area of 2,6623.5 m2, affecting 16 households with 72 persons. According to the latest monitoring data, the subproject actually involves HD with a total area of 16,944.61 m2, affecting 7 households with 7 persons, all of which are non-residential houses built by fruit farmers. There is no need for relocation and housing resettlement. See Table 3-11 for details.

(2) Livelihood Restoration

43. To mitigate the impacts of LAR and restore the livelihood of the affected people, restoration and resettlement measures had been prepared for all APs in updated RP, mainly including: i) supporting the development of cross-border trade and promoting cross- border trade with Vietnam, by which, this sub-project will drive economic growth in the project area and increase employment and income opportunities for local residents; 2) employment promotion, particularly 200 temporary jobs will be created during the construction period, and 10 jobs during the operation phase, including workers on construction sites, house and road maintenance workers, security personnel, and other auxiliary personnel along Changhu Road; 3) skills training for affected villagers to be provided by local government; and 4) social insurance measures. Affected farmers over 16 years old will be eligible to receive local government subsidies to participate in relevant endowment insurance. In addition, for residents affected by demolition of non-residential houses, the Dongxing LA and HD Office will also coordinate with relevant local government departments to help affected people in re-leasing new land or houses in nearby areas to restore their production or operations as needed. There are many hilly areas around the

project area, which can be re-leased by the affected households. The rent will be similar to the previous level. More details will be followed up and analyzed in subsequent monitoring reports.

3.2.3 Resettlement Progress

44. Up to now, the LA and HD of this subproject have been progressing in an orderly manner. See Table 3-13 for details.

(1) Implementation progress of LA

45. According to detailed measurement and verification, this subproject needs to permanently occupy 685.59 mu land (including 334.266mu collective land and 351.324mu state-owned land acquired from 2013 to 2018) in 25 villager groups in Nanmushan Village. As of this monitoring period, 598.189 mu has been acquired, with the remaining 87.401 mu land to be acquired in coming months. So far, accumulative payment of land compensation is CNY16.51371 million. (2)Implementation progress of demolition of non-residential houses

46. The subproject needs to demolish non-residential houses with 16,944.615 m2 of 7 households, all of which are non-residential houses built by local fruit farmers. Cash compensation will be provided only and there is no need for relocation and reconstruction. As of this monitoring period, the demolition of 5 houses has been completed, with a total amount of CNY899,560 paid. Two remaining houses with a total area of 14,150 m2 are planned to be paid and demolished by November 2021. The payment records have not been provided by the relevant departments yet and will be followed up in subsequent monitoring reports. See Table 3-15 for details.

49. According to detailed measurement surveys, 4 villager groups, including Bushatun, Kafangtun, Nongyaotun, and Qulitun, will be affected by LA. The total LA area is 170.382mu, including 44.805 mu of arable land, 5.543 mu of unused land, and 120.034 mu of forest land, affecting 41 households with 200 persons. See Table 3-18 for details.

(3) Resettlement and Livelihood Restoration

52. Agreed livelihood restoration measures in RP mainly include: 1) cash compensation for land-lost HHs; 2) providing social security to affected people, such as subsidies or medical assistance; 3) providing work and income opportunities during construction and operation; 4) developing self-employment in the tertiary industry (e.g., leasing of construction machinery and equipment, transportation, freight, repair, entertainment, food, catering and hotel services, and tourism); 5) providing skills training for the affected people to increase their capacity for employment in institutions and enterprises. These activities are ongoing, and will be followed up and analyzed in subsequent monitoring reports.

(1) Progress of LA

54. According to measurement surveys during implementation stage, the Pingxiang subproject needs to acquire a total of 170.382 mu, involving 4 villager groups in Kafeng Village. As of this monitoring period, the LA has been completed. The subproject has paid land compensation with a total amount of 3.86228 million yuan, as shown in Figure 3-7. Due to the shortage of government counterpart funds, the remaining land compensation of 258,874 yuan for Bushatun and 2.221678 million yuan for Kafangtun have not been paid yet. Pingxiang City Government agreed to complete the remaining payments by 20 July 2021. See Table 3-22 for details.

55. As of this monitoring period, the Pingxiang Subproject has paid a total of 3.8622 million yuan for LA compensation, including 2.0421 million yuan for LA compensation fee is, 219,276 yuan for crop compensation, and 1,600,904 yuan for other related expenses. See Table 3-23 for details.

4. Capacity Building for RPs Implementation

4.1 Organizational Structure

56. GRIP Tranche 2 is planned to be implemented from May 2018 to May 2023. The government of GZAR through Guangxi Foreign Loans Project Management Office (GPMO) is the executing agency. Respective municipal governments are the implementing agencies and state-owned enterprises at the local level are the project implementing entities (PIEs), except for subprojects #6 and #7. Public educational institutions (universities) are the implementing agencies and PIEs respectively for subprojects #6 and #7. See details in Table 4-1 and Figure 4-1.

Local PMOs are responsible for coordinating the land acquisition and resettlement works, including: organizing project resettlement work, formulating local policies for resettlement activities, coordinating the relationship between resettlement agencies at all levels; coordinating with relevant departments in project preparation and implementation stages, and making decisions and consultations on major issues raised during the construction stages. The specific implementing agencies of LAR are normally the local natural resource bureaus (NRB) and township governments in project areas. Other agencies involved in the LAR include the local city/district/county human resources and social security bureaus, women’s federations, civil affairs bureaus, etc. At the same time, village/community committees in project areas usually appoint 1-2 main cadres to participate and assist land acquisition and resettlement works.

4.2 Staffing

58. According to the intensity of LA and resettlement activities, resettlement implementation agencies at all levels have appointed relevant staff for RP implementation, as shown in Table 4-2. At the same time, each RP implementation agency has its fixed office location and office equipment.

4.3 Evaluation

59. The evaluation on capacity building for RP implementation are summarized as follows:

(i) The project management and resettlement implementation agencies have been designated by the relevant local government departments, and the responsibilities and tasks of these agencies at all levels are clear. Relevant staff have been organized for training during the project preparation and implementation phases, and the training contents cover applicable resettlement policies, ADB’s relevant requirements, key points of the resettlement plans, resettlement implementation management and experience sharing, data management and internal monitoring and reporting, etc. (ii) From project preparation to implementation stage, each project implementation agency gradually understands and becomes familiar with ADB's involuntary resettlement policies and procedures. (iii) The resettlement management and implementation agencies has relatively rich capabilities and experience for domestic projects’ LAR affairs, and needs to be more familiar with the relevant requirements on resettlement implementation and management of ADB projects, through training, study tour, experience exchange, etc. (iv) The resettlement consultants recruited in different stages have provided technical guidance and assistance on the update and implementation of the resettlement plans. (v) The focal persons of project management and resettlement implementation agencies should further strengthen intercommunication and data/information sharing related to the project and resettlement implementation, and do a better job in sorting and archiving of relevant documents. (vi) The project management and resettlement implementation agencies should

ensure the stability of the personnel, if the personnel changes, the handover of documents and necessary training should be done well in a timely manner.

5. Information Disclosure, Public Participation and

Grievance Redress

5.1 Information Disclosure and Public Participation

60. The GRIP T2 was approved by the ADB on April 4, 2018, and the loan agreement was formally signed on August 1, 2018. The GRIP T2 is planned to be implemented from May 2018 to May 2023, with a period of 5 years. Since the project implementation, the Guangxi DRC, as the leading agency of the project, has continuously publicized the project information on its government website. In addition, the Guangxi PMO and local PMOs have organized planning and design institutes to conduct field surveys in the project-affected area, publicizing the basic information of the project, investigating and verifying the physical impact indicators of the project, learning about the socio-economic profile of the affected population, and collecting information on the attitudes and needs of affected people.

61. Meanwhile, the China Financial News and the government websites of the sub-project districts and cities have also disclosed relevant information about the GRIP T2, to help concerned people to know the progress of the project.

62. The RPs have been disseminated to affected villages and HHs during the project preparation and implementation stage. PMOs at all levels have publicized and distributed the RPs and RIBs to affected villages and people; the updated RPs have been disclosed to the affected people as well. According to on-site investigations, before LA and HD, relevant local government agencies have carried out a large number of public participation activities, such as LA and HD mobilization meeting, LA and HD announcement, land/house

evaluation and measurement, announcement and publicity of applicable policies and compensation fees, etc.

63. Along with continuous project preparation and implementation, all project implementation agencies, townships and villages have being carried out public consultation and participation actives with affected people. The external monitoring team will continuously follow up and monitor the public consolation and participation actives in project areas.

5.2 Grievance Redress

64. To ensure smooth and saucerful implementation of RPs, local PMOs and PIEs have carried out extensive consolation with affected village and people, in which their views and expectations have been incorporated in RPs. Therefore, no serious complains are expected during project implementation. The GRIP T2 has established a grievance redress mechanism (GRM) to provide the affected people with channels to appeal and solve problems, if there is any during RPs implantation.

65. As of April 30, 2021, no complaints/appeals have been received from APs. With the progress of resettlement, all resettlement agencies will handle potential grievances and appeals (if any) as follows:

Stage 1: If any AP is dissatisfied with the RP implementation, he/she can file an oral

or written appeal to the village/community committee orally or in writing. In case of an oral appeal, the village committee shall handle such appeal and keep written records. Such appeal should be solved within two weeks. Stage 2: If the AP is dissatisfied with the disposition of Stage 1, he/she may file an appeal to the town government after receiving such disposition, which shall make a disposition within two weeks. Stage 3: If the AP is still dissatisfied with the disposition of Stage 2, he/she may escalate the appeal to city-level PMO and/or local natural resources bureau (LA and HD Office) in accordance with applicable laws and regulations after receiving such disposition for arbitration. Stage 4: If the AP is still dissatisfied with the the disposition of Stage 3, he/she may file an appeal to local City Government for arbitration after receiving such judgment.

66. The AP may appeal to a local court in accordance with the Administrative Procedure Law of the PRC as their alternative way of grievance redress at any time.

67. In despite of no complaints received, the external monitoring agency reminded that the remaining land compensation or HD compensation for the Pingxiang Subproject and Dongxing Subproject have not been paid fully, which may cause potential complaints and appeals. Special attention should be attached by PMOs and PIEs in Pingxiang and Dongxing cities. The pending compensation should be paid in a timely manner to avoid potential complaints and appeals from APs.

6. Main Findings and Recommendations

6.1 Main Findings

6.1.1 Project implementation progress

68. Out of the 7 subprojects of GRIP T2, 6 ones have started their civil works successively since loan approval. Only the implementation of Qinzhou cross-border trade e-commerce industrial park project has been delayed, due to the pending final design and business model. However, this subproject does not involve any additional LAR impacts.

69. Regarding the China-ASEAN SMEs Synergy Innovative Development Subproject, which involves legacy issues in DDR prepared during project preparation, the construction of resettlement site (1,534m2) is ongoing and the return land of 57.8 mu for collective economic developed has been handed over to affected village. The foundation treatment of the resettlement site will be completed in July 2021. After that, 5 HHs affected by HD can start to construct their resettlement houses.

70. For the China-ASEAN Educational Medicare Cooperation Subproject which involves legacy issues in DDR prepared during project preparation, the return land of 43.2 mu has been handed over to affected village, and there is no pending issue related to land use.

6.1.2 Implementation progress of LA and HD

71. Among the 7 sub-projects, there are 3 ones involving additional LA And HD impacts, with RPs prepared and approved during project preparation, including: i) Chongzuo Sino- Vietnam Border Economic Cooperation Zone Demonstration Project (Phase I), ii) Dongxing Changhu Road East Section Construction Project, and iii) Road Connectivity in Pingxiang (Guangxi) –Lang Son (Viet Nam) Cross-Border Project. The rest 4 sub-projects do not involve any additional LA and HD impacts in project implementation stage.

(1) Chongzuo Sino-Vietnam Border Economic Cooperation Zone Demonstration Project (Phase I)

72. This subproject actually needs to acquire 1,017.81 mu land, with an increase of 167.72 mu compared with the RP, affecting 28 households with 83 persons in Xinhe Town of Jiangzhou District, Chongzuo City. As of this monitoring period, land acquisition and compensation have been completed for this subproject, without any remaining issues. This subproject has paid resettlement costs with a total amount of 42.6232 million yuan, including 3,233,3700 yuan for permanent LA was, 768,000 yuan for temporary land occupation, and 8.1325 million yuan for crops and ground attachments. Two resettlement due diligence reports for this subproject have been cleared by ADB and disclosed on its official website in December 2017 and April 2018.

(2) Dongxing Changhu Road East Section Construction Project

73. This subproject actually needs to acquire 686.59 mu land (including 334.266mu collective land and 351.324mu state-owned land acquired from 2013 to 2018), with a decrease of 11.322 mu compared with the updated RP; meanwhile the actual demolition area of non-residential houses is 16,944.61m2, with a decrease of 9,678.885 m2 compared with the RP. This subproject affects 1,584 households with 2,482 persons in Nanmushan Village of Dongxing Town, Dongxing City. As of this monitoring period, this subproject has acquired a total of 598.189 mu of land (including 351.324mu land acquired from 2013 to 2018), and the remaining 87.401 mu will be acquired by the end of September 2021. Regarding HD, 5 non-residential houses with a total area of 2,794.651m2 have been demolished, and remaining non-residential houses with a total area of 14,150 m2 are planned to be paid and demolished by November 2021. So far, this subproject has paid a total of 21.41 million yuan for LAR costs, including 16.51373millon yuan for land compensation, 899,560 yuan for house compensation, and 4.00525 million yuan for young crops and ground attachments.

(3) Road Connectivity in Pingxiang (Guangxi) –Lang Son (Viet Nam) Cross- Border Project

74. This subproject actually needs to acquire 170.382 mu land, with an increase of 35.682 mu compared with the RP, affecting 41 households with 200 persons in Kafeng Village of Youyi Town, Pingxiang City. As of this monitoring period, the LA and compensation work of the Kafeng Village has been completed and a total amount of 3.86228 million yuan has been paid for LA. However, land compensation for collective with an amount of 258,874yuan in Bushatun and 2,221,678 yuan in Kafang Village has not been paid yet. Pingxiang City Government agreed to complete the pending land compensation payment by 20 July 2021.

75. For completed land acquisition and resettlement activities, applicable resettlement policies, including compensation rates and resettlement entitlements, have been complied with these stipulated in RPs.

76. Livelihood restoration measures in agreed RPs are being implemented by local government departments, which will be followed up and evaluated in subsequent monitoring reports.

6.1.3 Capacity Building for RPs Implementation

77. The staffs in agencies responsible for LAR affairs of GRIP T2 are stable in general, and their profession and work ability for RP implementation have been sustainably strengthened along with preparation and implementation of RPs. Local PMOs and PIEs have continuously improved the management and coordination of LAR affairs since project implementation, including interdepartmental communication and coordination, public consultation and participation, data collection and archiving, etc.

6.1.4 Information disclosure, public consultation, and grievance redress

78. Overall, local PMOs and PIEs have attached great importance to information disclosure and conducted extensive public consultation with APs, village collectives and

affected entities by various means, and feedback to APs’ concerns in a timely manner. The GRM in all subprojects function well throughout project implementation, and minor complaints and appeals related to LAR (e.g., verification of LAR impacts, disputes on land/assets ownership) can be addressed in a timely and proper manner. No significant complaints have been received so far.

79. However, the remaining land compensation or HD compensation for the Pingxiang Subproject and Dongxing Subproject have not been paid fully, which may cause potential complaints and appeals. Special attention should be attached by PMOs and PIEs in Pingxiang and Dongxing cities. The pending compensation should be paid in a timely manner to avoid potential complaints and appeals from APs.

6.2 Recommendations

80. To ensure smooth and successful implementation RPs of GRIP T2, it is recommended that more attention should be paid on following aspects in next steps:

6.2.1 Expediting LAR implementation progress

81. Following LAR activities should be completed as soon as possible.

(1) Dongxing Changhu Road East Section Construction Project

82. For Dongxing Subproject, remaining 87.401 mu land for Dongxing subproject should be acquired and compensated ion as soon as possible, and the remaining 2 non- residential houses with a total area of 14,150 m2 should be compensated and demolished timely, the same for a few high-voltage power lines affected.

(2) Road Connectivity in Pingxiang (Guangxi) –Lang Son (Viet Nam) Cross- Border Project

83. For Pingxiang Subproject, the remaining land compensation of 258,874 yuan for Bushatun and 2.221678 million yuan for Kafangtun should be paid by 20 July 2021, as agreed by Pingxiang City Government.

(3) China-ASEAN SMEs Synergy Innovative Development Project

6.2.2 Attaching more attention on livelihood restoration measures

85. After land acquisition and compensation, local PMOs and PIEs need to continuously coordinate with local human resource and social security bureau and other concerned to implement livelihood restoration measures agreed in RPs, such as skills training and employment assistance for APs, particularly for vulnerable groups, women aged 40 years above and men aged 50 years above, etc. 6.2.3 Keeping public consultation channels and grievance redress

86. Local PMOs, PIEs and resettlement implementing agencies need to make continuous efforts on information disclosure, public consultation and participation in line with RP. Meanwhile, GRM need to be functional throughout entire project circle and all received complains and appeals, if any, should be recorded, redressed and reported to GPMO and external monitor timely. 6.2.4 Strengthening capacity building and internal monitoring

87. Resettlement focal persons in local PMOs, PIEs and other responsible agencies need to continuously improve their capacity by means of training, workshops, and study-tours, etc., and maintain stability of main personnel. Meanwhile, staff of local PMOs, PIEs and resettlement implementing agencies need to further enhance the communication/coordination and data/information sharing on project and RP implementation, and do a better job on documentation, data sharing and archiving.

88. In addition, a sound internal monitoring and reporting system should be established with assistance of project management consulting team.
