East Creech Conservation Area Review Item 13 Council Meeting – 20 February 2018 East Creech Conservation Area review 1. Purpose of report The purpose of this report is to seek the Council’s approval to adopt the draft appraisal and boundary proposal prepared for East Creech Conservation Area. 2. Key issues 2.1 The Council designates and reviews conservation areas in fulfilment of statutory duties set out in Section 69 of the Planning (Listed Buildings and Conservation Areas) Act 1990. Purbeck District has twenty five Conservation Areas, twenty-two of which have been appraised and reviewed since their designation, twenty-one of these since 2008. 2.2 A conservation area is a historic built environment designation which promotes the preservation and enhancement of groups of buildings and structures which hold special historic or architectural interest, together with associated spaces and trees. This is primarily achieved through the sensitive management of change through the planning process. Conservation areas are not designated to protect sites of archaeological, geological or ecological interest, or to offer broad landscape protection. Other designations and planning policies are applicable in these cases. 2.3 Paragraph 127 of the National Planning Policy Framework (NPPF) highlights the importance of ensuring that conservation area designations are justified. In this regard a key objective of the review is to ensure that the boundaries are appropriate. This ensures fairness in the application of controls, and soundness in decision making. 2.4 The Council has a statutory duty to consider the impact of planning proposals upon conservation areas. This is reflected in paragraph 129 of the NPPF, which requires local planning authorities to assess the significance of heritage assets as part of the development management process. Assessment of significance is a key objective of conservation area character appraisals, and therefore provides the Council with an important part of the required evidence base in decision making. 2.5 A six week period of formal public consultation on the draft boundary proposals and appraisal ran between 7th November and 16th December 2016. Details were sent to the Parish Councils six weeks in advance, and the consultation was subsequently extended until 21st February 2017 to allow further time for comments. Consultation materials were made available online and at Westport House. A leaflet was posted to every property affected, and officers attended meeting of Church Knowle Parish Council to explain the draft proposals and take comments. The consultation was advertised through local media and Council newsletters. Following the recommendation of the July Council meeting, a further event was held at Westport House for residents and parish representatives from East Creech and Morden on 6th September 2017 (see Main Report). Substantial changes made to the proposed boundary were well received. Comments and responses are summarised in Appendix 1. 2.6 Copies of the draft conservation area appraisal and the boundary proposals are contained in Appendices 2-3. Councillors may also view colour copies of the documents in the Members’ Room at Westport House. CM-2018-02-20-east-creech-conservation-area-review.docx 1 Item 13 2.7 On 22 November 2017 Policy Group resolved that a report should be submitted to Council recommending adoption of the appraisal and boundary proposals prepared for the East Creech Conservation Area. At its meeting on 16 January 2018 Council deferred consideration of the appraisal and boundary proposals pending clarification of the relevance of the Hawk Post archaeological excavation to the review. 2.8 This report incorporates the clarification requested by Council at paragraph 5.6, and concludes that it is not relevant to consideration of the boundary changes proposed. 3. Recommendation The Council approves adoption of the appraisal and boundary proposal prepared for East Creech Conservation Area. 4. Policy issues 4.1 How will this affect the environment, social issues and the local economy? 4.1.1 The historic environment plays an important role in providing local identity, character and interest to the District, and enhancing the experience and quality of life of people who live, work in or visit it. 4.1.2 The conservation area appraisals will be used to provide guidance on the design of new development, and works requiring planning permissions and consents. It will also be useful where such permissions and consents are not required. This will help to ensure that the character and appearance of the conservation area is preserved and enhanced in line with statutory objectives, the NPPF, and policies in the Purbeck Local Plan Part 1. 4.1.3 The conservation area appraisals will be a useful resource for bodies or individuals wishing to undertake improvement or enhancement works, or whose activities could be designed in such a way to achieve this. 4.2 Implications 4.2.1 Resources Costs will be involved in placing advertisements detailing the variation of boundaries as required by statute. These costs can be met from within existing budgets. 4.2.2 Equalities There are no equalities implications. 5. Main report 5.1 Plan based boundary proposals arising from the review of East Creech Conservation Area is attached as Appendix 2. Written details are provided below together with statements of justification for the proposed changes. 5.2 As originally designated in 1990, the conservation area included large tracts of open land, and some scrub covered wasteland in the surrounding landscape. The boundary itself now appears arbitrary in places and apparently unrelated to physical features on the ground. As far as reasonably possible it is necessary and appropriate to draw a distinction between a settlement and its landscape setting in designating a conservation area. As both East CM-2018-02-20-east-creech-conservation-area-review.docx 2 Item 13 Creech and the whole of the surrounding landscape fall within the AONB – a planning designation specifically designed to conserve landscape character and quality – the landscape setting of the hamlet is amply protected regardless of its presence inside or outside the conservation area. The review also recognised a need to reflect the fact that land within the conservation area has undergone significant change around East Creech Farm since designation. 5.3 Changes are proposed to the conservation area boundary in order to ensure that the designation is focused on buildings and associated spaces, in line with its statutory definition, and paragraph 127 of the NPPF. The proposal also accommodates the wishes of local residents and the parish council as far as can be justified. This is outlined in more detail below. Elements proposed for removal are: i. an area of scrub woodland over former quarry workings (former Greenspecks pit); ii. part of a field north of Rockley and northeast of East Creech Farm, including some modern farm structures; iii. part of East Creech Farm caravan site; iv. open downland to the south of Creech Wood, Chaldecot’s Wood and Furlong’s Coppice; and, v. part of Cotness Wood. 5.4 Elements proposed for addition are: two fields and woodland on the west side of Creech Barrow Hill, bounded to their west by the road to between Creech and East Creech. 5.5 At the special meeting on 6th September 2017, and subsequently at the Policy Group meeting on 22 November 2017, concern was expressed by Parish Council representatives and the ward Member that a Roman villa site that had been a subject of archaeological excavation would be excluded under the proposed boundary changes. This was claimed to be located in the field north of Rockley (see (ii) in paragraph 5.3 above). Officers stated that a scheduled Roman villa site lies to the north west of the hamlet in farmland well outside the existing conservation area, but there was no record of a second villa. 5.6 Arising from the above, both prior to, and at the Council meeting on 16 January 2018, local residents presented copies of archaeological reports. These did not provide any evidence of a Roman villa or work on the site identified during the previous Policy Group meeting, but instead related to Hawk Post pit – a site to the north west of the hamlet outside the conservation area. The Council deferred a decision on adoption of the boundary changes and appraisal pending clarification of the relevance of this new information. This is summarised below. 5.6.1 Hawk Post pit is an open cast ball clay quarry which lies to the north west of the hamlet, well outside the current conservation area boundary. Hawk Post archaeological excavation was undertaken in 1995 in advance of ball clay extraction. This excavation followed an archaeological evaluation in 1994 which had indicated the archaeological potential of the site. The evaluation identified the ‘rarity’ and ‘importance’ of the site (rather than the wider area), forming a basis for the excavation. CM-2018-02-20-east-creech-conservation-area-review.docx 3 Item 13 5.6.2 The Hawk Post excavation identified elements of a multi-phase settlement which may extend to the east of the quarry (into land also outside the conservation area) and might also have extended to the south. Quarrying at the beginning of the twentieth century has destroyed most of the evidence for the latter. In this context some finds recorded at Greenspecks pit in 1912 might have an association, though this remains speculation. The overgrown site of Greenspecks pit lies within the conservation area boundary to the north west of the field within which the Roman villa was claimed to exist. It is currently proposed for removal from the conservation area ((i) in paragraph 5.3 above). 5.6.3 The processes of archaeological excavation and quarrying are each destructive. The archaeological sites in question – Hawk Post pit and Greenspecks pit – have each been destroyed.

Mr Percy, a neighbour, was concerned about an increase in traffic using the narrow road leading to to Puddlemill and felt that the visibility for drivers accessing the development was poor. The developer agreed but also pointed out that the road was classified as a road and that he would work with the landowner to improve visibility. Mr Tamplin went on to outline his proposals to convert some of the outbuildings into holiday lets and advised the meeting that he intended to use Puddlemill as a working farm. Mr Percy suggested that the development might have been better as a farm with affordable housing, but he was advised by Mr Tamplin that this had not been permitted by the planning authority. Cllr Bugler noted that there were no proposals for private sewerage, including septic tank, on the plans submitted and was advised by the developer that one would be installed since the units could not be connected to the main sewer.

Cllr Page, retiring chairman from the previous meeting proposed that Cllr Higgens take the Chair, there being no general wish by Members present to stand as Chairman of the Parish Council. His proposal was seconded by Cllr Parker. Cllr Higgens did not object to such appointment and the motion was carried unanimously. RESOLVED that Cllr Higgens should act as Chairman for the June Parish Council meeting. Cllr Higgens took the Chair for the meeting. APOLOGIES 158.17 The Clerk reported he had received apologies for late attendance/absence from PDC Cllr Mr Malcolm Barnes who hoped to attend later, DCC Cllr Ms Cherry Brookes, and Cllr Mrs Jayne Wilson.
