This has reference to vour online proposal submitted in the State Level Envircnment lmpact Assessment Authority to prescribe the Terms of Reference (ToR) for undertaking detailed EIA study for the pLrrpose of obtaining Environmental Clearance in accordance,uvith the provisions of the EIA Notification, 2006. In this regard, under the provisions of the EtrA Notification, 2005 as amended from tinae to tinre Sustainable Sand Management Guidelines 2015 and Enforcement & Monitoring Guidelines for the sand mining-2020 the ToR for the purpose of- preparing Environment Impact Assessment report and Environment Management Plan for obtaining prior Environmental Clearance is preseribed as follows:-

1. Year-wise production details sinee 1994 should be given, clearly stating the highest production achieved in any one yearpriorto 1994"It may also be categorically informed

whether there had been any increase in production after the ELA Notification 1994 carne

into foree, w.r.t. the highest produetion achieved prior to 1994.

2. A copy of the document in support of the fact that the Proponent is the rightful lessee of the mine should be given. a All doeuments including approved mine plan, EIA and Fublie Hearing should be eompatible with one another in terms of, the mine lease area, production levels, waste generation and its management, mining teehnology etc. and should be in the name of the

lessee"

4" All corner coordinates of thc mine lease area, superimposed on a High-Resolution Imagery / toposheet, topographie sheet, geomorphology and geology of the area should be provided. Sueh an Imagery of the proposed area should elearly show the land use and

other ecological features ofthe study area (core and buffer zone).

5. Information should be provided in Survey of Toposheet in l:50,000 seale indicating geological map of the area, geornorphology of land forms of the area, existing minerals and rnining history of the area, important water bodies, streams and rivers and soil charaeteristics"

6. Details about the land proposed for mining aetivities shor.lld be given with information as

to whether mining sonfomrs to the land use poiiey of the State; land diversion for mining

should have approval from State land use board or the eoncerned authority. t" It should be clearly stated whether the proponent Cornpany has a well laid down Environment Folicy approved by its Board of Direetors? If so, it rnay be spelt out in the ELA R.eport with description of the preseribed operating process/procedures to bring into focus any infringement / deviation / violation of the environmental or forest norms I eonditions? The liierarehical system or administrative order of,the Company to deal with the environmental issues and for ensuring eomplianee with the EC conditions may also be given. Thc system of reporting of non-eompliances / violations of environmental norrns to the Board of Directors of the Company and/or shareholders or stakeholders at large, may also be detailed in the EIA Report.

8. The study area will eomprise of l0 km zone around the mine lease from lease peripheny and the data contained in the EIA.

10. A Certificate from the Competent duthority in the State Forest Departrnent should be provided, aonfirming the involvement of forest land, if any, in the project area. In the evcnt of any contrary claim by the Froject Proponent regarding the status of forests, the site may be inspeeted by the State Forest Department along with the Regional Office of the Ministry to aseertain the status of forests, based on which, the Certificate in this regard as mentioned above be issued" ln all sueh cases, it would be desirable for representative of the Statc Forest Department to assist the Expert Appraisal Committees"

11" Status of forestry elcarancc for the broken up area and virgin forestland involved in the Project inoluding deposition of net present value (NPV) and eompensatory afforestation (CA) should be indicated. A eopy of the forestry elearance should also be f'urnished. t2 Irnplcmcntation statr"ls of, recognition of forest rights undcr thc Schcdirlcd Trihes nnd other Traditional Forest Dwellers (Reeognition of Forest Rights) Act, 2006 should be indicuted.

13. The vegetation in the RF / PF areas in the study area, with necessary details, should be given.

14. ,4 study shall be got done to aseertain the irnpact of the Mining Project on wildlife of the

study area and details fumished. Innpact of the projeet on the wildlife in the surrounding and any other protected area and accordingly, detailed mitigative measures required,

should be worked out with oost implications and submitted.

15. Location of National Parks, Sanctuaries, Biosphere Reserves, Wildlife Corridors, Ramsar

site Tiger / Elephant Reserves / (existing as well as proposed), if any, within l0 krn of the mine lease should be elearly indicated, supported by a location map duly authenticated by

Chief Wildlife Warden. Necessary elearanee, as may be applieabie to sueh pro.jects due to proximity of thc ecologically sensitive areas as mentioned above, should be obtained from thc Standing Committee of National Board of Wildlife and eopy furnished.

16. A detailed biological study of the study area [eore zone and buffer zonc (10 km radius of the periphery of the mine lease)] shall be earried out. Details of flora and fauna, endangered, endemic and Rare Endairgered and Threatened (RET) Speeies duly authentieated, separately for core and buffer zone should be furnished based on such

prirnary field survey, clearly indicatingthe Schedule of the faunapresent. In ease of any scheduled - I fauna found in the study area, the necessary plan along with budgetary

provisions for their conservation should be prepared in eonsultation with State Forest and Wildlife Department and details furnished. Necessary alloeation of funds for

implementing the same should be made as part of the project eost. 17. Proximity to Areas declared as 'Critieally Polluted' or the Frojeet areas attraeting court restrietions for mining operations, should also be indicated and where so required, clearanee eertifications from the preseribed Authorities, such as the SFCB or State Mining Dept. Should be secured and furnished to the effect that the proposed mining aetivities eould be considered.

18. R&R Plan / compensation details for the Project ,{ffeeted Feople (PAP) should be furnished. While preparing the R&R Plan, the relevant StateAdational Rehabilitation & Resettlement Folicy should be kept in view" In respect of SCs /STs and other weaker

sections of the society in the study area, a need based sample survcy, family-lvise, should be undertaken to assess their requirements, and action programrnes prepared and submitted aecordingly, integrating the sectoral programmes of line departments of the State Govemment. It may be elearly brought out whether the village(s) located in the mine lease area will be shifted or not. T'he issues relating to shifting of village(s) including their R&R and socio-eeonornic aspects should be discussed in the Report. 19, One season primary baseline data on ambient air quality as per CPCB Notifieation of 2009, water quality, noise level, soil flora and f,auna shall be eollected and the AAQ and lA,

Air quality modeling should be earried out forprediction of impaet of the project onthe air quality of the area. It should also take into aecount the impact of movement of vehieles for transportation of mineral" Details of the model used and input parameters used for modeling should be provided for both mining and non-mining scenario. The air quality eontours should be shown on a location map elearly indicatingthe location of the site, location of sensitive receptors, and the habitation. The wind roses showing pre- dominant wind direction also be indicated on the map. 2r" Soft copy of Geo-tagged site photographs of each locations used of collection of data for

Fublic Hearing points raised and eommitrnent of the Froject Froponent on the same along with time bound Aetion Plan with budgetary provisions to implement the same should be provided and also incorporated in the final EIA / EMP Report of the Project. 36" Details of litigation pending against the project, if any, with direction /order passed by any Court of Law against the Project should be given.

37. The eost of the Frojeet (eapital cost and ree urring cost) as well as the eost towards implementation of EIVIP should be elearly spelt out.

38. A Disaster management Plan shall be prepared and included in the EIA i EI\4P Report" 39" Benefits of the Froject if the Project is implemented should be spelt out" The benefits of the Froject shall clearly indicate environmental, social, economic, employment potential,

etc. 40" Additional conditions- (a) Submit a report based on cumulative assessment of increase in air pollutants due to inerease in traffie load in view of proposed mining activities on all the roads located

within aerial distanee of 10 km using suitable air mode

(b) Submit a map on appropriate seale to show extraction paths to be used outside the niining lease boundary to approaeh major public roads (Rural I Distriet road or State I National Highway). Alternative route shall be explored if extraetion path is passing through dense population / human settlements. Also submit cumulative traffic management plan for cluster sand mining proposal.

(c) Submit a map of the area falling within 2.5 krn radius from boundary of eaeh mining lease showing all rnan-made public utility features sueh as bridge/publie civil srruorurc (ineludltrg waTer lnrnke polflrs), culverrs crc" afld hlghw'uy's, uncl u rublu showing distanee of the above mentioned man-made features from the mining iease boundary to facilitate decision making pertaining to relevant rules / Guidelines. (d) Submit District Survey Report (DSR) and other relevant doeurnents prepared in aeeordanee with extant MoEF&CC, Govt. of India Notifications / rules I guideiines. (e) If the proposed mining lease has overlapping areas with previously allotted mining lease or already working or worked out mining lease the same should be elearly ( \

rnarked on euffent rnining plan. Details about quantity of sand extracted from overlapped area should be furnished duly eertified from Distriet hzlining Offieer.

(f) Satellite imagery of last three years for surnmer, rainy and winter seasons of each proposed mining iease shall be submitted.

(g) Frepare cluster EIA / EMF of nnining Ghats / blocks qualified to fall in a eiuster on a

river within a distriet" 41. The environment protection requires a strietly regulated mining in terms of area quantity as well as most importantly replenishment thcreof EIA/EMP shall be eonsidered only for grant of EC when following directions of SEIAA are eomplied by the project proponeirt & Deptt. of mines and Geology, Bihar Govt. together:-

A. Letter of intent (L"o.I ) issued to settles /suceessful tenderer to have following basic infonnation either as addendutrn" otr ineorporating thern in its revised fonn to be issued by Deptt. Of mines & Geology, Govt. of tsihar" (i) Details of Geo-eo-ordinates of,lease area (eorner points); (ii) Involvement of Forest land/Distance form forest land/wildlife or otherwise proteeted areas/ Areheological sites and details of eluster situation if any; (iii) Vlinable area and prohibited area (where mining shall remain prohibited due to

safety of Brid geslstruetures/Archeolo gical sites, other structures ete ") ; (iv) Annual production capacity of the concerned Sand Ghat which should not be more than 60,000 rn3/ha/year.

(v) Nature of river (Ferennial or Non-perennial etc.)"

B. Vlining Plan updation- (i) Flan to show "Red line" or B€nqh noark with respeet to NISL (Mean Sea Level ) in mining ehannel reaches (MCR) below whieh no nnining shall be allowed.

(ii) Reeording of the initial level of mining lease at shorter interval, say 25m X 25m grid.

(iii) To leave buffer distanee (unmined block) at least 50m after cvery block of tr000 m.

(iv) To show only a maximum of 60% lcascd land for removal of minerals. (

(v) N4ining plan to include the eertificate from the competent ,{uthority in the state forest department or FCCF on Forest land, distance from wildlife protected areas. MIine pian in pieees shall only be unaceeptable"

42. Besides the above, the below mentioned conditions points are also to be eomplied: -

a) All documents to be properly referenced with index and eontinuous page numbering"

b) Where data are presented in the R.eport especially in Tabies, the period in whieh the data were eolleeted and the sourees should be indicated.

e) Project Proponent shall enclose all the analysis/testing reports of water, air, soil, noise cte. using the \4oEF&CC / NABL aecredited laboratories" All the original analysis / testing reports should be available during appraisal of the Projeet.

d) Where the doeuments provided are in a language other than English, an English translation should be pnovided.

e) The Questionnaire for cnvironmental appraisal of mining projects as dcvised earlier by the Ministry shall also be filled and submitted"

0 Whilc preparing the EIA report, the instruetions for the Proponents and instructions for the Consultants issued by NioEF vide O.VI. No" J-11013141/2005- IA.II(D dated 4th August, 2009, whieh are available on the website of this NzIinistry, should be followed.

NGT order / statutory order of other institutions as wcll as relevant other laws enacted by: Ministry of Environment, Forest & Climate Change, Government of India, New Delhi. ToR may be amended, or shall remain liable for cancellation if any statutory order

requires so.
