"Disclosure" meansthe Credit Card Account Open ing Disclosure. TheAccount Opening Disclosure is incorporated intotMs Consumer Credit Card Agreement and is partof theAgreement. In this Agreementthe words"you ," "your,"and "yours" mean each and all of thosewho agree to bebound by this Agreement;"card" means the Visa credit card and anydupl icates,renewals, or substitutionsthe CreditUnion issues to you;"accoun t" meansyour Visa credit card line-of-credit accountwith the CreditUnion; and "Cred it Union" means the Credit Union whose name appears on this Agreementor anyone to whomthe Credit Uniontransfers this Agreement. 1. USINGYOUR ACCOUNT- If you areapproved for an account,the CreditUnion will establisha lineof creditfor you.You agree that your creditlimit is themaximum amount (purchases, cash advances, finance charges, "other charge s") whichyou will haveoutstanding on your accountatany time. Unless disclosed otherwise . theCredit Un ion will notallow advances over the credit li mit. If theCred it Unionhas a program wherebyit allowspayment of advancesthat exceed your cred it limit,subject to a fee,the Credit Union will provideyou wi th notice,e ither orally, in writing,or electronically (notwithstandingthe requirement s of theparagr aph entitled "Statementsand Notices' ') explainingyour right to opt in to theCredi t Union's programwhereby lt will honoradvance requestsover the . In theeven t youopt in to sucha program,you a greeto thet ermsof sucha program.You may request an increase in yourcredit limit only by a methodacceptable to theCredi t Union. The Credit Union mayincrease or decrease yourcredit limit, refuseto makean advance and/or termina te youraccount at anytime for anyreason no t prohibited by law.If youare permi ttedto obtain cashadvances on youraccount, we may, fromtime to time,issue convenience checks to youthat may be drawnonyour account. Convenience checks may not be used to makea paymenton your account balance. If you usea conveniencecheck, it will beposted to youraccount as a cashadvance. We reserve the rightto refuseto paya conveniencecheck drawn on youraccount for anyreason andsuch refusal shall not constitute wrongful dishonor. Youmay request that we stop the payment of a conveniencecheck drawn on your account. You agree to payany fee imposed to stopa payment ona conveniencecheck issued on your account. You m ay makea stop paymentreques t orally,if permitted,or in writing.Your request must be madewith sufficienttime in advanceof the presentmentof thecheck tor paymentto giveus a reasonableopportunity to act on yourrequest. In addition,your reque st mustaccurately describethe checkincluding the exact account number,the payee,any check number that may be applicable,andthe e xact amountof thecheck. If permitted, youmay make a stoppayment request orally but such a request will expireaft er 14 days unless youconfirm your request in writingwi thinth at time.Wr ittenstop payment order s areeffec tiveonly for six (6) months andmay be renewedfor additionalsix monthperiods by requestingin writing that thes top paymentorder be renewed.We arenot requiredt o notifyyou whena stop payment orderexpire s. If we re-credit youraccount after paying a checkor draft overa validand t imelystop payment order, you agreeto signa statementdescr ibingthe disput e with thepayee, to assignto usall of yourrigh ts againstthe payee or otherholder s of thecheck or draftand to assistus in anylegal action. You agree to indemnifyand hold u s harmless from all costs andexpenses, including attorney's fees, damages,or claims,relat ed to our honoringyour stop payment requestor in failingt o stoppayment of anitem as a resultof incorrectinformation providedto us or thegiving of inadequatetime to act upona stop paymentrequest. 2. USINGYOURCARO- Youunderst and that the useof yourcredit card or creditcard account will constituteacknowledgementof receipt andagreement to theterms of the CreditCard Agreement and Credi t Card AccountOpen ing Disclosure(Disclosure).You may use your card to makepur chasesf rom merchants andothers who acceptyour card. The credit union is not responsiblefor the refusalof any merchantor financial institutionto honoryour c ard. If youwi sh to payfor goodsor servicesove r the Internet,you maybe requiredto providecard number securityinformationbeforeyou will be permittedto completethe transaction. In addition,you mayobtain cash advances from the CreditUnion, from otherfinancial ins titutions that acceptyour card, and f rom someautoma ted tellermachines (ATMs). (Not all ATMsaccept your card.) If the credit unionauthorizes ATM trans actionswith your card, ~twill issueyou a personali dentificationnumber (PIN). To obtaincash advances from an ATM,you mustuse the PINissued to youfor usewith your card. You agree that you will not useyour card for anytransaction that is illegalunder applicable federal,s tate, or locallaw. Even if youuse your c ard for anillegal trnnsaction, you will beresponsible for all amounts and chargesincurredin connectionwi th thet ransaction.I f youare perm itted to obtaincash advances on youraccount, you may also use your card to purchaseinstruments and engage in transactions tha t we considerthe equivalent of cash.Such transactions will be postedto youraccount as cashadvances and include , butare not limitedto, wiretran sfers, moneyorders, bets, lottery tickets, and casino gaming chips, as applicable. Thisparagraph shall not beinterpreted as permitting or authorizingany transaction tha t is illegal. 3. PROMISETO PAY - Youpromise to payall charges(purchases, s, balancetransfers, use of conveniencechecksor anyother charge)madeto youraccount by you or anyoneyou authori ze to useyour a ccount.You also promise to payall financechargesand other charges addedto youraccount under the termsof this Agreementor anotheragreement you madewith the CreditUnion. If this is a joint account,the paragraphonJOINT ACCOUNTS also applies to youraccount. 4. PERIODICRATES - Theperiodic ra tes applicableto purchases, cash advances, and balance transfers are disclosed on the Disclosurethat accompaniesthis Agreement.Any penalty rat e thatmay be imposedfor failingt o makea paymentby thepayment due date is alsodisclosed on theDisclosure. Any rate change will bemade pursuant to applicable law. If therate for youraccount is variable,as indicated on theaccompanying Disclosure,the rate chargedon purchases,cash advances, balancetransfers and any penaltyrate will varyperiodically as disclosedin the Disclosureaccompanyingthis Agreement. The initial rat e on youraccount for certain typesof transactionsmay be an introductorydiscounted rate(Introductory Ra te) that is lowerthan the rat e thatwould ordinar ily applyfor that typeof transaction.If an IntroductoryRate applies to your account, ther ates andthe period of timeit will beeffect iveis shownon the Disclosure accompanying this Agreement. After the IntroductoryRate periodexpires, the periodic rat e will automaticallyincrease to therates that would ord inarilyapply for thattype of transactionbasedon the terms of this Agreement. 5. FINANCECHARGES- Newpurchases pos tedt o youraccount duringa billingcycle will notincur a financecharge for thatbilling cycle if you hada zeroor creditbalance at thebeginning of thatbilling cycle , or youpaid the entire newbalance on the previouscycle's billing statement by the paymentdue date of thatstatement : otherwise a finance charge will accrue from thedate a purchaseis postedto youraccount. This givesus theaverage daily balance of purchases. For cashadvances, the finance charge is computedby applyingthe periodic rate to theaverage daily balance of cashadvances. To calculatethe averagedaily balanceof cashadvances, we takethe beginningoutstanding balanceof cashadvances each day, add in anynew cash advances, and subtractany payments and/or credits that we applyto thecash advance balance.This gives us thedaily balance of cashadvances. We then add all of the dailybalances of cashadvances for the billingcycle together and divide the total by the numberof daysin the billingcycle. This gives usthe averagedaily balance of cashadvances. Balancetransfersare calculated in thesame manneras cashadvances. 6. FOREIGNTRANSACTIONS- Purchasesand cash advances made in foreigncurrencies will bedebited from your account in U.S.dollars. The exchangeratebetween the transaction currency and the billingcurrency used for processinginternational transactions is a rateselected by Visa from a rangeof ratesavailable in wholesalecurrencymarketsfor theapplicable central processing date, which rate may vary from the rateVisa itself receivesor the government-mandatedrate in effectfor the applicablecentral processing date. The exchange rate used on the processing date maydiffer from the rate that would have been used on the purchase date or cardholderstatementposting date. A fee (financecharge), calculatedin U.S.dollars, will be imposedon all foreigntransactions, including purchases, cash advances and credits to youraccount. A foreigntransaction is anytransaction that you completeor a merchantcompleteson yourcard outside of the UnitedStates, with theexception of U.S.military bases, U.S. territories, U.S. embassies or U.S.consulates. The Foreign Transaction Fee is set forth on the Disclosureaccompanyingthis Agreement. 7. FEES- In additionto the periodicrate, the following additional fees may be imposed on youraccount. If applicableto youraccount, the fee amountsand explanationsare disclosed on the Disclosureaccompanying this Agreement. Your account may also be subject to additionalfees as set forth on theDisclosure accompanying this Agreement. a. AnnualFee.If youraccount is subjectto anAnnual Fee, the fee will becharged to youraccount upon the issuanceof yourcard. Each year following,the annualfee will becharged to youraccount during the same month that you were first chargedthe fee. The fee will becharged each year untilyour accountis closedand paid in full. b. BalanceTransferFee(Finance Charge). If your accountis subjectto a BalanceTransferFee (finance charge), the fee as disclosedon the Disclosureaccompanyingthis Agreement will becharged to youraccount when you transfer a balancefrom anaccount of another creditor to the accountsubject to this Agreement. c. CashAdvance Fee (Finance Charge). If youraccount is subjectto a CashAdvance Fee (finance charge), the fee will be chargedto your accountwhenyou obtain a cashadvance from anATM, the Credit Union or otherfinancial institution. d. ForeignTransaction Fee (Finance Charge). If your accountis subjectto a ForeignTransaction Fee (finance charge), a feemay be charged to youraccount for transactionsmade outside of the UnitedStates or in a foreigncurrency. e. LalePayment Fee. If your accountis subjectto a LatePayment Fee, the feewill becharged to youraccount when you do not makethe requiredminimum payment by or withinthe numberof daysof thestatement Payment Due Date set forth onthe Disclosureaccompanying this Agreement. I. ReturnedPaymentFee.If youraccount is subjectto a ReturnedPaymentFee, the fee will becharged to youraccount when a paymentis returnedfor anyreason. 8. PAYMENTS- Eachmonth you mustpay at leastthe minimumpayment shown on yourstatement by the datespecified on the statement. You maypay more frequently, pay more than the minimum payment or paythe totalnew balance in full. If you makeextra or largerpayments, you arestill requiredto makeat leastthe minimum payment each month your account has a balance(other than a creditbalance). The minimum paymentis2.00%of yourtotal new balance, or $25.00,whicheveris greater, plusthe amount of anyprior minimum paymentsthat you havenet made,all outstandingunpaidfees and charges, and any amount you are over your credit limit bythe date specified on thestatement. The Credit Unionalso has the right to demandimmediatepaymentof anyamount by whichyou areover your credit limit. 9. PAYMENTALLOCATION - Subjectto applicablelaw, your payments may be applied to whatyou owethe CreditUnion in any mannerthe CreditUnion chooses. However,in everycase, in theevent you make a paymentin excessof therequired minimumperiodic payment, the Credit Unionwill allocatethe excess amountfirst to thebalance with the highest annualpercentagerate and any remaining portion to theother balances in descendingorder based on applicableannual percentage rate. 10. SECURITYINTEREST - Yougrant the CreditUnion a securityinterest under the UniformCommercial Code and under any common law rightsthe Credit Union may have in anygoods you purchase. If yougive the Credit Union a specificpledge of sharesby signing a separatepledge of shares,your pledgedshares will secureyour account.You may not withdrawamountsthat havebeen specifically pledgedto secureyour accountuntil the Credit Union agrees to releaseall or partof thepledged amount. YourAccount Is securedby all othershares you have In anylndlvldual or Jointaccountwith the CreditUnion, except for sharesIn an lndlvldualRetirementAccount or In anyother account that would lose special tax treatment under state or federal law If givenassecurity. Theseother shares may be withdrawn unless you are In defaultunder this agreement.You authorize the Credit Union to applythe balance In yourlndlvldual or Joint share accounts to payany amounts due on your Account If youshould default. Collateralsecuringother you havewith the CreditUnion may also secure this ,except that a dwellingwill neverbe consideredas securityfor this account,notwithstanding anythingto thecontrary in anyother agreement. 11. DEFAULT-Youwill be in defaultif youfail to makeany minimum payment or otherrequired paymentby thedate that it is due.You will be in defaultif you breakany promise you makeunder this Agreement. You will bein defaultif youdie, file for bankruptcyor become insolvent , that is, unableto payyour obligations when they become due. You will bein defaultif youmake any false or misleadingstatementsin anycredit applicaUonor creditupdate. You will alsobe in defaultif something happensthat the CreditUnion believes may substantially reduceyour ability to repaywhat you owe. Whenyou are in default,the CreditUnion has the rightto demandimmediatepaymentof yourfull accountbalancewithout giving you notice.If immediatepaymentls demanded,you agree to continuepaying finance charges at the periodicrate charged before default, until whatyou owe hasbeen paid, and any shares that were given as securityfor youraccount may be applied towards what you owe. 12.LIABILITYFOR UNAUTHORIZED USE-LOST/STOLEN CARD NOTIFICATION - Youagree to notifyus immediately,orally or in writing, at 3400SumnerBlvd.,Ralei gh, NC27616 or telephone(800) 849-5600 Mondaythrough Fr iday8 :00a.m . to 5:00p.m.Eastern Time or (800)991-4961 seven(7) daysa week,24 hoursa day,of the loss,theft, or unauthorizeduse of yourcred it card.You may be liablefor the unauthorizeduse of yourcredit c ard. Youwill not be liablefor unauthorizeduse that occursafter you notify us of the loss,theft, or possibleunauthoriz ed use.You will haveno liability for unauthorizedpurchasesmadewith yourcredit card, unless you are grossly negligent in the handlingof yourcard. In any case,your liability will not exceed$50.00. 13.CHANGINGOR TERMINATING YOUR ACCOUNT-As permittedby law,the CreditUnion may change the terms of this Agreementand any attachedDisclosurefrom time to time.Notice of anychange will begiven in accordancewith applicable law. If permittedby lawand specified in the noticeto you,the changewill applyto yourexisting accountbalanceas well as to futuretransactions. Eitheryouor theCred it Unionmay terminate this Agreementat anytime, but term inationby you or the CreditUnion will not affectyour ob ligation lo paythe accoun t balanceplus any finance and other charges you oweunder thi s Agreement.Your obligation to paythe accountbalance plus anyfinance and other charges you owe under this agreement are subject to all applicablelaws and regulations regardingrepaymentrequirement s. Youare also responsible for all transactionsmade to youraccount after termination, unless the transactionswere unauthorized. Thecard or cardsyou receiveremain the propertyof the CreditUnion and you mustrecover and surrender to the CreditUnion all cardsupon request or uponterm inationof this Agreementwhether by you or theCredit Union. If this is a joint account,the paragraph on JOINTACCOUNTS of this Agreementalso applies to termination of theaccount. 14.CHANGINGORTERMINATING AUTHORIZED USERS - Uponyour request,we mayis sueadditional cards for authorizedus ers that you designate. You mustnotify us in writingof anytermination of an authorizeduser's right t o accessyour account.Your letter must include th e name of the authori?ed userand your account number and/or any subaccount number issued to the authorizeduser along with the authorized user's card andany convenience or otheraccess checks issued to the authorizeduser. If youcannot return the authorizeduser's ca rd or checksand if you requestyour account to be closed,we will closeyour account and you mayapply for a newaccount. 15.CREDITREVIEWAND RELEASE OF INFORMATION - You authorize the CreditUn fon to investigateyour creditstanding when opening or reviewingyour account.You authorize the CreditUnion to discloseinformation regardingyour accountto creditbureaus and creditorswho inquireabout your creditstanding. If youraccount is eligiblefor emergencycash and/or emergency card replacement serv ices, andyou request suchservices, you agreethat we mayprovide personal information about you and your accountthat is necessaryto provideyou with the requestedservice(s). 16.RETURNSAND ADJUSTMENTS - Merchants and others who honor your card may give credit for returnsor adjustments,and they w i,11 do so by sendingthe CreditUnion a creditslip whichwill be postedto youraccount. If yourcred its andpayments exceedwhat you oweth e Credit Union,theamount will beapplied against future purchases and cash advances. If the creditb alanceamount is $1.00or more,it will be refunded uponyour wr itten request or automaticallyafter six (6) months. 17.ADDITIONALBENEFITS/CARDENHANCEMENTS- TheCredit Union may from timet o timeoffer additional services to youraccount, such astra velacc identinsuranc e, at no additionalcost to you.You understand that the CreditUnion is not obligatedto offersuch services and may withdraw or changethem at anytime. 18.MERCHANTDISPUTES- TheCredit Union is not responsiblefor the refusalof anym erchantor financialinstitution to honoryou r card.The CreditUnion is subject10 claimsand defenses (other than tort claims)ari sing out of goodsor servicesyou purchasew ith the cardif you have madea goodfa ith attempt but havebeen unable to obtainsatisfaction from the merchant or serviceprovider, and (a) your purchasewas made in responseto an advertisementthe CreditUnion sent or participatedin sending to you: or (b) your purchasecost morethan $50.00 andw as madein yourstate or within100 milesof yourhome. 19.JOINTACCOUNTS-If this is a joint account,each of youwill beindividually and join tly responsiblefor payingall amountsowed under th is Agreement.This means that the Credit Union can require any one of youindividu ally to repay theent ireamount owed under th is Agreement. Each of youau thorizesthe other(s)to makepurchases or cashadvances individually.Any one of you mayterminate the accountand t heterm ination wlll be effectiveas t o all of you. 20.EFFECTOF AGREEMENT - This Agreement is the contractwhich applies to all transactionson youraccount even though the sales,cash advances,creditor otherslips you signor receivemay contain different terms. 21.NOWAIVER - TheCredit Union can delay enforcing any of its rightsany number of timeswithout losing them. 22.STATEMENTSAND NOTICES - Statementsand notices will be mailedor deliveredt o youa t the appropriateaddress you haveg iventhe CreditUnion. Notice sent to anyone of youwill beconsidered notice to all. 23.SEVERABILITYAND FINAL EXPRESSION - ThisAgreement and the Disclosureare t hefinal expr essionof theterms and conditions of your account.Thiswritt en Agreementand Disclosuremay not be contradictedby evidenceof anyalleged oral agreement Shouldany p art of this Agreementor the Disclosurebe found to beinvalid or unenforceable,all otherparts of this Agreement andDisclosure shall remain in effectand fully enforceableto thef ullestextent possible under this Agreement. 24.COPYRECEIVED- Youacknowledge that you havereceived a copyof this Agreementand Disclosure. 25.INTERNETGAMBLING TRANSACTIONS PROHIBITED - Youmay not useyour cardto initiateany type of electronicgambling transaction throughthe Internet. 26.PENALTYRATE DISCLOSURES - If applicableto youraccoun t, all ratesfor youraccount, inc ludingthe ratesfor purchases,cash advances, and balancetra nsfers,will increaseto the PenaltyRate when you meet oneor more of the conditionsas set forthin the Disclosureaccompany ing this Agreement. Any rate increasesapplied to your accountare subjectto applicable noticerequ irements.Pleaserefer to the Disclosurefor additionalinformation regardingthe PenaltyRate. 27.NOTICETOUTAH BORROWERS - Thiswritten ag reementis a final expressionof the agreementbetweenyou and the CreditUnion. WhatToDoIf You Find AMistakeOnYourStatement If you thinkthereisan error onyourstatement,writeto us at the addresslistedon your statement. Within90daysof receivingyourJetter,wemusteithercorrectthe error orexplainto youwhy we believethebillis correct. Whileweinvestigatewhetherornot there has been anerror: - Wecannottry to collect the amount in question, or reportyouas delinquent onthatamount. - Thechargein questionmayremainon your statement,andwemaycontinueto chargeyouintereston that amount. - Whileyoudonot have to paythe amount in question, youareresponsiblefor the remainderofyourbalance. - Wecanapplyany unpaid amountagainstyourcreditlimit.
