CAWV FILES AMICUS BRIEF IN NUISANCE CASE

The CAWV Board of Directors voted at its July 14 meeting to file an Amicus Curiae in a lawsuit pending before the Supreme Court of Appeals of West that has the ability to affect future industrial and commercial construction activities. On October 11, 2013, 24 plaintiffs filed suit against Antero Resources Corporation and Hall Drilling in Harrison County generally alleging temporary nuisance and negligence. While this case was pending, 190 additional plaintiffs filed suit in Doddridge, Harrison, Kanawha, Marion, Monongalia, Pleasants and Ritchie counties similarly alleging that their homes, their properties and their quality of life have been negatively impacted by production of oil and national gas by horizontal drilling and hydraulic fracturing. In their complaints, plaintiffs allege that Antero’s and Hall’s natural gas activities and related construction activities have caused, among other things, excessive noise, traffic, dust, odors, lights, spills and toxic emissions.

On April 18, 2016, the Mass Litigation Panel granted Antero’s and Hall’s motions for summary judgment in the first trial group dismissing all claims on the basis that Antero was “operating within the scope of Antero’s leasehold rights to develop oil and gas underlying the properties that are the subject of Plaintiffs’ complaint, as well as various surface-use and right of way agreements Antero executed with several Plaintiffs, or the owners of the properties on which Plaintiffs reside, which agreements entitled Antero to conduct oil and gas-related activities on Plaintiffs’ properties.” The Plaintiffs appealed and the case is now pending before the Supreme Court of Appeals of West Virginia.

“Marcellus Shale development provides many opportunities for contractors in West Virginia, ranging from pad and other infrastructure construction to road grading and paving. In fact, many members of the Contractors Association of West Virginia are regularly hired by Marcellus Shale producers to complete a variety of jobs associated with the overall drilling program,” said CAWV President Scott Pierson, Pipe Plus, Inc., Nitro. “While the current lawsuits target Marcellus Shale development, these same tactics have been used to combat other industries nationwide. Moreover, many of the activities of which plaintiffs complain (driving on public roads, noise from machinery, lights at construction site, dust from earthwork) could be attributed to day-to-day activities of general contractors in West Virginia. It is for these reasons that the CAWV Board of Directors voted to join in the filing of an amicus brief in the Antero and Hall nuisance cases. Contractors, in particular, and the business community, in general, have a vested interest in ensuring that all businesses can undertake permitted and authorized industrial and construction activities,” said President Pierson.

VOLUNTEERS NEEDED FOR FLOOD CLEANUP IN NORTHERN WEST VIRGINIA

Volunteer labor is in demand in northern West Virginia where cleanup from the July 23 and July 28-29 flooding is in effect in parts of Marshall County, Marion County and Wetzel County especially. A volunteer reception center recently opened for the first time at Wheeling’s WesBanco Arena. From 8:30 a.m. to 2 p.m. daily except for Sundays, volunteer teams will be dispatched from that site to work at locations in Ohio County and Marshall County. For volunteer work in Ohio County and Marshall County, teams or individuals can register by calling 1-866- 786-4173. Hundred and Mannington sustained the most significant damage last weekend. In all, a State of Emergency was declared in eight counties: Monongalia, Marion, Harrison, Tucker, Taylor, Wetzel, Ohio and Marshall. More information can be found at wvvoad.org.

SHAWNEE COMPLEX TO BREAK GROUND IN NOVEMBER

The Kanawha County Commission (KCC) expects to break ground in November on an estimated $15.2 million multi-sport complex at Shawnee Park in Institute. The commission plans to accept bids on the project in September or October. The project will be paid for with a $10 million bond as well as grants and donations. Commissioners say they plan to cover the last $5,000,000 of the costs with grants. A 501c3 nonprofit has been set up to accept donations for the complex. A loan to cover a majority of the project costs has been given the green light by commissioners. During a meeting this week, commissioners approved the $10 million loan from Huntington Bank, which they say offered the lowest interest rate when they made their bid. Commissioners say the county's billing division will now look over the loan and make the final decision and they have until Nov. 17 to finalize it. According to Commissioner Ben Salango, environmental studies are still being conducted at Shawnee Park, but they're expecting the golf course will be closed in September or October and a groundbreaking ceremony will be held in November. The KCC will apply for two grants for the proposed Shawnee Park sports complex — one for funding from the U.S. Soccer Association for turf and lighting and one for funding from the BrickStreet Foundation for the overall construction of the complex.

KANAWHA COUNTY COMMISION TO TEAR DOWN OVER 100 ABANDONED STRUCTURES

The Kanawha County Commission (KCC) is putting together a major initiative to demolish 114 abandoned and blighted structures in the unincorporated areas of Kanawha County. The KCC is closing on a $500,000 zero-interest loan through the West Virginia Housing Development Fund’s Property Rescue Initiative. The KCC intends to combine this loan with $500,000 in Building Permit fees to demolish approximately 114 abandoned, unsafe, blighted and dilapidated structures in Kanawha County. The first home to be demolished will be on Monday, August 7 at 9:00 a.m. in Cross Lanes.

LIGHTNING SAFETY

In addition to increased heat, humidity and bugs, summer is also the peak season for lightning and thunder storms. According to the National Oceanic and Atmospheric Administration’s (NOAA) National Weather Service website, an average of 54 people in the United States are killed each year by lightning, and while lightning fatalities have decreased over the past 30 years, lightning continues to be one of the top three storm-related killers in the United States. Being aware of potential risks and following recommended practices can help you be safer during a lightning event and reduce your chances of being struck. The recommendations detailed below are from the NOAA National Weather Service and the National Safety Institute.

 PLAN AHEAD – Check local weather forecasts and the forecast for the area you will be visiting or working. Monitor a portable weather radio during outdoor activities so you aren’t caught off-guard.

 GET INSIDE – Get inside a safe building or safe vehicle. This is the best option during a lightning storm. o A safe building is a permanent structure that is fully enclosed, such as a school, home, office building, etc. This does not include car ports, open garages, covered patios, picnic shelters, pavilions, sheds, dugouts or tents. o A safe vehicle is a fully enclosed metal-topped vehicle, such as a bus, van, truck, or hard topped car. This does not include convertibles, golf carts, riding mowers, motorcycles or open cab construction equipment. If you are operating vehicles such as this during lightning, immediately seek shelter in a safe vehicle / building.

 IF IN A SAFE VEHICLE, roll up the windows and put your hands on your lap. It is important that you not touch any metallic object that is referenced to this outside of the vehicle. This includes door and window handles, radio dials, CB microphones, gearshifts, steering wheels, or other outside-to-inside metal objects. This recommendation comes from the National Lightning Safety Institute (NLSI) based on reported incidents and injuries.

 IF YOU CANNOT GET INSIDE, stay away from open fields and hilltops. Avoid tall objects such as trees; if in a wooded area, stay close to a lower stand of trees. Stay away from water or wet items. Avoid electrical fences, metal pipes, rails and telephone poles. Put down any object that might conduct electricity, such as a rake, hoe or shovel.

 IF YOU ARE OUTSIDE WITH NO SAFE SHELTER, do not lie flat on the ground. Doing so increases your chance of being affected by potentially deadly ground current. One recommendation is to crouch down with your feet together and your hands over your ears.

What should you do if you are operating heavy equipment and are caught in lightning? According to the NLSI, “backhoes, bulldozers, loaders, graders, scrapers, mowers and other heavy equipment that employ an enclosed [roll over protection system] (ROPS) are safe in nearby electrical storms. The operator should shut down the equipment, close the doors and sit with hands in lap, waiting out the storm. In no circumstances during a close-in lightning should the operator attempt to step off the equipment to the ground in an attempt to find another shelter. Very dangerous step voltage and touch voltage situations are created when a “dual pathway to ground” is created.

What should you do if someone has been struck by lightning? There is a common misconception that if you touch a lightning victim you will be electrocuted. According to the NOAA National Weather Service, this is a myth; the lightning victim does not carry an electrical charge. It is safe to touch a victim and administer first aid. Remember to call 911, and administer CPR or use an automatic external defibrillator if the person is unresponsive or not breathing.

SENATE COMMITTEE: DOT TO RECEIVE FUNDING IN KEY AREAS

The Senate Appropriations Committee unanimously approved legislation July 27 that would provide a $19.5 billion funding boost for the U.S. Department of Transportation (DOT) in 2018. The spending plan is $978 million above the DOT's current levels, and almost $3.3 billion more than what President Trump had requested. In addition, the Senate bill will also provide a $50 million increase to funding for the Transportation Investment Generating Economic Recovery (TIGER) for a total of $550 million. In the bill, the Appropriations Committee allowed for more funding to pay for airport infrastructure by raising a federal cap on the fee that airports are allowed to charge passengers to support infrastructure costs from $4.50 to $8.50. Both airports and travel advocates have long been in favor of the cap's increase or removal, saying that it will allow for improvements to be made without the need for federal funding. Additionally, the bill would allow for the Federal-Aid Highways Program to receive $45 billion in funding from the Highway Trust Fund; $1.1 billion would go to the Federal Aviation Administration's modernization program; and the Capital Investment Grant transit program would receive $2.1 billion.

FLOOD REPAIR COSTS TOP $10 MILLION

The state Division of Highways continues to assess the damage to the state road system following last week’s flood in northern West Virginia. The cost of repair is growing. See flood damage estimated costs by clicking here. The damages in 11 counties now total more than $10 million, according to information released by the DOH Friday. That’s approximately $3 million in additional damages from the first release. Damage numbers are growing in Wetzel ($2.5 million) and Marshall ($3 million) counties. The agency said the numbers would likely continue to go up as the reviews continue. The state plans to seek a federal disaster declaration for at least seven counties for public assistance and four counties for individual assistance.
