Directed Atlantic Herring Fishery Closure for Management Area 1A

The National Marine Fisheries Service (NMFS) projects the Atlantic herring fishery will catch approximately 92% of the Area 1A sub-ACL by October 18, 2016. The Area 1A directed fishery will close effective 12:01 a.m. on October 18, 2016 and remain closed until further notice. Vessels that have entered port before 12:01 a.m. on October 18, 2016, may land and sell from that trip more than 2,000 pounds of herring from Area 1A.

Vessels participating in the herring Research Set-Aside (RSA) Program may continue to fish in Area 1A for the remainder of the fishing year, and land, subject to state landing restrictions, greater than 2,000 pounds of Atlantic herring provided they are on a declared herring RSA trip.

During a closure, vessels participating in other fisheries may retain and land an incidental catch of herring that does not exceed 2,000 pounds per trip or calendar day. In addition, directed herring vessels traveling through Area 1A must have all fishing gear stowed.

In accordance with the Amendment 3 to the Interstate Fishery Management Plan for Atlantic Herring, the fixed gear set-aside of 295 metric tons will continue to be available to fixed gear fishermen operating in Area 1A west of Cutler, Maine through December 31, 2016.

ASMFC American Lobster Board Approves Jonah Crab Draft Addendum II for Public Comment

Bar Harbor, ME – The Commission’s American Lobster Management Board approved Draft Addendum II to the Jonah Crab Fishery Management Plan (FMP) for public comment. The Draft Addendum considers establishing a coastwide standard for claw harvest to address concerns regarding the equity of the current claw provision. Specific options include establishing a whole crab fishery or allowing for the harvest of claws coastwide. The Draft Addendum also considers establishing a definition of bycatch, based on a percent composition of catch, in order to minimize the expansion of a small‐scale fishery under the bycatch allowance.

The FMP currently establishes a whole crab fishery with the exception of fishermen from NJ, DE, MD, and VA who have a history of claw landings prior to June 2, 2015. Following approval of the FMP, claw fishermen from NY and ME were identified. Currently, these fishermen are required to land whole crabs. As a result, jurisdictions have expressed concern regarding the equity of this provision as some fishermen with a history of claw landings are allowed to continue this practice while others must land whole crabs.

In order to address concerns regarding the expansion of a small‐scale fishery, consideration of a bycatch definition was added as a second issue in the Draft Addendum. Addendum I established a bycatch allowance of 1,000 crabs per trip for non‐trap gears and non‐lobster trap gears (i.e., fish pots, crab pots, whelk traps). Fishermen using these gears are not required to have other species on Board when harvesting Jonah crab. As a result, fishermen harvesting Jonah crab under the bycatch limit may, in fact, directly target Jonah crab by landing 1,000 crabs per trip and nothing else. This does not reflect the intention of the bycatch allowance which is to account for Jonah crab caught while targeting another species.

The Draft Addendum will be available on the Commission website, www.asmfc.org (under Public Input) by mid‐November. To All Area 3 Lobstermen,

I am writing this letter to inform you of the President’s declaration of the “first” New England Offshore Marine Monument. As many of you know, word of this proposal became public in September of last year, after a presentation at the New England Aquarium, orchestrated by the Conservation Law Foundation and other NGOs. This meeting set the stage for the NOAA Town Hall Meeting on September 15, 2015 in Providence, Rhode Island. For those of you that attended the Town Hall, you’ll probably agree that it was nothing more than a horse and pony show.

What happened in Providence was an exercise for the NGOs to set up their campaign and to gather support throughout the country. I spoke to many of you after that meeting and stressed my concern with the organizational and political support backing the proposal. Understandably, the most common response was “they can’t do this, and this will never happen”. Well, here we are one year later and this has happened and they did do this. Yes, it could’ve been worse, but to think for one minute that the NGOs and future Presidents will not attempt to declare other Atlantic monument areas is kidding ourselves.

From the start, there were three parties leading the industry defense. David Borden and myself from Atlantic Offshore Lobstermen’s Assn., Eric Reid from SeaFreeze in Point Judith, RI, and Jon Williams from Atlantic Red Crab Co. in New Bedford, MA. Had this group not been on top of all the nuances of this process, we would probably be living with the Blumenthal proposal (closure up to ~50 fathoms from Oceanographer to the Hague Line) with no benefit of a 7 year drawdown.

The offshore lobster industry has been proactive in their approach to lobster management. We have not waited for our industry to collapse and fall on hard times, but have instituted severe measures to protect the resource. We have lived with the growing pains of gauge increases, minimum and maximum size limits, escape vent regulations, and, of course, trap allocation reductions. I truly believe this is our industry and we must remain proactive in our conservation and work to support the public fishery management process, while rebuking the NGOs “behind closed doors” tactics.

To all current members, I want to sincerely thank you for your continued support. To all of you who are not yet AOLA members, please remember that we work for the entire offshore lobster industry. To continue working with other Associations and fishing fleets and strategizing how to defend ourselves from the constant lies being printed about our industry takes time and money. As much as we don’t want to think about repeating the efforts of the last year, the Monument issue is most definitely going to rise to the surface again, plus we have the New England Fishery Management Council Deep Sea Coral action to attend to.

We are writing to you on behalf of the Massachusetts Lobstermen’s Association, the Menhaden Fisheries Coalition, the Gloucester Fisheries Commission, Channel Fish Co., ARK Bait Co., and Kingfisher Bait Co. Menhaden is a frequently overlooked fish, but it has a long tradition in the Commonwealth. Native Americans are said to have taught the original settlers how to use menhaden as a fertilizer, and today the species serves as a key bait fish for many of our fisheries, particularly the lobster fishery.

This week, the Atlantic States Marine Fisheries Commission (ASMFC) will meet to set the 2017 coastwide quota for Atlantic menhaden. An increase in the quota stands to benefit the many Massachusetts fishermen who rely on menhaden as a source of bait. We strongly encourage the Commonwealth to support a quota increase of at least 10 percent.

In 2012, the ASMFC reduced the coastwide menhaden harvest by 20 percent, based on the conclusions of a stock assessment that found overfishing was occurring. In 2015, however, a new, peer-reviewed assessment utilizing new data found that Atlantic menhaden were neither overfished nor subject to overfishing. Additionally, it found that menhaden were neither overfished nor experiencing overfishing at the time of the 2012 harvest cuts. sustainably. The attached technical addendum provides more detail on the healthy status of Atlantic menhaden. 6 1 0 2 In its 2015 assessment, the ASMFC showed that menhaden fishing mortality, the amount of fish being harvested, has been steadily decreasing, and is now at an all-time low. It also found that menhaden fecundity, or egg production, has been near record highs in recent years, and is currently 170 percent higher than target levels set by regulators to ensure a healthy fishery. Charts depicting both of these findings are available in the attached addendum.

The health of the Atlantic menhaden stock has led to an abundance of menhaden in Massachusetts’ waters. In August, the Cape Cod Times wrote of “large schools of Atlantic menhaden” being sighted along the Outer Cape. Also in August, the Boston Herald called it “a banner summer for menhaden across New England.” Earlier this month, the Warwick Beacon wrote, “there is a ton of peanut bunker (immature Atlantic menhaden) in the water.” These fish are literally dying in Boston Harbor. Unfortunately, fishermen are currently unable to take advantage of this abundance of menhaden due to an unnecessarily low quota.

The ASMFC’s 2015 assessment showed that the menhaden quota can be substantially raised without impacting the sustainability of the species, and an analysis by ASMFC scientists earlier this year confirmed this finding. In projections using nine different potential quota levels for the 2017 fishing season, the ASMFC’s Atlantic Menhaden Technical Committee found a 0 percent chance of overfishing, even when menhaden quota was increased by up to 40 percent.

The science, as Dr. David Pierce, director of the Massachusetts Division of Marine Fisheries, acknowledged in meetings with industry representatives, is clear that a substantial increase in menhaden harvest is sustainable and justified. Figure 1 from the ASMFC shows the fishing mortality rate – i.e., the rate of removal of menhaden by fishing – since 1955. The dashed line is the new, precautionary target fishing mortality rate set by the Commission based on the 2015 stock assessment. The solid line is the rate above which overfishing is occurring. Overfishing has not occurred since the early 1960s. Currently, catch rates are below the level managers believe can produce the highest sustainable menhaden yields.

Figure 2 shows the menhaden population in terms of total egg production or “fecundity.” The ASMFC uses fecundity as a measure of population size and to determine if menhaden are overfished. Current levels are near all-time highs.
