The Association of Black Psychologists (“ABPsi” or the “Association”) is focused on influencing and affecting social change and developing programs whereby psychologists of African descent (“Black Case: 12-4029 Document: 003111228416 Page: 2 Date Filed: 04/15/2013 psychologists”) can assist in solving problems of Black communities and other ethnic groups. 2. The Association is organized to operate exclusively for charitable and educational purposes. This case raises issues having a profound and direct impact on ABPsi’s purpose and goals. 3. The amicus curiae brief attached as Exhibit 1 with this Motion is intended to apprise this Court of the importance of the social issues involved in this case apart from the immediate interests of the parties, and in particular direct the Court’s attention to a position paper that the Association of Black Psychologists published in 2012, which studies the disproportionate placement of African American children in special education. 4. ABPsi believes that the social science research and data incorporated into the attached amicus curiae brief provides broader perspective regarding the issues raised by this appeal that should serve as a useful supplement to the submissions presented by the parties. 5. Plaintiff / Appellant consent to ABPsi’s Motion. 6. Counsel for ABPsi contacted counsel for Defendant / Appellee Lower Merion School District on the morning of April 15, 2013. Counsel for Defendant informed counsel for ABPsi, however, that he would not able to discuss ABPsi’s request with the Lower Merion School Board before the end of the day.
