PREAMBLE : The Department of Panchayat Raj and Rural Development, Government of Andhra Pradesh is implementing Solid waste management project in 659 Gram Panchayats for improving the cleanliness in the rural areas. For effective implementation of the solid waste management project the Commissioner, PR&RD, Government of A.P desires to equip the Gram Panchayats with various solid waste management tools, machinery and equipment listed in the EOI Schedule.

A. ELIGIBLE CONDITIONS FOR EOI SCHEDULE:

1. The manufacturers should have minimum of 3 years experience in supply and commissioning of various tools/machinery/equipment listed in the EOI Schedule. Firms must furnish performance certificate from concerned Department / Institution in support of the above.

2. The firms shall have VAT, CST (TIN) Registration and PAN Number.

3. The firms shall have annual turnover of not less than the amounts shown as below during 2014-15 and proof of same to be submitted.

B) INSTRUCTIONS FOR SUBMISSION OF EOI SCHEDULE 1. The Offerer shall submit EOI Schedule with all documents along with the demand drafts for prescribed amount towards cost of EOI schedule and a covering letter with Prescribed EMD in the form of DD drawn in favour of Commissioner, PR&RD, Andhra Pradesh, Payable at Hyderabad as indicated in Annexure- I in a separate sealed cover duly Super scribing “Technical quotation of EOI Schedule for Supply, Installation, Commissioning & Validation of “Solid Waste Management Tools, Equipment and Machinery “and Price Quote as per Annexure-III in a separate sealed cover duly super scribing “Price quote for Supply, Installation, Commissioning & Validation of ” solid waste management tools/machinery/equipment “ with name and address of the offerer.

Both covers are to be placed in a third cover as stipulated under Item No.1 of the instructions for submission of EOI schedule duly super scribing “ EOI Schedule for Supply, Installation, Commissioning & Validation of “Solid Waste Management Tools/Equipment/Machinery ”

The E.M.D in respect of each category of items listed above, shall be paid in the form of Demand Draft drawn in favour of Commissioner, PR&RD, Andhra Pradesh., payable at Hyderabad and it should be enclosed along with application and technical bid. EOI Schedules without EMD will be rejected. 6

3. The Earnest Money Deposit of successful firm will be retained by the Commissioner, PR&RD, Andhra Pradesh., and refunded only after satisfactory completion of the contract. The E.M.D. and performance guarantee deposit will not carry any interest.

The successful tenderer will have to deposit a Performance Guarantee Deposit as shown above in the form of Fixed Deposit Receipts(FDR)made in the name of agency and hypothecated to the Commissioner, PR& RD or in the form of Bank Guarantee from any Nationalized Bank in favour of the Commissioner, PR&RD, Govt. of AP covering the period of warranty offered in respect of each item. In case the contract is further extended beyond the initial period the FDR /Bank Guarantee will have to be accordingly renewed.

5. a) Performance guarantee produced by the successful offerer shall be forfeited and alternate arrangements shall be made, if the firm does not fulfil the obligation of supply of stocks as per orders / specification/ quality and alternate arrangements will be made for procurement of such products and any additional cost incurred in this regard will be recovered from the concerned firm. 7

b) The responsibility of quality and quantity of the Tools, Equipment or machinery supplied lies with supplier only.

6. The Offerer shall submit duly notarized declaration along with EOI, as per the proforma furnished under Annexure-IV, hereto on Rs.100/- non-judicial stamp paper.

7. The authorized person representing the firm who is signing in the EOI documents and also participating in the EOI opening shall invariably attach a copy of authorization from the competent authority of the firm as per the By-laws of the firm / Company.

8. The last date for submission of EOI schedule is up to 3.00 P.M. on 03-06-2015.

9. The pre-bid meet will be held on 30-5-2015 at 11.00 AM in the O/O The Commissioner, PR&RD, Govt of A.P, Urdu Hall Lane, Himayatnagar, Hydeabad 500029 and the detailed specifications will be notified after the pre-bid meeting. The specifications finalised will be placed in the website www.appr.gov.in.

10. The technical bids shall be opened on the dates specified in the EOI Notice 11. The rates quoted in the Price quote should be firm and valid up to two years from the date of entering in to agreement. The Commissioner, PR&RD will not entertain any upward price revisions during the agreement period. The validity period can be extended on mutual consent of both the parties

C) GENERAL TERMS & CONDITIONS

1. The EOI price quote of only those offerer(s) whose Technical EOI Schedules are qualified will be opened with due intimation to them.

2. Negotiations will be held as per the decision of the Technical Committee at the address indicated in the data sheet. The aim is to reach agreement on all the points and sign a contract. 3. No escalation charges will be paid for supply of items in next 2 years 4. The supplies made shall be invoiced on VAT invoice with Serial No. of invoice printed on it. No invoice other than tax invoice will be accepted. VAT applicable, if any, shall be clearly mentioned in the tax invoice.

5. The approved firm shall supply the ordered item as per terms and conditions within the stipulated time indicated in the Purchase Order.

6. In the case of Annexure-II, the items supplied must be covered with warranty as per manufacturer’s terms & conditions from the date of supply against any defective manufacture / workmanship etc., repairs/replacements/servicing shall be attended at free of cost within the warranty period. The firm will be screened 8

for its credibility and efficiency concurrently. Whenever the incidence of repairs reported in more than 10% cases during the warranty period a serious review will be taken up to decide if the firm can be blacklisted apart from forfeiture of Performance Guarantee Deposit. 7. The loading and unloading charges, if any, should be borne by the supplier only. 8. The firm shall provide detailed operational and maintenance manuals at the time of supply of the item. 9. The offerer has to quote the price only as per the technical specifications given in the EOI schedule 10. Commissioner, PR&RD, Andhra Pradesh., or officers authorised by him reserves the right to inspect the manufacturing / other premises of supplier and his principal/s during the EOI process or before supply or before payment in order to satisfy that the supply is as per the quality and specifications of item indicated in this EOI 11. The end users of the items are the Gram Panchayats (GPs) which are located in all the districts and mandals of the state. In order to meet the GPs specific needs Commissioner, PR&RD, Andhra Pradesh., reserves the right to award the EOI either in part or full to the L1 firm or follow any other suitable procurement procedure so that a variety of products can be made available to the GPs and GPs choose their preferred ones depending on their local needs. In such cases the Commissioner, PR&RD Reserves the right to empanel L2 and L3 offerer firms also to facilitate this arrangement provided such firms agree to the conditions and rates offered by L1. Commissioner, PR&RD, Andhra Pradesh., at his sole discretion and without assigning any reason thereof, reserves the right to accept / reject any or all schedules at any stage of the EOI process. 12. In case of any dispute or difference arising out of the Agreement between the two parties relating to any aspect of the agreement, the parties should attempt to settle the dispute through mutual and amicable discussions. If the dispute is not settled through such discussions, the matter shall be referred / settled as per provisions of Arbitration and Conciliation Act,1996. 13. It is further to be agreed by both the parties that all differences and disputes if not resolved as above, shall be got remedied through the Court of Law of Hyderabad jurisdiction only. In the event of Shifting of the Office of CPR&RD from Hyderabad to any other place as decided by the Government with in the geographical limits of Andhra Pradesh state, the CPR&RD reserves the right to modify the jurisdiction of court of law. 14. EOI can be rejected at any stage of the procurement process, if it comes to knowledge that any offerer is involved in any fraudulent practice or misrepresentation of the facts or tried to influence the selection process or indulged in any corrupt activities in competing with others. 15. The manufacturer shall be liable for blacklisting and further prosecution, if they fail to adhere to the above conditions. 16. The approved firm shall enter into an agreement with the Commissioner, PR&RD, Andhra Pradesh., duly incorporating all the above terms & conditions. 17. The item shall be supplied to the Gram Panchayats as stated in Annexure V. The offerer shall provide all information as per this EOI document. Commissioner, PR&RD, Andhra Pradesh., shall evaluate only those schedules that are received in the required format and are complete in all respects.

D) INSTALLATION, COMMISSIONING & VALIDATION

1. All tools, equipment and machinery required for the installation and 9

commissioning work has to be arranged by the successful firm only.

2. The period stipulated for completion of supply, installation, commissioning, validation and training of personnel shall be 30 days from the date of receipt of Purchase Order.

3. Penalty for delay in work will be levied @ 0.5% of the total value of Work per week up to a minimum of 5% in case of default in work completion within the stipulated time.

E) INSURANCE The contractor shall insure all goods in transit for all risks to the extent of value of goods specially mentioning that the claim amount under the policy shall be payable to the Gram Panchayat under the intimation to the Commissioner, PR&RD, Govt of A.P, Hyderabad. The contractor shall bear the insurance charges for all risks for the goods for the period upto expiry of warranty.

F) WARRANTY The performance guarantee period shall be for the period fixed up for each item during the pre-bid meeting.

G) TERMS OF PAYMENT

a) As soon as the material is delivered at the Gram Panchayat Level, the Gram Panchayat will pay the amount to the supplier subject to the quality check by a technical team as specified by the Commissioner, PR&RD, Andhra Pradesh, Hyderabad.

H) SPECIAL INSTRUCTIONS TO THE FIRMS 1. The bidders may come up with various models available with them and present them during the pre bid meeting. The detailed specifications will be notified after conduct of the pre bid meeting.

2. The firms should submit technical specifications / brochures / information, users list etc. along with offer.

3. The supplier should conduct working demonstration of the item and train the working personnel of the Gram Panchayat for which the material is supplied by the firm. The cost of such training and skill building shall be borne by the firm

4. List of fast moving spares if any and its selling price should also be enclosed. List of accessories which are recommended to be purchased separately for each item should be clearly mentioned in the offer.

5. The firm should maintain a rolling stock of 5% at any point of time during warranty period. Service centres should be located at least at District Head Quarters so that the repairs and replacements happen within 24 hours.

6. The firm should establish a call centre for prompt service. Repairs should be attended and should be rectified within 24 hours. Wherever repairs could not be taken up within 24 hours the firm should arrange a new piece of item from the 10

rolling stock.

7. If no repair or replacement of the item is carried out within the stipulated time (24 Hours) a penalty of 1% of the unit cost for each day of delay and it will be recovered from the Performance Guarantee Deposit.

8. The successful supplier will make a pre-delivery presentation about the details of item being supplied both to the Officers of Commissioner, PR&RD, Andhra Pradesh., and the DPOs of concerned Districts.

1. The basic rates quoted should be inclusive of all Taxes / Duties on FOL delivery to the concerned lab & inclusive of loading, unloading, TR, Transit Insurance, Registration, training to concerned officials with machine operation etc. VAT shall be shown separately.

2. The rates quoted in the Price quote should be firm and valid up to two years from the date of entering in to agreement for supply of goods and services. The Commissioner, PR&RD will not entertain any upward price revisions during the agreement period. The validity period can be extended on mutual consent of both the parties. 3. The rates and units shall not be over written. The rates and units shall always be in both figures and words.
