HOUSE BILL 590 B5 1lr0135 CF SB 492 By: The Speaker (By Request – Administration) Introduced and read first time: January 20, 2021 Assigned to: Appropriations A BILL ENTITLED 1 AN ACT concerning 2 Creation of a State Debt – Maryland Consolidated Capital Bond Loan of 2021, 3 and the Maryland Consolidated Capital Bond Loans of 2012, 2013, 2014, 2015, 4 2016, 2017, 2018, 2019, and 2020 5 FOR the purpose of authorizing the creation of a State Debt in the amount of One Billion, 6 One Hundred Seven Million, Four Hundred Twenty–Seven Thousand Dollars 7 ($1,107,427,000), the proceeds to be used for certain necessary building, 8 construction, demolition, planning, renovation, conversion, replacement, and capital 9 equipment purchases of the State, for acquiring certain real estate in connection 10 therewith, and for grants to certain subdivisions and other organizations for certain 11 development and improvement purposes, subject to certain requirements that 12 certain matching funds be provided and expended by certain dates; providing 13 generally for the issuance and sale of bonds evidencing the loan; imposing a certain 14 tax on all assessable property in the State; requiring that certain grantees convey 15 certain easements under certain circumstances to the Maryland Historical Trust; 16 providing that the proceeds of certain loans must be expended or encumbered by a 17 certain date; authorizing the Board of Public Works, under certain circumstances, to 18 approve certain appropriations, notwithstanding certain technical differences; 19 authorizing certain unexpended appropriations in certain prior capital budgets and 20 bond loans to be expended for other public projects; altering certain requirements for 21 certain programs in certain prior capital budgets and bond loans; reducing prior 22 authorizations of State Debt; requiring that certain projects be constructed at certain 23 locations; adding, altering, and repealing certain requirements for certain 24 appropriations; specifying the use of certain project funds; altering and expanding 25 the authorized purpose of certain grants; providing that certain grants may not 26 terminate before certain dates; authorizing premiums from the sale of State bonds 27 in certain fiscal years to be used for certain purposes under certain circumstances; 28 requiring the Comptroller to make certain transfers, adjustments, and 29 reconciliations; repealing certain Maryland Consolidated Capital Bond Loan 30 Preauthorization acts; authorizing the creation of State Debt in certain years to be 31 used for certain purposes; making certain technical corrections; providing for a EXPLANATION: CAPITALS INDICATE MATTER ADDED TO EXISTING LAW. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND, 5 That: 6 (1) The Board of Public Works may borrow money and incur indebtedness on 7 behalf of the State of Maryland through a State loan to be known as the Maryland 8 Consolidated Capital Bond Loan of 2021 in the total principal amount of $1,107,427,000. 9 This loan shall be evidenced by the issuance, sale, and delivery of State general obligation 10 bonds authorized by a resolution of the Board of Public Works and issued, sold, and 11 delivered in accordance with §§ 8–117 through 8–124 and 8–131.2 of the State Finance and 12 Procurement Article. 13 (2) The bonds to evidence this loan or installments of this loan may be sold as a 14 single issue of bonds under § 8–122 of the State Finance and Procurement Article. 15 (3) The cash proceeds of the sale of the bonds shall be paid to the Treasurer and 16 first shall be applied to the payment of the expenses of issuing, selling, and delivering the 17 bonds, unless funds for this purpose are otherwise provided, and then shall be credited on 18 the books of the Comptroller and expended on approval by the Board of Public Works, for 19 the following public purposes, including any applicable architects’ and engineers’ fees: 20 EXECUTIVE DEPARTMENT – GOVERNOR 21 DA02.01 DEPARTMENT OF DISABILITIES 22 (Statewide) 23 (A) Accessibility Modifications.
