Dear participants, distinguished speakers and guests,

We would like to heartily welcome you to the online ICC Prague Arbitration Day 2021. This is our third annual conference and we hope that the event will be an even greater success than in 2018 and 2019, when we had the pleasure of hosting more than 100 participants each year.

The theme for this year’s conference - “How to Effectively Manage Arbitration” - is somewhat of an evergreen topic, along with the current intensively discussed issue of “Modern and Innovative Approaches to Case Management”. Undoubtedly, COVID-19 is one of the factors that has had a considerable impact on arbitration proceedings, as distant case-management elements have been widely introduced.

We will thus focus on the implementation of new technologies in arbitration proceedings, cost efficiency, the settle- ment of disputes and the peculiarities of proceedings involving public entities in (international) commercial arbitration.

More than ever, users of arbitration worldwide need a respected and continuously evolving institution, which the ICC Court certainly is. It has recently updated the ICC Rules, which aim to ensure that ICC arbitration is even more efficient and cost-effective. Apart from the institutional side, despite the pandemic, we believe that Prague remains an excellent seat for international arbitration. We have experienced arbitrators and counsel, as well as interpreters, translators, and other support staff here, who can provide their services both in person and remotely, if needed. From our own experience, having arbitration in Prague can cost parties much less compared to , Paris or Vienna.

HJÖRDÍS BIRNA HJARTARDÓTTIR

Counsel at ICC International Court of Arbitration

Hjördís is Counsel at the Secretariat of the ICC International Court of Arbitration in Paris, where she manages the Case Management Team dealing primarily with matters from Central and Eastern Europe. Prior to joining the ICC Court in 2017, Hjördís worked as an associate with two Icelandic law firms where she focused mainly on corporate and commercial law. She was also heavily involved in a number of cases arising out of the 2008 financial crisis and the resulting collapse of the Icelandic banking system. Hjördís is an Icelandic qualified lawyer and a MIDS LLM graduate.

René is a collaborating attorney-at-law and head of the international desk of Urban & Hejduk (Prague) with nearly 10 years of previous experience in a top Czech law firm. He provides comprehensive legal advice to Czech and foreign clients in all stages of court litigations as well as commercial arbitrations – both domestic (the Czech Arbitration Court) and international (ICC, LCIA, UNCITRAL, VIAC, etc.). René has been involved in dozens of high profile and complex cases. He assists clients in preparing structured arbitration clauses, in proceedings on the annulment of arbitral awards, or in recognising and enforcing foreign judgments and foreign arbitral awards in the Czech Republic. In addition, he also specialises in sports law and has extensive experience with international sports arbitration (CAS), international disciplinary proceedings (UEFA), or as an arbitrator at the Czech Football Association. Last but not least, René focuses on the protection of foreign investments and has experience with representing investors vis-à-vis the state in investment arbitration relating to damages (ICSID). He serves as an arbitrator and is active in various professional associations (ICC Czech Republic, YCAP – Young Czech Arbitration Professionals, ICC YAF, YIAG, or Young ICCA). René is alumnus of the Charles University in Prague (Doctor of Laws) and holds the prestigious Geneva LL.M. in International Dispute Settlement (MIDS).

Miloš Olík is the head of the dispute resolution desk at ROWAN LEGAL (Prague). His practice focuses on arbitration proceedings, investment disputes, international commercial arbitration and various forms of ADR (mediation, negotiation).

Miloš has extensive experience as an arbitrator (e.g. ICSID, ICC, RSHKAK) and is listed with e.g. CIETAC, LCIA, VIAC, HKIAC, SAKIG, RSHKAK. He is the Chairman of the National Committee of the ICC Czech Republic, the Chairman of the Council of Arbitrators of the Football Association of the Czech Republic and is a member of many professional associations and organizations.

Jonathan Barnett is Market Head for Austria & CEE at Nivalion AG, a Swiss-based third-party funder. He was previously an investment manager with an Australian funder focusing on arbitration in Singapore, Hong Kong and Australia and in private practice specialising in international arbitration and litigation in leading law firms in London, Paris, Vienna and Zurich, Counsel at the Secretariat of the ICC Court and Researcher at UNICITRAL. MAŁGORZATA SURDEK

Małgorzata Surdek is a Polish-qualified advocate and the Partner at CMS. She also heads the Dispute Resolution Department in Poland.

She has many years’ experience in civil, commercial and criminal litigation before state courts, especially in matters relating to consumer protection, intellectual property and unfair competition (including unfair, misleading and comparative advertising), insurance claims, public procurement. Małgorzata represents clients in disputes with regulators of financial services, pharmaceutical, energy and telecommunications, and advises banks and insurers in class action litigations. Her experience also includes representing clients in commercial and investment arbitration cases.

Małgorzata is, among various arbitration affiliations, a member of the International Court of Arbitration of the International Chamber of Commerce in Paris and a Fellow of the Chartered Institute of Arbitrators. Martin Magál is managing partner and head of Allen & Overy’s Litigation and Arbitration practice in Slovakia. He also co-ordinates the Dispute Resolution practice in Allen & Overy’s CEE offices.

He advises clients on a wide range of corporate and commercial transac- tions including acquisitions, disposals, joint ventures and privatisations. Martin frequently acts as party representative in numerous arbitrations conducted under the arbitration rules of the ICC, VIAC, SCAI, SCCI (Court of Arbitration of the Slovak Chamber of Commerce and Industry) and PAC SBA (Permanent Arbitration Court of the Slovak Banking Association). He has also acted as an arbitrator in arbitrations conducted under International Chamber of Commerce (ICC), German Institution for Arbitration (DIS) and Vienna International Arbitral Center (VIAC) rules. He is currently serving as a member of the board at the Arbitration Court of the Slovak Bar Association and has been one of the key people behind the plan to develop it into one of Slovakia’s most trusted domestic arbitration institutions. Martin is also a Fellow of the Chartered Institute of Arbitrators.

Martin Magál has contributed articles and summaries to several domestic legal journals and international arbitration handbooks. Martin was the principal drafter of new Slovak legislation on com- mercial arbitration in effect since 2015 and is Slovakia’s national correspondent to UNCITRAL on commercial arbitration.

Christian Dorda is the founding partner of DORDA, now a successful, large and leading law firm of Austria. He presently serves as an arbitrator, in particular in disputes relating to joint ventures, distribution and construction. He is regularly sought out in both international and domestic commercial disputes. He has acted as arbitrator in approximately 60 cases, most of them as the chairman of the panel and several times as a sole arbitrator; almost always in the English language.

Having served as a member of the ICC International Court of Arbitration (2006-2009), Christian Dorda is now Vice-Chairman of ICC Austria. He is a delegate to the ICC Commission on Arbitration and ADR, Paris, and serves on its Task Forces. He is also a member of the Austrian and of the Swiss Arbitration Association. He is active on the Board of Trustees of the American Chamber of Commerce in Austria and is the permanent legal counsel to the French-Austrian Chamber of Commerce. Christian is also past chairman of the M&A commission of the Union Internationale des Avocats. He is fluent in German, English and French.

Originator of new investment opportunities within European civil law jurisdictions, with specific responsibility for the German, Swiss and Austrian markets.

Theo has funded some of Germany’s largest insolvency administrators disputes for leading global firms and continues to review and structure European cartel damage claims.

Prior to joining Harbour, after more than 20 years in practice with KPMG Legal, Ashurst and Norton Rose, Theo served a three year term as CEO of the German stock corporation FORIS AG (Litigation Funder) and subsequently as Regional Managing Director (Continental Europe) for Vannin Capital.

He obtained his German law degree from Bonn University and quali- fied after his articled clerkship with Freshfields and the Cologne Court of Appeal. MAREK PROCHÁZKA

Marek Procházka is a founding Partner of PRK Partners specialising in dis- pute resolution (arbitration, mediation), banking law, mergers and acquisitions.

Marek was educated in Switzerland and the United States before practicing in the Czech Republic. After graduating from the University of Bern, he worked in the Department of Banking Law in the universi- ty’s law faculty. Afterwards, he obtained a Master’s degree (LL.M.) from Georgetown University Law Center, in Washington D.C.

In 2020 Marek obtained a Master degree in Philosophy from the Ludwig- Maximilian University in Munich with a focus on business ethics in con- nection with corporate governance. This field is a speciality of Marek.

Marek is an experienced lawyer with a longstanding practice and, and his approach to resolving complex cases integrates various fields of law and other disciplines. Recent cases involve international litigations and arbitrations in various jurisdictions, regulatory advice to banks, and a number of successful mergers and acquisitions. In connection with representing clients in litigations, Marek is known for his high percentage of successful mediation outcomes for his clients.

Jana is a Director in the Deloitte Forensic & Dispute practice with prima- ry responsibility for dispute resolution services in Central and Eastern Europe. She is a Czech national and is based in Paris, France.

Jana has led teams and assisted experts on many international disputes, including bilateral investment treaties disputes as well as commercial disputes. She has worked on disputes including governments in Central Eastern Europe as well as other territories such as Egypt, Venezuela or Kyrgyzstan. The disputes concerned a wide range of industries, includ- ing the health insurance, real estate, electricity, oil & gas, agriculture, telecommunication, entertainment industries and intellectual property. She also worked on several fraud investigations including investigation of a large IT company for financial misrepresentations.

Jana holds a master degree in finance and accounting and qualified as a CFA charterholder with the Chartered Financial Analyst Institute in 2008.

KARL HENNESSEE

Senior Vice President at Airbus

Mr Hennessee, FRAeS, is SVP Litigation, Investigations & Regulatory Affairs at Airbus, where he leads the Group’s global activities in these areas. Separately, he occasionally sits as arbitrator and serves on the board of directors of companies and nonprofits. Until July, 2019, he also served as Chairman of the Governing Body of the ICC Court of International Arbitration and is now a member of the HKIAC Council. In a three year hiatus from Airbus, Mr. Hennessee was VP Public Law & Technology of Halliburton (2013-2016). Mr Hennessee has previously practiced law in Germany and in the United States on behalf of institutions including the German Government and private law firms. Educated at the University of Göttingen, Germany, the London School of Economics and SMU Law School (where he was Managing Editor of the Journal of Air Law and Commerce), he holds degrees in history, economics/econometrics, and law. He is a trustee of Houston Grand Opera, a cancer survivor- mentor, Fellow of the Robert Bosch Foundation and Phi Beta Kappa. Mr. Hennessee is the winner of the ILO Award for Litigation “Individual of the Year” for 2009 and the 2018 winner of the Golden Quill award from the Business and Legal Forum for published article of the year. He lectures at Paris Assas, Sciences Po, Toulouse Capitole University and Versailles and has published over 100 articles on various legal subjects and is a frequent speaker on law, technology, aviation, and public policy.

Al-Karim advises GCs and lawyers in private practice on technology, strategy and innovation. He works closely with clients to build solu- tions leveraging AI, data analytics and digitisation. DOROTHEE SCHRAMM

Dorothee Schramm is an arbitration partner at Sidley Austin LLP in Geneva, Switzerland, with particular experience in technology, engi- neering and life sciences. She is also a member of Sidley’s Global Life Sciences Leadership Council and Sidley’s Technology Committee.

Praised by clients as “impressive” and “most proactive and responsive,” Dorothee has strong advocacy skills and has prevailed in claims in excess of US$1.9 billion over the last few years. She is also regularly appointed as an arbitrator to decide high-value international disputes. Dušan Sedláček is a leading specialist in domestic and international litigation and arbitration. He represents Czech and foreign clients, acting for both claimants and defendants. In addition, he serves as an arbitrator and expert in expert proceedings under ICC rules and acts as mediator. Dušan has extensive experience with disputes primarily in the construction sector, but also with disputes concerning financial transactions, data protection and the transport industry. Maria Hauser-Morel is based in the Paris office of HANEFELD, a top tier international dispute resolution boutique firm with offices in Germany and France. She acts as counsel and arbitrator in international arbitra- tion proceedings, focusing on construction & engineering (specifically FIDIC model contracts) disputes, energy disputes and disputes involving states and state entities.

Rostislav Pekař is a partner in the Prague and Paris offices of Squire Patton Boggs. Rostislav’s main practice focus is international and domestic dispute resolution including investment arbitration, commercial arbitration and Czech litigation. He co-heads Squire’s global investment arbitration practice. Rostislav has represented his clients in more than 20 major international commercial arbitrations and more than 35 investment arbitrations. Some of his cases involved claims up to USD 8 billion. The International Court of Arbitration is the world’s leading arbitral institution. Since 1923, it has administered over 24,000 cases and has helped resolve difficulties in international commercial and business disputes to support trade and investment. The Court provides parties with a flexible and neutral setting for dispute resolution. It offers confidentiality and extraordinary freedom for parties to choose the framework for how and where they want to resolve their dispute. While the dispute itself is resolved by independent arbitrators, the Court supervises the process from beginning to end, increasing the quality of the process and enforceability of the awards.
