Introduction The Indian Nursing Council is an autonomous body under the Government of , Ministry of Health and Family Welfare. Indian Nursing Council Act, 1947 enacted by, giving statutory powers to maintain uniform standards and regulation of nursing education all over the Country.

Aims To establish a uniform standard of training for nurse midwives and health visitors.

Functions 1. To establish and monitor uniform standards of nursing for nurse midwifes, auxiliary nurse midwifes and health visitors’ education by doing inspection of the institutions. 2. To recognize the qualification(s) under section 10(2)(4) of the Indian Nursing Council Act, 1947 for the purpose of registration and employment in India and abroad. 3. To prescribe minimum standards of education and training in various nursing programmes and prescribe the syllabus & regulations for nursing programs under section 16 of the Indian Nursing Council Act, 1947. 4. Power to withdraw the recognition of qualification under Section 14 of the Indian Nursing Council Act, 1947 in case the institution fails to maintain its standards under Section 14(1)(b) of the Act when an institution recognised by a State Council for the training of nurses midwives, Auxiliary Nurse Midwives or health visitors does not satisfy the requirements of the Council. 5. To recognise Degree/Diploma/Certificate awarded by Foreign Universities. 6. To give approval for registration of Indian and Foreign Nurses possessing foreign qualification under Section 11(2)(a) of the Indian Nursing Council Act, 1947. 7. To maintain Indian Nurses Register for registration of nursing personnel. 8. To advise the State Nursing Councils, Examining Boards, State Governments and Central Government in various important items regarding nursing education in the country. 9. To promote research in nursing. 10. To prescribe code of ethics and professional conduct. 11. To regulate the policies of training of nursing programmes in the field of nursing to improve the quality of nursing education.

Composition of the Council Section 3(1) of the Indian Nursing Council Act, 1947, provides for constitution and composition of the Council consisting of the following:-

33 (a) One nurse enrolled in a State Register elected by each State Council. (b) Two members elected from among themselves by the heads of institutions recognised by the Council for the purpose of this clause in which training is given: - (i)- for obtaining a university degree in nursing; or (ii)- in respect of a post-certificate course in teaching of nursing and in nursing administration (c) One member elected from among themselves by the heads of institutions in which health visitors are trained. (d) One member elected by the . (e) One member elected by the Central Council of the Indian Medical Association. (f) One member elected by the Council of the Trained Nurses Association of India. (g) One midwife or auxiliary nurse midwife enrolled in a State Register, elected by each of the State Councils in the four groups of States mentioned below, each group of States being taken in rotation in the following order namely:- (i)- , , and , (ii) - Andhra Pradesh, Bihar, and , (iii)- , Punjab, Himachal Pradesh and , (iv) -Assam, Gujarat, and Orissa; (h) The Director General of Health Services, ex-officio; (i) The Chief Principal Matron, Medical Directorate, Army Headquarters, ex-officio; (j) The Chief Nursing Superintendent, Office of the Director General of Health Services, ex-officio; (k) The Director of Maternity and Child Welfare, Indian Red Cross Society, ex-officio; (l) The Chief Administrative Medical Officer (by whatever name called) of each State other than a Union Territory, ex-officio; (m) The Superintendent of Nursing Services (by whatever name called) ex-officio from each of the States in the two groups mentioned below, each group of States being taken in rotation in the following order, namely; (i)- Andhra Pradesh, Assam, Maharashtra, Madhya Pradesh, Tami Nadu, Uttar Pradesh, West Bengal and Haryana, (ii)- Bihar, Gujarat, Himachal Pradesh, Kerala, Karnataka, Orissa, Punjab and Rajasthan; (n) Four members nominated by the Central Government, of whom at least two shall be nurses, midwives or health visitors enrolled in a State Register and one shall be an experienced educationist;

Use of Hindi as Official Language The letters received in Hindi from different States are generally replied in Hindi. Efforts are being made to promote use of Hindi in writing notes and other correspondence.

Equivalency of Foreign qualification 1. Indian citizens possessing foreign nursing qualification are examined individually & after examination of the syllabi and confirmation from concerned foreign authorities, the nurses are granted approval for registration in India with the recommendation of equivalence committee under Section 11(2)(a) of Indian Nursing Council Act, 1947. 2. Indian Nationals who are registered nurses and midwives in India and has acquired foreign Nursing degree shall obtain equivalency from Indian Nursing Council, before registering their additional qualification in the respective State Nursing and Midwifery Registration Council. 3. The foreign Nationals possessing foreign qualification can also work in charitable institutions for a limited period with the approval of President, INC. Their transcripts are evaluated/examined by the Equivalence Committee Members and if they are found at par, temporary permission is granted under Section 11(2)(b) of Indian Nursing Council Act, 1947 for employment in charitable institutions. 4. If, the foreign Nationals (including Nepali, Bangladeshi and Bhutanese) who are Registered Nurses and Registered Midwives in their own country, they can be admitted for higher nursing , i.e. they can be admitted to P.B.B.Sc. (N) Programme and M.Sc. (N) except OBG. However, they will not be registered to practice in India. Even no temporary registration will be provided to them. - for admission to ANM, GNM, B.Sc. (N) the entry qualification equivalency i.e. 12th standard will be obtained by Association of Indian Universities. Nursing educational institution, State Nursing Council, Universities will be responsible to ensure that the qualification and eligibility shall be equivalent to what has been prescribed by INC. 5. With regard to qualification granted by five English speaking countries (New Zealand, Australia, USA, Canada, UK) to the NRI, the candidates’ qualification is found equivalent subject to the following conditions:

37 - shall be holding registered nurse licence to practice in that country with the said qualification; - if NRI candidates undergo PG nursing from the five English speaking countries, PG qualification will be recognized as higher qualification if the duration of the PG course is two years and it shall be regular course. During the year 56 cases for equivalency were received, 29 cases have been decided and rest are in process.

Court Cases 133 Court Cases were registered in various High Courts of India during the year 2017-2018. 71 cases are disposed off.

Sources of Income During the year 2017-2018 sum of Rupees 11,00,63,500.00 has been received from the training institution as inspection/affiliation fee etc.

53 15. Live Register 1.- As per the NRTS, initially it is targeted to capture all the Nurse data by enrolment agency. The enrolment of Nurses is based on online Aadhar Authentication. For this required application software was made ready in association with National Informatics Centre. This was discussed in the meeting of all the State Registrars of State Nursing Councils. One full day seminar was organized to demonstrate and take the feedback from all the Registrars. The seminar was inaugurated by Joint Secretary of Ministry of Health and Family Welfare. 2.- Subsequently all the Registrars of State Nursing Councils were requested to test the software for four weeks’ time. All the Registrars have responded that the software was working as demonstrated and discussed. 3.- 2,46,597 nurses have been enrolled as on 31st March 2018 16. Recognition of State, Private/ The following Universities, between April, 2017 to March, 2018, have requested for recognition of Universities to conduct the examination and to include in the INC schedule Part II as an examination authority for the Collegiate nursing programmes.
