Letter of Invitation
Dear Sirs,
The Food and Agriculture Organization of the United Nations (“FAO” or “Organization”) is an intergovernmental organization with more than 194 member nations. Since its inception, FAO has worked to alleviate poverty and hunger by promoting agricultural development, improved nutrition and the pursuit of food security - defined as the access of all people at all times to the food they need for an active and healthy life.
To achieve its goals, FAO cooperates with thousands of partners worldwide, from farmers’ groups to traders, from non-governmental organizations to other UN agencies, from development banks to agribusiness firms (further and more detailed information on FAO can be found on the internet site: http://www.fao.org).
In preparing your offer, you should take into account the international status and activities of FAO by submitting your best commercial terms. You should also be aware that FAO enjoys certain privileges and immunities which include exemption from payment of Value Added Tax ("VAT" or "IVA"), customs duties and importation restrictions.
FAO requests the provision of the following services:
“Third Party Technical Review to assess implementation and impact of the Somalia Emergency Drought Response and Recovery Project (SEDRP)”.
The following procedures have been established by this Organization for the award of this contract:
1. Procedures
1.1 A certain number of firms is being invited to submit proposals and this Organization intends, without having committed itself in any way to any of the firms it invites, to award the contract to the firm which it considers as having submitted the best proposal;
1.2 In submitting your proposal you are supposed to have considered all aspects relevant to the performance of the proposed contract and to have obtained all necessary information and data as to risks, contingencies and other circumstances, which may influence or affect your proposal;
1.3 It is understood that all documents, calculations, etc. which may form part of your proposal will become the property of the Organization which will not be required to return them to your firm;
1.4 The Organization may decide to make a partial award or no award at all should it consider that the results of this tender so require;
1.5 FAO has adopted a zero tolerance approach to fraud, and it prohibits firms from engaging in corrupt, fraudulent, collusive, coercive, unethical and obstructive practices when participating in procurement activities. As provided by the Vendor Sanctions Procedures (http://www.fao.org/fileadmin/user_upload/procurement/docs/FAO_Vendors_Sanctions_Policy_- _Procedures.pdf), if FAO determines that a firm has engaged in such conduct, it will impose sanctions and may share information on sanctioned firms with other Intergovernmental or UN Organizations;
1.6 A firm and its affiliates, agents and subcontractors should not be suspended, debarred, or otherwise identified as ineligible by any Intergovernmental or UN Organization, including any organization within the World Bank Group or any multi-lateral development bank, or by the institutions and bodies of economic integration organizations (e.g., the European Union). You are therefore required to disclose to FAO whether your firm, or any of your affiliates, agents or subcontractors, is subject to any sanction or temporary suspension imposed by any such organization or National Authority at any time during the three years prior to the contract or at any time throughout the execution of the contract. You acknowledge that a breach of this provision will entitle FAO to terminate its contract with your firm and that material misrepresentations on your status constitute a fraudulent practice;
1.7 Bidders must certify that their firm is not associated, directly or indirectly, with entities or individuals (i) that are associated with terrorism, as in the list maintained by the Security Council Committee established pursuant to its Resolutions 1267 (1999) and 1989 (2011), or (ii) that are the subject of sanctions or other enforcement measures promulgated by the United Nations Security Council. Selected bidders also agree to undertake all reasonable efforts to ensure that none of the funds received from FAO under the awarded contract are used to provide support to individuals or entities associated with terrorism or that are the subject of Security Council sanctions. This provision must be included in any subcontracts, sub-agreements, or assignments entered into under the awarded contract. The bidder acknowledges and agrees that this provision is an essential term of the awarded contract and any breach of these obligations and warranties shall entitle FAO to terminate the contract immediately upon notice to the Contractor, without any liability for termination charges or any liability of any kind of FAO;
1.8 Consortium of firms will be accepted provided that the companies indicate which firm will be the main Contractor and will be responsible for the signature of the relevant contract. Bidders adhering to the Consortium will have to notify FAO of their acceptance to participate in the Consortium;
1.9 Bidders must certify that their firm/organization (including all members of a consortium, if applicable) and any subcontractors are not associated, directly or indirectly, with the consultant or any other entity who prepared the terms of reference or other bidding documents for the project;
1.10 Please note that bidders who use an independent consultant to assist in the preparation of offers may risk engaging in unacceptable practices if the same consultant assists another bidder to prepare an offer for the same tender. Bidders are reminded that they are fully responsible for the conduct of any consultant who may be used to prepare offers for FAO tenders and they should take all measures to ensure that any independent consultant engaged to assist in the preparation of an offer for an FAO tender has not and will not be involved in the preparation of an offer for another bidder for the same tender process.
Bidders are kindly requested to disclose to the best of their knowledge whether their firm/organization has any personal or professional relationships with FAO. The disclosure shall include all relevant details and should include, but not be limited to:
- ANY current or past employment relationship between your firm/organization’s representatives or employees and FAO;
- ANY current or past relationship between your firm/organization’s representatives or employees and an FAO staff member (family members, spouses, etc.).
1.11 FAO reserves the right to publish the details of awards, including supplier name and country, total Contract value and a brief description of the services. In all cases, unsuccessful bidders will be notified.
1.12 The results of this tender are not made public but unsuccessful bidders will be informed. However, the Organization will not supply the name of the successful bidder nor the reasons for its choice.
2. Evaluation
Only Technical Proposals will be opened first (Financial Proposals will remain sealed until finalization of the evaluation of Technical Proposals). The Technical Proposals will be first screened through a pass/fail methodology for compliance with the minimum qualification requirements listed in paragraph 2.1 below. Technical Proposals that don’t meet the minimum qualification requirements will be rejected and excluded from further consideration. Technical Proposals that meet the minimum qualification requirements will be further evaluated based on the Technical Evaluation Criteria listed in paragraph 2.2 below. A Proposal shall be rejected if it fails to achieve the minimum technical score (60 points out of 100 points). Only those proposals which have achieved the minimum technical score will have their respective Financial Proposals opened.
Upon completion of the evaluation of the technical proposal, only those financial proposals will be opened which have passed the minimum technical qualification score of 60 points. Upon evaluation of the financial proposals (including verifying the costing of the activities described in the technical proposals and checking of any arithmetical calculations), the lowest evaluated Financial Proposal (Fm) will be given the maximum financial score (Sf) of 100 points. The financial scores (Sf) of the other Financial Proposals will be computed using the formula Sf = 100 x Fm / F, in which Sf is the financial score, Fm is the lowest price and F the price of the proposal under consideration.
Proposals will be ranked according to their combined technical (St) and financial (Sf) scores using the weights (T = the weight given to the Technical Proposal, which will be 80%; P = the weight given to the Financial Proposal, which will be 20%; T + P = 1) and applying the formula S (final combined score) = St x T% + Sf x P%. The firm achieving the highest combined technical and financial score (S) will be recommended for award of contract.
FAO reserves the right to consider, and disqualify firms based on, documented prior poor performance, including but not limited to poor quality of goods or services provided, late delivery and unsatisfactory performance. FAO also reserves the right to have further discussions/negotiations with the Bidder prior to issuance of a letter of acceptance.
2.1 Minimum Qualification Requirements
Bidders must fulfil the following minimum qualification requirements. Failure to provide required information/documents will result in the disqualification of the bidder from the tender evaluation process.
2.1.1 Legal registration;
2.1.2 Minimum five years of relevant experience in monitoring and evaluation in international development including impact assessments, baseline surveys and/or evaluations;
2.1.3 At least one previous proven experience in conducting a similar study in Somalia using mobile/electronic data collection;
2.1.4 Field permanent presence in Somalia including offices;
2.1.5 Access to and ability to work in all regions of Somalia;
2.1.6 A core permanent staff composed of a team leader and another core permanent staff with a profile equivalent to a field/data supervisor with the following minimum qualifications and experience;
2.1.6.1 Team Leader:
a) At least a master’s degree in a relevant field, such as agricultural economics, development studies, or social sciences;
b) At least five years in conducting development related studies, baseline surveys, evaluations or impact assessments;
c) English language skills.
2.1.6.2 Field Data Collection Supervisors/Enumerators;
a) Knowledge of Somali language.
2.2 Evaluation Criteria

3. Documents Enclosed
To facilitate preparing your proposal the following documents are enclosed:
3.1 The "Proposal Summary" form, to be used for submitting your proposal;
3.2 Technical Evaluation Criteria
3.3 The Terms of Reference (TOR) detailing the scope of services to be performed;
3.4 Technical Proposal Forms (Tech-1 through Tech-7)
3.5 Financial Proposal Forms (Fin-1 through Fin-6)
3.6 The Contract this Organization intends to award.
4. Documents to be Submitted
Your proposal should be submitted in two separate parts consisting respectively of a Technical Proposal and a Financial Proposal which should be prepared as follows:
4.1 Part A: Technical Proposal:
4.1.1 Information/Documents to support the minimum qualification requirements indicated in paragraph 2.1 above;
4.1.2 The "Proposal Summary" referred to in paragraph 3.1 above;
4.1.3 Duly completed Form Tech-1 stating your firm's general and specific experience in the field(s) of work contemplated under the proposed contract. The information provided should include a description of specific experience in similar projects in the specified technical environment and references concerning previous contract work of this nature undertaken by your firm;
4.1.4 Comments and suggestions on the Terms of Reference including workable suggestions that could improve the quality/effectiveness of the assignment, as well as comments on any support to be provided by the Organization (Form Tech-2);
4.1.5 Description of the approach, methodology and work plan for performing the assignment covering the following subjects: technical approach and methodology, work plan, and organization and staffing schedule. Guidance on the content of this section of the Technical Proposals is provided under Form Tech-3. The work plan should be consistent with the Work Schedule (Form Tech-7) which will show in the form of a bar chart the timing proposed for each activity;
4.1.6 The list of the proposed Professional staff team by area of expertise, the position that would be assigned to each staff team member, and their tasks (Form Tech-4);
4.1.7 Estimates of the staff input (staff-months of foreign and local professionals as applicable) needed to carry out the assignment (Form Tech-6). The staff-months input should be indicated separately for home office and field activities, and for foreign and local Professional staff;
4.1.8 CVs of the Professional staff signed by the staff themselves or by the authorized representative of the Professional Staff (Form Tech-5);
4.1.9 The Technical Proposal shall not include any financial information. A Technical Proposal containing financial information may be declared non responsive.
4.2 Part B: Financial Proposal:
4.2.1 The Financial Proposal shall be prepared using the attached Financial Proposal Forms referred to in para. 2.5 above. It shall list all costs associated with the assignment, including (a) remuneration for staff (foreign and local, in the field and at the Consultants’ home office), and (b) reimbursable expenses. If appropriate, these costs should be broken down by activity and, if appropriate, into foreign and local expenditures. All activities and items described in the Technical Proposal must be priced separately; activities and items described in the Technical Proposal but not priced, shall be assumed to be included in the prices of other activities or items.
5. Completeness of Proposal
5.1 Proposals will only be considered if they contain all of the above information and documents and observe the provisions of the enclosed contract as otherwise it will not be possible to evaluate them on an equal basis. Since this Organization is not allowed to sign contracts, which do not specify its maximum financial liability, proposals which do not allow us to calculate such liability may be rejected.
6. Currency of Proposal and of Contract
Your proposal should be expressed in US Dollars.
7. Duration of execution
The required services are expected to be completed within a maximum of five (05) months.
8. Form of submission and closing date
8.1 Both Technical Proposal and Financial Proposal shall be prepared in ONE ORIGINAL clearly marked “ORIGINAL”.
8.2 The original of the Technical Proposal shall be placed in a sealed envelope clearly marked “TECHNICAL PROPOSAL”. Similarly, the original Financial Proposal shall be placed in a sealed envelope clearly marked “FINANCIAL PROPOSAL” followed by the tender number and the name of the assignment, and with a warning “DO NOT OPEN WITH THE TECHNICAL PROPOSAL.” The envelopes containing the Technical and Financial Proposals shall be placed into an outer envelope and sealed.
8.3 This outer envelope shall be clearly marked as follows:

8.4 The Organization shall not be responsible for misplacement, losing or premature opening if the outer envelope is not sealed and/or marked as stipulated. This circumstance may be case for Proposal rejection. If the Financial Proposal is not submitted in a separate sealed envelope duly marked as indicated above, this will constitute grounds for declaring the Proposal non-responsive.
8.5 Your proposal should reach this Organization, to the above address, not later than at 12:00 hours, Nairobi time, on:
"06 November 2017"
Proposals which do not conform to the above instructions will not be considered.
9. Cases in which no proposal is submitted
In this case, kindly inform us in writing, before the tender closing date, of the reason for which you would not submit a proposal. In lack of such information, FAO will assume that you are not interested to participate, and will therefore not invite your firm for future tenders.

11. Participation by FAO
You should examine carefully the nature and extent of the participation in the contract performance by FAO as set out in Part III of the “Proposal Summary” as it is assumed that all other requirements for its successful completion are provided at the cost of the contractor. You should therefore state in the appropriate space any additions or modifications which you suggest for a satisfactory performance of the contract.
12. Registration with FAO
If your firm is not yet registered as a potential supplier with the Organization, you are kindly requested to register your company in http://ungm.org as FAO supplier for Somalia and/or Kenya. Please promptly notify us of any change in the information on the Supplier Registration Form at the same Internet site.
13. Bidder Protest
Bidder Protests: Fairness and transparency are fundamental principles for FAO procurement activities. Bidders that believe that the procurement process was not fair and transparent may request feedback from the office that issued the tender. If a satisfactory response is not received, the bidder may present a protest following the instructions detailed in the following link: http://www.fao.org/unfao/procurement/codedeconduitethique/protests/en/.
