MINUTES OF THE REGULAR FRANKFORT VILLAGE BOARD MEETING MAY 3, 2021

INSTALLATION OF ELECTED OFFICIALS

Mayor Elect Keith Ogle introduced Will County Judge and former Frankfort Mayor Ray Rossi, who administered the Oath of Office to Mayor Keith Ogle; Clerk Katie Schubert; and Trustees Michael Leddin, Daniel Rossi, and Eugene Savaria.

Mayor Keith Ogle called the regular meeting of the Frankfort Village Board to order on Monday, May 3, 2021, at 7:09 P.M.

Village Clerk Katie Schubert called the roll. In attendance were Mayor Keith Ogle, Clerk Katie Schubert, Trustees Adam Borrelli, Margaret Farina, M' el Leddin, Jessica Petrow, Daniel Rossi, and Gene Savaria. Also in attendance were Atto ge Mahoney, Hannah Lamore, Police Chief John Burica, and Village Administrator Rob

Mayor Ogle provided a few opening remarks s passion to be a part of making Frankfort a better place to live, not just for today, bu w. He thanked the voters of Frankfort for bestowing this honor to serve as m his family for their support and voiced his appreciation of serving under the ayor Jim Holland. He wished Jim and his wife, Stacy, the very best in the next cha r lives. He welcomed Clerk Schubert and the newly elected Trustees and voiced his comm1 to serve the residents of Frankfort.

b. First Resubdivision of Lighthouse Pointe Phase Three - Final Plat Approval Accept the Plan Commission recommendation and approve the First Resubdivision of Lighthouse Pointe Phase Three, a Planned Unit Development, prepared by M. Gingerich Gereaux & Associates, latest revision dated 03.18.2021, conditioned upon final engineering approval.

White Street - Ordinance (Waive 1st and 2nd Readings) Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3292) GRANTING A DRIVEWAY SETBACK VARIANCE TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (BULBROOKE RESIDENCE - 41 N. WHITE STREET), from 5 feet to 0.5 feet along the southern property line, in accordance with the reviewed plans and public testimony.

4. Chef Klaus Bier Stube Special Use for Outdoor Seating: 20827 S. LaGrange Road - Ordinance (Waive 1st and 2nd Readings) Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3293) GRANTING A SPECIAL USE PERMIT FOR OUTDOOR SEATING TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (CHEF KLAUS BIER STUBE - 20827 S. LAGRANGE ROAD), to allow a pennanent outdoor seating area associated with a permitted restaurant, in accordance with the reviewed plans Village Board May 3, 2021 Page 3

and public testimony and conditioned upon the hours of operation being Sunday - Thursday 11 AM to 11 PM and Friday & Saturday 11 AM to 12 AM (midnight) and final review, inspection, and approval by the Building Department.

5. Multack Eye Care Rear Yard Setback Variance: 22200 Wolf Road- Ordinance (Waive 1st and 2nd Readings) Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3294) GRANTING A REARYARD SETBACK VARIAN CE TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (MULTACK EYE CARE - 22200 WOLF ROAD) from 30 feet to 9 feet 7 inches to accommodate construction of a 2,587 square foot addition to the existing building located on the premises, in accordance with the reviewed plans and public testimony and conditioned upon final engineering approval and that the existing A TM be removed.

6. Chelsea Intermediate School Fence Design & Height Variances: 22265 S. 80th Avenue - Ordinance (Waive 1st and 2nd Readings) Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3295) GRA TWO VARIANCES TO CERTAIN PROPERTY LOCATED WITHIN THE LI THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINO A INTERMEDIATE SCHOOL - 22265 S. 80TH AVENUE), a fence ·ance from the open/decorative style requirement to a non-decorative styl and a fence height variance from the 4- foot requirement to 8 feet, 4 i e construction of a new masonry wall and new screenwall, in accorda iewed plans and public testimony.

Special Use for Outdoor Sto (Waive 1st and 2nd Readings) Accept the Plan Commission recommendation, waive the First and Second Readings, and pass AN ORDINANCE (NO. 3296) GRANTING A SPECIAL USE PERMIT FOR OUTDOOR STORAGE TO CERTAIN PROPERTY LOCATED WITHIN THE LIMITS OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS (MILLINEUM-KYLE HOLDINGS-22790 S. CITATION ROAD & 22791 S. CHALLENGER ROAD), in accordance with the reviewed plans and public testimony and conditioned upon final engineering approval, providing architectural banding on the front and sides of the building, and screening the rooftop (or ground-mounted) mechanical units from view.

b. Millineum-Kyle Holdings - Final Plat Approval Accept the Plan Commission recommendation and approve final plat for Millineum­ Kyle Holdings consolidating Lots 10 & 21 in Fey & Graefen Industrial Park Phase I, prepared by DesignTek Engineering, Inc., dated 04.06.2021.

Trustees Borrelli, Farina, Petrow, and Savaria presented a brief overview of the consent agenda docket items under consideration for approval. Village Board May 3, 2021 Page4

Mayor Ogle invited trustee and audience comment on the consent agenda items prior to a vote being taken.

Trustee Leddin noted the April 19, 2021 meeting minutes listed Trustee Clavio as one of the presenters for the consent agenda and he was not present at the meeting. Trustee Petrow made a motion (#1), seconded by Trustee Farina, to approve the Unanimous Consent Agenda, as amended.

Clerk Schubert called the roll. Ayes: Trustees Borrelli, Farina, Leddin, Petrow, Rossi, and Savaria. Nays: None. The motion carried.

MAYOR'S REPORT

• Mayor Ogle recognized the volunteers who participated in the clean-up activities for the Earth Day celebration on April 24 and SW Chicago Wholesale located on Mustang Road in Frankfort who donated work gloves.

• Mayor Ogle entertained a motion from the floor to adopt a Resolution extending the waiver of water and sewer fees for qualified Frankfort resi rving on active duty in the United States Armed Forces.

Trustee Farina made a motion (#2), second e Borrelli, to adopt A RESOLUTION (NO. 21-16) AUTHORIZING THE WATER AND SEWER FEES FOR VILLAGE OF FRANKFORT M NNEL SERVING ON ACTIVE DUTY IN THE ARMED FORCES OF T ;r A TES OF AMERICA. A voice vote was taken. All were in favor. The motion c

• Mayor Ogle entertained a motion from the floor to support motorcycle safety with a proclamation.

Trustee Farina made a motion (#3), seconded by Trustee Savaria, declaring May 2021 as "Motorcycle Awareness Month in the Village of Frankfort." A voice vote was taken. All were in favor. The motion carried.

• Mayor Ogle presented commission appointments for those controlled by State statute and local ordinance including: the Board of Fire and Police Commissioners, Board of Trustees of the Police Pension Fund, Zoning Board of Appeals/Plan Commission, and the Historic Preservation Commission.

Mayor Ogle entertained a motion from the floor to approve the commission appointments as presented.

Trustee Petrow made a motion (#4), seconded by Trustee Borrelli, to approve the Village of Frankfort commission appointments made by Mayor Ogle with the advice and consent of the Board as presented. A voice vote was taken. All were in favor. The motion carried. Village Board May 3, 2021 Page 5

Mayor Ogle reported the Village is currently accepting applications to fill a vacancy on the Plan Commission/Zoning Board of Appeals and the Historic Preservation Commission. Applications for these positions are available on the Village website.

• Mayor Ogle announced the modified Spring Country Market continues every Sunday, April 25, from 9:00 A.M. to 1:00 P.M. in downtown Frankfort.

POLICE DEPARTMENT REPORT

Chief Burica warned residents to be on the alert for an on-going telephone scam where unknown callers are identifying themselves as members of the Police Department and in most cases are asking to take care of money owed for court fines or warrants through gift cards. He cautioned residents not to respond to these calls. He congratulated the new Village Board and stated that he looked forward to working with them. He congratulated Officers Jamie Dulkowski and Nicole Davis who graduated from academy on April 29 and began FTO today. He also congratulated Officers Steven Smock and Kevin Tamme on their successful completion of their 14-week FTO period. ChiefBurica reminded residents to continue locking their vehicles, removing keys and key fobs, and closing their garage doors at night.

VILLAGE ADMINISTRATOR'S REPORT

Administrator Piscia offered his congratulati wly elected officials and stated he looked forward to working with the Village ue to do great things for the community. He reported new informational signs lled in Prairie Park. He thanked Jamie Viebach with the Conservation Foundation stance in updating the information on the signs. He reported the watennain replacement s on Bankview Drive, Walnut Ridge Court, North Butternut Circle/Hickory Ridge Court, L ust Street, and Wisconsin Road are nearly complete and resurfacing and landscape restoration will take place in the near future. Administrator Piscia reported pavement patching and crack and joint sealing on US 45 from north of Colorado A venue to Stuenkel Road is scheduled for improvements this summer.

VILLAGE ATTORNEY'S REPORT

Village Attorney Lamore had no report.

OTHER BUSINESS

The entire Village Board congratulated the new Village Board and stated they looked forward to working together and serving the people of Frankfort. Residents who are interested in serving on the Plan Commission or the Historic Preservation Commission were encouraged to apply.

Trustee Borrelli expressed his appreciation to former Trustee John Clavio and Clerk Brian Feehery for their time on the Village Board and commitment to the community. Village Board May 3, 2021 Page 6

No public comments were received by the Village Board.

Hearing no further business, Trustee Savaria made a motion (#5), seconded by Trustee Borrelli, to adjourn the regular board meeting of Monday, May 3, 2021. A voice vote was taken. All were in favor. The motion carried. The meeting adjourned at 7:40 P.M.

1. LEAF COLLECTOR REPLACEMENT PURCHASE APPROVAL - RESOLUTION

At its May 12, 2021 meeting, the Committee of the Whole reviewed a request from Supt. Kestel to purchase a 2021 Xtreme Vac Model LCT600 Leaf Collector to replace a 2012 ODB XV6000 which has experienced several mechanical issues and is no longer reliable for the Village's Leaf Collection Program. Standard Equipment Company provided a bid of$59,210.00 through Sourcewell Cooperating Purchase which meets all of the competitive bid requirements.

It was the consensus of the Committee (Farina/Savaria) to forward a recommendation to the Village Board authorizing the purchase of the leaf collector.

Motion: Accept the recommendation of the Committee of the Whole and adopt a Resolution authorizing the execution ofa contract with Standard Equipment Company for the purchase ofa 2021 Xtreme Vac Model LCT600 Leaf Collector, in an amount not to exceed $59,210.00.

2. FORD F-450 DUMP TRUCK REPLACEMENT PURCHASE APPROVAL - RESOLUTION

Members also considered a request from Supt. Kestel to purchase a 2022 F-450 I-ton dump truck to replace a 2008 Ford dump truck. The truck's dump body and snow removal equipment have significant failure and are not reliable for its intended use. Supt. Kestel sought the Committee's approval to purchase the replacement truck from Currie Motors of Frankfort through the State Purchase Program in the amount of $45,912.00 and the purchase of the dump body and snow removal equipment from Monroe Truck Equipment through Sourcewell Cooperative Purchasing Contract, in the amount of $43,323.00. The cost of the fully equipped vehicle is $89,235.00.

It was the consensus of the Committee (Savaria/Borrelli) to forward a recommendation to the Village Board to approve the purchase of the vehicle replacement.

Motion: Accept the recommendation of the Committee ofthe Whole and adopt a Resolution authorizing the execution of a contract with Currie Motors ofFrankfort and Monroe Truck Equipment for the purchase of a 2022 F-450 Chassis Truck with dump body and snow removal equipment, in an amount not to exceed $89,235.00.

3. INTERNATIONAL DUMP TRUCK REPLACEMENT PURCHASE APPROVAL - RESOLUTION

Utilities Director Zach Brown presented a request to purchase a 2022 International dump truck to replace a 2001 International dump truck that is at the end of its useful life and the cost of repairs are no longer justified in relation to the equipment's value and reliability. The truck chassis would be provided by Rush Truck Centers ($84,289.97) through the State Bid Program Presenter: Trustees Borrelli and Petrow

and the dump body and snow equipment package by Monroe Truck Equipment ($69,194.00) through Sourcewell Cooperative Purchasing Contract.

It was the consensus of the Committee (Farina/Savaria) to forward a recommendation to Village Board to approve the purchase of the vehicle replacement.

Motion: Accept the recommendation of the Committee of the Whole and adopt a Resolution authorizing the execution of a contract with Rush Truck Centers and Monroe Truck Equipment for the purchase of a 2022 International HV507 Chassis Truck with dump body and snow removal equipment, in an amount not to exceed $153,483.97.

4. DISPOSAL OF SURPLUS VEHICLE - ORDINANCE

In addition to the replacement truck purchase, Director Brown requested the disposal of the 2001 International dump truck that is no longer useful in the daily operations of the Village.

It was the consensus of the Committee (Farina/Petrow) to forward a recommendation to the Village Board to approve the disposal of the surplus vehicle.

Motion: Accept the recommendation of the Committee of the Whole, waive the First and Second Readings, and pass an Ordinance authorizing the sale of certain surplus property owned by the Village of Frankfort, Will and Cook Counties, fllinois.

2 RESOLUTION NO. 21-xx A RESOLUTION AUTHORIZING THE EXECUTION OF A CONTRACT WITH STAND ARD EQUIPMENT COMPANY FOR THE PURCHASE OF A XTREME V AC LEAF COLLECTOR

WHEREAS, the Village of Frankfort desires to purchase a 2021 Xtreme Vac Model LCT600 Leaf Collector from Standard Equipment Company via Sourcewell Cooperative Purchasing Awarded Contract #041217-0DB, in the amount of $59,210.00; and

WHEREAS, the Village's Fiscal Year 2021 /2022 Budget allocates funds for the purchase of this replacement equipment; and

WHEREAS, at its May 12, 2021 meeting, the Committee of the Whole of the Village of Frankfort reviewed said bid proposal and forwarded a recommendation to the Village Board to authorize the purchase of a 2021 Xtreme Vac Model LCT600 Leaf Collector from Standard Equipment Company; and

WHEREAS, the President s of the Village of Frankfort have considered the purchase and determined that it is int ests of the Village and its residents to approve the purchase of the replacement equip

Re: Vehicle Replacement

The Utilities Department is seeking to replace U-22, a 2001 International dump truck with 54,055 miles and 58,188 hours (2,424 days or 6.64 years). The vehicle is at the end of its useful life and the cost of repairs are no longer justified in relation to the vehicle's value and reliability. The Utilities Department has not purchased a new dump truck since 2008. The truck will be outfitted with a plow and snow removal equipment for use during the winter months. Delivery ofthe t ruck is expected to take 10-12 months.

Rush Truck Center holds t he state bid for International trucks and Monroe Truck Equipment has a Sourcewell contract for the dump body and snow equipment. Both contracts meet the state bid requirements. The quoted prices are provided below:

Rush Truck Center $84,289.97 Monroe Truck Eauipment $69,194 Total $153,483.97

The cost for this vehicle is included in the FY2021 / 2022 budget. U-22 will no longer pass the required annual safety inspections without substantial repairs and as such staff recommends it be declared surplus and sent to auction.

1. ULTIMATE VOLLEYBALL SPECIAL USE: 10850 LARAWAY ROAD, UNITS l-3W - ORDINANCE

Applicant Ultimate Volleyball requests the granting of a special use permit to expand their existing business within the Heritage Sports Plaza, located at 10850 W. Laraway Road. Ultimate Volleyball has been operating within the main indoor sports field area for over 20 years and proposes to expand its existing operations into suites 1-3W for additional training and office space. To accommodate the proposed use, the applicant requests the granting of a special use permit for indoor recreation and entertainment within the B-2 Community Business District.

At the April 8, 2021 Public Hearing on the project, several neighboring residents were present and expressed concerns with the traffic and parking from the tournaments taking place at the Heritage Sports Plaza. Staff noted the traffic and parking concerns would be addressed at a future meeting of the Traffic Advisory Committee.

The Plan Commission forwarded a unanimous (6-0) recommendation to the Village Board to grant the special use request with two conditions: all activities shall occur within the building and that [volleyball] tournaments shall not be held at the location.

At its May 5, 2021 meeting, the Traffic Advisory Committee discussed the matter and determined the proposed special use within the complex would be appropriate in reference to parking and traffic. The committee also agreed that the Police Department would continue to gather data and revisit the issue as the data indicates.

Motion: Accept the Plan Commission recommendation, waive the First and Second Readings, and pass an Ordinance granting a Special Use Permit for indoor recreation and entertainment to the property located at 10850 Laraway Road, Units 1-3W, to permit the operation of Ultimate Volleyball, in accordance with the reviewed plans and public testimony, with the condition that all activities occur within the building and that tournaments will not be held at this location. 3 • Resident Christian Wilson residing at 20394 Grosse Point Drive questioned the standing water on his lot. Mr. 0 'Malley noted that the standing water will have to be discussed with the Village to see if there's a leak. Mr. Brown noted he will have a Village employee go to the site to further investigate;

• Resident Rita Robe1tson residing at 20357 Mackinac Point Drive questioned if the doors on the 2-units will match those of the existing units on the same street. Mr. O'Malley noted they will match;

• Resident on Mackinac Pont Drive questioned if there is a landscaping plan in place to screen the cemetery on the rear of the lots. Mr. O'Malley noted there is no plan in place, but any resident can purchase any plantings and coordinate with him to be incorporated with the existing plantings;

• Resident Laura Johnson who lives on lot 14 expressed her concern with the added traffic resulting from office/model home on lot 13. Other neighboring residents also expressed a concern with the traffic on lot 13 which is on a cul-de­ sac on Indiana Harbor Drive. Mr. Brown questioned the builder how many visitors he anticipates each day. Mr. O'Malley noted it varies some days it could be 10-13 and some days it could be 1-2 visitors. Mr. O'Malley noted any overflow parking can also park on Pfeiffer road. Chair Rigoni noted for staff to review with the builder the 3 parking spots in the middle of the cul-de-sac showing on the previous plan.

Senior Planner, Christopher Gmba presented the staffrepo1t and provided an overview of the request noting Ultimate Volleyball has been operating in this building for several years within the main indoor spo1ts field area and are proposing no tournaments at this facility. Mr. Gmba noted that Ultimate Volleyball is seeking units 1-3W for office use and strength training activities. The representative Laura Sues was present and noted

Other concerns are that the overflow parking is happening in streets where parking is restricted and concern with access to Laraway Rd from Heritage Drive. Mr. Brown noted the traffic concern can be addressed at the Traffic Advisory Committee;

• Commissioner Leddin questioned how the Village could guaranty no increase of athletes/ patrons on the facility. Applicant noted at the current time they are not planning on increasing the number of patrons but not sure on the future. Mr. Brown noted there is a capacity limit on the building that will have to abide by;

E. Public Hearing Request: Buford's BBQ and Bourbon (Ref. #105) Public Hearing Request: Special use for accessory liquor sales to permit the operation of Buford's BBQ and Bourbon, a carry~out restaurant, proposed at 21112 S. LaGrange Road.

Senior Planner, Christopher Gruba presented the staff report and provided an overview of the request noting the prior restaurant at the location did not hold a liquor license. The accessory liquor license would allow for sales of beer, wine, and bourbon only. The applicant, John Mathis, was present and noted he will like to employ about 10 employees and will like to be open on Mondays also. On his current request his intent was to only open Tuesday- Sunday.

During the Plan Commission Discussion:

• Applicant noted the hours of operation will be Monday - Thursday 11 am - 8 pm, Friday - Saturday 11 am - 9 pm, and Sunday 11 am - 8 pm;

Chairman William Dowding called the regular meeting of the Traffic Advisory Committee to order on Wednesday, May 5, 2021 at 9:00am

In attendance were Chairman William Dowding, John Burica, Adam Nielsen, Scott Potter, Terry Kestel, Chris Gruba, and Mike Schwarz.

APPROVAL OF THE MINUTES (March 3rd, 2021)

Terry Kestel made a motion (#1 ), seconded by Adam Nielsen, to approve the minutes of the Traffic Advisory Committee meeting that occurred on March 3, 2021. The motion carried unanimously.

DISCUSSION - TRUCK TRAFFIC/ LARAWAY RD.

Chairman Dowding was contacted by Jim Hollan asked to discuss the increased truck related crashes on Laraway Rd. Terry Kestel open · cussion and reminded the group that Laraway Rd remains a Will County roadway. Chair g provided the group with 9 truck related crash reports that occurred from Janua ate. Many of the crashes stemmed from distracted drivers and speed.

John Burica advised that the poli ted several traffic details in the area targeting distracted and speeding drivers.

Discussion continued and Scott Potters gested that data collection should take place at several places along Laraway Rd. The group agreed and the stealth stat collection units will be placed on Laraway Rd once they become available. Scott Potter advised that he follow up with this committee once the data is collected. The group agreed.

SIGN REQUEST - STOP SIGN/ LOCUST ST.@ OREGON ST.

Chairman Dowding was contacted by Chris Connors in reference to speeding vehicles on Locust St. Chairman Dowding opened the discussion and explained that Mr. Connors was concerned about increased traffic and vehicle speed on Locust between Nebraska St. and the Park District buildings.

Scott Potter advised that this area had been added to the enhanced traffic patrol list and would be monitored by the NPO and DPO officers. Terry Kestel explained that the lack of sidewalks and side parking would dictate that a stop sign would not be appropriate at this time. Scott Potter agreed and stated that he would add this location to his traffic study list in order for data to be collected. Terry Kestel advised that a Children at Play sign may be appropriate for the street given the location of the playground and sports fields. The group agreed, and the informational signage

1 would be posted. The group continued their discussion and agreed that we would re-visit the matter once new data was collected.

PARKING ISSUES- LIMITED TIME PARKING REQUEST - CHAMBER OF COMMERCE

Chairman Dowding was contacted by Kris Pasquini of the Frankfort Chamber of Commerce in reference to a request for timed parking in front of the Chamber of Commerce Building (Kansas St @ Hickory St.). Chairman Dowding opened the discussion and stated that Ms. Pasquini's concern is with the limited parking in front of the office being occupied for long periods of time. This eliminates the possibility of patrons parking to conduct business in the area.

The group discussed the overall downtown parking situation and agreed that more discussion would be needed to ensure that the entire downtown is considered if a new comprehensive parking plan is explored. The group agreed and advised they would re-visit the issue if an overall parking plan was developed.

TRAFFIC ISSUES - STOLL RD.@ JEANETTE CT.

Scott Potter was contacted by Eileen Morissette in A:.f~ nce to speeding traffic issues on Stoll Rd. @ Jeanette Ct. Mr. Potter explained that Ms e was concerned with speeding vehicles heading eastbound on Stoll Rd. She r a stop sign to control the speed. Mr. Potter explained it according to the manual ontrol devices, stop signs were not appropriate for speed control. Mr. Potter al s eral studies that indicated the same.

TRAFFIC/ PARKING ISSUES- HERITAGE KNOLLS SPORTS COMPLEX

Chairman Dowding was contacted by Zachary Brown in reference to traffic and parking issues that surround the Heritage Knolls Sports Complex. Chairman Dowding opened the discussion and explained that the police department had also received a few complaints in relation to parking. These complaints stemmed from weekend sports tournaments where multiple teams were appearing at the same time. Officers responded to the complaints and were able to rectify the situation while they were on scene.

Chris Gruba ex lained that the complex is in the process of rearranging some businesses, and this has become a debated issue in other committees. Adam Nielsen was aware of the changes in businesses and he explained that the volleyball training facility was sim r.2 ly conducting small group training and no additional tournaments would be conducted by the business.

2 Group discussion continued and John Burica noted that under the current Will County Laraway Rd project, additional traffic control devices are anticipated at the entry / exit points of the subdivision. Heritage Dr. is scheduled for a traffic signal and Regency Dr. is roposed to be and right in / right out intersection.

The committee agreed that they would continue to gather data and would revisit the issue as the data indicates. However, it should be noted that the committee all agreed that the proposed changes to the businesses within the complex would be ap Qropriate in reference to parking and traffic.

TRAFFIC ISSUE- WALNUT CREEK DR@ ST FRANCIS RD.

Chairman Dowding was contacted by Terry Kestel in reference to a potential traffic issue involving a possible blind spot on St. Francis Rd @ Walnut Creek Dr. Chairman Dowding opened the discussion by advising that he had viewed the video sent by a concerned citizen in reference to the bridge Uust west of the intersection) obstructing the view of E/B traffic from Walnut Creek Dr. Chairman Dowdin h n drove to the area and attempted to recreate the condition observed in the vide ugh the video is valid, Chairman Dowding noted that as he moved forward to the , he could clearly see E/B traffic approaching the intersection.

Terry Kestel advised that he chec e a cl noticed that St. Francis Rd. had speed limit signage (45mph) when it uld h en marked 35mph in that area. Mr. Kestel advised that the proper signs wo talled.

John Burica advised that he compiled all crash reports from that intersection and only 1 crash had occurred that involved intersection related issues. Given the above information the committee agreed to continue to gather information and re-visit if necessary, in the future.

TRAFFIC ISSUES-GOLFVIEW LN- PRIVATE DR

Chairman Dowding was contacted by Tom Barz in reference to traffic control on Golfview Ln. Chairman Dowding opened the discussion explaining that Golfview Ln is a private drive within the village limits. Mr. Barz represents the condo owners association and explained that his clients were concerned about increased vehicular traffic on their private roadway. They requested that the traffic advisory committee discuss some of their proposed remedies for their problems.

Adam Nielsen advised that if the HOA wished to gate the entrance to the roadway it would present many problems. First, they would have to get permission from the HOA just to

3 the south due to the sharing of the roadway and egress points. The Cook County Highway Department would also need to be consulted due to the need for deceleration and turn lanes on Harlem Ave. Blocking the intersection at Harlem Ave also poses a problem due to the subdivisions needing 2 points of entry/ egress.

The group agreed that signage would be the most cost-effective way of informing the motoring public that the roadway is private.

OTHER BUSINESS

Prestwick John Burica advised that he was contacted by Brandon Palmer of the Prestwick HOA who pointed out a traffic / parking issue during child pickup at Chelsea. According to Mr. Palmer this is occurring daily at pick up time near the intersections of Highland Rd. and Sauk Trail.

Scott Potter advised that he will ensure that additional traffic patrols were posted in the area to confirm that the situation is being monitored. Chairman Dowding added that the Neighborhood Patrol Officers would also coordinate with SRO Riff re that the school is notified about the issue. Also the NPO's will attempt to meet with resid e area to see if additional No Parking signage would be appropriate for the zone.

Candle Creek Adam Nielsen presented a subdivisi sal from the Candle Creek Subdivision. In summary the sign would meet all nts and would be located near the intersection of Waterview Trail and St. Franci e signage did not appear to adversely effect the sightlines from either roadway.

The group discussed moving the project forward will discuss further at the next meeting.

1 Analysis

In consideration of the request, staff offers the following points of discussion:

• All activities related to the special use would occur inside the building. The space would be utilized for office space and strength training for volleyball. Actual volleyball would occur in the main central sports arena area, not in suites 1-3 W, which have a drop-ceiling.

• No exterior site work is proposed for this special use.

• The actual building measures approximately 59,622 square feet. The indoor recreation/entertainment area would measure 80' x 41', or 3,280 square feet, within Units 1-3 W.

• Staff was unable to locate an original Special Use Permit for Ultimate Volleyball. However, with the use proposing to expand into additional units, a Special Use Permit is required.

• The Zoning Ordinance states that "other indoor recreational uses" require 1 parking space for every 4 patrons based upon maximum capacity, plus 1 space for each employee during the largest working shift. There will be a maximum of 10 employees during the largest working shift and the maximum occupancy for suites 1-3 Wis 44, requiring 21 parking spaces.

• An aerial photograph of the site illustrates approximately 175 parking spaces, although many of the parking space lines appear faded.

• A special use permit for Polaris Martial Arts within suite 3E was recently approved by the Village Board on March 1, 2021. The martial arts facility previously occupied suite 3W.

Development Comments

• The applicant must apply for a business license through the Village prior to operation, should the Special Use Permit be approved by the Village Board.

1. LIQUOR CODE AMENDMENT: CHAPTER 113 - ORDINANCE

The Village Board periodically reviews business regulations regarding liquor as contained in the Code of Ordinances and has deemed that an amendment to the Code of Ordinances, Chapter 113, reducing the number of Class D-1 liquor licenses permitted in the Village from one to zero, to reflect the closing of Parmesans Wood Stone Pizza, is in the best interest of its citizens.

Motion: Waive the First and Second Readings and adopt an Ordinance amending the Village of Frankfort Code of Ordinances, Chapter 113: Intoxicating Liquor, to reduce the number of Class D-1 liquor licenses from one to zero in the Village of Frankfort

2. TOBACCO CODE AMENDMENT: CHAPTER 119 - ORDINANCE

The Village Board periodically reviews business regulations regarding tobacco as contained in the Code of Ordinances and has deemed that an amendment to Chapter 119, reducing the number of Class A tobacco licenses permitted in the Village from nine to eight is in the best interest of its citizens.

Motion: Waive the First and Second Readings and adopt an Ordinance amending the Village of Frankfort Code of Ordinances, Chapter 119: Tobacco, to reduce the number of Class A tobacco licenses from nine to eight.

3. LANDSCAPING REGULATIONS AMENDMENT: CHAPTER 158 -ORDINANCE

At its May 12, 2021 meeting, the Committee of the Whole discussed an amendment to the Village's landscaping regulations to remove the tree species, Pyrus calleryana (Callery Pear and Chanticleer Pear) and the related cultivars (Bradford Pear) from the acceptable tree list due to its invasive nature.

It was the consensus of the Committee of the Whole (Farina/Savaria) to forward a recommendation to Village Board to pass an Ordinance amending the Village of Frankfort Code of Ordinances, Chapter 158, as presented.

Motion: Accept the recommendation of the Committee of the Whole, waive the First and Second Readings, and pass an Ordinance amending the Village of Frankfort Code of Ordinances, Chapter 158: Landscaping Regulations, to remove the tree species, Pryus calleryana from Appendix A, B, and C and add Pryus to Appendix G. ORDINANCE NO. 3 2XX AN ORDINANCE AMENDING THE VILLAGE OF FRANKFORT CODE OF ORDINANCES, CHAPTER 113: INTOXICATING LIQUOR

WHEREAS, it is important for the Village of Frankfort to periodically review business regulations regarding intoxicating liquor as contained in the Code of Ordinances to ensure the health, safety and welfare of its citizens are maintained; and

WHEREAS, the President and Board of Trustees of the Village of Frankfort have reviewed an amendment to the limitation of the number of Class D-1 (Restaurant, permitting bar and certain carry-outs) liquor licenses permitted in the Village; and

WHEREAS, these same Corporate Authorities have deemed that an amendment to the Code of Ordinances, Chapter 113, is in the best interest of the citizens of the Village of Frankfort;

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF FRANKFORT, WILL AND COOK COUNTIES, ILLINOIS, AS FOLLOWS:

SECTION 1. SECTION 113.20 LIMITA UMBER OF LICENSES

Chapter 113, Intoxicating Liquor, 20 (A), Paragraph (4) of the Code of Ordinances for the Village of Frankfort is ded as follows:

(A) There shall be availab he following number of licenses for each of the following classifications:

( 4) There shall be issued in the Village not more than zero Class D-1 licenses, not more than one Class D-2 license, not more than zero Class D-3 license, and not more than one D-4 license.

SECTION 2. PENALTY

In addition to and not in lieu of any other remedies available to the Village under this Ordinance or law, any person or entity found to have violated any provision of this Ordinance shall be fined not less than $250 not more than $750, with each day of violation constituting a separate offense.

SECTION 3. REPEALER

That all other ordinances or parts or provisions of ordinances of the Village of Frankfort in conflict with any of the provisions of this Ordinance shall be, and the same are hereby repealed. SECTION 4. SEVERABILITY

This Ordinance, and every provision thereof, shall be considered severable. In the event that any court of competent jurisdiction may find and declare any word, phrase, clause, sentence, paragraph, provision or section or part of a phrase, clause, sentence, paragraph, provision or section of this Ordinance is void or unconstitutional, the remaining words, phrases, clauses, sentences, paragraphs and provisions and parts of phrases, clauses, sentences, paragraphs, provisions and sections not ruled void or unconstitutional shall continue in full force and effect.

SECTION 5. EFFECTIVE DATE

This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.

WHEREAS, as authorized by the Illinois Municipal Code 65 ILCS 5/1-1-1, et. seq. the Village of Frankfort has established by ordinance the classification, type, authorized number, and various regulations relating to the licensing of premises to sell tobacco products; and

WHEREAS, the President and Board of Trustees of the Village of Frankfort have reviewed an amendment to the limitation of the number of tobacco licenses permitted in the Village; and

WHEREAS, these same Corporate Authorities have deemed that an amendment to the Code of Ordinances, Chapter 119, is in the best inte he citizens of the Village of Frankfort.

WHEREAS, it is important for the Village of Frankfort to periodically update the landscaping regulations within the Village; and

WHEREAS, at a meeting held on March 22, 2021, the Tree Board of the Village of Frankfort recommended removing Pyrus species from the recommended plant materials due to its invasive nature; and

WHEREAS, at a meeting held on May 12, 2021, the Committee of the Whole forwarded a recommendation to the Village Board to amend Chapter 158, Landscaping Regulations, Appendices A, B, C, and G; and

WHEREAS, the President and Board of Trustees ofthe Village of Frankfort have considered the amendment and determined that it to be in the · terest of the citizens of the Village of Frankfort to amend Chapter 158 of the Municipal C

Re: Village Tree Board Recommendation - Landscape Ordinance Amendment

At its March 22, 2021 meeting, the Tree Board reviewed the tree list included in the Village's Landscape Ordinance for tree viability. Members discussed an amendment to Chapter 158, Landscaping Regulations, to address the tree species, Pyrus calleryana (Callery Pear, Chanticleer Pear) and related cultivars (Bradford Pear). These tree species have been identified by the United States Department of Agriculture (USDA) as invasive. In addition, the trees have weak branch unions allowing damage during adverse weather conditions.

It was the consensus of the Tree Board to remove the Pyrus tree species from the Village's acceptable tree list and add Pryus to the Village's plant material list for unacceptable trees.

Motion: Forward a recommendation to the Village Board amending the Village 's Landscape Ordinance, Chapter 158, Landscaping Regulations, to remove the tree species, Pryus calleryana from Appendices A, B, and C, and add Pryus to Appendix G. Bradford Pear Pyrus calleryana

Description and Biology

o Plant: grows 30 to 50 feet tall and 20 to 30 feet wide; exhibits rapid growth (12 to 15 foot increase in height over 8 to10 years); has a short to moderate life span (25 to 30 years). o Leaves : simple, alternate, deciduous, shiny green and leathery with round-toothed margins; turn mahogany-red and sometimes bright orange-red in late autumn. o Flowers, fruits and seeds: produces showy white flowers in the spring before the leaves expand; small, round, brown fruits appear during late spring and summer. o Spreads : by seeds that are dispersed to new locations by starlings and other birds that eat the fruits. ~=-

Distribution and Ecological Threat Bradford Pear is a native of China. Grown throughout the United States, Bradford pear grows best in full sun butwill tolerate partial shade and a variety of soil types and conditions, including occasional wet soils or drought. New hybrids produce viable seeds through cross­ pollination with the Bradford cultivar. The descendants are aggressively invading natural and disturbed open areas, displacing native plant communities and disrupting natural succession .

Prevention and Control Do not plant Bradford pear. Seedlings and shallow-rooted plants can be pulled when soil is moist. Small trees need to be dug up or pulled out using a Weed Wrench®, ensuring removal of the root system. Large trees should be cut down and stumps treated with an appropriate systemic herbicide (e .g., glyphosate or triclopyr), following label directions, or ground up to prevent resprouting. If cutting is not possible, trees can be girdled during the spring and summer, by cutting through the bark all around the trunk, about 6" above the ground.

1. Swearing-In Ceremony of Officer Joshua Maxwell It is my honor to swear in Police Officer Joshua Maxwell this evening. Officer Maxwell was hired in September of 2019 and has successfully completed his primary training requirements and probationary period.

Officer Maxwell is a graduate of Andrew High School. He holds a Bachelor of Science in Business Administration with an emphasis in Organizational Leadership from Illinois State University. Pursuing a career in law enforcement has been a family affair. His father served as a Chicago police officer, as well as several other family members have served in the police and fire field. Officer Maxwell is looking forward to a long career as a police officer with the Village of Frankfort and is off to a great start.

I, Joshua Maxwell, do solemnly swear (or affirm) that I will support the Constitution of the United States, and the Constitution of the State of Illinois, and that I will faithfully discharge the duties of Police Officer for the Village of Frankfort to the best of my ability.

2. Frankfort Garners Financial Reporting Award The Village of Frankfort has been awarded the Certificate of Achievement for Excellence in Financial Reporting by GFOA (Government Finance Officers Association of the United States and Canada) for its comprehensive annual financial report for the fiscal year ended April 30, 2020. The Certificate of Achievement is the highest form of recognition in the area of governmental accounting and financial reporting, and its attainment represents a significant accomplishment by a government and its management. The Village has received the award consecutively since 1989.

3. Memorial Day Ceremony Scheduled for Monday, May 31 The Village of Frankfort, VFW Post 1493, Will County Chief Deputy States Attorney Ken Grey and the Hickory Creek Middle School Band and Orchestra come together to honor the service men and women in a virtual ceremony. The ceremony will air on FCTV Channel 6 and the Village of Frankfort's Y ouTube channel on Monday, May 31.

4. Young Angler Fishing Derby Scheduled for June 12 The annual "Get Hooked on Frankfort" fishing derby will be held on Saturday, June 12, from 8:00 A.M. to 11 :00 A.M., at Prairie Park for youngsters ages 3 to 12. Registration is required for this event. Information and registration forms are available on the Village website and at the Village Administration office.

5. Annual Beautification Award Nominations Are Due by June 30 Summer beautification award nomination applications are available on the Village website. The deadline for all entries is June 30, 2021. Awards will be presented in July. 6. Frankfort Country Market Continues in Historic Downtown The modified Country Market continues in downtown Frankfort every Sunday, from 9:00 A.M. to 1:00 P.M. Enjoy a variety of fresh produce, plants, prepared foods, and specialty products that are locally grown.

7. Applications to Fill Commission Vacancies Are Available The Village of Frankfort is currently accepting applications to fill a Historic Preservation Commission member vacancy and a Plan Commission vacancy. Residents of Frankfort who wish to submit applications for the appointments are encouraged to do so. Applications are available at the Village Administration Building or online at www.frankfortil.org. All applications must be turned in by 4:00 P.M. on Friday, May 21, 2021.
