QUESTIONS SUBMITTED BY POTENTIAL TENDERERS UNTIL 27TH MARCH 2007

In accordance with the appropriate tender procedure, questions concerning the Tender Documents have been submitted by Companies/Consortia/Joint Ventures after the mandatory Information meeting held in on 09.03.2007. All the questions are quoted as received and no corrections of spelling or grammar errors have been made. The enumeration of the questions is a continuation of the list of questions received in relation to and/or at the Information meeting and already answered (published on the EuropeAid website on 12th April 2007, as well as on the website of the Contracting Authority).

Question 28 Reference According to position plan no. 27 "Station / Halts" is the switch 48 Contract scope of till plan finish planed. How far does it go? It was considered until works, Tender he plan finishes. Is this correct? Documents, Volume 5, Answer Subject to the Contractor's design, after the starting point of turnout No. 48 reconstruction of the existing siding shall be envisaged for approx. 70 m, so that a smooth connection is implemented between the reconstructed part with the existing track.

Question 29 Reference According to position plan no. 56 "Situation" is presented the Contract scope of construction end for S49 track to Greek till km 2+200. This was works, Tender considered as the construction end. Is this correct? Documents, Volume 5, Answer From the station towards Greek border a new track with new alignment shall be constructed till (subject to Contractor's design) approx. km 2+190, this point coinciding with km 301+700 (existing benchmarking). From this point to the Greek border (km 302+741) rehabilitation shall be implemented as described in the answer to question 19.

Question 30

1 Reference The existing track must be completely dismantled, where the Contract scope of operation will be stopped. There are no plans included in the works, Tender tender documents showing the necessary details of these railway Documents, Volume 5, lines. On the tender drawings only the new line and a part of the existing lines are shown and not the whole existing line. Can we obtain plans, where the dismantling is to be distinguished clearly in terms of colour from needing reconstruction? Answer As explicitly said in the Tender Dossier this is a Design-Build Contract and the Tenderer himself shall, in accordance with the provisions as in the Tender Documents, make all investigations/studies and obtain all additional information he considers appropriate for preparing his tender. The drawings of the existing railway line shall be given to the successful tenderer, upon request, after signing of the Contract.

Question 31 Reference We assume that the whole halt Harmanli is part of the project and Contract scope of should be rehabilitated, inclusive the complete connection to the works, Tender main line. Is this right? Documents, Volume 5, Answer It is clear from Volume 3, Part 2, item 4, that Harmanli West Post, Harmanli-Center halt, Harmanli station and Harmanli East Post shall be included in the scope of the Contract.

Question 32 Reference Reconstruction station tracks Simionovgrad & Hamanli. We Contract scope of assume that at these stations only defect sleepers replacement and works, Tender fastening repair and installations has to be executed. Documents, Volume 5, Please confirm this. Answer The works to be performed at and Harmanli stations shall be strictly in accordance with the Contract provisions as in Volume 3 and Volume 5.

Question 33 Reference 'The number of sleepers in 1 km of railway track with rails S49 Contract scope of and UIC60 shall be defined according to the category of the line'. works, Tender Please inform us about the line categories for the project - Documents, Volume 3, for the main line and the siding lines. 2 As explicitly said in the Tender Dossier this is a Design-Build Contract. It is for the Contractor to make his own calculations about any technical parameters (including the number of sleepers in 1 km of railway track) while observing the standards and regulations in force and the Contract provisions. Although the Tender Procedure does not include interpreting of the Bulgarian legislation, it should be noted that the railway lines' categorization shall be in accordance with the Regulation for categorization of the railway lines in Republic of , included in the railway infrastructure, and closing of separate lines or sections from lines.

Question 34 Reference Jointless track on bridges with a ballast bed shall be with wooden Contract scope of sleepers instead of pre-stressed concrete sleepers? Could you works, Tender please confirm this? Documents, Volume 3, Technical specifications, Section 14.1.2.5 Answer The wording as in Volume 3, Part 3, item 14.1.2.5. is an exact quotation of the regulations in force, related to jointless track. It is evident that the provisions are permissible and may be applied for existing structures along the line, mainly steel structures. For the new structures the provisions of Regulation 55 for the design and construction of railway lines, railway stations, railway crossings and other elements of the railway infrastructure shall apply and pre-stressed concrete sleepers on ballast bed shall be used.

Question 35 Reference Are guard rail systems to be installed on all railway bridges? Contract scope of Please clarify. works, Tender Documents, Volume 3, Technical specifications, Answer As explicitly said in the Tender Dossier this is a Design-Build Contract. For guard rails the Contractor shall observe the requirements as in Regulation 55 for the design and construction of railway lines, railway stations, railway crossings and other elements of the railway infrastructure.

Question 36 Reference Are compensating devices needed at the bridges? If yes could you Contract scope of please specify at which bridges these expansion devices shall be works, Tender Documents, Volume 3,

3 installed? Technical specifications, Answer As explicitly said in the Tender Dossier this is a Design-Build Contract. For compensating devices the Contractor shall observe the requirements as in UIC 720 and the Bulgarian regulations in force.

Question 37 Reference Railway bridge km 296+378: Vol 5 Part 01, Vol 5 Part 01 drwg. no. 55 shows a bridge in plan with 2 tracks situations and including a switch crossing a river. plans, drwg. no. 55 Vol. 5 Part 04 drwg. no. 76 shows a cross section of this bridge with 1 track only. From the CD: Preferred alignment - Initial Preliminary Design, Report IV page 10, a bridge at km 296+378 is described as 2 track bridge. Furthermore, Vol 5 Part 01 drwg. no. 55 also shows a new single railway line in green as well as a second hand single railway line in orange. Therefore this bridge ought to be designed to take 4 tracks including a switch. Unfortunately, we do not have cross- sections for this Tender. Please provide the necessary cross-sections and specify the bridge required. Also, please state which document of the Tender documents has priority if such discrepancies occur. Answer It is clear that the bridge shall be designed and constructed to carry 4 railway tracks. The Contractor, upon his discretion, may consider a single structure or several structures.

Question 38 Reference Are the following tasks to be included in the scope of the railway Contract scope of superstructure works: works, Tender 1. Stabilising of the track with use of dynamic track stabiliser Documents, Volume 3, (DGS), and Technical 2. Grinding of the rails before taking the new or reconstructed specifications, lines into operation? Section 14, Track Please clarify! design data Answer 1. As explicitly said in the Tender Dossier this is a Design-Build Contract. The Contractor shall elaborate and implement his method statement (subject to the approval procedures and in observation of the requirements as included in the Contract) with the view of obtaining and guaranteeing the main indicators as indicated in Volume 3, Part 2.

4 2. It is explicitly said in Volume 3, Part 3, item 14.1.1.1.(10), that "All new rails on the main line shall be ground in the track after construction works have been completed and prior to the commissioning of the site."

Question 39 Reference Is the securing of workers at the railway line by specialised Contract scope of security personnel (flag men) included in the scope of the works, Tender contractor or will this service be provided by the employer? please Documents, Volume 3, clarify. Technical specifications, Answer It is clear that the Contractor shall, at his own responsibility and for his own account, perform all the works under the Contract in compliance with the relevant regulations in force (including the safety regulations), whereas providing the necessary staff and resources.

Question 40 Reference In the legend of the drawing a light blue line is specified: "existing Contract scope of single railway line – needing reconstruction". Does this mean that works, Tender the existing line has to be dismounted completely and at the same Documents, Volume 5, location a new line with S49 rails has to be reconstructed? If so, Part 1, Situations and does the new line has to be constructed with new rails S49 and Plans pre-stressed concrete sleepers or with second hand rails S49 and second hand pre-stressed concrete sleepers? Please clarify. Answer Within the stations the main track(s) and the sidings that are used for arrival/departure of trains shall be with new track materials and turnouts. The remaining sidings shall be with second-hand materials (these materials being subject to the approval procedures and in observation of the requirements as included in the Contract).

Question 41 Reference Could you please specify the guarantee period for the project Contract scope of according to the Bulgarian legislation? works, Tender Documents, Volume 2, Sub-Clause 11.12 Guarantee Period Answer It is clear that the Tender Procedure does not include interpreting of the Bulgarian legislation. In this respect the guarantee period for the works shall be in accordance with the Law on Territory Arrangement and Regulations No. 1 of 30 July 2003 and No. 2 of 31 July 2003 thereto issued by the Ministry of Regional Development and Public Works.

No. 39; Vol 5, Please clearly state, whether a road overpass is required or not. part 4 If a new road overpass is required, please produce the necessary information to enable the Tenderer to make a price for the overpass. Answer The new road overpass at km 269+259.3 shall be included in the scope of the Contract. It shall be designed and built as indicated in Volume 5, Part 1, drawing No. 39, in accordance with the standards and regulations in force and subject to the approval procedures and in observation of the requirements as included in the Contract.

Question 43 Reference Road Underpass km 278+656 : Vol 5, Part 1, Vol 5 Part 01 drwg. no 45 describes a new road underpass. situations and The Tender Documents Vol 5 part 4 don't describe a new road plans, drwg. underpass at this point. No. 45; Vol 5, Please clearly state, whether a road underpass is required or not. part 4 If a new road underpass is required, please produce the necessary information to enable the Tenderer to make a price for the underpass. Answer The new road underpass at km 278+656 shall be included in the scope of the Contract. It shall be designed and built as indicated in Volume 5, Part 1, drawing No. 45, in accordance with the standards and regulations in force and subject to the approval procedures and in observation of the requirements as included in the Contract.

Question 44 Reference Is there a topographical survey. Volume 3, Technical specifications Answer The digital model files of the preliminary design shall be submitted to the Successful Tenderer after the signing of the contract.

Question 45 Reference Are there any maps / drawings showing location and depth of Volume 3, Technical

6 existing utilities? specifications Answer As explicitly said in the Tender Dossier this is a Design-Build Contract. In accordance with Volume 3, Part 5, item 9.2 the Contractor shall make his own enquiries and investigations to ascertain the existence, nature, location and size of utilities. He shall, in accordance with the Contract provisions, design and perform all the works related to reinstating/amending/repositioning of any such utilities that might be affected by the Works, including the EMC issues.

Question 46 Reference Is there any information concerning contamination / pollution of Volume 3, Technical soil. specifications Answer With reference to the information about the contamination of soils along the railway line refer to Environmental Impact Assessment Report and to Environmental Impact Assessment Report – Supplement, included in the CD with additional information, as part of the Tender Dossier.

Question 47 Reference Livestock overpass km 288+228,25 : Vol 5, Part 1, Vol 5 Part 01 drwg. no 50 describes a new livestock overpass. situations and The Tender Documents Vol 5 part 4 don't describe a new livestock plans, drwg. overpass at this point. No. 50; Vol 5 Please clearly state, whether a livestock overpass is required or not. part 4 If a new livestock overpass is required, please produce the necessary information to enable the Tenderer to make a price for the overpass Answer The new livestock overpass at km 288+228,25 shall be included in the scope of the Contract. It shall be designed and built as indicated in Volume 5, Part 1, drawing No. 50, in accordance with the standards and regulations in force and subject to the approval procedures and in observation of the requirements as included in the Contract.

Question 48 Reference RAMS plan:- Volume 3, Technical a). What are the levels of redundancy & reliability. specifications b). what are the beneficiary requirements. c). does EN SO126 provide sufficient detail. d). does Electrical specification sub-clauses 15.2.4 and 16.12 - 14 provide enough detail? Answer

7 In order to understand the question it has been assumed that it refers to Volume 3, Part 4. Design of Electrification, item 6.3.1.7. RAMS Plan. It has also been assumed that the standard referred to in c) shall be EN 50126. The Contractor shall prepare the RAMS plan in compliance with EN 50126 and with the requirements of Volume 3, Part 4. Design of Electrification and of to Volume 3, Appendix 14. Reliability, Availability and Maintainability (RAM).

Question 49 Is there any seismic activity? Answer As explicitly said in the Tender Dossier this is a Design-Build Contract. The Contractor shall make his own enquiries and investigations to ascertain the seismic parameters as contained in a number of Bulgarian regulations.

Question 50 Reference What is Act - 16. Technical Specifications, Part 3 - Civil & Track, Sub-clause 10.4 Answer It should be underlined that the Tender Procedure does not include interpreting of the Bulgarian legislation. The forms (acts) related to the construction sites are described in Regulation No. 3 for commissioning of the construction sites in Republic of Bulgaria.

Question 51 Reference Is there a signal block plan for the estimation of the number and Technical type of track insulators? Specifications, Part 4 Answer In order to understand the question it has been assumed that "track insulators" should be regarded as "insulated joints". There shall not be any insulated joints on the tracks or within the turnouts at the time of commissioning of the Site. However, with reference to the Contractor's obligations as described in the answer to question 23, there may be a need of temporary insulated joints, subject to the Contractor's organisation of work and his solutions for observing the obligations stated therein. Any such temporary insulated joints shall be removed by the Contractor and the integrity of the rails/turnouts shall be restored prior to the time of commissioning of the Site.

Question 52 Is there any free issue material? Answer

8 The Contractor may, subject to the approval procedures and in observation of the requirements as included in the Contract, use any of the dismantled existing infrastructure elements for those parts of the construction, where it is explicitly permitted in the Contract. Apart from such materials there shall be no other free-issue materials available.

Question 53 Reference Locations of signals required in order to determine the number of Technical foundations. Specifications, Part 4 Answer In order to understand the question assumption has been made that the temporary signaling and telecommunications (S&T) system is referred to therein. As explicitly said in the Tender Dossier this is a Design-Build Contract and the temporary S&T system shall be subject to the Contractor's design. Therefore, the Tenderer himself shall, in accordance with the provisions as in the Tender Documents, make all investigations/studies and obtain all additional information he considers appropriate for preparing his tender.

Question 54 What role does the NRIC Railway Commission play? Answer The question is not clear. The involvement of NRIC in the Contract performance is described in details in the Tender Dossier. If the question refers to the NRIC Technical Council, then it should be underlined that all Contractor's design submissions shall be agreed by the said Technical Council prior to the final approval by the Engineer.

Question 55 Under what circumstances would the employer intend to call upon the tender guarantee? Answer The circumstances under which the tender guarantee of the Tenderer shall be subject to forfeiture are explicitly stated in Volume 1, Instructions to Tenderers, Section 1, item 24.3 and item 30.2, as well as Section 3, Tender Guarantee Form.

Question 56 the website quoted in the Tender Documents Vol 1 page 13 does not exist. Please send us the correct website preferably by e-mail as a link. Answer This is to confirm, that there is a missing letter "p" in the word "europeaid" in the EuropeAid website address given in items 9 and 10 of the Instructions to Tenderers. However the correct EuropeAid website is clearly indicated in the Procurement Notice, item 18, namely: http://europa.eu.int/comm/europeaid/index_en.htm The website of the Contracting Authority is correct.

Question 57 (The following text extracted from page 1-29 in the "Preliminary Design Report" revised in May 2001, regarding the railway construction and rehabilitation work in Plovdiv/ Svilengrad, Bulgaria is to be considered for the questions 57-60) Double tracking of five sections: - Katounitza to Popovitza - Parvomai to Yabalkovo - Dimitrovgrad to Simeonovgrad - Harmanli east to Svilengrad - Svilengrad to Kaptain Andreevo using the existing line and building a new track. Here the railway between the above-mentioned stations is understood to be double track. However Question According to the design, a large cross-section for a double track is shown for 12 railway bridges starting from the bridge at Km: 203+740 to the bridge at Km: 217+734.30; but only a single track is drawn; So, since these bridges shall be constructed for double track, are the "fill – cut" between these bridges, from (Parvomai station) Km: 202+300 to (Yabalkovo station) Km; 219+476 going to be executed as appropriate for double tracks? Answer It is clear that the initial preliminary design has been included in the CD with additional information, in the folder "Preferred alingment - Initial_Preliminary design", only as supplementary information/data for the Tenderers. The Contract shall be performed on the basis of the Preliminary design as included in Volume 5 of the Tender Dossier. The line from Parvomai to the Turkish/Greek border as within the scope of the Contract shall be a single track line, where the eventual future second track shall be to the left in the direction of kilometrage increase (except for the Svilengrad – Turkish border, where for the major part the second track will be to the right). For the section Parvomai – Yabalkovo refer to the answer to question 22.

Question 58 The superstructure for all the railway bridges after the "Yabalkovo station" (Km: 219+476) is illustrated for only one track; however, according to the Preliminary Design Report page 1-29, as it is written above to be a double track, please clarify: - If the "fill-cut" shall be for single track, according to the bridge cross-section? - Or if it is going to be for double track according to the report? Answer Refer to the answers to questions 22 and 57 above.

Question 59

10 Although the bridges between Km: 203+740 and 219+476 are designed for double track, the lengths of the box and concrete slab structures are given in the same part for one single track, Can you please clarify this issue? Answer For all railway structures in the section Parvomai – Yabalkovo (including the box and concrete slab structures) refer to the answer to question 22.

Question 60 You are kindly requested to state the type of construction and rehabilitation works to be executed for the bridges and superstructures, the km(s) of which between Km: 296+699 and 315+655 are given? Answer Refer to the answer to question 19

Question 61 For the superstructures where the new track and the existing track meet; please clarify if the culverts shall be demolished and constructed as a single structure or if the new one and the existing one shall be coupled to a new one? Answer Refer to the answer to question 15

Question 62 The tender documentation includes the plans and profiles of the alignment. Could you please also give us the cross-section covering the entire railway at reasonable intervals? Could you please, also provide the railway typical cross-section, indicating the platform width, slope and other details to be applied during excavation and filling activities for design purpose? Answer Refer to the answer to question 24. The typical cross-sections shall be in accordance with Regulation 55 for the design and construction of railway lines, railway stations, railway crossings and other elements of the railway infrastructure.

Question 63 km 298+700 to Turkish/Greek border All bridges and culverts beyond this point apart from the Generalovo road bridge at km 309+543,9 are neither indicated as new bridges nor described for rehabilitation. Therefore, we assume, that no work has to be done for these bridges. Please confirm Answer Refer to the answer to question 19.

11 Question 64 The number of the station platforms is different from the number of platforms given in the revised design report. Provided that the numbers in the technical specification will be essential, please confirm that 1 x 220 m long platform shall be constructed in Krum and Konstantinovo Halts. Answer In accordance with the appropriate drawings in each of the two halts – Krum and Konstantinovo, one passenger platform shall be constructed.

Question 65 Could you please kindly explain more briefly the scope of the rehabilitation work to be executed between Svilengrad (Km. 296+699) and Turkish Border (Km.315+655) and Svilengrad (Km. 296+699) and Greek Border (Km.300+646)? Answer Refer to the answer to question 19.

Question 66 Could you please explain more specifically, the works to be executed and the required relevant criteria for the station buildings to be newly constructed and refurbished? Furthermore, if applicable, you are kindly requested to provide the design and design requirements also for the stations to be newly constructed? Answer The requirements for the stations' and halts' buildings are indicated in Volume 3, part 2, item 4.2.(1) d). As explicitly said in the Tender Dossier this is a Design-Build Contract and the Tenderer himself shall, in accordance with the provisions as in the Tender Documents, make all investigations/studies and obtain all additional information he considers appropriate for preparing his tender.

Question 67 No details about the supports of the slopes and the retention wall or structures are covered in the documentation we are given for examination. Could you please provide the details and locations for such structures throughout the alignment? Answer As explicitly said in the Tender Dossier this is a Design-Build Contract. The Contractor shall propose solutions (including retention walls or any other structures) and make the appropriate calculations in his Preliminary and Definitive designs, subject to the approval procedures and in observation of the requirements as included in the Contract.

Question 68

12 Could you please provide the plans and details illustrating the existing utility system, so that we can identify the temporary and permanent utility relocation works throughout the alignment? Answer Refer to the answer to question 45 above.

Question 69 Please provide a clarification for the volume of works described as "rehabilitation" in the section of the track from km 298+700 to km 315+655 (Turkish border). What works exactly need to be performed and what will be the thickness of the different construction layers? Answer Refer to the answer to question 19.

Question 70 Please provide a clarification for the volume of works described as "rehabilitation" in Simeonovgrad station. What works exactly need to be performed and what will be the thickness of the different construction layers? Answer Refer to the answer to question 32 above.

Question 71 Please provide a clarification for the volume of works described as "rehabilitation" in Harmanli station. What works exactly need to be performed and what will be the thickness of the different construction layers? Answer Refer to the answer to question 32 above.

Question 72 During the studying of the Tender documentation was discovered a conflict between the position of new track and the construction of the existing bridge at km 269+360 (existing kilometer mark). Is this bridge going to be reconstructed and to what extent? Answer The Contractor shall redesign and implement (subject to the approval procedures and in observation of the requirements as included in the Contract) the track alignment within the zone prior to the existing bridge at km 269+360, so that to avoid major reconstruction of the existing structure.

Question 73

13 In Volume 5, Part 1 - in the Situation an underpass is shown at km 237+108. In the other parts of the specification (for example in Volume 5, Part 4) this underpass is not shown. Is this underpass part of the specification and does it have to be included in our tender? Answer The underpass at km 237+108 shall be included in the scope of the Contract.

Question 74 In Volume 5, Part 1 - in the Situation an underpass is shown at km 213+997. In the other parts of the specification (for example in Volume 3, Part 2) this underpass is not shown. Is this underpass part of the specification and does it have to be included in our tender? Answer The agricultural underpass at km 213+997 shall be included in the scope of the Contract.

Question 75 What works exactly are included under the term "temporary safety equipment"? Answer Refer to the answer to question 23.

Question 76 Is the performing of the cable routes, including the shafts and crossings with the railway tracks, for the future new safety equipment, which has to be performed simultaneously with the works on the track foundation, part of the works under Phase II? Could you please specify the extent to which such works need to be performed? Answer Refer to the answer to question 23.

Question 77 Should the delivery of electric heating for the turnouts be included in the contestant's tenders? If so - will electric heating be delivered both for the new and for the regenerated turnouts? Answer Electric heating systems shall be delivered and implemented within the scope of the Contract only for the turnouts on the main track(s) within the stations.

Question 78 In Volume 4, TWC 10 - Overhead catenary system and associated equipment are included items „Supply of Overhead Catenary Maintenance Vehicles (CMV)" and „Supply of equipment for catenary cable wear-and-tear control to be installed on CMV's". Are these two items to be performed by the Contractor for Phase II? If the answer is positive - to what extent?

14 Answer The supply of catenary maintenance vehicles and equipment shall not be included in the scope of the present contract. Therefore, in Volume 4, page 64, the bullets "Supply of Overhead Catenary Maintenance Vehicles (CMV)" and "Supply of equipment for catenary cable wear- and-tear control to be installed on CMV's" shall be deleted in their entirety.

Question 79 Reference Demolition of existing bridges. Vol 3, part 2, The Tender Documents state, that the demolition of the existing track page 8 including substructures ie. bridges, culverts, embankments, recultivation etc. form part of the Contractors scope of work. In order to estimate the demolition of existing structures we need the drawings of the existing structures. Please provide a list of all structures you want to be demolished and state the extent of demolition ie. excluding or including the foundations. Furthermore, in the case of existing overpasses to be demolished you need to clarify who has to remove the embankments of the overpasses and who has to rebuild the existing road in order to enable the traffic to cross the previous railway line. It is also a question to which extend the backfill of a cut is to be executed to allow the road traffic to cross the previous railway line. To what extend to you want culverts and underpasses to be demolished and how do you expect the rebuilding of for example rivers and roads? Answer Refer to the answers to questions 15 and 30 above.

Question 80 Does the Contractor need to pay a fee/tole to run on the existing Bulgarian railway for the purpose of this project? If there are different cases, could you specify? Answer The Contractor shall not pay any infrastructure taxes for his railbound vehicles when they work or move within the site. However, when travelling outside the construction site, infrastructure taxes are due for the traffic of these vehicles. Normally such taxes are calculated within the rates of the railway operators. In any cases the provisions of the Law on the Railway Transport shall be observed.

Question 81 Does the Contractor have to dismantle the entire existing track from Parvomai to Greek border, even if it does not merge with the layout of the new track to be laid? Answer

Question 82 In « Volume 5, Stations & Halts, drawing nr.27 », what is the dotted blue line (320 km to be dismantled) in Svilengrad station? Answer The line on the drawing as referred to in the question indicates an existing siding. It shall be dismantled.

Answer In order to understand the question assumption has been made that it refers to the scope of the electrification works in Simeonovgrad station and in Harmanli station. Question 84 Are the sidings tracks, for instance the S49 tracks, second hand and brand new, to be welded or fishplated? (NB: second hand S49 is already drilled at its end). Answer All the sidings to be implemented with S49 rails shall not be welded.

Question 85 At Dimitrovgrad station, there are two turnouts tg 1:12 (nr. 14 and nr. 16), in "CD, Volume 5, Switches specification" and also in "Volume 5 - Stations & Halts, drawing nr.8") with UIC profile. However, there is no reference to these two turnouts tg 1:12 in "Volume 3, Part 3 - Technical specifications, art. 14.1". Could you clarify? Answer The turnouts No. 14 and No. 16 in the station of Dimitrovgrad shall be designed and implemented as UIC60 1:9 R300.

Question 86 At Dimitrovgrad station, in south direction of turnouts nr.46 and nr.48, could you specify the km of the end of Contractor's scope regarding the reconstruction works (blue turquoise tine)?

16 Answer The question is not clear, because in Dimitrovgrad station there are no turnouts with numbers 46 or 48.

Question 87 At Dimitrovgrad station, could you explain how does end the main siding track (red track UIC 60) at km 234+700? Answer The track as referred in the question will be used as eventual future doubling of the line. Within the scope of the present Contract it shall be designed and constructed until km 234+700 and shall end with a buffer stop (dead-end siding).

Question 88 In "Volume 5 - Part 2 - Longitudinal Profile", at five (5) crossing points between existing track and new track we did not find some information about level of existing track "Elev./Dist. - existing railways", and notably at the following km points: 267+910, 235+109, 236+588, 237+005 and 237+592. Please, could you give us the information? Answer The elevation of the existing railway track is as follows: km 267+910 – elevation 74.90 km 235+109 – elevation 119.25 km 236+588 – elevation 104.18 km 237+005 – elevation 100.43 km 237+592 – elevation 96.89 The above elevation values are indicative only.

Question 89 At the approximate km 298 and 299, please, could you specify at which km point has the green track to end? Answer It is clear that the track as referred in the question shall be the new part of the line from Svilengrad to the Greek border.

Question 90 Could you explain why the red track is ending as indicated at km 298+800? Indeed, we do not understand the purpose of this proposal. Answer The track as referred to in the question will be used as eventual future doubling of the line from Svilengrad to the Turkish border. Within the scope of the present Contract it shall be

17 designed and constructed until km 298+800 and shall end with a buffer stop (dead-end siding).

Question 91 According to « Volume 3, part 2, articles 4.1.8, page 7 of 15 », please, could you clarify what is the scope of works between Svilengrad station and Turkish border. For now, we understood that the scope has to be defined by the contractor himself. If it is really the case, could you tell us what will be the criteria to evaluate and compare the offers? If you have any idea about the scope of works, why not to give this guide-line in order to compare similar proposal from the competitors? Answer Refer to the answer to question 19.

Question 92 Could you clarify definition of track components (type of rails, new or second hand components, etc...) between Svilengrad and Turkish and also between Svilengrad and Greek borders? Answer Refer to the answer to question 19.

Question 93 In Lyubinets station, at km 286+900, there is an industrial line needing reconstruction. At which km does the scope of works end? Answer The reconstruction works shall be implemented up to the end of the turnout. Then smooth connection to the industrial branch shall be arranged.

Question 94 Generally, what is the meaning of the "needing reconstruction" scope (blue turquoise line)? Answer In general the tracks marked as "needing reconstruction" shall be repositioned and renewed. As explicitly said in the Tender Dossier this is a Design-Build Contract and the Tenderer himself shall, in accordance with the provisions as in the Tender Documents, make all investigations/studies and obtain all additional information he considers appropriate for preparing his tender.

Question 95 Ref Required Time for Completion is 37 months for the Signalling Contract Contractual and 39 months for Infrastructure Contract. Construction and T&C

Question 96 Ref Acceptance of intermediate integration tests and of Line sections obviously Contractual requires availability of Electrical Motorized Units. Please confirm whether any EMUs delivery schedule is already anticipated. Answer The information required in the question is not related in any way to the present Tender procedure. Such information is available at the railway operators acting in Bulgaria at present. In any case the Contractor, at his own costs, shall arrange for any suitable vehicles to be used for the performance of all the tests as indicated in the Tender Dossier.

Question 97 Ref Volume 3 technical specification part 5 §13.10 mentions a 12 months Trial Running, and in Part 6 § 4.8, a duration of 15 days Test Running is Contractual mentioned. Please clarify whether these both periods are refering to the Tests after Completion following the Taking Over (according to FIDIC Clause 12) and thanks to consequently clarify the duration. Answer The trial run shall be 15 days and shall be in accordance with Volume 2, Section 2. General Conditions, Clause 12. "Test after Completion" of the Contract Conditions.

Question 98 Ref In Appendix to tender the Defects Notification Period is required to be 365 days, starting from the Provisional Acceptance of the Works (=Taking Over according to the FIDIC Clause 10). In Glossary Volume 1 Section 6. Contractual the Execution Period is required to be 18 months after the Provisional Acceptance. Please clarify what are Contractor's obligations during the 6 months beyond the DNP ? Answer The Defects Notification Period (DNP) shall be governed by the General Conditions of Contract (GCC), as amended by the Particular Conditions of Contract (PCC), namely Sub- clause 1.1.3.7, Clause 10 and Clause 11. The period is calculated from the date on which the

Why is the pedestrian subway approximately 330m away from the halt and why is the drawing different to the Technical Specification. Answer The new Harmanli-Central halt shall be at km 269+650 (old km). The new pedestrian underpass shall be at 269+980 (old km). The appropriate positions as in Volume 3 are in accordance with the new kilometrage marks.

It is not obvious to locate new motorized turnouts Please indicate the line KPs where the old and new turnouts should be motorized. Answer - All the new turnouts to be supplied and installed within the scope of the Contract shall be with turnout motors. The types and the parameters of the motors shall be proposed by the Contractor, subject to the approval procedures and in observation of the requirements as included in the Contract. The existing turnouts to be reused shall be equipped by the Contractor with the existing motors (after the relevant repair/rehabilitation). - All turnouts within the scope of the Contract shall be with motors.

Your answer was very clear, indicating that there will be no changes in the technical selection criteria, in accordance with article 5.3.3 of PRAG. You also mentioned that this position would be confirmed in writing to all participants. We understand that an eligible candidate (sole of in a consortium) should have performed at least three projects which include simultaneously civil works, track works and electrification works. These, at least three projects, should also have been executed on a Design & Built basis, as it is the case on the project in reference. Is our understanding correct? If your answer is negative, we kindly ask you to provide us with clear and detailed details on the term "Similar Nature". Answer In order to answer to the question assumption has been made that it refers to the Mandatory Information meeting held on 9th March 2007 in compliance with the Tender procedure. Question 208 Will a reconstruction of the relay interlocking system in Dimitrovgrad station be necessary due to the works that have to be performed during this Second Phase of the Project? Answer Refer to the answer to question 23.

Question 212 From the Technical specification it doesn't become clear whether the adoption of the approved catenary construction for the First Phase is advisable or not during the tender preparation for the Second Phase of this Project. With regard to this we shall need some clarifications to the following issues: - Does the Employer have a different vision for the contact wire height above the level of the rail head from the one quoted in "Technical Specification for operational compatibility for "Energy" subsystem" - Attachment No. 4 to art. 5, item 1 from Ordinance No. 57? In the TD, Volume 3 Technical Specification, Part 4 Design of Electrification, item 16.5.5.(3) is stated: "The design nominal contact wire height for Plovdiv to Svilengrad tine shall be confirmed to the Contractor upon confirmation of the rolling stock(s) and/or the pantograph(s) details" - Will it be possible to use the power simulation for the First Phase of the Project - Krumovo - if it already belongs to the Employer or should be envisaged costs for performing a new one? In the TD, Volume 3 Technical Specification, Part 4 Design of Electrification, item 16.5.2.(2) is written: "The interactive dynamic performance of the OCLS and the pantograph systems shall be simulated in order to anticipate the dynamic

46 performance of the OCLS with various introduced characteristics of design." and also in TD, Volume 3 Technical Specification, Part 4 Design of Electrification, item 16.9.1.(3): "As part of power simulation and system dynamic validation the Contractor shall select and propose a suitable contact wire (see contact wire material and wear) to satisfy all mechanical and electrical design and other project requirements specified in this document" Answer The contact wire height shall be in accordance with the provisions of Regulation No. 57 of 9th June 2004 issued by the Ministry of Transport and Communications, subject to the approval procedures and in observation of the requirements as included in the Contract. The power simulation for Phase I of the project shall be submitted to the Contractor after the signing of the Contract. Notwithstanding that, the Contractor shall comply with the relevant provisions as in Volume 3. Technical specifications and shall perform power simulations for the Dimitrovgrad – Turkish/Greek borders line, subject to the approval procedures and in observation of the requirements as included in the Contract.

Question 213 Is it necessary for the energy transfer in the catenary between Bulgaria and Turkey to be registered? Should in regard to this be planned additional equipment and if yes - please specify where? Answer It is explicitly stated in Volume 3, Part 4. Design of electrification, item 15.5.5.1.(2) that "The sectional post shall be assembled with a current measuring transformer to read the transmitted energy between the two countries."

Question 217 According to the Tender documents, volume 1 (Instructions to tenderers), paragraph 4.2.2.3 (Technical and Professional capacity), subparagraph d) the Lead Party must have the plant and equipment (either owned or leased/hired) necessary to enable him to carry out at least 50 % of the contract by himself. Does above-mentioned subparagraph mean that the Lead Party must have the proportion of responsibility in Joint Venture/Consortium at least 50 % ? Question 219 In case that the amounts mentioned in the originals of tenderer's documents are not in EURO what currency exchange rate should be applied for conversion of foreign currency into EURO? Answer As explicitly stated in the Volume 1. Instructions to Tenderers, item 16. Currencies of Tender and Payment, "The currency of the tender is the Euro. All sums in the Breakdown of the Overall Price, the questionnaire and other documents must be expressed in Euro, with the exception of the originals of bank and annual financial statements." It is up to the Tenderer to decide what conversion rate to apply, however the Tenderer shall indicate this in the documents.

Vol. 4, part 4, Vol 5, part 4, drawing No. 87 shows the Coffer Culvert to be 8,20 m drawing No. 87 long. Parallel to the 2 railway lines are further 5 railway lines planed. Please clarify whether you want the coffer culvert to cross these further railway lines as well, or if not, please explain the purpose of the coffer culvert. Which document of the Tender documents has priority if such discrepancies occur Answer The culvert as referred to in the question shall cross all the tracks and shall ensure the dewatering of the station area.

Question 223 Reference Railway bridge km 297+466: Vol 5 Part 01 Vol 5 Part 01 drwg. no. 55 shows a bridge in plan with 1 old and 1 new drwg. no. 55 track.

49 Vol. 5 Part 04 drwg. no. 77 shows a cross section of this bridge with 1 track only. Furthermore, Vol 5 Part 01 drwg. no. 55 also shows a new single railway line in green. Therefore this bridge ought to be designed to take 2 or 3 tracks. Please clarify how many tracks will cross this bridge and at what level, i. e. as mentioned before, we need cross-sections. Answer The railway bridge as referred to in the question shall be for 3 tracks.

Question 224 Reference Possessions Vol 3, part 7 Vol 3, part 7 page 2. Here it is mentioned, that possession are possible page 2 varying up to 6 hours. It is also mentioned that alternative transport for passengers has to be provided at the Contractor's cost. This is also valid for possessions of longer durations and line closures. 1. Please note that temporary bridges have to be installed in order to maintain the rail traffic. For the installation and removal of these temporary bridges possessions longer than 6 hours are necessary. Please confirm that these possessions will be possible. 2. Please provide the necessary required analysis and the permissible values. Answer As explicitly said in the Tender Dossier this is a Design-Build Contract. It is for the Contractor to make the appropriate assumptions/calculations in his design (subject to the approval procedures and in observation of the requirements as included in the Contract) for all the elements included in the scope of the Contract (including the noise barriers) in accordance with the standards and the regulations in force.
