SUPPLEMENTARY DECISION to the partial environmental protection consent

1. 2. Point II of the partial environmental protection consent shall be added an Point 13 that shall read as follows: 13. Additional conditions during the construction for the Beka Landscape Park section: - the construction of access roads, foundations and bridges within the scope of project implementation for acquiring the building permit and at the implementation of works for the construction of the second track of the railway line and at the construction of access roads on sections where the tracks cross the Glinš čica brook as well as on sections where tracks cross the influxes of the Glinš čica brook must be implemented without intervening in embankments and the riverbeds of the Glinš čica brook and its influxes; - no waste water may be flown in the Glinš čica brook riverbed and its influxes; - the project solutions from the Study for the implementation of measures for the prevention of Glinš čica area pollution must be considered at the preparation of the project for the acquisition of the building permit for preventing the pollution of watercourses and the destruction of water and riparian world on the area of the Beka Landscape Park, i.e. except in the parts that envisage the interventions in the Glinš čica brook influxes; - bridging structures across the Glinš čica brook with the railway line must be designed in such manner that the construction functions as an appropriate noise protection.

3. No costs arise from this procedure.

Explanation

The Slovenian Environment Agency which as a body within the Ministry of the Environment and Spatial Planning implements environment protection tasks (hereinafter referred to as the addressed authority) on 15 February 2012 received an application for the intervention of constructing the second track of the Diva ča–Koper railway line from the carrier of the planned intervention, i.e. the Ministry of Infrastructure and Spatial Planning, Railways and Cableways Directorate, Langusova ulica 4, 1535 Ljubljana, which is according to the minister's authority represented by DRI upravljanje investicij, Družba za razvoj infrastrukture d.o.o., Kotnikova 40, 1000 Ljubljana (hereinafter referred to as the carrier of the planned intervention).

On 13 February 2014 the addressed authority issued the Partial environmental protection consent no. 35402- 2/2012-96 (hereinafter referred to as the partial environmental protection consent), where land plots where the intervention will be implemented and for which the partial environmental protection consent was issued, are indicated under Point I. Furthermore, Point II indicates the conditions of the issue of the environmental protection consent during construction; Point III defines the conditions during operations. The issue of the partial environmental protection consent also determines that the carrier of the intended intervention received the nature protection consent which is shown in Point IV of the operative part. Point V of the operative part determines that the supplementary decision will determine the part of the claim referring to the issue of the environmental protection consent for the construction of the second track of the Diva ča–Koper railway line on the area of the Beka Landscape Park. Furthermore, Point VI defines the termination of the validity of the 3 environmental protection consent, Point VII determines the costs.

The purpose of the supplementary decision is to supplement the partial environmental protection consent no. 35402-2/2012-96 of 13 February 2014, where the addressed authority decided only on the part of the route of the second track of the Diva ča–Koper railway line and did not decide on all claims that had been lodged with the application for the issue of the environmental protection consent for the planned intervention.

The description of the planned intervention on the Beka Landscape Park area (hereinafter referred to as the Glinš čica valley)

The organisation of the construction site for the construction of T1 and T2 tunnels as well as two bridges is envisaged in the Glinš čica valley. Constructions sites are envisaged on both portals, the platform under the Mihele area will be partially used for the construction site needs. The following objects and containers are envisaged on the construction site of the T1 tunnel platform, i.e. staff room, dining room, first aid room and wardrobe, temporary area of intake of the excavated material and construction material, toilets, ventilation station, oil separator and sedimentation basin as well as temporary dry transformer station. The following objects and containers are envisaged on the construction site of the T2 tunnel platform, i.e. staff room, first aid room and wardrobe, temporary area of intake of the excavated material and construction material, toilets, ventilation station, oil separator and sedimentation basin, temporary dry transformer station, explosives warehouse and carpentry workshop. On the construction site at the Mihele area, the following objects will be arranged: temporary area of intake of excavated material and construction material, concrete plant, staff containers, first aid room, wardrobe, fuels and lubricants warehouse, dining room, car park for machinery, washing platform with a sedimentation basin and oil separator, fuel pumping site with a sedimentation basin and oil separator (made from concrete), jaw crusher for material transport and temporary dry transformer station.

Road T-1b2 that is connected to T-1b1 and temporary T1c construction road are envisaged in the Glinš čica valley. Roads will be built during the railway line construction and will also function after the construction is concluded. The T-1c road is an exception, since it will be removed after the construction finishes, the area will be recultivated. The T-1b1 road is a connecting road between the –Klanec local road and the T-1b2 road with the temporary landfill of construction waste. The road is 2.900 m in length. It consists of an asphalt carriageway of 3.00 m, a shoulder of 0.50 m, a gutter of 0.50 m and a berm of 0.50 m. In passing places, the carriageway is 3.00 m +2.00 m with a shoulder of 0.50 m, a gutter of 0.50 m and a berm of 0.50 m. The T-1b2 road diverges from this road. After the completion of works, the road will be used for maintenance access and as an emergency route for tunnel rescues, as well as a footpath and cycleway. The road will also serve as a firebreak. The T-1b2 road enables access to the platform at the T1 tunnel exit portal, and connecting, together with the T-1b1 road, the platform with Kozina. The length of the road is 1,240 m. It consists of an asphalt carriageway of 3.00 m, a shoulder of 1.00 m, a gutter of 0.50 m and a berm of 0.50 m. The road leads to a junction with the T-1b1 road. The T-1c temporary construction road has 4 m transverse profile and is 625 m long. The T-1c temporary construction road will be used for accessing the locations of supporting permanent and temporary pillars and side abutments of the support of the bridge in the Glinš čica valley, as well as for accessing the location of the construction of the supporting wall between the bridges. After the mentioned objects will be implemented, the temporary construction road will no longer be required, since the construction transport between the south portal of the T1 tunnel and the north T2 tunnel will be relocated to the built bridges. The design of the bridges across Glinš čica envisages the implementation of a maintenance road across bridges, which will be used for construction transport during the tunnel construction. When the bridges in the Glinš čica valley will be built, the T-1c road will be terminated and the original condition will be restored. The temporary T-1c construction road will not be used to transport excavated and other materials as well as machinery at the construction of tunnels, since separate access roads will be implemented for accessing each tunnel portal in the Glinš čica valley.

The following objects will be built to bridge the Glinš čica valley: the T1 gallery (13.0 m long), Glinš čica 1 bridge (74.0 m long), Glinš čica gallery (41.0 m long), Glinš čica 2 bridge (104.0 m long), T2 gallery (16.25 m long). The envisaged bridging solution encompasses the bridging of the Glinš čica with an object 26 m above the ground, 74 m long and 6.6 m wide, the Glinš čica influx will be bridged with an object 19 m above the ground, 104 m long and 6.6 m wide. The entire object is a closed box construction that entails: the gallery in front of the T1 tunnel portal (13 m long) to which the bridge across the Glinš čica is connected (74 m long), this is followed by the Glinš čica gallery with a supporting wall (41 m long), a bridge across the Glinš čica influx (104 m long) and the gallery in front of the T2 tunnel portal (16.26 m long).

The following impacts will be possible during construction: - When interventions will be made in the Glinš čica riverbed and its influxes, the value of suspended substances in water could increase. There is also a possibility of pollution caused by concrete sewage and hazardous substances. The mentioned facts can have a negative impact on all water organisms or could lead to a kill of individual specimens near the location of the intervention. In the event of significant pollution, an impact on the organisms downstream the Glinš čica could be detected; - The construction of all facilities on the hills of the Glinš čica valley (access roads, support, temporary pillars, supporting walls, construction platforms etc.) can cause slides of hills and the accumulation of material in the Glinš čica brook and its influxes, causing an increase in the value of suspended substances in water and a negative impact on aquatic organisms. Slides of excavated area and construction material are also possible during construction works. If the construction material, which would slide in the watercourse, would contain toxic 5 substances, this could cause major negative impacts on aquatic organisms, also kill off organisms; - The envisaged construction of the concrete plant above the Glinš čica valley could cause leakage of concrete sewage in the water stream, if inappropriate technology would be selected or if works would be implemented negligently. Such sewage is toxic for aquatic organisms. The operations of the concrete plant would additionally increase the burdens on the environment due to noise in the valley; if the construction mechanisation is inappropriately maintained, dangerous substances (e.g. residues of concrete, oil, lubricants) could be irrigated in the water streams from accessible roads (especially during rainfall); - The impact on flora and fauna on the Glinš čica valley area is also possible due to irregular depositing of construction waste, e.g. if puddles, depressions, gutters are covered with material or if ground texture changes in any other way; - the noise at the construction site (Mihele, construction sites on platforms in front of T1 and T2 tunnels) as well as heavy trucks on the road (impact on birds, mammals and bats) will also be a great disturbance besides the direct impacts on the entire fauna; - light pollution could also negatively impact the fauna of the wider area, presenting a disturbance in the natural environment, especially for butterflies, bats, night birds and other animals, active at night. - Environmental and other accidents could emerge during preparatory and construction works due to: - spillage of fuels and lubricants from construction machinery and transport vehicles; - spillage at transport, storage or pouring fuels from one tank to another; - spillage, wastage or scattering of stored or waste fuels, lubricants and other substances as well as their packaging at the maintenance of mechanisation and vehicles; - accidents at transport or storage of construction material and their packaging that contains hazardous substances.

During operations, easy access by cars on roads in the Glinš čica valley, which also function after the construction finishes, will be enabled to what has so far been a difficultly accessible area, and this will have an indirect negative impact on the entire Glinš čica valley.

General Administrative Procedure Act (Official Gazette of the Republic of Slovenia, no. 224/06-ZUP UPB2, 105/206-ZUS-1, 126/207, 65/08, 8/2010 and 82/13, hereinafter referred to as the ZUP) in the first paragraph of Article 220 stipulates that if the competent authority does not issue a decision on all issues subject to the procedure, a special decision can be issued upon the client's proposal or ex officio, i.e. on issues that were not included in the initially issued decision (supplementary decision). The second paragraph of the same article determines if all facts relevant for decision making were established in the procedure, the supplementary decision can be issued without the new finding procedure.

When reviewing the Ordinance amending the Ordinance designating natural sites of special interest and cultural monuments in the area of the Sežana Municipality (Official Gazette of the Republic of Slovenia, no. 26/14), the addressed authority has found that the construction and operations of the second track of the Diva ča–Koper railway line is permitted in the Beka Landscape Park. Based on the mentioned facts, a supplementary decision can be issued and a decision can be made also for this part of the claim.

After reviewing the documentation, the addressed authority has found that the assessment of the impacts of the intended intervention on land plots mentioned under Point 1 of the operative part of this supplementary decision was made in the finding procedure of the issue of the partial environmental protection consent, therefore, a new finding procedure is not necessary.

After assessing the impacts on the environment, it was found that the intervention is acceptable under certain conditions during construction and during operations also on the mentioned land plots, therefore a new assessment of impacts of the intended intervention on the environment is not necessary according to the opinion of the addressed authority, however, additional conditions are envisaged to prevent the above mentioned potential impacts caused by the interventions in the Glinš čica valley besides the conditions mentioned in the partial environmental protection consent, i.e.: - No interventions are permitted and also no waste water can be drained in the riverbed and the embankments of the Glinš čica and its influxes. With the purpose of implementing the measures for pollution prevention on the Glinš čica area, a special Study for the implementation of measures for the prevention of Glinš čica area pollution was prepared under no. 1290-13 SP in June 2013 and supplemented in August 2013, September 2013 and April 2014 by Aquarius d.o.o., Cesta Andreja Bitenca 68, 1000 Ljubljana (hereinafter referred to as the Study), which the project engineer must consider for acquiring the building permit, except in the parts that envisage the interventions in the influxes to the Glinš čica. The Study also envisages the intervention in the no named left influxes of Glinš čica, i.e. it envisages the regulation of the box culvert, bottom sill, coarse raked bars for catching debris and the regulation in the shape of a stone sill. Considering the fact that this intervention could pollute the Glinš čica, the addressed authority decided as is determined in the first line of Point 3 of this decision; - The route of the railway line across the Glinš čica valley must run in closed concrete construction that will prevent the derailment of the trainset during the operations of the railway line and will at the same time function 6 as anti-noise protection.

If the above mentioned mitigation measures will be implemented, there will be no pollution of the Glinš čica river and no hazard to the water and waterside area during construction and operation.

Considering the mentioned facts, the addressed authority issued an environmental protection consent also for the following intervention: the construction of the section of the second track of the Diva ča–Koper railway line on the area of the Beka Landscape Park under the construction conditions in the period as determined under Points 1 and 2 of the operative part of this decision.

In accordance with the provisions of the fifth paragraph of Article 213 and in relation to Article 118 of ZUP, the issuing of this Decision also anticipates the fixing of costs. With regard to the fact that no costs arose from this procedure, the costs were determined as follows from Point 5 of this Decision.

Notification of the right to legal appeal: an appeal can be made against this Decision at the Ministry of the Environment and Spatial Planning, Dunajska cesta 47, 1000 Ljubljana, within 15 days from the notification of this Decision. The appeal can be made in writing or by an oral deposition entered in the record at the Ministry of the Environment and Spatial Planning, Environmental Agency of the Republic of Slovenia, Vojkova cesta 1b, 1102 Ljubljana. An administrative fee of EUR 18.12 is to be paid upon the appeal. The administrative fee is paid in cash or electronic money or other valid payment instrument and the appropriate certificate is submitted at payment. The administrative fee for the appeal can be paid to the public administration account: "Administrative fees - state fees", account no. 0110 6100 0315 637 with reference no. 11 23345-7111002-00435414.
