Abstract This work is based primarily on the register of the abbatial peculiar of Cerisy in Normandy (1314-1486), the Act book of the Consistory court of the diocese of Rochester (1347-1348) and the visitation returns for the diocese of Hereford from 1397. Material is also taken from the civil register of the officiality of Paris (1384-1387) and visitation returns for the diocese of Barcelona from 1303. All the sources highlight several aspects of the disciplinary concerns of the church. They are also valuable sources both for historians of crime and social historians in general. Their potential is great and in the context of this sudy it has only been slightly exploited in the case of the Hereford visitation returns. Further work on this particular document would be greatly enhanced by the production of a new edition of the text complete with the necessary critical apparatus and including the omissions made by the original editor. The material relating to violence within the Cerisy register is of particular significance. The cases of physical assault are striking both for their exceptionally large numbers - for a church court - and their descriptions of the nature and effect of the injuries sustained by victims. These are outlined with care and increasingly graphic detail. Certain themes stand out. Violence was very much a masculine preserve. It was characteristically spontaneous, generally without motive, and often of a petty nature. Most men appear only once in the court record either as agents or victims of violence. Rape was very much a crime of violence and proved to be an important factor in motivating attacks on women. Women were also particularly vulnerable to domestic violence. The other business of all three main sources is very much as to be expected for the 'bawdy courts'. At certain times, crimes against sexual morality predominate at Cerisy, as they do generally at Rochester. The Hereford visitation was also primarily concerned with sexual morality, but this material has not been utilised in the course of this study. Fornication was more common than adultery, and the two courts adhered to a canon-legal hierarchy of sin in determining the appropriate punishments. Adultery was considered to be a more heinous offence than simple fornication. Rape was usually placed at the top of the hierarchy. The court employed different approaches in punishing these crimes. At Rochester public penitential beatings were the order of the day, while at Cerisy, pecuniary penalties were used. This perhaps represents the general commutation of penance. Material from Cerisy, Hereford and Rochester sheds light on the church's desire to control and regulate the process whereby marriages were formed and lay habits in this area. Instance litigation, ex officio prosecutions for clandestinity and informal separations, point to a view among certain of the laity that marriage was a private contract rather than an indissoluble sacrament. The church itself sought to promote individual consent, but was willing to sacrifice the principle under certain circumstances. The traditional narrative of French literary history describes the vernacular canon as built on the imitation of the ancients. However, this dissertation demonstrates that Early Modern French canon formation also depends, to a startling extent, on claims of inter-vernacular literary theft. Throughout the sixteenth and seventeenth centuries, a central preoccupation of French authors, translators, and literary theorists was the repatriation of the romance genre. Romance was portrayed as a cornerstone of French literary patrimony that Italian and Spanish authors had stolen. The repatriation of individual romance texts entailed a skillful co-opting of the language of humanist philology, alongside practices of translation and continuation usually associated with the medieval period. By looking at romance translation as part of a project of national canon formation, this dissertation sheds new light on the role that chivalric romance plays in national and international politics.

Morgan Loyola College Berta ai piedi grandi is one of the few chansons de geste with a female in the title—five out of the 86-100 normally listed in chanson de geste repertoires. She also shares a title; of the six chansons de geste listed with two characters as a title, Berta e Milone is one.2 In St. Mark’s Ms. Fr. 13 (henceforth, Geste Francor), a manuscript compilation probably dating to the first half of the fourteenth century, Berta occupies 1753 lines of verse (out of 17,067 total), about 10%; together with Berta e Milone, where the younger Berta is a major character, a female figure dominates 13% of the manuscript text. A female figure this conspicuous has, as might be expected, drawn critical attention.3 Critics reading Berta have worked primarily with Adenet le Roi’s late thirteenth-century Old French version, Berte aus grans piés. They have concentrated on two issues: 1) the historicity of the figure (where she came from, who she really is) and 2) her literary relationship with Charlemagne. In comparing various versions of the Berta story (which exist in French, Latin, Spanish and German as well as Italian), different solutions to the two issues have been proposed, but without a conclusive result. Recently, Krauss’s volume (translated into Italian in 1980) has suggested a third issue: the socio-cultural meaning of differences between the Geste Francor Berta poem and the Old French version. Several historical studies provide useful background to the literary texts of Berta .

The Renaissance produced many tracts and descriptions dealing with Mos- lems, such as those by Ogier de Busbecq and Phillipe du Fresne-Canaye,' which remain the main source for gauging western attitudes toward Moslems, but these can be supplemented by popular literature which reflects, forms, and gives classic expression to the ideas and stereotypes of a culture.' This study examines and compares the image.of the Moslem in the three greatest epics of the sixteenth century, Ariosto's Orlando furioso, Tasso's Gerusalemme liberata, and Camoens's Os Lusiadas." All three epics enjoyed wide popularity and present Christian heroes struggling against Moslem enemies. Ludovico Ariosto, courtier to the d'Este lords of Ferrara, first published Orlando furioso in 1516 but continued to polish and expand it until 1532. With 38,728 lines, it is the longest poem of the Renaissance, perhaps of west- ern literature, to attain wide popularity. It describes the defense of Paris by Charlemagne and his knights against the Moors of Spain and Africa. This was traditional material already developed by the medieval chansons de geste and by Orlando innamorato of Matteo Maria Boiardo, who preceded Ariosto as court poet at Ferrara.

Brodeur Doctor of Philosophy Department of History University of Toronto 2015 Abstract Medieval indulgences have long had a troubled public image, grounded in centuries of confessional discord. Were they simply a crass form of medieval religious commercialism and a spiritual fraud, as the reforming archbishop Cranmer charged in his 1543 appeal to raise funds for Henry VIII’s contributions against the Turks? Or were they perceived and used in a different manner? In his influential work, Indulgences in Late Medieval England: Passports to Paradise, R.N. Swanson offered fresh arguments for the centrality and popularity of indulgences in the devotional landscape of medieval England, and thoroughly documented the doctrinal development and administrative apparatus that grew up around indulgences. How they functioned within the English social and devotional landscape, particularly at the local level, is the focus of this thesis. Through an investigation of published episcopal registers, my thesis explores the social impact of indulgences at the diocesan level by examining the context, aims, and social make up of the beneficiaries, as well as the spiritual and social expectations of the granting bishops. It first explores personal indulgences given to benefit individuals, specifically the deserving poor and ransomed captives, before examining indulgences ii given to local institutions, particularly hospitals and parishes. Throughout this study, I show that both lay people and bishops used indulgences to build, reinforce or maintain solidarity and social bonds between diverse groups.

Pounds Frontmatter More information A HISTORY OF THE ENGLISH PARISH Most writings on church history have been concerned mainly with church hierarchy, and with theology, liturgy and canon law. This book looks at the church ‘from below’, from the lowest stratum of its organisation – the parish – in which the church build- ing is seen as the parishioners’ handiwork and as a reflection of local popular culture. The book discusses in turn the origin and development of the system of precisely defined parishes, their function – in terms of economics and personnel – and the church fabric which embodied the aspirations of parishioners, who saw the church more as an expression of their cultural and social hopes than as the embodiment of their faith. The book ends with the failure of the parish to meet all its obligations – social, governmental and religious – from the late eighteenth century onwards. The book emphasises throughout that the parish had a dual function, secular and religious, becoming both the lowest level in the administrative structure of this country, and a unit for spiritual and pastoral care. These functions became increas- ingly incompatible, although the book ends on the brink of the final breakdown in the nineteenth century. N. J. G.
