Call to The regular meeting of the Sussex County Council was held Order on Tuesday, September 18, 1973 at 10:00 A. M. with the following members present:

The meeting was opened with the repeating of the Lord's Prayer and the Pledge of Allegiance to the Flag.

Department of the Army, Philadelphia District, Corps of Engineers. Re: Application by James M. Tunnell, Jr. for a Department of the Army permit to perform maintenance dredging and construct bulkheads and to fill areas in existing lagoons in Indian Landing, Sussex County, Delaware.

Department of the Army, Philadelphia District, Corps of Engineers. Re: Application by Roland A. Hudson for a Department of the Army permit to construct two bulkheads and a boat ramp in Pepper Creek at Holland Point, Dagsboro, Sussex County, Delaware.

Corres­ Robert H. Reed, Secretary of State of the State of Delaware. pondence Re: Requesting a private meeting with the Sussex County Cont. Council to discuss something being done to improve the Historic Sussex County Court House site in back of the Farmers Bank at 101 S. Bedford Street, Georgetown, Delaware. Mr. Conaway, County Administrator, and Mr. Henry, County Engineer, will investigate this and a meeting will be arranged by Mr. Conaway.

EPA Mr. Henry, County Engineer, reported on an article which appeared in the Evening Journal relating to EPA funds to the Greater Bethany Regional Sanitary District being with­ held if the Sussex County Council allows high density zoning to continue in the Delaware beach area. Mr. Henry's office has contacted the EPA and they answered they have received questions and inquiry from the News Journal. They have issued a statement that they were watching what was going on down here and that they would examine the situation as it related to the requirements of the Impact Statement. EPA did not imply a positive or negative outlook. Mr. David Snyder, Regional Administrator, Environmental Pro­ tection Agency, will be invited to meet with Mr. Henry, the Council and the Planning and Zoning Commission to get the concern of EPA and to get some understanding about a line of communication.

Solid Waste Mr. Henry, County Engineer, reported that the State Divi­ Regulations sion of Environmental Control is drawing up new solid waste regulations and he met with them on September 17, 1973 to review the first draft. The significant changes are that it will give the Environmental Control the authority over all landfills, where, previously, they only had control over household garbage that was dumped in the landfills. It will be required, in order to continue using landfills, that the landfills be sealed either through the use of clay or natural material or through synthetic lines and all the liquids that are generated be treated before they are discharged into any surface water. This will require studies of other methods or reduce our number of landfills and substitute some transfer stations. One of the requirements will be to install monitoring wells so that ground water in the vicinity of the landfills can be checked for contamination.

Meeting Mr. Conaway, County Administrator, reported on the meeting that he and Mr. Henry, County Engineer, attended in Kent County on September 17, 1973 regarding "garbage".

Bookmobile Mr. Sidwell, Finance Director, reported that the Bookmobile has been ordered and delivery will be in approximately six months.

Certificates Mr. Sidwell, Finance Director, reported that he had invested of Deposit $100,000.00 in Certificates of Deposit with the Farmers Bank for ninety days at 10~%. These funds are from this year's collections.

Pension Mr. Sidwell, Finance Director, reported that in studying Plan the pension plans that have been submitted, none have all of the features that he feels the County needs. He is, now, studying another phase of starting a Pension Plan which would be on a Trusteeship basis with banks. He will report on this at a later date.

Revenue Mr. Sidwell, Finance Director, submitted samples of our Sharing Revenue Sharing Grant froms for cities and towns to members of the Council.

Children's Mr. Sidwell, Finance Director, reported that he had received Bureau a letter from the Children's Bureau of Delaware requesting half of their appropriation in the amount of $6,000.00. This will be sent as an appropriation in the amount of $12,000.00 has previously been approved by the Council.

M 474 73 A Motion was made by Mr. Chandler, seconded by Mr. Benson, Calculators to authorize Mr. Sidwell, Finance Director, to purchase two calculators, one for the Planning and Zoning office and one for the Board of Assessment office, at a total cost of $590.00. Motion Adopted; 5 Yea.

Auction Mr. Conaway, County Administrator, reminded everyone that Sale the auction sale of excess equipment at the Airport will be this coming Saturday, September 22, 1973.

Off Shore Oil Mr. Conaway, County Administrator, reported that he will Drilling be attending the Off Shore Oil Drilling Hearing on October Hearing 12, 1973 in Ocean City, . Mr. William Green has said he will be glad to assist the County if he is in town on that date.

County Mr. Conaway, County Administrator, reported that letters Government inviting all Row Office Holders to participate in the two Days County Government Days have been sent.

Air Exec Mr. Conaway, County Administrator, reported that the meeting with the Air Exec representatives to discuss the necessary physical arrangements to begin air service by October 15 is being rescheduled. He will report on this at a later date.

Clean-up Mr. Conaway, County Administrator, reported that 4-H Clubs worked on Saturday, September 15, 1973 cleaning up various areas of the County.

North A meeting with Mr. Henry, County Engineer, the Council, and Coastal Area the Planning and Zoning Commission has been scheduled for Planning September 26, 1973 at 7:00 P. M. to discuss the North Coastal Jurisdiction Area Planning Jurisdiction.

Nanticoke Mr. Conaway, County Administrator, reported on the meeting Bridges with the Coast Guard that he and Mr. Hill attended on Tuesday, September 11, 1973 regarding the Nanticoke Bridges. As the Coast Guard sees no reason to revoke the permit given to Maryland to build the bridges at the low level, Mr.

Nanticoke Conaway suggested one of three possible choices of action. Bridges Cont. 1. Work with Maryland officials to get the bridges raised.

2. Go to Court to resolve the problem.

3. Prove that the bridges present a navigational hazard so that the permit will be revoked.

Invitation Walter Sherwin, Civil Defense Director, invited the Council to the Firemens monthly dinner meeting to be held in Gumboro on Tuesday, September 25, 1973 at 7:30 P. M.

Civil Walter Sherwin, Civil Defense Director, reported the Federal Defense Examiners were down on September 13, 1973 and all records Off ice were found to be in order.

Disaster Walter Sherwin, Civil Defense Director, reported that a new Plan disaster plan for the State of Delaware is being worked up by State, Federal, and County Directors.

Map for Walter Sherwin, Civil Defense Director, reported he will be Call Board receiving a new map of the towns of Sussex County which will be photographed and put on projectors for use in the Call Board.

M 476 73 A Motion was made by Mr. Chandler, seconded by Mr. Benson, Dewey Beach that the agreement between the Sussex County Council and Sanitary David Marine be signed for the purchase of land to be used Sewer & Water for Pumping Station No. 4 for the Dewey Beach Sanitary District Sewer and Water District at a cost of $16,250.00. (b) From the State Department of Natural Resources and Environmental Control that said building has a proper system for the disposal of sewage; and

(c) From the State Fire Marshal's Office that said building is in compliance with the requirements of the State Fire Code."

Action on this Proposal to Amend the Comprehensive Zoning Ordinance was deferred for two weeks to allow the Planning and Zoning Commission to give a recommendation.
