3.1 The tenderer should note that the sale and acceptance of the tender forms is online and opening of the bid shall take place online at Pusad in the office of Deputy Conservator of Forests, Pusad Division, Pusad. 3.2 The tender document containing terms and conditions covering qualification criterion, specifications of item, instructions to tenderers, as well as prescribed forms/ formats, can be downloaded by paying Rs. 590/- (Rupees Fife Hundred Ninety Only) online as Tender fee. Tender fee shall not be refunded in any circumstances. 3.3 The tender should be addressed to: Deputy Conservator of Forests Pusad Division Pusad Tq. Pusad Dist. 445 302. 3.4 Earnest money Deposit (EMD): Each tender must contain Earnest money Deposit of Rs. 4050/- (Rupees Four Thousand & Fifty Only) as prescribed by the e-tender facility of government of Maharashtra. If the tenderer is exempted from submitting EMD, it should be mentioned on original letterhead along with a copy of government resolution or order, and the firm must have registration with C.S.P.O., D.G.S. & D. or similar organization (please specify). Photocopy of valid registration certificate for the relevant item must be furnished in such cases. 3.5 The tenderers are encouraged to include a copy of the last income tax clearance certificate from the competent authority. 3.6 The tenderers are required to read carefully all Terms & Conditions of the tender, and submit the Tender after fixing the authorized representative’s signatures on each page as a token of acceptance. 3.7 Each page of the Tender including Technical & Price bid, Qualification Criteria, Information about the tenderer and all enclosures must be authenticated by affixing signature of an authorized signatory. 3.8 The tenderer must submit complete technical & Price Bid including qualification criteria and related documents/technical literature/ brochure duly attested along with EMD. Tenderers are advised to submit their tenders without waiting for the last date of tender submission in order to avoid any unforeseen circumstances.

3.9 All documents must be clear and readable. In absence of clarity of documents or any dispute over documents, the interpretation of the Deputy Conservator of Forests, Pusad Division, Pusad shall be treated as final. 3.10 All tenderers have to ensure proper delivery of the tender before the scheduled date & time as specified in this tender document. 3.11 Tenderers are at liberty to be present or authorize a representative to be present at the opening of tender on the date and time as specified in this form. In case the date of opening is declared a holiday subsequently, the same shall stand extended automatically to the next working day. 3.12 If the tenderer has any doubt about the meaning of any conditions or the specifications, it shall be represented before submitting the tender. 3.13 The tenderer must quote only one best suitable model in one tender. Separate tender must be submitted for each additional model proposed. 3.14 The Deputy Conservator of Forest Pusad keeps the right to select any tenderer on the ground of experience, the clients and other matters which can infuse confidence that selected tenderer can complete the order within the given time. 3.15 The conditions in the Purchase Procedure Rules and Purchase manual of the Government of Maharashtra, and relevant government resolutions and orders as amended till date shall be applicable and binding. 4. Specification of the Product and Scope of Work 4.1 This tender is issued for procurement of Purchase of Providing and Fixing Solar Light listed in the tender notice by the Deputy Conservator of Forest Pusad division Pusad (hereinafter referred to as Purchaser). The quantity of the items can be increased or decreased as per the requirement.

5. Qualification Criteria 5.1 The tenderer must be a registered Indian manufacturer or authorized Dealer/ Distributor of a manufacturer. Authorized Dealer/ Distributor should furnish current and valid authorization letter/ dealership certificate from original equipment manufacturer

mentioning this particular Tender in its authorization letter. The name of item should be clearly mentioned in the authorization letter. Tenders submitted by retailers or representatives of online dealers are liable to be rejected. 5.2 In case of a foreign manufacturer, the tenderer must furnish an undertaking that the goods are legally imported in the country. 5.3 The Tenderer should not have been debarred as supplier of the same or similar goods by Forest Department or any other Department of the Government of or any State Government. 5.4 The company should be registered under the service tax and CST department. 5.5 The tenderer must be a Indian manufacturer and / or authorized distributors / dealers of manufacturer. Authorized distributors should submit their valid and current authority letter. 5.6 The tenderer shall have adequate experience of successful supply and / or manufacture of Solar Light and service support in the past 3 years to Government departments. 5.7 The tender shall have necessary after sales service facilities with trained team of technicians for repairs and service of the cabins. Relevant details about the service team along with details of after sales service organization chart, location of service center, man power, qualification of technicians to be submitted along with the tender. 5.8 The tenderer shall have executed at least one order in the past 3 years with a Govt. / Semi Govt. organization worth Rs 10 Lakhs. 5.9 The tenderer must meet all the Qualification Criteria of the Tenderer as listed in Annexure- II, and non-adherence to the ‘Qualification Criteria’ shall make the tender liable to be rejected. 5.10 Preference will be given to Indian Manufacturer under the GOI “make in India” initiative

6. Bidding System 6.1 The bid shall consist of two separate parts. 1. Technical Bid 2. Price Bid 6.1.1 Technical Bid– Document Required a. EMD:-EMD should be paid online as per process available online on www.mahatenders.gov.in b. Scanned copy technical bid form duly filled. c. Scanned copy of current & valid authorization letter / dealership certificate form / original equipment manufacturer. d. Scanned copy of details about after sales & service supported network in this part of Maharashtra. e. Scanned copy of self certified copies of at least two purchase orders as per Annexure–II. f. Scanned copy of last income tax return. g. Scanned copy of sales tax / VAT clearance certificate or copy of application. h. Scanned copy of sales tax, CST, VAT registration details (Whichever is applicable) i. Scanned copy of technical specification of desired product & prescribed enclosures. j. Scanned copy of any supporting document to as per qualification criteria. (Annexure II) k. Scanned copy of GST registration Certificate. 6.1.2 Price Bid (Envelope No. 2) a. Price Bid offer to be submitted online in the form of BOQ. 6.2 Conditional offers may be rejected at the discretion of the Deputy Conservator of Forest, Pusad Division, Pusad on recommendation of the Bid Evaluation Committee Constituted for this purpose. 7. Technical Specification 7.1 The tenderer shall also submit the specification's compliance/ deviation report duly filled in and clearly bringing out the deviation from the specifications if any, in Annexure-I. 7.2 The tender without the desired documents/ information is liable to be rejected out rightly. No document/ information will be accepted after the due date.

7.3 The tenderer shall submit copies of rate contracts, if any, with any Government/semi government organizations for the quoted items. 7.4 Catalogue of the offered model must be submitted along with tender. 7.5 Submission of the Tender shall be considered as deemed guarantee for availability of spare parts and consumables for a period of minimum five years from the date of supply. 7.6 Deviations, if any, from the tender specifications, tender conditions, etc., must be clearly mentioned and indicated, wherever applicable, against the tender specifications. 8. Quoted Price 8.1 The rate must be quoted online. The tender is for two items. Combined price of four items will be considered for Financial Bid. No separate bids for each item will be entertained. 8.2 Rates should be quoted only for items fulfilling or having better specifications given in column marked ‘Features and Requirements’ in Annexure-I, and explained in terms & conditions, wherever applicable. 8.3 The prices quoted/ accepted will be binding till the complete supply is made. No increase in the price will be entertained in any case whatsoever till the completion of supply order or one year from the first supply order, whichever is later. 8.4 The rates should be quoted F.O.R. at the purchaser’s places at Pusad & city (Dist. Yavatmal) in Maharashtra. The quoted rate must include Custom Duty, Excise Duty, Transportation, Packing, Warranty, Forwarding, Loading-unloading, Transit Insurance, CST/VAT, Operational Trainings and other incidental charges & other statutory levies including local body tax (LBT) if applicable. 8.5 The tenderers shall be responsible to communicate and pass on the benefits due to Statutory/Budgetary reduction, if any, in Excise duty, Custom Duty and CST/VAT immediately after its notification. The purchaser shall be entitled to reduce the price unilaterally one week after such notification. The Supplier shall be bound to accept the reduced price from the date of such notifications.

8.6 The tenderers must ascertain the GST rate applicable to the purchaser, namely, Maharashtra Forest Department, and consider the same while filling up the Technical & Price Bid forms. 8.7 NA 8.8 In case of the products having same or similar specifications, the tenderer quoting the lowest rates will be given preference while placing the order. Considering exigencies and administrative demands for procuring the cabins, the purchasers reserve the right to procure the cabins from more than one tenderer. 8.9 The Price comparison shall be on the landed cost inclusive of all taxes, levies and incidental expenses considering all technical criteria are as per specification 9. Assurance of the Competitive Price 9.1 The rates submitted should be supported with the prevailing market rates/ price list of the items of the quoted specifications. In case the tenderer had supplied the store to any other government agency, the same shall be attached as the evidence for the prevailing market rates. 10. Security Deposit 10.1 The approved rates will be communicated through Speed post, fax or e-mail to the successful tenderer for submission of security deposit with individual purchaser. The successful tenderer will have to submit a security deposit / cum performance guarantee equivalent to 10% (ten percent) of value of the intended order from the concerned purchaser. The EMD deposited by the successful Tenderer will be adjusted against the security deposit to be furnished, and the balance amount of security deposit shall be submitted before issue of the order. The security deposit may be submitted in form of demand draft/pay order payable at head quarter of the Purchaser or the bank guarantee issued by any nationalized bank in favour of the purchaser. The supplier shall be responsible to ensure that the bank guarantee remains valid till expiry of the comprehensive warrantee period.

10.2 If the supplier desires to maintain the entire amount of security deposit in form of bank guarantee, the EMD shall be refundable on successful execution of all the supply orders and on submission of equivalent bank guarantee issued by any nationalized bank in favour of the Deputy Conservator of Forest Pusad Division Pusad. 10.3 Failure to supply the items on the quoted rates shall be considered a breach of agreement making the security deposit liable for forfeiture. 10.4 Any damage, compensation or other sums due from the supplier to the purchaser on any account whatsoever under the terms & conditions of this tender or subsequent agreement including supplements, if any, shall be liable to be deducted/ recovered from the Security Deposit. In the event of the Security Deposit being reduced by reason of such deductions, the supplier shall deposit equivalent amount in the form of DD / pay order of any nationalized bank payable at the head quarter of purchase in favour of the purchaser within 10 (ten) days of the receipt of intimation of such reduction. Failure to do so shall be considered a breach of agreement/ contract. 10.5 No interest shall be payable on the Security Deposit or the Earnest Money Deposit. 11. Delivery and Receipt 11.1 Time, date and place specified for delivery in the supply order shall be the essence of the agreement. The successful tenderer (hereinafter referred to as Supplier) shall arrange to supply the material within the stipulated time on receipt of the firm supply order(s). The supplier shall have no claim or right to alter the delivery schedule, and shall strictly adhere to schedule of delivery given in the supply order(s). Failure to abide by the delivery schedule shall be considered serious breach of agreement. 11.2 In exceptional circumstances, the purchaser may, at its discretion, revise the delivery schedule. 11.3 If the delivery is delayed beyond two weeks of the stipulated delivery, date the purchaser may purchase the goods elsewhere including from other tenderers, the entire or the remaining items on the supplier’s risk and cost. 11.4 All items/ goods/ materials supplied shall be new and of the best quality in every respect as per the specifications quoted in Technical & Price Bid form (Annexure-I). The

supplier shall be deemed to have carefully examined the condition/ specifications, etc., of the goods supplied. 11.5 The purchaser may consider the Supplier’s request to substitute goods/ materials having specifications better than the quoted specifications. However, such substitution shall be effective only after obtaining written concurrence from the purchaser. 11.6 On receipt of supply order, the Supplier shall inform the authorized officer of purchaser (under intimation to purchaser) the time at which the deliveries shall be made. The supplier shall obtain approved receipt (in duplicate) from the authorized consignee(s) & the purchaser for all the materials delivered. 11.7 No item shall be considered as delivered until it has been accepted after due inspection and a proper receipt granted. Further, no delivery shall be considered as complete until the full quantity of approved materials mentioned in the supply order has been supplied, and all the rejected materials have been removed. 11.8 The supplier shall be responsible for delivery of the material in good condition to the authorized consignee(s) of the purchaser at destination as indicated in the agreement supply order, and ensure proper packing of the materials for transport by rail/ road so as to prevent loss/damage/ deterioration in transit. The packing shall be sufficient to withstand, without limitation, rough handling during transit and exposure to extreme weather/ atmospheric conditions during transit and storage. 11.9 In the event of any loss, damage, breakage, leakage or any shortage found at the time of inspection/ checking of the goods/ materials by the purchaser or the Authorized Inspection Officer (including expert or inspection team), the supplier shall be liable to replace/ make good of such loss and shortage free of cost within the given time. If the supplier fails to do so, the purchaser shall be free to obtain the replacements at the supplier’s risk and cost from any other source. 11.10 Demurrage and/or Warf rage, if any, shall be on the supplier’s account. Purchaser shall not be liable for such charges. 12. Risks and Safe Custody of Goods

12.1 The goods/ material and every constituent part thereof, whether in possession or control of the authorized person of the supplier, his agents or with his servants, or with the carrier or at the site of the purchaser/consignee shall remain in every respect at the risk of the supplier till actual delivery (against proper receipt) to the purchaser at the destination given in the supply order. 12.2 Risk of the goods and responsibility of safe custody shall remain with the supplier until the goods are approved and accepted by the purchaser/ consignee after due inspection and approval receipt is given. 12.3 Purchaser shall not be responsible for safe custody of the materials rejected, disapproved or supplied in excess. 13. Testing and Inspection 13.1 The Authorized Inspection Officer (including expert or inspection team) of the purchaser will carry out inspection of the goods supplied to the purchaser/ authorized consignee(s) of the purchaser at the indicated site on receipt of the consignment. The Authorized Inspection Officer (including expert or inspection team) of the purchaser shall have the right to reject any goods not conforming/ inferior to the accepted specifications. The supplier must ensure presence of his representative at the time of the inspection. 14. Payment of the Bills 14.1 The supplier shall raise the bill / invoice in the name of the purchaser and present the bills to purchaser in duplicate along with the following documents: a. Receipt of goods/ material by the authorized consignee, duly signed and complete in all respects and countersigned by an officer not below the rank of Assistant Conservator of Forests. b. Inspection certificate issued by the Authorized Inspection Officer. c. Such other documents as may be specified in the tender/supply order. 14.2 The payments to Supplier shall be made by purchaser at the earliest after due adjustment of the deductibles/ recoveries through crossed Account Payee cheques or Demand Draft.

15. After Sales Services 15.1. The Tenderer shall provide the details of after Sales Services available in Maharashtra. 16. Warranty and Service & Support 16.1. The supplier will supply the goods on comprehensive warranty basis. If during the period, the purchaser finds the goods unsound, imperfect and defective, the supplier shall promptly replace the same free of cost and any expenses incurred by the purchaser / purchaser for such replacement shall be recoverable from the supplier. 16.2. All the material shall have the warranty for the period of minimum one year against any manufacturing defect for equipment from the date of supply. 16.3. The Supplier shall provide One Year Comprehensive Warrantee from the date of supply of the goods and accessories. 16.4. The Supplier shall arrange supply of products within the stipulated time at the place of destination from the date of order. 16.5. If any product rejected by the purchaser at the time of taking delivery with valid technical reason then article must be replaced/removed by the supplier from the purchaser within 15 days of the date of information for replacement or removal. 16.6. The tenderer shall have to provide prompt after sales support as per the following: The supplier shall repair/replace the equipment/component/ sub-component/ battery within seven working days, and shall ensure that all the goods supplied by him remain in fully functional condition. Additional reasonable time may be given if service requires more time. 16.7. Failure to provide prompt after sales support will attract a penalty of Rs. 100/- per day per unit of equipment beyond the period stated. 16.8. Forfeiture of Security Deposit for delay in service –The performance of the supplier shall be reviewed regularly. The supplier shall be advised to improve their services as and when such cases are noticed by the user. In case of consistent poor performance of the supplier, purchaser / purchaser may forfeit the Security Deposit and / or Black list the supplier for all future purchases.

17. Force Measure Clause 17.1. If at any time during the currency of the supply period, the performance in whole or in part by either party or any obligation under this agreement/ contract shall be prevented/delayed by reasons of any war, acts of the public enemy, civil commotion, floods or acts of God (hereinafter referred to as eventualities), then neither party will be entitled to terminate this agreement/ contract nor shall have any claim for damages against the other party in respect of such non-performance or delay in performance, provided notice of the happening of any such eventuality is given by either party to the other within seven days from the date of occurrence thereof. Deliveries under this agreement/ contract shall be resumed as soon as practicable after such eventuality has come to an end or ceased to exist. 18. Liquidated Damages 18.1. In case of breach of any of the conditions of the agreement or delay in supply/ failure to supply at the quoted rates, purchaser may take any one or all of the actions detailed below: (a). Recover from the supplier liquidated damages for delay / non-supply @ 2% per month or part thereof calculated on the price of goods not delivered in the stipulated time up to maximum of 6% of such price; (b). Purchase from elsewhere the entire or the remaining items on supplier’s Risk and cost; (c). Forfeit either wholly or the part of the earnest money deposit or security deposit; (d). Cancel the agreement/ contract; (e). Debar the supplier; (f). Take any other action against the supplier including legal action; 19. Change of Conditions 19.1. The purchaser reserves the right to change any or all of the provisions of this tender before the due date of submission of the Tender. 20. Right of Acceptance/ Rejection of the Offers 20.1. The purchaser shall have the power to accept/reject any offer partly or fully or all offers without assigning any reason thereof.

21. Termination of Agreement/ contract 21.1. The purchaser shall have the power to revoke/cancel the agreement/contract during its currency for any supervening impossibility or unforeseen reasons with due notice to the supplier. 22. Dispute and Jurisdiction 22.1. Only the Civil Courts in the Pusad (Dist. Yavatmal) City shall have jurisdiction to entertain any dispute or claim out of or consequent to this Tender, subsequent agreements or any other related matter.
