The Canadian Constitution outlines how Canada is meant to be governed. It sets the terms of the relationship between the federal and provincial governments, the relationship between government and citizens, and it dictates who is responsible for which policy areas. It also sets limits on what laws and government programs can do.

The Constitution is a rigid document, which can’t be changed as easily as ordinary legislation, but changing the constitution isn’t impossible. For most changes to the constitution that affect the entire country, there is a complex process that demands near- consensus from federal and provincial governments.

Significant changes to the written Constitution must happen by using the amending formula, where all of the following conditions are met:

-The Canadian Parliament supports the change -At least seven of ten provincial legislatures agree -The supporting provincial legislatures must represent at least half of all Canadians

In practical terms, this means that in addition to the support of the Canadian Parliament, at least seven provinces are needed, including at least one of the biggest provinces: Ontario or Quebec.

Constitutions aren’t meant to be changed easily or frequently, They’re meant to stand the test of time and provide stability. But it’s not inconceivable to imagine that the drafters of our constitution might have forgotten something.

Suppose, for example, that the government agreed with environmental activists like David Suzuki who suggest the Charter of Rights and Freedoms should recognize Canadians’ right to a healthy environment. In order to guarantee such a right, the amending formula would have to be used.

No matter what is written in the constitution, the courts remain responsible for interpreting it, and how this new right, or any existing rights apply in the present day. In this way, it is a like a living tree.

The living tree of our constitution has many caretakers. The House of Commons and provincial legislatures are responsible for adding and removing branches, and courts prune those branches.

Because the Constitution and Charter are difficult to change, they are a strong guarantee of our continuing rights and freedoms. At the same time, some people worry that they are much too difficult to change, even when there might be a really good reason to do so.

Over the next three weeks we explore some of the subtle ways government shows up in our everyday lives. 6
