D’var Torah : Rav James We find ourselves starting a new Sefer of Chumash this week - Sefer Devarim. It is not coincidence that this is happening during the nine days. In fact, this occurs every year as we read Parshat Devarim on Shabbat Chazon, the Shabbat before Tisha B'Av. The reason that it is mentioned in Halacha is the phrase Eicha that Moshe uses in this week's Parsha, which is additionally the opening word and name of the that we read on Tisha Bav. According to Rashi, the entire opening of Sefer Devarim is a Mussar Shiur from Moshe to Bnei Yisrael reviewing how they behaved on so many occasions. Each name of a location that is mentioned is alluding to another incident where Bnei Yisrael misbehaved. This speech is given on the first day of the month of Adar just several days before the passing of Moshe Rabeinu. Rashi explains that Moshe learned from Yaakov to wait and give constructive criticism to his children only before his death. In the middle of the speech Moshe says something that looks out of place. “Behold, I have set the land before you: go in and possess the land which the LORD swore unto your fathers, to Abraham, to Isaac, and to Jacob, to give unto them and to their seed after them.” The Ramban’s commentary on the Torah suggests this isn’t just a historical description but rather a reminder of a positive commandment for all Am Yisrael. So why in the middle of telling off Am Yisrael does Moshe mention a Mitzvah? Why only one Mitzvah? I have spent the past month giving daily shiurim to staff at Moshevet Stone. The entire camp was looking at the development of Zionism and the early pre-state Aliyah bringing us to conclude the session this week with the establishment of the State of Israel. One of my shiurim was looking at the question whether the mitzvah of Yeshuv HaAretz exist today. We looked at numerous sources from all sides of the halachic argument, both old and new, from Zionist Rabbis and anti Zionist Rabbis as well as secular and religious intellectual articles. One item was the speech from last year’s conference commemorating the disengagement from Gaza held in Israel. This speech was presented as part of a panel where the MK representing the Aguda, said, "We believe that the Mitzvah of settling the land of Israel is one out of the 613, unlike you Religious Zionists that think it has a greater significance over other Mitzvot". Maybe this MK accidentally used the argument presented by the Sifrei as to why we as Religious Zionists believe in the centrality of this Mitzvah; not just as one of the 613 Mitzvot but as equal to all of the other 613 Mitzvot together. Perhaps an explanation as to why Moshe mentions only this one key Mitzvah in this speech is that Moshe wants us to understand its importance. Moshe is telling us that the only way to correct our sins that push us away from God is committing to the Mitzvah of settling Eretz Yisrael, the land of God. Hopefully next year we will all be celebrating together our full Geula and the complete return of Am Yisrael to our one and true home.
