ORDER: WHEREAS,in the Notificationissued with the S.O. first read above, by invoking sub-rule(3) of the rule 120 of the TamilNadu Panchayats (Elections) Rules, 1995, the Commissiondirected that all the contestingcandidates in the electionslisted therein shall lodgea true copy of their electionexpenses kept by them or by their respective electionagent under sub-rule (1) of rule t20 of the said Rules in the format prescribedtherefor under sub-rule(2) of the rule 120 of the said Ruleswith the officers mentioned therein, within thirty days from the date of declarationof the resultof the elections; 2. WHEREAS,in the Notificationissued with the S.O. secondread above, this Commissionprescribed a format for the said purposeby invokingsub-rule (2) of the rule 120 of the said Rules; 3. WHEREAS,this Commissionconducted Ordinary Elections to the Rural'Local Bodiesduring October20LL; 4. WHEREAS,the DistrictElection Officer/District Collector, Kancheepuram, in the letter third read above reported that 1330 candidatescontested in the said OrdinaryElections for variousoffices failedto lodgecopies of their accountof election expensesas directedby this Commission; 5. WHEREAS,based on the report of the said District Election Officer/District Collector,a show cause notice was issued in the referencefourth read above to each of 1330 contested candidatewho failed to lodge a true copy of the account of electionexpenses in the OrdinaryElections held during the month of October,2OLt, through the DistrictElection Officer/District Collector, calling for explanationwithin 20 days of the receiptof the said Notice,as to why action should not be taken against him/her as per sub-section(4) of section37 of the Tamil Nadu PanchayatsAct, L994 (Tamil Nadu Act 21 of L994); 6. WHEREAS,on receiptof show causenotices 13 number of candidateshave submitted their account directly to the Commission and the same have been forwarded to District Election Officer in the reference sixth cited and requested to send his remarksalong with the repofts of other candidates. 7. WHEREAS,the said District ElectionOfficer/District Collector, in his letter seventhread above,has now reportedthat out of the said 1330 contestedcandidates two candidatesexpired, tt62 contestedcandidates have submitted their accounts and the explanation and the remaining 166 contested candidates have neither submittedtheir explanationsnor lodgedthe accountof electionexpenses in spite of the show causenotices issued to them; and 8. WHEREAS,in view of the said repoft of the DistrictElection Officer/District Collector,the Tamil Nadu State ElectionCommission is satisfiedthat 166 candidates listed in column (3) of the Table below againstthe contestedelection mentioned in the correspondingentry in column (2) thereof, have failed to lodge an account of electionexpenses as requiredby or under the said Act and have no justificationfor the failure. 9. NOW,THEREFORE, in exerciseof the powersconferred by sub-section(4) of section37 of the Tamil Nadu PanchayatsAct, L994 (Tamil NaduAct 21 of 1994), the Tamil Nadu State ElectionCommission hereby declaresthat the candidateslisted in column (3) of the Table below against the contested election mentioned in the correspondingentry in column (2) thereof,shall be disqualified,for beingchosen as a memberor presidentfor a periodof three yearsfrom the date of this Order. 3 THETABLE KANCHEEPURAMDISTRICT S. In spite of the district’s top-notch status in terms of high educational, human development index and humungous industrial productivity, given its geography, climate and certain other socio-political attributes, the district administration and its people have to co-exist with the probabilities of hazards like floods, cyclone, Tsunami, drought, heat wave, lightning and chemical, biological, radiological and nuclear emergencies. The Disastrous events in the recent past like the Tsunami of 2004, the catastrophic floods of year 2015, the cyclone of year 2016 and most recently the COVID-19 pandemic, will serve as a testament to the district’s vulnerability to such hazards. How the society responds to such vagaries of nature decides the magnitude and intensity of the destruction that may entail hazardous events. It is against this back drop, the roll of the District Disaster Management Authority can be ideally understood. The change in perspective from a relief- based approach to a more holistic disaster management approach has already begun to gain currency among the policy makers due to its substantial success in efficient handling of recent disasters across the globe. The need of the hour, therefore, is a comprehensive disaster management plan which is participative and people-friendly with the component of inter- departmental co-ordination at its crux.
