Council Handbook THE COUNCIL OF THE DISTRICT OF COLUMBIA HANDBOOK The Council of the District of Columbia councilofdc DC Council The stage was originally set in the Constitution of 1789 when an area of 10 Square Miles was set aside as the Federal Capital of the United States on the banks of the Potomac River. The Residence Act of July 16, 1790, established a site along the Potomac River. This federal area was first called Territory of Columbia and the federal city was called the City of Washington. Land was donated from the State of Maryland and the The City of Commonwealth of Virginia. The 10 Square miles included all of present day District of Washington, D.C. Columbia which was donated from the State of Maryland and Arlington County, VA and a portion of the City of Alexandria, VA. In 1846, the Virginia territory was ceded back to the Common- wealth of Virginia. The recorded history of the District of Columbia dates back to 1802 when President Thomas Jefferson signed an act of Congress that established the Corporation of the City of Washington and the First Council. COUNCIL OF THE DISTRICT OF COLUMBIA HANDBOOK 02 In 1871, Congress amended the District’s Charter by uniting Washington City, Georgetown, and the County of Washington under a Territorial Government. In 1874, Congress amended the Charter to abolish the Terri- torial Government. In 1878, Congress passed the Organic Act that established a 3-Member Board of Commissioners of the District of Columbia to govern the District which lasted nearly 100 years. The City of In 1961, District residents were allowed to vote in presidential Washington, D.C. elections as a result of the 23rd Amendment. In 1967, the President established the Mayor-Commissioner form of government with a mayor and a council, all appointed by the President of the United States. In 1970, the District gained an elected, non-voting Congressman to the House of Representatives. (There is no representation in the U.S. Senate.) In 1973, the Home Rule Act passed in Congress, and District residents approved it in a special referendum the next year. We appreciate your concerns and would like to address each of your requests. 1. Backpay: “We urge DOES to plan a claims processing “blitz” in the next 30 days in order to expediently process all remaining claims from 2020 and the backlog of emailed weekly certification forms that resulted from recent IT errors.” The agency did not have IT errors that resulted in a backlog of weekly certification forms that were emailed to DOES. As a result of changing federal guidance, we have utilized a strategy of updating our system while also continuing to collect certification forms, which is a pre-requisite for receiving payments. This strategy allows DOES to have the proper documentation in place to facilitate payments to claimants, as well as ensuring the new federal benefits can be dispersed as quickly as possible. DOES’ unemployment teams are working as quickly as possible to process all eligible claims.

(5) “Mayor” means the Mayor of the District of Columbia. (6) “Policy” or “policies” means written directives that guide Department policy, including General Orders, Special Orders, Circulars, Standard Operating Procedures, and Bureau/Division Orders.

    8 February 2021 Dear Mayor Bowser, As you develop your 2022 fiscal year budget, the undersigned stakeholders urge you to launch a bold restructuring and expansion of DC’s efforts to eliminate gun violence. Without systematic changes, Washington, DC will remain among the most deadly cities in the country.1 It does not have to be this way. We have the solutions that can solve this public health crisis.2 The District has the potential to truly be a world-class city. To get there, we must adopt a thorough, focused plan to put an end of gun violence in our great city. The District must fully commit to a comprehensive, fully scaled, multidisciplinary approach to reducing gun violence. We have the data driven, proven strategies that have worked in many other cities, but no effort will be successful unless we tackle gun violence head on in a fair and balanced manner, with sufficient, sustained funding, and exacting focus.3 We can point to strategies implemented successfully in other cities such as Oakland, CA and Eugene, OR45 but we also need to recognize that DC successfully worked in a multi-faceted, collaborative manner to bring the homicide rate down from a high of 489 high to a low of 88 (1989-2012).6 Research strongly shows that a small number of people are driving the majority of gun violence and that it often tracks social networks.7 This is in part because gun homicides, nonfatal shootings, and exposure to gun violence reflect and intensify our country’s long-standing racial inequities.

The ARP also provides substantial direct assistance to DC residents struggling to meet their basic needs. Rebuilding DC communities requires targeted and sustainable investments as well as efforts to connect residents to these new resources. Even better, paired with new local funding to sustain investments, federal relief can help DC build a just recovery and an antiracist, equitable future that all our neighbors urgently need and deserve. This year’s budget choices—both to supplement the current Fiscal Year (FY) 2021 budget and to adopt a budget for FY 2022—will be critical. By targeting resources to those most in need, making programmatic shifts to address long-standing systemic racism, and planning to sustain these investments in the long-term with local revenues, the District can reduce its deepest inequities and build a stronger future for all residents and businesses. We encourage you to make these decisions by engaging DC residents and providing clear information on how federal relief funds are being used. On March 17, 2020, you and your team took the important action of utilizing the Federal Emergency Management Agency’s (FEMA) Public Assistance (PA) program funds to commence the Pandemic Emergency Program for Medically Vulnerable Individuals (PEP-V). The goal of PEP-V is to reduce exposure to COVID-19 of elderly and medically vulnerable individuals residing in congregate shelters. We want to commend you for consistently being receptive to community and expert input on ways to improve and expand PEP-V to meet the changing needs of our residents and requirements of the Federal Government. For example, since its inception, you have expanded PEP-V capacity by adding a third hotel and allowing program participants to double-up in rooms. These changes, all implemented in 2020, mean that as of March 18, 2021, 656 eligible individuals were placed in PEP-V instead of a congregate shelter or living unsheltered. Unfortunately, there remain 656 people referred and waitlisted for a PEP-V placement until more beds open or program capacity is expanded. Of these 656 waitlisted referrals, 35% are currently in shelter and 38% are unsheltered, which demonstrates the critical role that PEP-V plays in ensuring adequate social distancing in the low-barrier shelter system and moving our unsheltered residents indoors. We are concerned that the already sizable waitlist will grow because a handful of the seasonal hypothermia shelters, which have been operating 24/7 to reduce community spread of COVID-19, will be taken offline in the coming days and weeks.

Gray, I am introducing the “Expanding Student Access to Period Products Act of 2021.” Please find enclosed a signed copy of the legislation. Many students continue to face obstacles in accessing period products, which is a basic healthcare need for over half of our residents. Current menstrual health education standards are extremely limited and only begin in grade 9, leaving students unprepared and uninformed during the beginning of puberty. During Council Period 23, I introduced with Councilmember Grosso Bill 23-0887, the “Expanding Student Access to Period Products Act of 2020”. A public hearing was held on Bill 23-0887 on November 24, 2020. This bill is a revised and expanded version of Bill 23-0887. The “Expanding Student Access to Period Products Act of 2021” would: • Require local education agencies and private schools to provide free period products in all women’s and gender-neutral bathrooms in middle and high schools, and in at least one women’s and gender-neutral bathroom in elementary schools. If a school does not have a gender-neutral bathroom, the school would be required to provide free period products in at least one men’s bathroom.
