Will the Minister for Law and Justice be pleased to state the number of cases filed against the officials of LESCO in the office of Federal Ombudsman during the last two years indicating also the number of cases out of the same in which the officials were found guilty and punished?

Nature of complaints is excessive / wrong / inflated billing as well as delay in provision of connections. Some cases are of replacement of defective meters, transformers and poles. These Complaints are filed against the officers / officials due to maladministration.

Will the Minister for Human Rights be pleased to state:

(a) the amount allocated for the Human Rights wing of the Ministry of Human Rights during the last three fiscal years with year wise break up; and

(b) the names of projects on which the said funds were spent during that period?

Mr. Kamran Michael: (a) It is clarified that Human Rights Wing being part of the Ministry does not have any separately allocated amount. The Ministry has a Development Wing which manages the Public Sector Development Program (PSDP). Under PSDP, an amount of Rs. 119.603 million was allocated for Ministry of Human Rights during the last three years. (iii) Establishment of Helpline for Legal Advice on Human Rights Violations, Islamabad.

Will the Minister for Religious Affairs and Inter-Faith Harmony be pleased to state the steps taken / being taken by the Government to provide / ensure safety to minorities with particular reference to the Christian community, in practicing their own religion in the country?

Sardar Muhammad Yousaf: In the wake of 18th Constitutional amendment, this Ministry has been mandated the task of Policy and Legislation with regard to Interfaith Harmony in the country, while following subjects of defunct Ministry of Minorities Affairs have been devolved, as under: —————————————————————————————— S# Official Business Status —————————————————————————————— i. Therefore, issues pertaining to “steps to provide/ensure safety to minorities, in practicing their own religion in the country” are outside the mandate/purview of this Ministry and relates to Ministry of Interior, Ministry of Human Rights and Provincial Governments. 4 *Question No. 64. Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the present status of work on 7-km pipeline of Neshpa Well No. 6 indicating also the time by which the same will be completed; and

(b) the quantity of crude oil and gas to be supplied through the said pipeline indicating also the names of areas which will benefit from the same?

Mr. : (a) The construction work for pipe line of Nashpa # 6 had been completed on 8th October, 2016 and subsequently oil and gas was injected into the system on 10th October, 2016.

(b) Daily average production of oil and gas from Nashpa Well No. 6 during the month of December, 2016 remained 3367 barrels of oil per day and 12 MMCFD of gas.

The gas is being injected into the system of SNGPL for supply to prioritized sector i.e. domestic & commercial.

Will the Minister for Parliamentary Affairs be pleased to state:

(a) the names, designations, educational qualifications date of appointment and place of domicile of the persons working in BPS-16 and above in the Election Commission of ;

(b) the names and designations of the said officers working on deputation basis in ECP;

(c) the steps being taken by the Government to improve the capacity of those officers; and 5 (d) the steps being taken by the Government to ensure transparent elections in the country?

Will the Minister for Water and Power be pleased to state whether it is a fact that Asian Development Bank has refused to provide funds for the construction of Diamer-Bhasha Dam, if so, the alternative measures adopted / being adopted by the Government in this regard?

Khawaja Muhammad Asif:

¦ ADB had shown interest in financing of the Project. Their Reconnaissance Mission visited WAPDA in March-April, 2009 and advised to improve Resettlement Action Plan and Environment Management Plan. All the Pre-requisites desired by ADB were fulfilled and Aide Memoire was also issued on 8th June, 2009. However, later on, ADB used delaying tactics and shied away from giving any firm commitment.

¦ Recently, financing strategy for Implementation of Diamer Bhasha Dam Project has been approved by the Cabinet Committee on Energy on 30-11-2016. In the light of financing strategy, WAPDA has been directed to update PC-Is (one for dam part and the other for power generation). Updation of PC-Is is in process. 6

¦ According to the financing strategy, Dam & Pre-requisites will be implemented through PSDP grants plus WAPDA aranged financing, whereas Power Generation Facilities shall be implemented through Local/Foreign loans plus WAPDA arranged financing.

¦ Construction of infra-structure/preliminary works of Diamer Bhasha Dam Project i.e. Project Colony at Thore Valley, Composite Model Village-II at Harpan Das are in progress whereas work on KKH Bypass is stopped since December 2015 due to boundary dispute between GB & KP.

¦ Most of the land required for the Project has already been acquired through PSDP funds.

*Question No. 68. Senator Col. (R) Syed Tahir Hussain Mashhadi: (Notice received on 02-12-2016 at 10:00 a.m.)

Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) whether it is a fact that the Capital Development Authority has made payment in September, 2005 to the Sui Northern Gas pipelines Limited (SNGPL) for provision of gas to Sector I-14, Islamabad;

(b) whether it is also a fact that SNGPL has failed to provide natural gas to the residents of the said Sector so far, if so, the reasons thereof; and

(c) the steps being taken by the Government to provide natural gas to the residents of the said Sector?

Mr. Shahid Khaqan Abbasi: (a) No. SNGPL has reported that CDA had made payment in April 2006.

(b) Yes. M/s SNGPL has informed that supply main of 10” dia was required to be laid for supply of gas to this sector, which could not be laid due to non-provision of clear line route by CDA. 7 (c) 10” dia. X 8.80 Kms supply main has been laid for sector I-16 which is passing through sector I-14. The company has further indicated that the work for laying of distribution network in I-14 shall commence shortly.

*Question No. 69. Senator Col. (R) Syed Tahir Hussain Mashhadi: (Notice received on 23-12-2016 at 01:00 p.m.)

Will the Minister for Human Rights be pleased to state:

(a) the procedure laid down by the National Commission for Human Rights (NCHR) for receiving complaints from individuals and taking suo moto actions in case of violation of human rights;

(b) the number of complaints received from individuals and suo moto notices taken by the said Commission during the last three years and the action taken thereon separately; and

(c) the steps being taken by the Government to check and control human rights violations and ensure protection of human rights in the country?

Mr. Kamran Michael: (a) The NCHR deals with the complaints from individuals and by taking suo moto notice in accordance with Section 3 of the National Commission for Human Rights (Complaints) Rules, 2015 (Annexure-I).

(b) The Commission started functioning in mid December 2015. From December 2015 to 10th January, 2017, the Commission received 518 complaints of various nature (Annexure-II). During the period from December 2015 to 10th January, 2017, the Commission took suo moto notices of 89 petitions out of which 71 processed, 7 in hearing, 2 resolved and 8 have been consigned.

(c) Government is committed to ensure Human Rights of its citizens as envisaged under the Constitution as well as international commitments by adopting all possible measures to ensure protection and promotion of such rights. However, despite various positive efforts at Federal and Provincial level, violations of Human Rights do take place. In this context, responsibility of the Governments both at Federal and Provincial levels has increased manifold. In this regard, the Federal Government has taken various initiatives in order to ensure protection and promotion of Human Rights, with special focus on Rights of Women, Children, Minorities and other vulnerable segments of the society. These include: 8 I. Action Plan for Human Rights, approved by the Prime Minister of Pakistan on 13th February, 2016, is being implemented. The Plan ensures following major areas of intervention to further improve Human Rights situation in the country:

i. Policy Legal Reforms & Access to Justice;

ii. Implementing key Human Rights Priorities: Rights of women, children, minorities and vulnerable population;

iii. Cross cutting interventions for protection of Human Rights: education, sensitization, awareness raising, research and communication;

iv. Intemational/UN Treaty Implementation;

v. Establishment and strengthening of National Human Rights Institutions;

vi. Implementation and Monitoring of Action Plan.

II. An amount of Rs. 750.00 million has been approved to put in place institutional mechanisms for realizing the rights proposed in the Action Plan which includes an amount of Rs. 400.00 million for human rights education, sensitization, awareness raising, research and communication, Rs. 250.0 million for establishrnent of National Institute of Human Rights for capacity building, training, research and development and Rs. 100.0 million Endowment Fund for Free Legal Aid for Poor Victims of Human Rights Violations.

III. A Project titled, Helpline “1099” for Legal Advice to the victims of Human Rights Violations has been launched. The Helpline (1099) provides referral services to address grievances of the victims. Public Notices have been issued in newspapers to create awareness among the masses in this regard. Since 10th February, 2016 total calls received are 36341, out of which 4696 cases were eligible which were taken up with the relevant departments for redressal.

IV. National Commission for Human Rights (NCHR) has been established with a broad mandate and powers to take suo-moto 9 actions. The Ministry of Human Rights has also notified the NCHR Complaint Rules, 2015 which comprehensively elaborate the procedure regarding evaluating and disposing of complaints of Hurnan Rights Violations.

V. Similarly, autonomous National Commission on the Status of Women (NCSW) and National Commission on Minorities (NCM) are also working to check and control Human Rights violations of women and minorities respectively and to effectively protect/promote their rights.

VI. Ministry of Human Rights has launched Public Awareness Campaign on Human Rights Education and Sensitization under Action Plan for Human Rights, 2016 through Seminars as well as advertisements in print and electronic media. The campaign’s target is general public, civil society, researchers, academia, students, government functionaries, and different segments of society. The campaign focuses Right to Life besides promotion of Human Rights’ values for creating a culture of tolerance and respect.

VII. Ministry of Human Rights has formulated a draft National Policy Framework for promotion and protection of human rights after completing the consultative process at federal and provincial level. The draft has been circulated among Ministries/Divisions for final consultation/input before submission to Federal Cabinet for its approval. The task for formulation of provincial strategies on human rights has also been started in collaboration with provincial governments.

VIII. A National Task Force (NTF) to monitor implementation of Action Plan for Human Rights has been notified under the chair of Federal Minister for Human Rights comprising parliamentarians (one each from National Assembly & ), relevant Federal Ministries and Provincial Human Rights Departments. Provincial Task Forces (PTF) in Punjab, KP and Sindh have also been established. The Provincial Task Force in Balochistan is in process.

IX. District Human Rights Committees are also being constituted to check and control Human Rights violations of women and minorities respectively and to effectively protect/promote their rights. 10 X. The human rights situation in Jails has also been monitored through Jail Monitoring visits. So far more than 100 prisoners with petty offences have been released and re-unified with their families along- with HR Sensitization among Prison’s staff Annex-I 11 12 13 Annex-II 14 *Question No. 70. Will the Minister for Petroleum and Natural Resources be pleased to state the names of countries from which Pakistan is purchasing Gas at present?

Inter State Gas System (Pvt) Limited (ISGSL)

The Following projects are under ISGSL mandate:—

¦ Turkmenistan Afghanistan Pakistan India Gas Pipeline Project ¦ Iran Pakistan Gas Pipeline Project

With regard to above projects, Gas Sales and Purchase Agreements (GSPA’s) were signed with Turkmenistan and Iran respectively. However these projects are currently under implementation stage therefore at present there is no flow of gas under these projects.

Pakistan State Oil Limited (PSO)

PSO is importing LNG through Government to Government Agreements and tendering/ Competitive bidding. Under Government to Government arrangement, the LNG is being imported from Qatar while under competitive bidding, the suppliers arrange LNG from various sources, viz.

(a) whether it is a fact that a Sufi Council was established in the country during the Pervez Musharraf regime, if so, the present status of the same;

(b) the major functions and achievements of the said Council; and

(c) the details of support which the Government is providing to that Council?

Sardar Muhammad Yousaf: (a) A Sufi Advisory Council was constituted on 9-6-2009 but it ceased to function due to non-availability of funds from 29-08-2011.

Will the Minister Incharge of the Prime Minister’s Office be pleased to state:

(a) the criteria laid down for granting permission to foreign investors for making investment in Pakistan;

(b) the number of foreign investors applied for permission for investment in Pakistan during the last three years indicating also the number of those who were granted the same; and

(c) the number of those investors who were not granted permission during the said period and the reasons thereof in each case? 16 Minister Incharge of the Prime Minister’s Office: (a) Investment Policy 2013 stipulates an “open-admission” system that does not require pre- screening or approval for entrants. All sectors are open for foreign investment except a few specified industries like arms and ammunition, explosives, radio- active substances, security printing, currency & mint. As such no permission is required from Board of Investment for making investment.

Will the Minister Incharge of the Prime Minister’s Office be pleased to state:

(a) the volume of foreign investment made in the country during the last three years with sector-wise break-up; and

(b) the steps taken by the present Government to attract more foreign investment and to facilitate the foreign investors?

Minister Incharge of the Prime Minister’s Office: (a) The total inflow of FDI from July 2013 to Dec, 2016 was US $ 9,660.2 Million. (Net FDI after adjustment of outflow was US$ 5,603.5 Million).

Detail of Sector-wise break-up of FDI from July 2013 to Dec, 2016 is at Annex-I.

Will the Minister for Petroleum and Natural Resources be pleased to state:

(a) the number of foreign investors who have shown interest for making investment in oil and gas sectors in Pakistan during the last three years; 20 (b) the number of meetings of the said investors held with the Minister and officers concerned of the Ministry of Petroleum and Natural Resources during the said period; and

(c) the steps being taken by the Government to facilitate the foreign investors in the field of oil and gas?

Mr. Shahid Khaqan Abbasi: (a) Seven foreign companies formally showed interest for making investment in oil and gas exploration during last three financial years. Out of them, three companies have been granted three exploration licences, whereas request of remaining four foreign companies for grant of seven exploration licence would be included in the next bidding round.

(b) The said foreign companies are already working in Pakistan and have frequent meetings with Minister and officers concerned of the Ministry of Petroleum and Natural Resources.

(c) The present Government has taken various measures to attract foreign investors and create an investment friendly environment in the Exploration & Production (E&P) Sector, which includes but not limited to the following:

i. Petroleum Policy 2012 is being implemented, which offers attractive terms & conditions for foreign as well as local investors.

ii. 46 new blocks have been awarded under Petroleum Policy 2012.

iii. Terrain security clearance process has been initiated for award of Thirty two (32) new exploration blocks to E&P Companies through bidding process.

iv. The producer gas price under Petroleum Policy 2012 has been increased from 31% to 68% for different Zones.

v. For New Exploration Efforts in old blocks, Supplemental Agreements have been signed for conversion to 2012 Petroleum Policy’s better price.

vi. The Bonanza of US$ 1/MMBTU has been introduced for first three discoveries in Offshore area. 21 vii. The E&P Companies have been allowed to sale 10% of gas production to any buyer.

viii. Gas price of Petroleum Policy 2012 has been extended to entire incremental gas production, subject to meeting minimum threshold of 10% addition in existing maximum production of any day during six months w.e.f 31-07-2013 or volume committed in approved development plan, whichever is higher.

ix. Windfall levy has been reduced from 50 to 40 percent.

x. After the expiry of a lease period, the Lease can be further renewed or re-granted for another 5 years subject to payment of an amount of 15% of well head value.

xi. Tight Gas Price under Tight Gas Policy 2011 has been improved by offering 20% premium over 2012 Petroleum Policy.

Will the Minister for Parliamentary Affairs be pleased to state the number of persons working in BPS-1 to BPS-22 in the Ministry of Parliamentary Affairs, its attached departments, corporations, authorities, subordinate offices and autonomous & semi-autonomous bodies with grade wise and province wise breakup?

Sheikh Aftab Ahmed: Presently, sanctioned/working Strength of employees of M/o Parliamentary Affairs is 170. The grade wise and province wise breakup is at Annex-I.

Will the Minister for Human Rights be pleased to state the steps taken by the Government for protection of human rights in the country?

Mr. Kamran Michael: The Government of Pakistan is committed to ensure Human Rights of all citizens as envisaged under the Constitution as well as international commitments by adopting all possible measures to ensure protection and promotion of such rights, i.e. rights of women, children, persons with disabilities and minorities, etc. “The Criminal Law (Amendment) (Offences relating to Honor Killing) Act, 2016 and “The Criminal Law (Amendment) (Offences relating to Rape) Act, 2016” passed by the joint session of the Parliament and “The Criminal Law (2nd Amendment) Act, 2016 (Child Protection)” are the landmark legislations for protection of Human Rights, particularly rights of women and children. The Ministry regularly takes up all Human Rights violation cases with the concerned authorities for their redressal.

The steps taken by the Government for protection of Human Rights in the country are as under:

1. Action Plan for Human Rights, approved by the Prime Minister of Pakistan on 13th February, 2016, is being implemented. The Action Plan provides for specific interventions in order to ensure protection of Human Rights in the country.

2. The Ministry of Human Rights has initiated Public Awareness Campaign on Human Rights Education and Sensitization under Action Plan for Human Rights, 2016 through Seminars as well as advertisements in print and electronic media. The campaign’s target is general public, civil society, researchers, academia, students, government functionaries and different segments of society. The campaign focuses promotion of Human Rights’ values for creating a culture of tolerance and respect. In this regard, the following activities have been undertaken:

i. 09 Seminars have been organized in various Universities during 2015 and 30 Seminars during 2016 as a part of Human Rights Education, Sensitization & awareness raising.

ii. 3 Day Public Awareness Campaign on Pakistan Radio Network, PTV and ATV has been launched for awareness raising among general masses.

iii. Moreover, 6 Day Public Awareness Campaign has been launched on print media through publishing half page/quarter page advertisements.

iv. “Information, Education and Communication (IEC) Material on Human Rights Issues” has been developed as a part of Public Awareness Program. The material also contains messages against rape and child protection.

v. Universal Children Day (20th November) International Human Rights Day (10th December) and International Women’s Day (08th March) are also celebrated as regular features in order to create awareness among the masses. 25 vi. Ministry of Human Rights has formulated a draft National Policy Framework for promotion and protection of human rights after completing the consultative process at federal and provincial level. The draft has been circulated among Ministries/ Divisions for final consultation/ input before submission to Federal Cabinet for its approval. vii. Will the Minister for Water and Power be pleased to state:

(a) whether it is a fact that through 18th Constitutional Amendment the Provinces have been allowed to generate electricity by their own with prior permission of the Federal Government;

(b) whether any province has sought permission of the Federal Government for generation of electricity by itself since the passage of the said amendment, if so, the details thereof; and

(c) the steps being taken by the Government to encourage the Provinces to generate electricity by their own?

Khawaja Muhammad Asif: (a) As per Article 157 (2) (c) & (d) of the Constitution of Pakistan, the Provinces may construct power houses and grid 26 stations and lay transmission lines for use within the Province and determine tariff for distribution of electricity within the Province. (b & c) In order to encourage the Provinces to generate electricity by their own, the Government of Pakistan (GoP) announced “Power Generation Policy 2015” in April 2015, which offers various initiatives to allow Provinces/ AJK/GB to develop their own Power Projects. The Power Policy 2015 also allows Provinces/AJK/GB entities to issue Letter of Interest (LOI) and letter of Support (LOS), prepare pre-qualification and bid documents, pre-qualify the Sponsors, evaluate the bids/proposals, and award the projects. As per Power Policy 2015:

Total 607 persons have been inducted in OGDCL during the period from June-2013 to Dec.-2016. Province-wise breakup is as under;

(ii) Sui Southern Gas Company Limited (SSGCL):

SSGC has appointed 385 Executive and 210 Sub-ordinate staff (total 595) since 1st June 2013 till 30 January, 2017. Province-wise break-up is as under; 28 (iii) Sui Northern Gas Pipelines Limited (SNGPL)

Mr. Kamran Michael: (a) In the wake of 18th Constitutional Amendment, the subject of minors/ children has been devolved to the Provinces. The requisite information is required to be provided by the ICT Administration and Provincial Home Departments. Accordingly, they have been requested to furnish the requisite information by return fax on 30th January, 2017 (Annex-I). Their response is still awaited. However, Unicef estimated that 10 million child labourers in Pakistan, out of them nearly 264,000 children were estimated to be domestic workers, working in unprotected and unregulated environments whereas during 2013, twenty one (21) cases of torture of child domestic workers were reported.

(b) ¦ The Ministry of Human Rights has enacted the Criminal Law (Second Amendment) Act, 2016 which addresses the issue of cruelty to child.

¦ The Ministry of Human Rights has also drafted the ICT Child Protection Bill, 2016 which provides for protection of children from violence, abuse and exploitation. The Bill has been approved by the Cabinet’s Committee on disposal of legislative cases.

¦ As per directives of the Prime Minister’s office, the Ministry of Human Rights has convened a meeting of the representatives of the Provincial Governments, Capital Administration and Development Division (CADD) and ICT Administration on 24th January, 2017 to prepare a coordinated strategy to address the issue. In this regard a consultation with relevant federal and provincial counterparts will shortly be convened to develop a coherent strategy.

¦ The Government of the Punjab has drafted Law on domestic labour which is under consultation process.

¦ The Government of Sindh is considering the domestic labour policy and law. Besides, an agreement has been signed with UNICEF for conducting a survey to collect data regarding number of minors engaged in domestic labour.

Sardar Muhammad Yousaf: (a) At present there are 742 Hajj Operators registered with the Ministry. Regarding Umrah operators, this Ministry has no data about the number of Umrah Operators in the country as these operators are registered with the Department of Tourism Services (DTS) being regulatory authorities of respective provinces and ICT. However, MORA & IH attests the Contract/Agreement made between Pakistan Tour Operators and Kingdom of Saudi Arabia’s Umrah Services Provider on yearly basis on the request of Kingdom Saudi Arabia.

Consequently, this Ministry has attested 539 agreements during the year, 2015-16 whereas 219 contracts have been attested till date during year 2016-17.

(b) Hajj quota is allocated to Hajj tour operators in line with the procedure/ criteria as prescribed in Hajj policy of the concerned year. Procedure and criteria for allocation of Hajj quota for Hajj 2017 will be finalized in the light of Hajj Policy, 2017; which is yet to be approved. With regard to umrah, the Ministry does not grant any quota of Umrah to Umrah operators.

All the WAPDA Hydel Power Stations are under operation except Gomal Zam Dam Power Satation (2 x 8.5 = 17 MW) which is currently non-functional due to fault on its generating units. The units are under Defect Liability Period (DLP).

The rectification of the fault will be carried out at the cost of Contractor and there will be no extra cost to be paid. The first unit will be in operation within one month whereas the other will be available after 5-6 months.

(b) Presently, Jinnah Hydel Power Station (8 x 12 = 96 MW) is running with reduced output due to outage of two units. Both units are under Defect Liability Period (DLP). In order to boost effective recovery against Govt. and Private consumers, following steps are being taken by the Government:—

¦ Strict vigilance over payment of electricity hills of big industrials, commercial and tubewell consumers.

¦ Physical checking of the premises of the permanently defaulting consumers to make sure that the defaulters are not using electricity from any other source.

¦ Follow up of court cases/settlement of billing disputes.

¦ Timely delivery of electricity bills to consumers.

¦ Circle review and Regional review committees have been activated for reviewing the disputed cases.

¦ Provincial Finance Secretaries are being pursued for recovery of outstanding dues against the major defaulting departments of provincial governments.

¦ Reconciliation with Government Departments to recover the legitimate dues.

¦ All DISCOs (except TESCO) have sent cases of private running / disconnected electricity defaulters of Rs. 1 lac and above having more than 01 year of period to NAB for recovery.

Khawaja Muhammad Asif: (a) It is not a fact that excessive bills are being sent to consumers. However, if any complaint is reported the same is being addressed and corrected through the DISCO and the Federal Complaint Cell. (b)

(c) The mechanism and procedure for addressing the complaints of excessive billing by SEPCO is as under:—

(i) Registration of consumer complaint.

(ii) Field report from the concerned SDO regarding complaint.

(iii) As per report, bill adjustment note is prepared by the concerned Revenue officer.

(iv) Approval of bill adjustment note by the competent authority in each case.

(v) The approved amount is fed to computer for issuance of correct revised bill by computer center. 53 (vi) Average time to resolve complaint regarding excessive billing requires 20 days and according to batch sequence in the same month as per billing program.
