Sunday, July 4 (Independence Day) City of Aliso Viejo | Summer 2021 City Manager’s Message The past year has been challenging across the nation, but it has also been an opportunity for our residents, local business owners, City Council, and City staff to come together with a stronger sense of community. As summer approaches, I am pleased to share the new and innovative programs we are offering for all to enjoy. I am proud of the role Aliso Viejo has played in helping the County and State in taking the necessary steps to reopen. From quickly activating the City’s Emergency Operations Center at the onset of the pandemic, to hosting a County Super POD site at Soka University to aid in the distribution of COVID-19 vaccines, Aliso Viejo is an integral part of a nationwide response and recovery strategy. The State recently announced that California is set to fully reopen on June 15 with limited restrictions in place, which is perfect timing for the long-awaited return of camps and recreation programs to the City. Camp AV registration is now open, and we are excited to welcome our younger residents to more than 130 camps and activities for a wide variety of interests, including our new City Day Camp. This year, scholarships are available to eligible participants on a first-come, first-served basis for up to two weeks of summer camp. To learn more about scholarship opportunities and to register for classes, visit campav.org. In equally exciting news, the Aliso Viejo Ranch is officially open to the public! The City Council’s vision launched this one-of-a-kind project on the last remaining parcel of the original 22,000-acre Moulton Ranch. This multi-faceted project includes the restoration and re-use of the historic barn and bunkhouse, both over 100 years old, as well as construction of two other buildings which are replicas of buildings formerly on the site. The City has partnered with Moulton Museum to display historical artifacts specific to the Moulton family and the Aliso Viejo Ranch site. By displaying these artifacts and telling the Moulton family story, we hope to educate the community about the role and importance of agriculture in the history of Orange County. Our goal is to create a unique visitor experience for everyone that visits the Ranch and educate future generations about Orange County’s agricultural past. Aliso Viejo Ranch will be a recreational hub hosting a variety of educational, athletic, cultural and enrichment programs for the community. Reservations are being accepted for this beautiful facility’s indoor and outdoor accommodations for private events. INDOOR/OUTDOOR HISTORIC BARN AND BUNKHOUSE Aliso Viejo Ranch is a project that was started by the City of Aliso Viejo to preserve the location’s history. This project includes the rehabilitation and adaptive reuse of the Historic Barn and Bunkhouse along with the New Barn, five separate outdoor spaces, a working farm with fruit and nut tree orchards, raised- bed vegetable gardens, and several fish ponds. GOLD COAST FARM Gold Coast Farm at Aliso Viejo Ranch is also open for public enjoyment and available to rent for weddings and private events. Gold Coast offers opportunities for education and community enrichment, including free community workshops.     ARTICLE ADAPTING COPYRIGHT FOR THE MASHUP GENERATION PETER S. MENELL† Growing out of the rap and hip hop genres as well as advances in digital editing tools, music mashups have emerged as a defining genre for post-Napster generations. Yet the uncertain contours of copyright liability as well as prohibitive transaction costs have pushed this genre underground, stunting its development, limiting remix artists’ commercial channels, depriving sampled artists of fair compensation, and further alienating netizens and new artists from the copyright system. In the real world of transaction costs, subjective legal standards, and market power, no solution to the mashup problem will achieve perfection across all dimensions. The appropriate inquiry is whether an allocation mechanism achieves the best overall resolution of the trade-offs among authors’ rights, cumulative creativity, freedom of expression, and overall functioning of the copyright system. By adapting the long-standing cover license for the mashup genre, Congress can support a charismatic new genre while affording fairer compensation to owners of sampled works, engaging the next generations, and channeling disaffected music fans into authorized markets. Very few people had these song books, and some, like me, weren’t even aware that they existed. While new songs had been printed in the American Go Journal, there was clearly a need for a new collection of Go songs. I wanted to collect as many of the old songs as I could find, as well as the new songs that had been written since Bob High’s last song book. Sometimes the best things in life happen when we least anticipate they might. Such is the case with Toby McDonald. Until the Torino Winter Olympic Games, his most notable curling achievement by far was a Brier title in 1976 as the mate for Jack MacDuff. It is still Newfoundland & Labrador’s only Brier championship but when Brad Gushue needed a coach for his team’s run at the Curling Trials leading to the Torino Winter Olympic Games, Toby was the one the team wanted and a great choice it was! By now, several books have been written about Team Gushue’s Gold Medal performance in Torino and I’m personally pleased that many of the authors have noted the contribution Toby made. All was not blue skies and roses for Team Canada during those Olympic Games and had it not been for the expertise of Toby, the result might have been very different! Toby sent this essay to me several months ago re. the role of the fifth player and how to ultimately select someone for this most misunderstood position. I asked if he might allow me to publish it in the “A Pane in the Glass” series which he graciously has done.

    REGULATORY INCENTIVES FOR INNOVATION: THE FDA’S BREAKTHROUGH THERAPY DESIGNATION Amitabh Chandra1 Jennifer Kao2 Kathleen L. Miller3 Ariel D. Stern4 Abstract In approving new medical products, regulators confront a tradeoff between speeding a new product to market and collecting additional information about its quality. Alternatively, with the right allocation of resources, this tradeoff function may be “shifted outward,” thereby allowing important products to come to market more quickly without compromising quality evaluation. We study the FDA’s Breakthrough Therapy Designation (BTD), a novel policy tool that was created to accelerate the clinical development and regulatory approval processes for developers of high-value therapies by increasing feedback and communication with regulators during later phases of drug development. Using algorithmic matching models, we assess the impact of the BTD program on measures of (1) time-to-market and (2) post-approval drug safety. We find that the BTD program shortened late-stage clinical development times by 24 percent. We do not find evidence of a difference in the ex post safety profile of drugs with (vs. without) the BTD. In exploring mechanisms, we find support for reduced BTD trial design com- plexity, but not for trial size as driving these findings.
