1.0 CALL TO ORDER

The regular meeting of the California Association of Health and Education Linked Professions Joint Powers Authority (CAHELP JPA) Steering Committee Meeting was called to order by Jenae Holtz, Chairperson at 9:04 a.m., in the Desert Mountain Educational Service Center, Apple Valley. The meeting Minutes for May 12, 2017 and the meeting Agenda for June 9, 2017 were adopted as presented.

Emilio Torres introduced Kristen Singh. Kristen will be the associate director of special education for High Tech High beginning July 1, 2017. Emilio also introduced Carlin Mallman. Carlin is a graduate student working with the special education department. Emilio stated he is transitioning to a principal position with High Tech High beginning next year. The committee congratulated Julie Kroener as she recently earned her educational doctorate degree.

Jenae stated today is Rhonda Evans last Steering Committee Meeting; Rhonda’s retirement celebration will be later this afternoon.

2.0 COMMITTEE MEMBERS' COMMENTS/REPORTS

Vici Miller, Lucerne Valley USD, shared thoughts of gratitude for the SELPA and DMCC’s support and encouragement when she was hospitalized recently.

3.0 PRESENTATIONS

3.1 Inland Regional Center (IRC) & Department of Rehabilitation (DR)

Employment Specialist Andrew Burdick, Inland Regional Center (IRC), explained how the IRC’s employment specialists and the Department of Rehabilitation (DOR) are working collaboratively with vendors through the Paid Internship Program (PIP). PIP helps subsidize wages up to $10,400 per year for eligible clients. Andrew stated IRC is hopeful that eligible students in the D/M SELPA will be able to benefit from PIP. Currently students must be at least 18 years old and have an assessment from the DOR to be eligible for PIP.

Adrienne Shepherd stated the SELPA is requesting directors to invite an IRC representative to attend the IEP meetings for students that may be eligible for the paid internship program. She stated the IRC representative can forward the student’s documentation to the DOR.

Julie Kroener, Health Sciences High & Middle College (HSHMC), inquired whether the PIP program is available in San Diego.

Andrew stated the program depends on the local regional center.

Adrienne commented San Diego would need to development a local partnership agreement with the regional center in San Diego. Adrienne further stated she will follow up with the San Diego Regional Center.

Susan Wright, Team Manager, Victorville DOR, spoke on the Competitive Integrated Employment (CIE) program. She explained currently students with disabilities ages 16-22 are the main focus at DOR; roughly 15% of the funding is required to go towards students. Susan stated one of the conditions of the CIE program is the student must be integrated into the workforce with others that do not have a disability.

Ramona Flores, DOR Service Coordinator, explained the DOR’s Career, Counseling, Information and Referral (CCI&R) services. Ramona stated CCI&R promotes self-advocacy, self-determination, peer mentoring, and training Steering Committee Meeting Minutes June 9, 2017 Page 4 of 10

opportunities in communities. CCI&R services encourage Competitive Integrated Employment (CIE), and promote employment with at least minimum wage earning for clients.

Adrienne concluded she will prepare a presentation for a future Steering Meeting that includes the information shared today.

4.0 DIRECTORS OF EDUCATION REPORTS

4.1 Due Process Complaints & Statute of Limitations

Cheri Rigdon, Silver Valley USD, inquired whether the looser time limits ruling in the Avila v. Spokane School District court case would impact the statute of limitations for SELPA Local Education Agencies (LEAs).

Jenae read a portion of the Avila v. Spokane case. The parent alleged denial of free, and appropriate public education (FAPE) and requested an Independent Educational Evaluation (IEE), the district filed to defend its evaluation. The parents appealed to 9th Circuit Court of Appeals. The administrative law judge (ALJ) ruled in favor of the districts claims and concluded eleven of the parents’ claims were time-barred.

Maurica Manibusan commented the high court looked at what the intent of the language was of the discovery rule versus the occurrence rule. If the parent forms the basis or has the knowledge they can file a due process complaint within two years from the date of knowledge. In this case the parent argued that the district court improperly applied the IDEA’s statute of limitations to their two substantive claims. The high court reversed and remanded the case to the district court to make the determination of when the parent knew or should have known about the actions forming the basis of the complaint. Maurica stated the case offers more clarification on the statute of limitations.

Jenae concluded the bottom line is there are no changes in the language of the law or the statute of limitations because of this case.

5.0 DESERT/MOUNTAIN OPERATIONS AREA DIRECTOR’S REPORTS

None.

6.0 CHIEF EXECUTIVE OFFICER’S REPORTS

6.1 Disproportionalities

Jenae Holtz presented the SELPA preview of the Disproportionality Data by LEA for the 2016-17 year. Jenae reported the California Department of Education (CDE) changed the formula for calculating disproportionalities resulting in the majority of LEAs being disproportionate statewide. Jenae asked directors to notify the SELPA Steering Committee Meeting Minutes June 9, 2017 Page 5 of 10

(Colette Garland) when they find categories where the disproportionality is based on a count of only one student. The SELPA will follow up with CDE for corrections.; currently over a thousand LEAs statewide are disproportionate with the new formula. Jenae stated the SELPA will work with LEAs when they receive their reports; she concluded these are only previews.

6.2 2015-16 Annual State Performance Indicators

Jenae Holtz presented the 2015-16 State Annual Performance Indicator Measures by LEA. Jenae stated these are the SELPA previews; she concluded the SELPA will work with LEAs when they receive their reports.

Julie Kroener, HSHMC, inquired why HSHMC would have data for preschool age children (Indicator 7- Preschool Assessments) when they do not have any preschoolers.

Jenae stated she will follow up with the CDE regarding HSHMC. She concluded the SELPA will plan a meeting in the fall for directors to collaboration on these reports.

6.3 D/M SELPA & Charter SELPA Policies & Procedures Revised: Low Incidence Equipment Reimbursement

Jenae Holtz presented the revised SELPA and Charter SELPA Low Incidence Funding Policies & Procedures to maintain a more accurate balance of funds from year to year. Historically requests were submitted and approved, and the funds were encumbered but the invoices were not received. The funds then roll over from year to year. She explained the steps for requesting reimbursement for Low Incidence Equipment (LIE) were revised for both SELPAs to include specific timelines for submitting invoices for reimbursement within the fiscal year the funds are encumbered.

6.4 OT/PT Consult & Collaboration Fee-for-Service Rates

Jenae Holtz presented the Governance Council approved 2017-18 Occupational Therapy and Physical Therapy (OT/PT) Fee-for-Service (FFS) rates. Jenae stated over time the number of teacher consultation minutes written in IEP meetings has increased. She further stated no charges are applied if an OT/PT consult with staff is under 120 minutes. If the time is over 120 minutes the FFS will apply for consult and collaboration with staff (teachers). Jenae encouraged LEAs to consider spending more time/money on direct services for children over consultation.

6.5 2017-18 Approved Fee-for-Service Rates

Jenae Holtz presented the 2017-18 Fee-for-Service (FFS) rates for D/M County Operated Programs. She stated these FFS rates were approved by the CAHELP Governance Council in April. Steering Committee Meeting Minutes June 9, 2017 Page 6 of 10

6.6 Bright Futures Academy

Jenae Holtz reported Bright Futures Academy (BFA) is pending the Town of Apple Valley’s decision on whether the Town will revoke BFA’s business license following the town council meeting next Tuesday. The suspension on BFA’s Riverside campus was lifted by the CDE so they can receive new placements to their Riverside location. The SELPA is hopeful the Town will approve BFA to finish the school extended school year. (ESY). However, if their license is revoked the D/M SELPA will take over the remainder of ESY under a contract with BFA to provide the services at a site in Apple Valley. BFA is looking at other locations to operate for next year. The administration is aware of the need for significant changes and the SELPA is providing professional development for BFA, and there will be a counselor on-site fulltime next year. Jenae then stated the SELPA, DMCC, and D/M Operations (DMOPS) County Services is working collaboratively on an alternative therapeutic program to open in the fall. Jenae stated the SELPA is also in communication with Altus Academy but is not certain of their plan for next year.

Discussion followed on the concerns for transporting students to Riverside, other NPS placement options and receiving 20-day notifications for some students due to certain incidents at BFA.

Jenae also stated every child attending BFA should have a treatment plan. She asked directors to contact the SELPA when they receive a 20-day notification. Jenae concluded the SELPA’s plan if BFA’s license is revoked is not to transport to Riverside but to provide the remainder of ESY at the Apple Valley site.

6.7 CAHELP Website

Jenae Holtz reported the CAHELP website is approximately 80% complete on being compliant for Americans with Disabilities (ADA) accessibility requirements. The team is working with the auditor and the web programmer to correct the noncompliance and accessibility issues from the Office of Civil Rights (OCR) complaint. The correction plan will be submitted to OCR by the end of June. She stated the website is also being reconfigured to improve access to resources. The reconfiguration will include an educator portal.

7.0 DIRECTOR’S REPORTS

7.1 DMCC Client Services Reports

Jenae Holtz presented the Desert/Mountain Children’s Center (DMCC) Client Reports. She concluded directors may contact Linda Llamas should they have any questions regarding their LEA reports.

8.0 PROGRAM MANAGERS’ REPORTS

8.1 Professional Learning Summaries

Corinne Foley presented the D/M SELPA and Charter SELPA Professional Learning (PL) Summaries totals through May 2017. Corinne reported the year-end PL totals will be presented in August. Corinne shared a summary of the training topics covered in 2016-17. There were 8,508 participants trained.

Jennifer Rountree reported six students graduated from the Program for the Education and Enrichment of Relational Skills (PEERS) second cohort. Jennifer stated nine students are scheduled to participate in the next cohort.

8.2 CAC 2017-18

Corinne Foley reported the 2017-18 Community Advisory Committee (CAC) meeting dates are confirmed as follows: October 12, 2017, December 7, 2017, February 8, 2018, and May 17, 2018. Corinne stated all CAC meetings will be held at the D/M Educational Service Center. Corinne further stated teleconference streaming is available if a director is interested in their LEA participating remotely.

8.3 End-of-Year Summary

Corinne Foley reported a total of 391 professional learning participants for the Charter SELPA, and 8508 participants for the SELPA.

8.4 Directors’ Trainings 2017-18

Corinne Foley reported on August 25, 2017, Program Specialists Bonnie Garcia and Karina Quezada will present Dyslexia Overview. Corinne concluded the training topics will be determined for the October 13, 2017, February 9, 2018, and April 13, 2018 Special Education Directors’ trainings at a later date and based on the needs and/or suggestions of the members.

8.5 Due Process Activity Summaries

Jenae Holtz presented the D/M SELPA and D/M Charter SELPA Due Process Summaries for 2016-17. Jenae stated a total of 33 filings year-to-date for the D/M SELPA and 3 filings for the Charter SELPA. There are 8 open cases currently. Jenae briefly reviewed the cases. Jenae then reported the SELPA has received several records requests recently. She further stated she was informed recently another Charter SELPA in California received a records request for records of all their students with disabilities at all sites for the past three years. Fiscal Updates

Jenae Holtz reported the Maintenance of Effort (MOE) changed since what was presented to the Finance Committee in May. Jenae stated Marina Gallegos will send Steering Committee Meeting Minutes June 9, 2017 Page 8 of 10

updated MOE reports to members. She concluded as of now all LEAs will pass MOE.

9.0 COORDINATORS’ REPORTS

9.1 Transition Services Reports

Adrienne Shepherd presented the Transition Partnership Program (TPP) monthly report. Adrienne concluded directors may contact her should they have any questions.

9.2 TPI-2 Training

Adrienne Shepherd announced the upcoming Transition Planning Inventory – Second Edition (TPI-2) Training. Adrienne encouraged directors to send representatives to this training. The training will be held on September 14, 2017 in the City of Victorville’s training room on Civic Drive. She stated the cost is $250 per team. Adrienne added if a participant was previously trained and wants a refresher and does not need the TPI-2 kit, the cost is reduced to $150. Adrienne then commented this training is valuable with the increasing number of due process cases that are resulting in LEAs needing to administer the vocational assessments.

9.3 Year-End PBIS Data Review

Kami Murphy reported on the 2016-17 year-end Positive Behavioral Interventions and Supports (PBIS) data. She presented the Spring Assessment Results Regional PBIS Implementation Tiered Fidelity inventory (TFI) Tier Reports which gives teams an efficient, valid survey to guide implementation and sustained use of PBIS. Kami reported significant progress since implementation of the Early Childhood PBIS based on spring assessments. The PBIS Coaching Time-Spent per District chart provides a visual reference of how much time is spent coaching by site. Kami concluded the CAHELP PBIS team has served 23 LEAs in 2016-17, provided 94 regional trainings and 181on-site trainings and coaching.

9.4 PBIS Specialist District Assignments

Kami Murphy shared the SELPA PBIS Assignments and Contacts; a list of PBIS Specialist and their primary school sites. Kami stated directors may find this helpful as a quick reference when needing to contact a SELPA PBIS staff member.

9.5 2017-18 PBIS Training Dates

Kami Murphy presented the 2017-18 PBIS training dates by cohort. Kami stated an Alternative Education cohort was added for 2017-18.

9.6 2017 PBIS Recognition Event – Save the Date

Kami Murphy reported the CAHELP PBIS Recognition Celebration will be held on September 7, 2017 from 4:00-6:00 p.m., at Adelanto High School. She encouraged all committee members to attend this special event to honor PBIS regional and state recognition recipients in participation with the California PBIS Coalition.

9.7 2017 CPC Conference

Kami Murphy reported the 2nd Annual California PBIS Coalition Conference will be held October 11 & 12, 2017 in Sacramento. She concluded Dr. Steve Goodman and Dr. Rob Horner are the keynote speakers.

9.8 2017 PBIS Leadership Forum

Kami Murphy reported the 2017 National PBIS Leadership Forum is scheduled September 28-29, 2017 in Chicago.

9.9 Sustainability Network

Kami Murphy reported the PBIS Sustainability Network meetings are scheduled for October 25, 2017 and May 2, 2018. The PBIS Sustainability Network will focus on a Multi-Tiered Systems of Supports (MTSS) Model. There is no cost to attend.

10.0 PROGRAM SPECIALISTS’ REPORTS

10.1 Special Education Teachers Academy

Stephanie Hedberg presented an update on the 2017 Special Education Teacher Academy. She stated the focus this year was developed based on LEAs areas of need, beginning with classroom basics and then concentrating on the legal components – writing the IEP, learning the WebIEP and PLOPS and Goals. Participants will receive a resource book -Tools for a Successful School Year. The academy consists of three full-day trainings on August 23rd, September 15th, and September 28th, and a WebIEP training. Stephanie stated directors may register with their name to hold slots for their new sped teachers. Stephanie concluded the cost is $100.00 per individual.
