Offences punishable under Sections 417, 420, 376 (2) (n), 448, 323, 506 read with 34 of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for short ‘POCSO Act’). This petition is coming before me today i.e., on 12-06-2020 for hearing via Whatsapp videocalls by Sri N. Parameshwar, Advocate for the petitioner/accused No.1 and the learned Additional Public Prosecutor for State and having heard them, this Court made the following :- ORDER 1. This is the second bail petition filed under Section 439 of Cr.P.C by the petitioner/accused No.1 in Cr.No. 28 of 2020 of P.S. Choppadandi for the offences punishable under Sections 417, 420, 376 (2) (n), 448, 323, 506 read with 34 of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for short ‘POCSO Act’). 2. Heard both the learned counsel for the petitioner/accused No.1 and the learned Additional Public Prosecutor for the State via Whatsapp videocall made from their cell phones to my cell phone. 2 3. The petitioner/accused No.1 in Cr.No. 28 of 2020 of P.S. Choppadandi for the offences under Sections 417, 420, 376 (2) (n), 448, 323, 506 read with 34 of Indian Penal Code and Section 6 of Protection of Children from Sexual Offences Act, 2012 (for short ‘POCSO Act’) is remanded to judicial custody in the said crime on 16-04-2020. 4. The allegations levelled against the petitioner/accused No.1 who is remanded to judicial custody on 16-04-2020 are that in the year 2016 and 2017 at Sainagar/Chillanagar Choppadandi village and mandal the petitioner/A-1 committed rape on the minor victim girl who is under the lawful guardianship of her parents with deceitful words in the name of love and promised to marry her and when the victim asked about her marriage, the petitioner/A-1 bluntly refused to marry and cheated her, and A-2 to A-12 assaulted the victim on 06-03-2020 at Chakunta village when she was in her house by beating her with hands, tore her clothes and abused her by dragging on the road threatening to kill her. 5. Heard the learned counsel for the petitioner/accused No.1 through whatsapp video call who submitted that the de facto complainant has lodged a false complaint against the petitioner/A-1 and other accused even though no incident took place but, only to extract money from him, the petitioner/A-1 gave some hand loan to the family of the victim girl when she was studying in the school during the years 2016 to 2019, when the petitioner/A-1 asked them to repay the said amount to meet his needs, this false case is foisted against the petitioner/A-1, his wife and other family members pertaining to the alleged incident which took place some years ago. It is submitted that entire investigation in this case is completed, A-2 to A-5, A-8 to A-12 were given notices under Section 41-A of Cr.P.C and no evidence is available about the involvement of A-6 and A-7, and therefore, except filing of the charge sheet no further investigation is pending, taking into account the date of remand of the petitioner/A-1 which is on 16-04-2020 he may be enlarged on bail on any conditions. 6. Sri V. Venkateshwarlu, learned Additional Public Prosecutor, while referring to the contents of the counter has submitted that draft charge sheet is pending approval in this crime to delete the names of A-6 and A-7 and 41-A Cr.P.C notices are served to A-2 to A-4 and A-8 to A-12 and no further investigation is pending but, 3 opposed the relief claimed in this petition. 7. Having regard to the submissions and on a perusal of the material on record, it is evident that the petitioner/A-1 is remanded to judicial custody in this crime on 16- 04-2020. The allegations whether he has cheated the de facto complainant and committed forcible sexual assault on her repeatedly and the other accused have assaulted by abusing her and dragged her on to the road and tore her clothes on 06-03- 2020 by humiliating her, have to be adjudicated during the course of trial in this case after adducing appropriate evidence. Since it is submitted by the learned Additional Public Prosecutor that draft charge sheet is made ready and pending for approval, if the petitioner/A-1 is enlarged on bail on some conditions, taking into account his date of remand i.e., on 16-04-2020, there is no possibility of his interfering with process of further investigation, if any. Hence, this petition deserves to be allowed on some conditions. 8. In the result, this petition is allowed and the petitioner/accused No.1 is ordered to be released on bail on condition of executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties each for the like sum to the satisfaction of Prl. Judicial Magistrate of First Class, Karimnagar. Further, the petitioner/accused No.1 is directed to make himself available for investigation by the police as and when required in the said case, and he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case and he shall not leave India without the previous permission of the concerned Court and he shall deposit his passport if any before the Court of Prl. Judicial Magistrate of First Class, Karimnagar and shall file an affidavit if he does not own any passport. Further, the petitioner/accused No.1 shall appear before the Station House Officer Choppadandi Police Station on every Sunday between 1000 hours and 1200 hours for a period of three months from the date of his release on bail, or till the case is taken on file whichever is earlier. The Court of Prl. Judicial Magistrate of First Class, Karimnagar shall act upon the downloaded copy of this Order from the e-Courts Website, Karimnagar for accepting the sureties and before issuing the release order, the Court below shall 4 verify this Order from the e-Courts Website, Karimnagar.
