Re: Danburv Innovation Center License Agreement

Dear Council Members:

As you are aware, the voters of the City of Danbury passed the Vision 2020 Bond Package in the Noverrber 6,2012 election. The package included funds designated for the renovation of the former Union Savings Bank space in the Danbury Public Library. That space will then house the Danbury Innovation Center (DIC) a 501(c)3 organization.

As the renovation is now complete, a license agreement is required between the DIC and the City of Danbury. Therefore, I respectfirlly ask that you approve the attached license as submitted by the Corporation Counsel's office so this exciting new use may cornmence.

THIS LICENSE is granted this _ day of _ 2014, by the City of Danbury, 155 Deer Hill Avenue (hereinafter "City") to Danbury Hackerspace, Inc, a non-profit corporation, of the City of Danbury, County of Fairfield and State of Connecticut, (hereinafter "Licensee"):

WHEREAS, the Licensee wishes to obtain a license from the City permitting Licensee to use a portion of the first floor of a certain building located at'150-162 Main Street as described on Schedule A attached hereto and incorporated herein (hereinafter "Licensed Premises').

NOW, THEREFORE, in consideration of the mutual promises, covenants, and conditions contained herein, the parties do hereby agree as follows:

1. The City does hereby grant a non-transferable, revocable license to the Licensee to allow Licensee to use the property described subject to the further provisions hereof.

2. This license shall commence on the day first written above and shall continue, unless sooner terminated in accordance with the terms hereol and shall continue until terminated as provided for herein, upon payment of an annual license fee of one dollar ($1.00).

3. Non-RentObligations.

(a). Utilities and other costs. The Licensee agrees that it shall be responsible for, and pay, including but not limited to alectricity, internet, cable, hot water, heat, air conditioning, telephone and all costs utilities, including-pest water, sewer, alarm security services, control and garbage removal, utilized for the premises leased. Such costs shall include use charges as well as any expenses relating to maintenance or repair of facilities necessary to provide the utilities or services as identified. (b).' ' Cleaning Services. The Licensee agrees that it shall retain the cleaning service utilized by the City to clean the premise-s at least 5x per week, with costs thereof paid by Licensee as billed- Any other service for thls purpose must be pre-approved bY the CitY.

4. The Licensed Premises is shown on Schedule A as "AREA A" and shared space in 'AREA B' and Schedule A-2.

5. The use of the Licensed Premises shall be for the limited purposes as set forth in Schedule B hereof. Prior to making any improvements, alterations or modifications thereto, or placing any fixtures or personal property upon or abo-ve the aiea of the Licensed Premises, the Licensee shall submit a detailed site plan to the Superintendent of public Buildings, or his/her designee depicting the nature and location of the proposed improvements, alterations or modifications. All improiements, alterations or modifications shall be made in accordance with the approved plan. prior to starting the work, the Licensee shall obtain all permits necessary from any state or local agbncy or department which mly be required by law to make such improvements, alterations or modifications.

6. Either the Licensee or the City may terminate thls license without obligation or liability of any kind to the other as a result of said termination, upon written notice to the non-terminating party. For purposes of the termination provision of this license, the Mayor of the City shall have authority to exercise the City's right of termination on the City's behalf.

7. During the term hereof, Licensee shall take out and maintain such Comprehensive General Liability Insurance as will piotect it and the City from claims from damages for personal injury, including. action or omissions in the couise of the use of this license property, whither such actions or omission are undertaken by the Licensee or by directly or indirectly employed any contractor or suoconii""torf ireit by'or on behalf of the License'e or any ,anyone bytr acting on behalf of any of the foregoing entities. The minimum limits of such insurance shall be as follows:

Bodity Injury Liabitity and Property Damage Liability $2,000,000.00 (combined) each occurrence

prior to the execution of this license, certificates of such insurance shall be filed with the City for its review.. All of the protectio-n they policies of insurance shall be subject to the approval of the city with legard !9_tl'9_4ery.?cy purport to provide. THE ctTy SHALL BE NAMED AS AN AbDITIoNAL INSURED oN EACH SUCH PoLlcY. insurance companies providing coverage hereunder shall be licensed by the State of Connecticut or otheMise acceptable to the City. Full diiclosure of all exclusions shall be provided with respect to all required coverages. All p;ticies relating t6 this license shall be written so that the City shall be notified of cancellation or change at least ten (10) days prior to the effective date of such cancellation or change' l-A Certiflcates of insurance shall be filed in hiplicate with the City and shall state the limits of liability and the expiration date for each policy and type of coverage. Renewal certificates covering the renewal of all policies expiring during the life ofthis license shall be filed with the City not less than ten (10) days before the expiration of such policies.

The Licensee agree that in the event that one or more claims are paid under policies contalning an aggregate coverage limit, it shall immediately notify the City thereof and at the same time shall either reinstate the limits of said policy or policies or obtain a new policy or policies providing for fuli coverage in accordance with the limits established herein. Said replacement coverage shall be obtained within twenty-four (24) hours and the City shall be notified thereof within said time.

8. The Licensee agree that it shall indemnify and save harmless the City and any of its officers, agents, employees, Boards, Commissions and Representatives who may be named as co-defendants in any claim or suit, on account of any and all claims, damages, losses, judgments, litigation expenses and legal counsel fees arising out of injuries to persons (including death) sustained by or alleged to have been sustained by the otficers, employees, agents, Boards, Commissions and Representatives of the City or by any officers, employees, agents of the Licensee, or by any business invitee or patron of the Licensee, or arising out of damage to property real or personal, including the occupancy of the Licensed Premises and/or the sidewalk adjacent to the Licensed Premises, alleged to have been caused in whole or in part by acts or omission of the Licensee or any business invitee of the Licensee or by anyone directly or indirectly employed or working for the Licensee, including volunteers, subcontractors, materialmen, suppliers and agents, in connection with the license or use of the Licensed Premises. The Licensee further undertake to reimburse the City for any damage to its real or personal property occurring in connection with the license or use of the licensed property by the Licensee or by any of its officers, agents or employees or any of its business invitees, unless the damage is caused by the City. The Licensee agree to comply with, and conform to all laws of the State of Connecticut, and to the ordinances, rules and regulations of the City and to obtain all necessary permits to make any improvements, alterations or modificationa to the Licensed Premises, from any applicable authority, including but not limited to the State of Connecticut, the Department of Health, Housing & Welfare, the Fire Marshal and the Department of Planning and Zoning of the City.

10. The Licensee agrees to restore the Licensed Premises to its originai condition upon the termination of the license to the sole satisfaction of the City

11. The Licensee agree that no accumulation of boxes, barrels, packages, waste paper, or other articles shall be permitted in or upon the Licensed Premises, and that it shall maintain the Licensed Premises in a neat and orderly condition.

Re: Historic Document Reserve Account

I would like to request $13,050.00 be appropriated from Historic Document Reserve Accotnt2-2129 to be transfened to Office Equipment 002.1 160.5700.2700 to order 3 map cabinets and hanging strips to accommodate the maps which are filed in this office. Also we have been working on the old maps which are filed in draws and put them into the new hanging map files. See attached quote.

I would also like to request $5,990.00 be appropriated from Historic Document Reserve Account 2.2129 to be transferred to Outside Services 002.1 160.5300.2040 for Cott Systems to load index history to the land record system. Cott Systems is our land record system and they found this index history. See attached proposal.

Therefore the total amount requested from the Historic Dbcument Reserve Account is $19,040.00.

Please note that the Historic Document Reserve Account is for the Town Clerk's Office and must be used for the "preservation and management of historic documents"'

On lZSDOlg on behalf of he Danbury Police Explorers, the Explorer Post purchased a 2006 Ford E350 Super Duty 12 passenger Van, VIN #1F8NE31176D467931 , with a trcw package. This van was previously oivned by Sgl Lobraico's late mother--inlaw and he notified us that it was avaihbb and may suit our needs. On 12t4D013 | asked public works mechanic it erian Ledan to inspect the van as he did our last one in 2OO8 tirat Boehringer-lngelheim donated to the. post He told me that ippeared to be in excellent condition and should serve our needs well. He noted no issue hat would prcdude the city from accepting this van into our fleet.

Our post has over 80 youh on its rosbr and regularly perbrms community service evenb with over thirty Explores. In fact the Memorial Day paride had 63 Explorers assiJting. Aiso, we have had at least two days in fie past year where we assisted in three evenb iimulhneously. For he last two years the post has had to hire a school bus to transport Explorers to he annual Cadet Police Academy at the University 6t nartiorC and o$er evenb such as the NERLEEA SHion's Day at the Academy in Meriden. About 30 Explorers attended the Academy each year ftom our post

Furthermore, his van has a tcw hitch which will give us t\^/o vans capable of torving our two failers..This third van is needed to help us safely meet our mission. I sent this letter trc Chief Baker for approval and he requ_e.sted that I address it to Mayor eoughton and tie City Council. WHEREAS, the United States Department of Homeland Security, through the State of Connecticut Department of Emergency Management and Homeland Security ("DEMHS") has made funds available for the 2012 federal fiscal year State Homeland Security Grant Program; ano

WHEREAS, said program requires authorization to enter into a Region 5 Memorandum of Agreement to engagsin the regional cost sharing and allocation of funds for the purposes of this program, as may be recommended by the regional body; and

WHEREAS, there are no required matching funds.

NOW, THEREFORE, BE lT RESOLVED THAT the City Council of Danbury authorizes Mayor Mark D. Boughton or his designee, Paul D. Town of Danbury 2012 HSGP Omnibus MOA MEMORANDUM OF AGREEMENT fi-a REGARDING USE OF /d' FEDERAL FISCAL YEAR 2012 STATE HOMELAND SECURITY GRANT FUNDING AND CUSTODIAL OWNERSHIP OF REGIONAL ASSETS IN DEMHS REGION 5

A. lntroduction The following facts are understood and agreed to by all parties: 1. The parties to this part of the Memorandum of Agreement (MOA) are the State of C{nnecticui Department of Emergency Services and Public Protection (DESPP), including the Division of Emergency Managemint & Homeland Security (DEMHS), the Town of Danbury, the Litchfield Hills Coun6il of Elected-Officials, and the Region 5 Regional Emergency Planning Team (Region 5 REPT). 2. DESpp is the designated recipient and State Administrative Agency (SAA) of the United States Department of Homeland Security for Federal Fiscal Yeat 2012 State Homeland Security Grant Program (SHSGP), Grant Number EMW-2012-SS-991 54, including the following _p.rograms: Metiopolitan Medical Response System (MMRS); Citizen Corps Program (CCP). DEMHS is the division of DESpP responiible for program management of the grants, including consulting with the DEMHS Advisory Council, and the DEMHS Regional Planning Teams to provide a coordinated and integrated program of emergency management and homeland security. 3. The DEMHS Coordinating council, now known as the DEMHS Advisory council, has approved the allocation formula for granl funds available under such programs as the SHSGP, MMRS, CCPI 4. DEMHS is retaininq pass-through funds from SHSGP Grant Number EMW-2012-SS-99154 in the set- total amount of $1 J81,344on behalf of local units of government, for the following seven regional aside projects designed to benefit the state's municipalities:

a. Expanded Regional Collaboration; b. Connecticut Intelligence/Fusion Center/Criiical Infrastructure; c, CBRNE Detection/lED Attack Deterrence; d. Medical Preoaration and ResPonse; e. NIMS/lCS Training and Exercise; f. Metrooolitan Medical Response System; and Citizen Corps. Program

5. DEMHS - in coordination and cooperation with the municipaljties located within DEMHS Region 5, including Danbury - has created, and established bylaws for, the Region 5 REPT, a multi-di""Pil."ty, multi-luri-sdictional regional group to facilitate planning and resource coordination within DEMHS Region 5. 6. Danbury is eligible to participate in those Federal Fiscal Year 2012 SHSGP regional allocation: lade through the nEgion S-Reetand not included in the sefaside projects, in the amount of $161,288 for Regio'n 5, which will be made available to the jurisdictions in Region 5 in the manner rec_ommended -the grant by Region 5 REPT in accordance with its approved bylaws, upon execution of the application and as accepted by the SM. B. Purpose of Agreement Tha Sp,A and banbury enter into Part I of this MOA authorizing the SAA to act as the agent oJ Danbury and allowing the S4,qio retain and administer grant funds provided under Grant Number EMW-2012-Ss- 99154 for the seven regional set-aside prolelts listed above, and also for Litchfield Hills Council of Elected Officials to provide the flnancial and programmatic oversight described below' c. Town of Danbury 2012 HSGP Omnibus MOA approved by the federal Department of Homeland Security and supported by the Initial Strategy lmplementation Spending Plan (lSlP) approved by the Emergency Management & Homeland Security Coordinating Council. Danbury agrees to allow the SAA to hold, manage, and disburse the grant funds that have been reserved for the seven regional set-aside projects listed above.

Litchfield Hills Council of Elected Officials and Danbury Responsibilities. Danbury also agrees to allow Litchfield Hills Council of Elected Officials to provide financial and programmatic oversight of the Federal Fiscal Year 2012 regional allocation not included in the seven iegional set-aside piojects in the amount of $161,288 targeted to member municipalities in DEMHS Rjgion 5 and recomm'ended through the Region 5 REPT in accordance with its approved bylaws. Such fun-ds will be applied to specific projects developed and approved by the Region 5 REPT and DEMHS. Successor Fiscal Agent Responsibilities. The parties agree th;t the Litchfield Hills Council of Elected Officials is the successor fiscal agent to the Council of Governments of Central Naugatuck Valley (COGCNV), and as such shall perform seryices as necessary to implement any previous rry Hscp grants, including, but not limited to, the FFY 2009 HSGP SupDlemental.

II. AGREEMENT REGARDING CUSTODIAL OWNERSHIP OF REGIONAL ASSETS A. lntroduction The following facts are understood and agreed to by all parties: 1. AgreemenG and Responsibilities of the Parties. 1. Definitions. As used in this MoA: . The term "authorized training' means training thai is authorized by DEMHS' . The term 'custodial owner' means a political subdivision or tribe that has agreed to accePt title and responsibility for the asset(s), subject to possible redeployment under the terms outlined in Paragraph C(7) below. 2, Responsibilities of DEMHS and LHCEO. Town of Danbury 2012 HSGP Omnibus MOA -" ,7 ln its role as SAA, DESPP/DEMHS will subgrant funds to Litchfield Hills Council of Elected Officials, 'f 7 which, as the Region 5 FiscalAgent, will procure the asset(s) listed in Appendix A Amendment of Appendix A. The parties agree that decisions regarding the placement of regional assets in Danbury may be made after the execution of this agreement and that Appendix A shall be amended accordingly (see attached form). Danbury agrees to be bound by the terms of this agreement for any asset added to Appendix A. The parties also agree that any amendment to Appendix A must be signed by the DEMHS Deputy Commissioner, the Chair of the Region 5 REPT, and the Chief Executive Officer, or his/her designee, of Danbury. 4. Responsibilities of Custodial Owner/Danbury. Danbury understands that it is the Gustodial Owner, on behalf of itself and the Region, of the asset(s) listed in Appendix A, as may be amended pursuanl to Paragraph C(4) above. As Custodial Owner, Danbury agrees: a. To safeguard the asset(s) in a secure location, including, for example, providing refrigeration or protection from the elements, if appropriate, b. To regularly test, use and maintain the asset(s) in working order. lt is understood bythe parties that tralned personnel of Danbury municipal agencies may use the asset(s) for appropriate emergency response/emergency management purposes, including authorized training and exercise; c. To provide the asset(s) in a timely manner, in working order, and with appropriate staffing, if necessary, when deployment is requested: under the terms of thls MOA; under a mutual aid agreement, including a civil preparedness riutual aid agreement approved by DEMHS' as required by Conn. Gen. Stat. S28-7(d); under the terms of the intrastate mutual aid system, connecticut General statutes s28-22a; or at any time by the state of connecticut, including DEMHS; d. To provide the asset(s) in a timely manner, in working order, and with appropriate staffing, if necessary, when deployment is requested for authorized training and/or exercise; e. To maintain records of the use of the asset(s), includlng deployment for an actual incjdent or for authorized training, and to provide these records to DEMHS as requested; (including the f. To maintain an inventory of the asset(s), including a unique tagging system - DEMHS logo) so that th'e asset(s) can be easily identified as separate from the Custodial Owne/s other property, and to provide that inventory to DEMHS as requested g. To maintain all necessary insurance regarding the asset(s) and their use; h. To cooperate with any state or federal audit of lhe asset(s) and/or iheir use; i. To abide by the bylaws and/or procedures established under any applicable State of Connecticut or regional plan; j. That the state, including DEMHS, does not guarantee any further funding for, or provision of repairs to, the asset(s) beyond the terms of this MOA; k. That all maintenance and operations of the asset(s) by Danbury shall conform to the manufacturer's recommendations. lf appropriate, Danbury shall maintain trained personnel available to transport and supervise the operation of the asset(s). All personnel or agents of Danbury performing any maintenance or repair services in connection with these asset(s) shall be fully quil6led and authorized or permitted under federal, state, and local laws to perform such services. Responsibilities of the REPT. The Region 5 REPT understands and acknowledges that, in accepting responsibility as the custodial owner o:f the asset(s), Danbury is furthering regional collaboration and mutual aid on behalf of all of the members of Region 5. Assignment of Asset(s). lf Danbury does not comply with the requirements under this MoA, or terminates its involvement in this MOA:then DEMHS, inconsultation with the REPT Chair, may redirect the asset(s), preferably to a different town within the Region. whenever possible, DEMHS will provide 60 days' notice before re-assigning the asset.

A. Effective Date. The terms of this agreement will become effective when all parties have executed it. Authority to Enter Agreement. DESPP/DEMHS is authorized to enter into this Agreement through the Deputy Commissioner of the Department of Emergency Services and Public Protection, Division of Emergency Management & Homeland Security, pursuant to the authority provided under Connecticut General Statutes S4-8 and Titles 28 and 29. The Town of Danbury (Danbury) is authorized to enter into this agreement through its Chief Executive Officer, authorized pursuant to the attached foriginal or certified copy of resolution, ordinance or charter provisionl. The other persons executing this Memorandum of Agreement (MOA) on behalf of their respective entities hereby represent and warrant that they have the right, power, legal capacity, and appropriate authority to enter into this agreement on behalf of the entity for which they sign, as indicated by valid resolutions, if necessary. c. Duration of Agreement. part I of this MOA, as modified with the consent of the parties, remains in full force and effect until the end of the grant period, or any extension thereof, covered by this MOA, unless cancelled by the SA.i{' giving Danbury written notice of such intention at least thirty (30) days in advance. Any party may terminate its involvement with Part ll of this agreement upon sixty days' written notice to the other parties. DEMHS reserves the right to cancel any funding under this MOA without prior wriften notice when the funding is no longer available. Amendment of the Agreement. This agreement may be modified upon the mutual written consent of the parties E. Litigation. ThJparties agree to good faith consultation with one another to resolve disagreements that may arise under or relating to this MOA before referring the matter to any other person or entitf for settlement...The parties agree th;t any disputes under Part ll, Paragraph C.6 shall be resolved by DEMHS. The Parties presentation of any claim against th-e also agree that the sole and exclusive means for the state, . including the SAA, arising from thls agreement shall be in accordance with Chapter 53 of the Connecticut Generaistatutes (Claima Against the State) and the Parties further agree not to initiate legal proceedings in any State or Federal Court in addition to, or in lieu of, said Chapter 53 proceedings. F, State Liability. The parties agree to indemnify and hold harmless the State of Connecticut with regard to the activities described wittin this MOA, and recognize that the State does not waive its right to sovereign immunity with regard to any provision of this MOA. The State of Connecticut assumes no liability for funding under the terms of this MOA until Danbury, through the Region 5 REPT, is notified by the S4,q that this MOA has been approved and executed by DEMHS and by any other applicable state agency. Audit Compliance. lf Danbury, through the Region 5 REPT, agrees to serve as a host or custodial owner of equipment purchased with the grant funds referenced in this MoA, then Danbury must comply with the Federal Single Audit Act of 1984, P.1.98-502 and the Amendments of 1996, P.L. 104-156 and with the Corinecticut Statutes S7-396a and 396b, and the State Single Audit Act S 4-230 through 236 inclusive, and the regulations promulgated thereunder. Danbury agrees that allfiscal records, if any, pertaining to the projecti shall be mainta-ined for a period of not less than three (3) years from the date of the signing of this MOA. Such records will be made available to state and/or federal auditors upon request. H. Lobbying, Debarment, and Suspension. Danburyiommits to compliance with the requirements under 28 CFR Part 66 (Uniform Administrative Reouirements for Grants to States); 28 CFR Part 69, New Restrictions on Lobbying; 28 cFR Part 67, Government-wide Debarment and Suspension (Nonprocurement) and Government-wide Requirements for Drug Free Workplace (Grants); ofiice of Management and Budget (oMB) Circular A-87, addressing governments; 28 CFR Part 70 (Common Rules for cost principles for grants to state and local - Administrative Requirements for Grants to Non-Profits); OMB Circulars 4-122 and A-21 addressing Cost principles for Grants to Non-Profit Entities and requirements included in the Department of Homeland Security Office of Grants and Training Financial Guides. This contract is subject to the provisions of Executive Order No. Three of Governor Thomas J. Meskill promulgated June 16, 1971, and, as such, this contract may be cancelled, terminated or suspended by 7-6 the State Labor Commissioner for violation of or noncompliance with said Executive Order No. Three, or any State or federal law concerning non-discrimination, notwithstanding that the Labor Commissioner is not a party to this contract. The parties to this contract, as part of the consideration hereof, agree that said Executive Order No. Three is incorporated herein by reference and made a part hereof. The parties agree and abide by said Executive Order and agree that the State Labor Commissioner shall have continuing jurisdiction in respect to contract performance in regard to non-discrimination, until the contract is completed or terminated prior to completion. Danbury agrees, as part consideration hereof, that this contract is subject to the Guidelines and Rules issued by the State Labor Commissioner to impiement Executive Order No. Three, and that it will not discriminate in its employment practices or policies, will file all reports as required, and will fully cooperate with the State of Connecticut and the State Labor Commissioner. This contract is also subject to the provision of Executive Order No. 16 of Governor John G. Rowland promulgated August 4, 1999 adopting a zero tolerance policy for workplace violence, and as.such, this contraCt may be cancelled terminated or suspended by the State for violation of or noncompliance with said Executive Order No. Sixteen. The parties to this contract, as part of the consideration hereof, agree that said Executive Order No. Sixteen is incorporated herein by reference and made a part thereof. The parties agree to abide by such Executive Order. The contract is also subiect to provisions of Executive Order No. Seventeen of Governor Thomas J. Meskill promulgated February 15,1973, and, as such this contract may be cancelled, terminated or suspended by ihe contractin! agency or the State Labor Commissioner for violation Of or non-compliance with said Executive Order No. Seventeen, notwithstanding that the Labor Commissioner may not be a party to this contract. The parties to this contract, as part of the consideration hereof, agree that Exetutive Order No. Seventeen is incorporated herein by reference and made a part hereof. The parties agree to abide by such Executive order and agree that the contracting agency and the stale Labor C-ommissioner shall have joint and several continuing jurisdiction in respect to contract performance in regard to listing all empbtment openings with the Connecticut State Employment Service. J. Non-DiscriminationClause. In accordance with Public Act 88-351 , the Town agrees and wanants that, (a) For the purposes of this section, "minority business enterprise' means any small grantee or supplier of materials fifty-one percent or more ofthe cip1al stock, if any, or asset(s) of which is owned by person or persons: ('1) Who.are active in the daily affairs of the enterprise, (2) who have the power to direct the management and policies of the enterprise and (3) who are members of a minority, as such term is defined in subsection (a) of Conn. Gen. Stat. Sect. gZ-gn; and "good faith" means that degree of diligence which a reasonable person would exercise in the performance of legal duties and obligations. "Good faith efforts' include, but not be llmited to. those ieasonable initial ;fforts necessary to comply with statutory or regulatory requirements and additional or substituted efforts when it is determined thal such initial efforts will not be sufficient to comply with such requirements. For purposes of the section, 'commission" means the commission on Human Rights and opportunities. For purposes of this section, 'Public works contract' means any agreement between any individual, firm or c;rp;ration and the State or any political subdivision of the State other than a municipality for constiuction, rehabilitation, conversion, extension, demolition or repair of a public building, highway, or other changes or improvements in real property, or which is flnanced in whole or in part by the State, including but not limited to, matching expenditures, grants, loans, insurance or guarantees' The Town agrees and wanants that In the performance of the contract such Town will not discriminate or permit discri-mination against any person or group or persons on the grounds of rac€, coior, religious creed, age, marital status, national origin, sex, mental retardation or physical disability, including bui not limited to-, blindness, unless it is shown by such Town that such disability prevents performance of the work involved, in any manner prohibited by the laws of the United States or of the State of Connecticut. Chairman Seabury called the meeting at 7:00PM. In attendance were council members Visconti and Nero. Also in attendance were Mark Nolan, Friends of Tarrywile; Dave Manacek, Tarrywile Park Authority;Rick Palanzo, Public Buildings Superintendent; Becky Petro, Tarrywile Park Executive Director; Dennis Elpern, Director of Planning and Michael Marcus, Chairman of the Tarrywile Park Authority. Also in aitendance were ex-officio council members, Peter Nero, Michael Haddad, Duane Perkins, Wanen Levy and Colleen Stanley and members of the public.

Following introductions, Chairman Seabury stated that the purpose oJ the meeting to discuss Hearthstone Castle and possibly recommend to the Council of the Whole authorization for an application for a grant in ihe amount of $25,000 with a partial match by the City of Danbury.

Rick palanzo was called upon to start the discussion. The building has a lot of benefit to it, but needs considerable work. A thorough study was done with some suggested uses for the building. A structural engineer needs to be engaged to do an analysis no matter what is done with the castle.

Dennis Elpern gave a brief overview of the study performed by the consulting team. lt was determined urgency that it would colt $+S,0OO to develop engineering plans to stabilize the castle. There was some in the evaluation because the struclure ii in danger of collapse. The castle is considered an historic structure and is on the National Register of Historic Structures. The CT Trust for Historic Preservation has expressed interest in restoring ihe castle. The walls are in pretty good shape but a retaining wall is in danger of falling affecting the rest of the structure. The study document indicated possible uses includi'ng a schooi which would be a very unique use and the only type in the slate. The first step would be to do-the engineering work in order to obtain working drawings and then stabilize the castle.

Upon the request of council member Wetmore, Mr. Palanzo stated that the castle is located off of Biushy Hill Road, is fenced off and an individual would need to walk into the site.

Council member Visconti requested clarification on grant applications. Mark Nolan stated that there are several grants available. The study that was performed was very comprehensive and.the- request is move tolhe next step, to have structural engineering plans in place to secure the castle from further deterioration and to make it safe. The authoiity wouh then move foMard incrementally, leveraging city funds with state funds, with Friends of Tarrywile, Tarrywile Authority and members of the business ancl public community. The Women's Club of Danbury/New Fairfield has adopted the castle for their annual iundraising effori and would be donating towards this next step. State Representative Esty has committed to work on federal level to secure funding for the castle.

Dennis Elpern stated that he came to Danbury in 1988 and at that time, the castle was in pretty good shape, bui over time the inside of the building collapsed due to lack of maintenance. He ended by stating that if you want a great city you have io do great things and this would be a great thing for the City.

Upon the request of council member Perkins, Mr. Elpem stated that the castle was a low priority and maintenance was not funded and addressed. Rick Palanzo stated that the last work done was prior to the establishment of the Tarrywile Park Authority. Some work was done to stabilize rotting timbers and roof truss timbers under Mayor Sauer and was probably the last work done. Mark Nolan stated that r1

$408,000 is needed to stabilize the walls, as the walls stand and it would be a struclure in the woods. There would be no change in access.

A discussion regarding the frequency of accepting unwrapped coins, the logistics. and security of accepting ioins ensued. l.,lr, Ferguson, Tax Collector, stated that accepting large quantities of unwrapfed and wrapped coins creates an undue burden for his staff, other tax payers, and the bank will noi accept this amount of coin in one deposit. The discussion continued about the legal issues related to accepting coin to pay taxes and notice of the amendment to the public. Mr' Le-vy commented that most rules and regulations are made for those who want to step outside the normal lines. He continued that this ordinance was designed to prevent the problems associated with those who want to make a statement; there is flexibility in the ordinance so the Tax Collector can accept a reasonable amount of coin.

(c) Membership. Said commission shall consist of ten (10) regular members, six (6) who shall be chosen from legal residents of the city, three (3) who shall be chosen from non- residents outside of the cit5z and one (1) ctty offcial, for their knowledge, competence or experience in connection witJl nature conserva.ncy, by the mayor subject to the approval of the cit5r council.

I. Program Synopsis

Per the proposal endorsed by Mayor Boughton and the City Council, Dream Homes Community Center (DHCC) was established at ARC to serve as the Point of Entry for people who are homeless or low-income renters and to facilitate first-time home ownership for people with hard-to-serve backgrounds.

II. Program Updates

Dream Homes Community Center continues to put the “Boots on the Ground” in the efforts to end homelessness. The numbers of people served throughout Danbury continues to increase. Through our Coordinated Access Services, Dream Homes Community Center has served 368 people in the city of Danbury alone since July 1, 2013.

Point of Entry Since July 1, 2013, DHCC has provided services to 544 people (70 individuals and 131 couples and families) through the Point of Entry at ARC. The following is a breakdown by town:

III. Outreach Highlights: Dream Homes Staff attended the following meetings and trainings:

• Housing Advocate Sharice Coleman attended the “Revolving Door” meeting at the City Center. Representatives from different agencies in the city of Danbury met to discuss how to address homelessness in Downtown Danbury.

• ARC’s Executive Director, Rev. Phyllis J. Leopold, and DHCC Housing Advocate Sharice Coleman attended the monthly Danbury Housing Partnership meeting. DHP discussed updates on the RFP for a consultant to lead a study on chronic homelessness. Next step is for the review committee to review the RFP’s in January. The financial results of the DHP Breakfast were also discussed, very successful and ended on time! Project Homeless Connect was also highlighted as an achievement for this month.

• Housing Advocate Sharice Coleman attended the Project Homeless Connect meeting. Members met at WCSU for a walk through of the gym to discuss the set up of the event.

• ARC’s Executive Director, Rev. Phyllis J. Leopold, and DHCC Housing Advocates Sharice Coleman and Heather Ely attended the Annual Project Homeless Connect event. The Advocates managed an information booth. All staff were able to network with other agencies in the community as well as provide information to the homeless population and other agencies.

• Housing Advocates Sharice Coleman and Heather Ely continue to meet once a week at Dorothy Day to perform homeless outreach for ARC.

• Housing Advocates Sharice Coleman and Heather Ely attended bi-weekly Case Management meetings at Catholic Charities. Case Managers from different organizations in the community came together to discuss client issues, referral issues and process and different ways to continue the efforts of ending homelessness.

• Housing Advocates Sharice Coleman and Heather Ely attended the Monthly Balance of State meeting for the HUD Grants. Housing Advocates were updated on the changes that HUD is requiring and other matters that agencies should look out for in the upcoming months.

• Housing Advocate Sharice Coleman attended a follow up Project Homeless Connect Meeting. Updates on the Annual Event were presented along with statistics of the population served during the event. Committee members also discussed things that the committee would like to see changed for next year’s event.

IV. Program Highlights—Story of one family served by DHCC this month (names changed)

A Point of Entry and Coordinated Access Success Story

Richard and Crystal were referred to ARC by the AIDS Project. Richard had been released from prison and was staying at a shelter in Danbury and Crystal had been doubled up with a friend for a couple of months. The couple had been working with a case manager from AIDS Project to find housing and were having a difficult time.

Since Richard was released from prison he wasn’t working and Crystal, his wife, was working two jobs trying to save money to afford housing. Richard came to ARC requesting housing and financial assistance. ARC’s Housing Advocate met with Richard and Crystal and reviewed their current income. Housing Advocate quickly determined that even with Crystal working two jobs, Richard would need to find employment in order to secure housing. Housing Advocate along with the AIDS Project worked closely with Richard in searching for jobs and filling out job applications.

Within two weeks of Richard and his wife coming to ARC, Richard was able to gain two part time jobs with a third is in the process. With Richard gaining two part time jobs and Crystal working a full time and a part time job, the couple would be able to sustain housing. DHCC Housing Advocates worked closely with the couple to establish an affordable rent that would not be a strain on their finances. Through a collaborative effort, AID’s Project and ARC’s Housing Advocate began to assist Richard and Crystal in their search for housing.

An affordable apartment for Richard and Crystal was located, just before the holiday. DHCC Housing Advocate met with the potential landlord and performed a housing inspection to ensure housing was adequate for the couple. Housing Advocate was able to secure a partial payment toward a Security Deposit and was able to arrange a payment agreement between the couple and the landlord to pay off the remaining balance of the Security Deposit over time. The AIDS Project was able to supply payment of the couples’ first month’s rent.

The couple has moved into their new home. They are working hard, and are happy to be back together and able to celebrate the holiday season in their new home.

FIRE CHIEF'S MONTHLY REPORT

I hereby submit my report as Fire Chief of the Danbury Fire Department, which covers the period of 21 November through 21 December 2013 and details activities of the Department. Happy 2014! Once again the cold weather is back after an all too brief respite. Cold weather brings about certain risks and the need to practice some basic precautions. These include being sure heating systems are operating correctly as well as having functioning carbon monoxide detectors in your homes. If you have a heating system where there is a fuel burned, whether it is wood, pellets, fuel oil or gas, there is the potential for a carbon monoxide exposure. Additional precautions are necessary when outdoors either recreationally or even while walking to or from a vehicle. With extreme cold comes the risk of hypothermia. This I condition results when a body is exposed to prolonged cooler temperatures or even short times exposures to very cold temperatures. This is an especially serious risk for elderly or the very young. Please be sure to cover childrens’ heads and hands and limit exposure for elderly or anyone whose circulation is impaired. Winter recreation often includes sledding, skiing and snowshoeing for example. It is necessary to take some simple risk reductions here as well. We advise that wearing a helmet while skiing or sledding is always a good idea. There are many serious injuries each year that might be prevented or lessened if helmets are used. It is also important to remember the recent warm spell and the lack of ice on the water in the area. The snow may cover a thin coating of ice and before venturing out either on foot, skis or snowshoes, please be certain the ice is thick enough to hold you as you

1 cross. And finally, never venture far without a friend or telling someone where you are going and when you expect to return. Have a great New England winter!

Public Education / Prevention / Public Relations

Crews participated in the Salvation Army food drive and the Angel Tree toy drive, both again spearheaded by Lt. Chip Daly. Our Smoke detector installations continued this period. Engine 22 delivered Santa to St. Paul’s Church and stayed to entertain attendees of the Santa’s Workshop holiday festivities on December 21st.

Suppression / Response Activities of Note

The crew at Engine 25 rescued a young girl who was badly injured while sledding at Richter Park. FF Stabile provided excellent care to the child while awaiting the

2 stretcher. After treating her she was carried up the snowy hill and transported to the ER.

Crews responded to a structure fire at the former Borders Books being remodeled into Planet Fitness. The investigation of this fire found that metal studs were energized behind sheetrock due to an electrical cable penetrated by a screw.

A basement fire caused by improperly placed hot fireplace embers was extinguished on Farview Avenue.

Emergency Medical / Haz-Mat - Rey Rodriguez

EMS Wednesday Each year sudden cardiac arrest strikes about 220,000 Americans. CPR and early defibrillation are the most critical factors in determining patient survival. Studies indicate that survival rates from sudden cardiac arrest can exceed 50 percent if CPR and defibrillation are administered within the few minutes. For the month of December, make up classes in CPR were offered to make sure that all members of the department are certified in this life saving skill.

HazMat Training: A Four Gas Meter/Photo Ionization Detector metering and monitoring class was provided to the members of A-group on two separate dates as a make up for the members of the department who had missed the Haz-Mat component of the year end training evolutions.

Medical Control: The Department’s 40 Advanced Emergency Medical Technicians will be applying for medical control for the up-coming year from our sponsor hospital, Danbury Hospital. This involves meeting the continuing medical education requirement set forth by the Department of Public Health and the Danbury Hospital.

Training - Mark Omasta Volunteer Division

Quarterly Fourth quarter training which consisted of live burn drills is complete. 102 Volunteer personnel participated in this Fourth Quarter training that was held on 5 dates from October into December. We currently have 124 active Volunteer firefighters: 85 interior, 11 exterior, 17 support and 11 probationary firefighters. Probationary personnel are new members and are enrolled in our next firefighter course which starts in January. Steve Ortiz (Eng 9) and Lauren Symon (Eng. 13) passed all their certification exams and are now CT certified Firefighter I.

Career Division

Ice Rescue training was conducted. Airport layout drill and standpipe/hose pack drill were held.

Recruits Our 14 recruits successfully completed the 15 week Fire Academy class and graduated on December 6. The graduation ceremonies were held in Milford. These probationary firefighters spent the next week at Fire Headquarters with a full schedule of orientation and training. They received their shift assignments and started working with their crews on Dec. 15.

Mandatory Training Mandatory training for all crews was completed at the end of November. All drills were conducted at our Fire School facilities and burn building.

Deputy Chief Training Our Deputy Chiefs participated in an all day workshop on Dec. 13 presented by the CT Fire Academy. Incident Commander Responsibilities for various incidents was the major topic.

High Rise Firefighting tactics A High Rise Firefighting seminar was held at the Danbury Hospital Creasy Auditorium on Dec. 7. The class was presented by Chief Ron Kanterman from Gold Horn Associates and sponsored by Danbury Hospital, Danbury Housing Authority and the

Danbury Fire Dept. Approximately 50 people from Danbury and neighboring towns attended this informative event.

Naugatuck Valley Community College The new Fire Behavior and Combustion class has gone well. This fall semester class ended with the final exam on Dec. 18. We will offer a new course, “Firefighter Safety and Survival” for the spring 2014 semester.

Fire School Fire Departments from Newtown, Dodgingtown, and Hawleyville utilized our facilities for various training activities. The school is also being used frequently by the Danbury career and volunteer divisions for annual live burns and other training such as rescue and tool evaluations.

EAP All crews sat in on an informational session with our Employee Assistance Program representative.

Pump Operator Firefighters Mike Vitolo and Tim O’Hanlon successfully completed the requirements for driver/pump operator.

Apparatus / Equipment - Joe Cavo

The Department’s 4-gas meters were calibrated this month. We replaced the O2 sensor in E-25’s meter. The third new staff car is complete and after some repairs and installation of software should be ready to be placed in service. This past month all of the department’s ground ladders were tested and as required, heat labels replaced by a third party testing company. We worked with this company as testing progressed replacing rivets and other minor repairs. A 14’ roof ladder and a 24’ extension ladder that were previously removed from service by our division did in fact fail the testing process. We sent them out to be evaluated and received notice this week that the cost to repair the damage was more than the cost of a new ladder. The SRV had a sudden transmission leak and it was discovered that the repair was covered by Ford under a silent recall.

We presented several fire prevention talks this month including one at Crosby Manor and one at Jericho Partnership. Both were well received. DFM Osborne was at the CT Homeless Outreach this month, another successful event. The smoke detector program is still receiving calls but has slowed slightly due to the weather recently. Inspections continue daily on all buildings that are due in the month of December.

The November 2013 Health & Human Services Department monthly report is provided for your review. Detailed reports are attached for each Service, including the Housing, Food Service, Lead Poisoning Prevention, Social Services transition, Seasonal Work, School Based Health Centers transition and Environmental Health which identify specific inspections, tasks and hours provided by our staff.

Main Topics: The Department continues to work on the computer systems to test and update our inspector’s programs to produce reports so the public may have access to inspection results and improve partnerships with the Hospital and other medical clinics to improve services have continued as well. On Friday December 13, 2013, the Greater Danbury Continuum of Care in conjunction with the City of Danbury’s Housing Partnership and Social Services Department held the Seventh Annual Project Homeless Connect. You are encouraged to review all the information for each Division, as it provides details concerning ongoing activities. Environmental Health Division Narrative Report 3

The status of major project and program activities of the Environmental Health Division (EHD) for November, 2013 can be summarized as follows.

Wetlands / Water Resource Management: The EHD continued to provide technical support staff to the Environmental Impact Commission (EIC). EHD staff has conducted review of permit documentation and site plans, site inspection of on going construction of EIC Permitted Projects, attended EIC Meeting and discussed environmental issues related to future projects by organizing pre-application meetings with developers and their consultants.

The EHD continued its management of water resource projects, including Tarrywile Lake. The EHD continued to provide staff support and liaison to the Environmental Impact Commission. (EIC), conducting oversight, environmental monitoring and inspection of public and private construction projects.

The EHD conducted site investigations of complaints and construction activities along the shore front of Candlewood Lake in cooperation with The Candlewood Lake Authority (CLA). The EHD receives and processes complaints, service requests and inquiries through the 311 “City Line” and Q-Alert systems.

Program Planning and Administration: The Director of Health (DOH) and Associate Director continued to coordinate various environmental programs New employees both full time and part time are attending training courses to obtain required certifications.

Subsurface Sewage Disposal & Private Water Supply Wells Compliance Program: The on-site sewage disposal and well permitting program staff continued to perform plan review, site soil suitability testing and inspection.

Land Use: The EHD continued administration of the Grading Permit Program, conducting permit application review, site inspection and enforcement.

Hazardous Materials Management & Public Health Preparedness: The Environmental Health Division (EHD) continues in planning, training and preparedness activities for all hazard events as well as completion of annual contract deliverables required by the Connecticut Department of Public Health (DPH) Public Health Emergency Preparedness Grants.

HOUSING AND FOOD PROTECTION PROGRAM NARRATIVE 4

The statistical report reflects field activities conducted in connection with housing, public health and food service functions undertaken by the department. This narrative report is intended to summarize administrative activities and enforcement actions initiated by these sections. The narrative also highlights tasks and initiatives that may be of special interest.

The inspectors were not required to make court appearances. Several other cases were resolved by the City’s attorneys prior to court hearings being held. While every effort is made to encourage cooperation to correct violations, non-compliance with department orders leads to court action and possible penalties for contempt of court.

The department continues to participate in systematic and complaint inspections with the UNIT program as needed. Our Department inspectors serve as the liaison’s to UNIT and participates in inspections as requested. The department also investigates complaints throughout the city referred through the Mayor’s complaint line and from other departments in addition to complaints filed directly with the department. The department also receives complaints and service requests through the 311 system. Food service inspections for the month were affected by the extended leave of a full-time food service inspector.

The department’s lead poisoning prevention efforts for the month included monitoring of laboratory reports regarding blood lead levels in children in cooperation with the Connecticut Department of Public Health. Staff made contacts with clients in need of follow up tests according to State testing protocols. Preparations were also made to deal with the increased activity expected to result from the implementation of Connecticut’s new law that mandates universal blood lead testing of all children in Connecticut. The law went into effect on January 1, 2009 and has resulted in an increase in department activity in the monitoring and follow up of child blood lead test results. Increased testing may also result in the need for more mandatory environmental inspections by the department to address individual cases of elevated blood lead levels. The law also lowers the action level for triggering such investigations. The department also performed functions as a community partner in the LAMPP Program during the month. Participation makes Danbury property owners eligible to apply for grant funds to abate lead paint, replace windows and perform other repairs necessary to make units lead safe. One application involving a Danbury property is under consideration by LAMPP. In addition, the Health department has submitted program grant application to the HUD Healthy Homes Production and LAMPP. Danbury as a partner will be included in this exciting initiative!

Services to the Health Department and Danbury Home owners will include: Health Intervention providing, Rug replacement; Ventilating fan installation; Mold/mildew removal, etc. LAMPP will provide training the following: Training on healthy homes issues, Assessment tools (HUD Program & IPAD), Training on assessment process. LAMPP will also provide energy efficiency assessments of homes partnering with Northeast Utilities

Our Social Services seek to provide the community and its residents with access to municipal and community social services in an expeditious, cost effective and comprehensive manner. Efforts are focused on improving access to housing and emergency shelters; improving access to medical care and coverage and improving social conditions for residents via collaboration and advocacy at the local, state and federal level by identifying and working to create systems of resources that are inclusive of all residents/clients in need.

The following are the highlights from our Social Services activities for November, 2013:

1. Our Housing Caseworker managed approximately 54 active cases. 2. The Day Center, located at the Emergency Shelter, had approximately 601 visits from homeless individuals or those at risk of becoming homeless (this includes weekend service meetings). 6 *MCCA counseling services have RESUMED on Saturday and Sunday from the hours of 9:00am – 3:00pm. In- house counseling referral and case management services at the Day Center are also provided Monday through Friday. Due to MCCA weekend counselor having 3 prior commitments, there was 3 weeks of no counseling services. ** Providing computer access in Emergency Shelter for job placement and availability.

3. Social Service collaborations were continued for clients regarding health/medical/veteran status and any other required entitlements 4. Our Emergency Shelter continues to provide homeless individuals with support services, case management and any other necessary mental and physical assistance. 5. The Homeless Management Information System (HMIS) is continually updated on a monthly and quarterly basis to reflect current clients and activities in the Social Services section of the Health Department and through constant liaison with Dream Homes (ARC). 6. Attended meeting of the CoC to discuss coordinated access for the Balance of State CoC’s and following procedures and new policies for all social service agencies provided a variety of services to the homeless population. 7. One (1) meeting conducted at United Way in developing a Collaborative City wide Community Food Bank and finalizing a food pantry pamphlet for all local food banks serving the local community. The pamphlet will be printed in English and Spanish and distributed in December. 8. Receiving weekly food donations from arrangement with Community Plates. 9. One (1) committee meeting for Project Homeless Connect scheduled for December 13, 2013 at Western Connecticut State University. 10. Attended one (1) meeting for the Social and Supportive Service Committee of the Danbury Housing Partnership. 11. Prepared Press Releases and Invites for the City’s Website and DHP website regarding Project Homeless Connect scheduled for December 13, 2013. 12. Finalized speakers for the Danbury Housing Partnership breakfast at the Amber Room on November 7, 2013. 13. Attended one (1) meeting of the CoC. 14. Attended webinar for Coordinated Access for the State of Connecticut and Danbury’s participation. 15. Attended final meeting of the Farmers’ Market, updated information provided on the success of the annual summer event. Preparations for funding applications to be submitted in the late winter. 16. 8 School Based Health Centers (SBHCs) Monthly Operating Report December 2013 Brief Program Description: The School Based Health Centers (SBHCs) are freestanding medical centers, located on the grounds of Broadview and Middle Schools, and Henry Abbott Technical School. The SBHCs promote the physical and mental health of children and youth and ensure their access to comprehensive primary and preventive health care. SBHCs emphasize early identification of physical and mental health concerns and the prevention of more serious problems through early intervention.

Mission: Through improved access to care, children and adolescents will know and adopt behaviors that promote their health and well-being and experience reduced morbidity and mortality through early identification intervention.

This report reflects patient visit data for the time period July 1, 2103 through November 30, 2013 and highlights program activity during the transition phase of moving the SBHC programs from under the administrative oversight of the City of Danbury, Health & Human Services Department to the Connecticut Institute For Communities, Inc. Rogers Park Middle School (RPMS) – 76% enrolled (912 out of 1,200 students Broadview Middle School (BMS) – 90% enrollment (900 out of 1,050 students) b. DHS – At completion of first reporting period (10/31/13), 278 students received at least one or more clinic visits representing approximately 10% of the total enrolled population of 2,619 students. During FY 2012-13, 773 enrolled students received one or more visit, representing 30% of the total number enrolled. Staff continuously strive to increase this number to the targeted 45% through increased outreach.

Greater than 80% of the school’s population has received an outreach contact regarding services at the SBHC. These outreach activities include direct mailings to students’ homes with information about SBHC services, a bulletin board display outlining services, staff participation in the school’s open house and a beginning of the year introduction to SBHC services in September in student cafeteria at lunch periods. RPMS – At completion of the first reporting period (10/31/13), the APRN has seen approximately 200 students. Historically, the RPMS SBHC sees approximately 30% of the registered students each year. School nurse who acts as primary referral source is to be absent for an extended period of time 2013-14 school year, likely impacting number of patients referred to SBHC APRN. SBHC staff participated in both open house meetings held at the beginning of the school year, including participation in the Hispanic parent night sponsored by the bilingual teachers. Staff conducted additional presentation to all science classrooms, reaching over 80% of student population. Information is disseminated through the faculty bulletin which is received by all staff. School clinicians, nurses, guidance counselors and also teachers are very involved with referring students in need to the clinician for evaluation and treatment. Bulletin boards with information about SBHC and our services are also displayed prominently.

RPMS - Through classroom presentations, assemblies, work with guidance counselors and other school staff, 90% of the school staff have received information regarding mental health services at the SBHC. The guidance counselors have worked very closely with the counselor in coordinating services for students exhibiting mental health, peer, family, or other behavioral issues. c. DHS - Over 85% clinic users identified with a mental health concern receive a mental health assessment. Risk factors such as suicidality and homicidality are assessed during the initial visit as well as preliminary background information. A full mental health intake is completed on or by the third visit.

RPMS - 85% of clinic users with identified mental health concerns have been screened by the counselor. The APRN and counselor work closely together in identifying, prescribing and following students with ADD/ADHD.

d. DHS - 50% clinic users receiving mental health treatment on a regular basis for at least three months demonstrate improved psychosocial functioning. Self-report and ongoing observation and assessment as well as collateral contact with school staff and parents as necessary inform this measure. RPMS - More than 50% of the students who receive mental health services for at least 3 months have demonstrated improved psychosocial functioning. Examples of types of issues dealt with include a student who was refusing to come to school because of emotional trauma now comes part time and checks in frequently with counselor for support; a number of students have disclosed past trauma and work has been done with the student and family; overwhelming

d. DHS - 90% of users identified as having mental health needs in excess of the scope of services provided through the SBHC are referred for treatment in the community. For example, a long-time client of the clinician who presented with an exacerbation of depressive symptoms has been referred to her physician for a medication evaluation in conjunction with ongoing treatment. In addition, students presenting with poor compliance have been referred to providers within the community allowing parents to be responsible for transporting them to sessions. RPMS - 2-3 students have been referred out to crisis or other services that were more complex. BMS – Site may not reached targeted number of visits/patient due to staff vacancies and delayed hiring date.

During the month of November, as the holidays approached, we had the explorers continue and finish the. Danbury Youth Soccer detail on Saturdays. The detail has worked the first Saturday during the month. Beginning with November 7th ’s meeting, we began conducting our seventh Basic Essential Skills Training (BEST) for all new explorers who have come into the Post and have not completed 1 year of service or completed the Cadet Police Academy. For five consecutive Thursday evenings, the classroom is divided with the explorer recruits in one classroom attending the various training sections and specifically going over the Law Enforcement Explorer Manual. They also learned some very basic military style commands and movements, such as standing at attention and facing movements when marching. They were given a class on RESPECT which is part of our “total acceptance” approach to exploring. There will be an all day skills practicum, date to be determined in January, culminating with a graduation ceremony scheduled at police headquarters. This has become mandatory training for all new explorers in the Post and gives them a small sampling of what is required to be a Danbury Police Explorer. We have started out with 27 potential Explorers and are down to 22 already.

Also, during this month on Wednesday, the 20th, P.O. Antedomenico and I attended the monthly Cadet Police Academy Executive Board meeting at the police academy. Discussion was on the posting of registration forms electronically on the NERLEEA website (http://www.nerleea.org ) so that we can begin the registration process in earlier in the year, the cost of the academy for 2014, and reducing expenses.

On Thursday, 11/28, before the Thanksgiving dinners were served, approximately 10 Explorers and several Civilian Associate Advisors worked the Don Hassiak Memorial 5k run, also called a Turkey Trot, at Tarrywile Park in the morning. The money raised from this event was given to in memory of the late, P.O. Don Hassiak, an IHS alumni. It was a frigid cold and sunny morning and there was a large turnout. This event has grown in size each year.

“Black Friday”, November 29th, brought the return of the 15th Annual Santa Wears Blue holiday toy drive. Once again this year, the Danbury Police Explorers are holding their annual toy drive for the greater Danbury area. We will be collecting new, unwrapped toys for local abused and underprivileged children to open during the Holiday season. We are looking for your support for our toy drive. The toy drive began on Friday and run until Thursday, December 19th. All donated toys will be disbursed locally to the Danbury area that is serviced by the explorer program. New unwrapped toys may be dropped off at any of these locations in our toy drive boxes. The locations are: Danbury Police Department headquarters lobby, Danbury City Hall lobby, Danbury Public Works, and Sikorsky Financial Credit Union at 345 Main Street. In conjunction with the 15th annual “Santa Wears Blue” toy drive for children who are victims of neglect and abuse in the Danbury area, the Danbury Police Explorers Post is conducting their annual “Stuff A Police Cruiser” at TOYS R US in the Danbury Square Mall located on Backus Ave. The event is scheduled to take place on Saturday, December 14th and Sunday, December 15th from 9 am to 6 pm. A police vehicle will be there to be stuffed with new unwrapped toys to be donated through the toy drive. If anyone has any questions in regards to this event, please contact the Danbury Police Explorers at 203-796-1572. Thank you!

As you can see, we ended the month with 89 Explorers registered. We currently have several Explorers away at college out of the area/state or serving in the military. We have not held a First Night event this year as we are to capacity with our attendance. Weekly we see between 65-75 Explorers on Thursday night meetings and training.

RE: Monthly Report for November 2013

Dear Mayor Boughton and Members of the City Council:

I am pleased to present the Public Works Department report for the month of November.

November is always a major transition month for every division of the Public Works Department. We are pushing the limits of continuing construction projects and other programs while transitioning out equipment for snow and ice removal. The leaf pick-up program continues as we strive to complete this program prior to snow arriving.

The sand and salt storage facility has received deliveries of material. A department-wide special meeting was held for the managers responsible for snow emergency operation and plans were confirmed for standard operating procedures for snow removal activities.

The Parks Maintenance Division will start performing maintenance and repairs to all of our summer maintenance equipment. The rest of the Parks Maintenance will perform repairs to the fences, bleachers, docks, lifeguard shed and chairs, and paint all of the City’s garbage cans in order to have them ready for the spring and summer seasons. All of this work will be accomplished in between snow plowing and shoveling the parking lots and sidewalks.

After several month of finding a solution for the septic issues at the airport, a new system was not only designed and approved, but the system was installed. The work was done in-house saving thousand of dollars. The director worked with the Highway Division to do the installation which was completed in two days.

Construction Services Report submitted by Thomas Hughes III, Superintendent:

Tarrywile Park: School House Project: The architectural service for the renovation was awarded to Friar Associates. Friar Associates has finalized the project specifications and bid documents. The project is out to bid for the Tarrywile Park Authority. Construction Services will administer the project. This project will be funded through a LOCIP Grant.

Osborne Street at Fifth Street Traffic Signal Installation: ConnDot project 34-344, Construction Services has been approved by ConnDot to perform the contract administration and inspection of the project, eliminating the need to hire an outside consultant. The contractor, A.M. Rizzo has completed the civil portion of the project. All the Mast Arm Foundations have been installed. The ground water table was discovered to be extremely high requiring the Design Engineer to redesign the remaining three Mast Arm Foundations due to this unforeseen condition. We have met with ConnDot District IV to approve the change. A.M. Rizzo will be submitting a proposed change order for the additional work required. A.M. Rizzo has completed the project we are awaiting the City of Danbury Traffic Engineer to accept the project.

School Additions: Shelter Rock, Stadley Rough, Park Avenue and Mill Ridge Intermediate: Construction Services is administrating the school addition projects. All four of the schools have signed contracts and Notices to Proceed documents issued.

Mill Ridge sub-contractors have mobilized and begun the abatement, demolition and mechanical phase of the contract. The demolition / abatement is continuing and should be completed by 10/30/13. The site contractor has mobilized and is installing the new drainage and excavating for the new curbs and sidewalks.

Stadley Rough School Phase II work has begun. The excavation for the footings and foundations is completed. The contractor has poured the foundation walls, waterproofed the foundation and installed the slab structural fill. The classroom addition concrete slabs have been poured. The structural steel has been set for the cafeteria addition. The contractor has begun setting the classroom structural steel. The mechanical contractors are onsite completing the inside plumbing. The mason has started installing the CMU on the cafeteria walls. An additional 27 parking spaces and two more Handicap parking spaces have been added (80 parking spaces including 4HC).

Shelter Rock School Phase II work is underway. The footings / frost walls for both the cafeteria and rear additions have been poured. The slabs have been poured for the cafeteria and the classroom additions. The structural steel has been set for the cafeteria addition and classroom additions. The roof decking is in place and mason and framers are presently working enclosing the cafeteria addition. The mechanical contractor has also installed all the below slab plumbing and radon system. An additional 7 parking spaces and two more Handicap parking spaces have been added (80 parking spaces including 4HC).

2 Park Avenue School Phase II work is underway. The contractor has formed and poured the footings and foundation walls. The drainage has been completed and the new playscape installed. The contractor is setting the structural steel and decking on the new addition. The mason has installed the CMU for the stair towers and elevator shaft. The addition concrete slab is scheduled to be poured by the end of the month. An additional 25 parking spaces and two more Handicap parking spaces have been added (66 parking spaces including 3HC).

All schools now have a dedicated bus drop off zone. At this time both Rizzo Corporation and Worth Construction have stated they are on schedule and anticipate meeting the contractual completion date for all four school projects.

East Franklin Street Pump Station: Hemlock Construction has mobilized and has completed the installation of the new sewer pump station. Hemlock has completed the installation of conduits, sewer force main and sewer laterals. We expect to tie the force main sometime in January.

Long Ridge Road Culvert: Hemlock Construction mobilized to install the new culvert to replace the collapsing stone culvert on Long Ridge Road. The project has been completed installing the new 48’’ culvert and manholes designed in house by the Engineering Division. The contractor set the drainage structures, installed the 48’’ pipe, concrete headwall, installed rip rap slope protection and paved. Construction Services acted as the general contractor and project administrator. Working long hours along side Hemlock Construction, this project was completed in approximately forty days. The project finished ahead of schedule and within budget. Atlas Companies has been contracted to install new metal beam rail (Guide Rail) on both sides of Long Ridge Road. Once the metal beam rail is installed the remaining temporary concrete jersey barriers will be removed.

Engineering Report submitted by Farid L. Khouri, P.E., City Engineer:

The following assessment projects are the only projects pending on the list based on residents’ petitions: 1. Johnson Drive and Pembroke Terrace Sanitary Sewer Extension: Referred to an Ad Hoc committee at the City Council meeting. The Ad Hoc committee met. The meeting is to be continued. 2. Butternut Lane, Bayberry Lane and Boxwood Lane Sanitary Sewer Extension: Working on preliminary design and cost estimate. 3. Hawley Road Extension Sanitary Sewer Extension: Working on preliminary design and cost estimate.

Long Ridge Road Bridge: Coordination to construction was done by in-house Engineers and Construction Services Managers. Construction signs were ordered and installed. Bridge materials have been delivered and bridge replacement is well underway.

East Franklin Street Bridge/Sanitary Sewer Pump Station: Bridge work has been completed. We completed the in-house design to relocate the existing sewer in the brook with an above-ground pump station. City contracted with one of our on-call contractors. Work is 75% completed and work will be completed this winter weather dependent.

3 Miscellaneous Schools (Park Avenue, Shelter Rock, Stadley Rough and Mill Ridge): Construction has started on all schools. We are working with various interior designers and school officials to finalize furniture and equipment to all schools mentioned above. The furniture and equipment packages have been delivered to the State for review and have been accepted for review. Playscape at Park Avenue School has been completed.

Spring Street: In house survey was completed for Phase II & III (the remaining neighborhood enhancement work) which will include new sidewalks, drainage, and pavement improvements. The design for this project will be completed in the Spring of 2014.

Foster Street: In house design and survey to Foster Street from West Street to West Wooster Street was completed and will be out to bid after CDBG money has been allocated for this project. Survey to Boughton Street and Bank Street was completed and design of these two streets was completed. We anticipate to bid the entire neighborhood project this winter for start of construction in Spring 2014.

Kennedy Park: Surveys have been completed and the schematic design has commenced and was presented to City Center for approval. Preliminary design has been completed and we are soliciting for Spring 2014 start of construction.

Traffic Light – Osborne and Fifth Avenue: The project has started and will be completed in Winter 2013.

Traffic Light – Lake Avenue/Shannon Ridge: All plans and specifications that have been completed and approved by the State have been secured. Project was bid out and work will start in Spring 2014.

Traffic Engineer and his Technicians are reviewing various land-use development plans; handling of public complaints and routine repair and maintenance of traffic control signal devices and pavement markings. The Backus Avenue corridor traffic lights plans and specifications have been accepted by the State and were bid out. Construction started and will be completed by spring of 2014.

Staff Engineers are reviewing various site plans, water and sewer applications, special exception applications, and subdivision applications for various land-use approvals of on-going development projects throughout the City. Field inspection of sanitary sewer, water mains and new roads are performed regularly on various developments. The Staff Engineers also review various drainage problems which may include site visits, analysis and design.

Survey Crew verifies various R.O.W., prepares surveys and easements for in-house design of City projects and assists other divisions in locating utilities in the field.

Highway Division Report submitted by Duke Hart, Superintendent of Public Services:

In the month of November, the Highway Division was busy finishing the construction and paving projects for the season, while preparing for the winter season. The construction crew was able to 4 install new drainage on Pocono Point Road and perform catch basin repairs and upgrades on Abigail Road. A new septic system was installed at the airport using in-house personnel, saving the City both time and money. A new parking area was created at the New Street Fire Headquarters by the construction crew. A crew was dispatched to repair a dip on Maple Avenue and grading on Old Town Road, Durham Road and Wilkes Road to prepare them for the winter season. Guide rail repairs were made on Payne Road and a dug out upgraded at Rogers Park. The trim miller was dispatched to Sandpit Road and Rockwell Road in preparation for paving. The in-house paving crew was able to pave Saddle Rock Road, Abigail Road, Sandpit Road, Aunt Hack North and a section of Rockwell Road. Sections of Joe’s Hill Road, Virginia Avenue, Forest Avenue, South King Street and Sandpit Road were repaved. Repairs were also made to the drainage trench on Pocono Point Road. Several driveway aprons were also repaired.

While the paving crew was busy paving, the construction crew started installing sanders on the dump trucks. Leaf collection crews were out collecting the last of the leaf bags. The sign crew installed twelve (12) new signs at four (4) locations in addition to many repairs. The pothole crews were out whenever possible. The recycling truck remains a very popular stop for the residents.

In the month of November, the Parks Maintenance Division transitioned from the fall sports season to the winter season. The football and soccer fields were painted. The baseball and softball fields were lined and dragged for the end of the season. The final lawn mowing was performed at all locations prior to the leaf clean-up. The Park Maintenance Division fertilized the fields and Town Park at Lake Candlewood. All Veterans Memorials were prepared for the ceremonies on Veterans Day. The crew was pleased to assist with the installation of the holiday lighting on the ornamental street lights downtown.

The mowing equipment was put away for winter and the winter equipment prepared and tuned-up in preparation for winter. The crews also assisted the Highway Division with leaf and bundled branch pick-up.

The Forestry Division performed various types of tree work during the month of November. Cutbacks were performed behind the New Street Fire Station and on Saddle Rock Road in preparation for paving projects. In preparation for a drainage project, cut backs were also performed on Bear Mountain Road. Removals and pruning was done on Bear Mountain Road, Morris Street, City Hall, Morris Street School, South King Street, King Street and Mountainville Avenue. The Division responded to tree calls on Briar Ridge Road and Tiffany Drive. The crew was pleased to install the wreath and lights at the Library Plaza. 5 Public Buildings Report submitted by Rick Palanzo, Superintendent of Public Buildings:

City Hall: `I am pursuing an energy efficiency upgrade for the boiler room at City Hall. The project will include the removal of one steam boiler and electric water heater; and replacing these items with two high efficiency gas fired water boilers. The upgrade will save a good amount of fuel while yielding a very comfortable environment. This is a very important project as we only have one operational steam boiler, and the major shift is from steam to hot water (the newer addition, the basement and the perimeter loop are all hot water). There have been two engineering firms that have been at city hall to review the current status and provide PB with a proposal. I shall include this work as a priority project for next summer. RZ Design, a mechanical-electrical engineering firm, submitted a proposal. The intent is to design the project this year and fund the replacement in the 2014-2015 capital budget. Farrington Park – Westside Open Space: The guest house and workshop are now vacant and usable. The guest house requires work before it is habitable. The workshop can be used immediately for dry storage. We shall winterize this building and reduce the heat to a minimum level. The chow house at the Farrington Park has been advertised for rent. It was offered to employees and the general public. I have no takers but I have received a proposal from a citizen to live at the chow house at a reduced rent while providing services in lieu of rent. I will send the proposal to the Mayor and City Council for review and disposition. The Friends of the Library are currently using the main house to store their books prior to the book sale. Once the sale is finished the building will be readied for the winter. This building is slated for renovation in the spring. : There are two high voltage transformers at Danbury High School which CL&P has stated belong to the school which are of the older design containing PCB’s. This year we are working with our consulting electrical engineer to remove the PCB laden transformers and replace them with safer models. Additionally, these transformers are in the school building. It is our goal to relocate them outside of the school building which will increase safety and performance. We have retained Friar Associates Engineers to perform the electrical engineering for the city. They have begun their analysis and design has begun. The project will be bid in the late winter/early spring to be performed while school is out for summer vacation. There are three school buildings that require new roofs; Morris Street School, Great Plain School and the Educational Services Center. The H. B. Fishman Co. has been hired to perform the analysis and design of the replacement roofs. Two roofs are eligible for state reimbursement from the State School facilities Department (Morris St. & Great Plain) All roof will be designed and bid over the winter, with work to begin with the summer recess. Library Annex: The Library annex is undergoing a major renovation. The renovated first floor space will house the Danbury Innovation Center; a downtown think tank for inventors and planners. Part of this first floor will house a café for the Danbury Library as well as the Innovation Center patrons. Work is proceeding and should be ready for a ribbon cutting on New Year’s Eve. The license agreement for the tenants shall be coming before the City Council in January for their disposition. General: These are issues and projects that are being worked on by the public buildings team: 1) Heating and plumbing issues are topping the list of work requests as we get closer to winter.

6 2) The staff is also getting prepared to do their part in snow removal efforts in the plowing of the school parking lots. 3) The underground heating fuel storage tanks are coming of age. We will have them reviewed by professional engineers and begin a replacement program. 4) The roofs of our public buildings are beginning to reach the end of their life and will require replacement. They have been surveyed and we are utilizing the roof report to begin our replacement program! Requests for Maintenance Service: Attached please find the statistical report of repairs and maintenance work that the Public Buildings Mechanics engaged in during the month of November 2013. In the month of November we received 212 new work requests and completed 196 work requests. In reviewing this report, you will find the repair time that was expended in major work categories. Public Building mechanics were engaged in Plumbing repairs with a total of 214.00 man-hours dedicated to this service. The next largest area of concentration was in Electrical repair work, utilizing 80.00 man-hours of labor. Maintenance repairs came in as the third highest category with 38.00 man-hours. Below is a table highlighting UNIT activity from the time of last month’s City Council report. This does not include any UNIT activity regarding follow up and re-inspection work from previously noted issues. The UNIT works to ensure that each and every issue is resolved as quickly as possible.

UNIT HIGHLIGHTS:

2013 is nearly complete, and a busy year it has been. Our office continues to be the department that residents can go to get their issues resolved in a timely manner. The UNIT does much more than simply ensuring that properties are kept clean, or that living conditions are kept safe. Everyday, our department members can be found walking the streets downtown talking to business owners and shoppers; or driving around town 2

knocking on doors helping to resolve any quality of life issues. The UNIT’s goal has always been to “Build a Better Danbury”. By addressing all of the little details within our community, greater and more extreme problems can be prevented. Commonly referred to as the Broken Windows principle, taking care of the many smaller issues, thus preventing them to become larger problems is an effective process resulting in a positive impact in the neighborhoods that property and business owners recognize. UNIT members, Jeff, Rich, Officer Ken Utter and myself work relentlessly to identify these quality of life issues and carry out strategies to resolve them quickly.

Year End Statistics:

• 32% of UNIT activity involved properties with garbage/rubbish • UNIT identified 60 vacant/foreclosed properties, and banks were sent appropriate orders to clean and secure properties. • Issued nearly $4K in parking violations, mostly pertaining to vehicles parked on the sidewalk. • Partnered with State’s attorney and DPD to oversee community service program, where our office manages these individuals, assigns them work within the community and signs off on their completion. • Vigilant on the immediate removal of graffiti on bridges, signs, power boxes, etc. Also, on the removal of unwanted signs tacked up telephone poles, street lights and lawn signs posted on city property.

Additionally, a statistic that year after year, I continue to be proud of is that approx. 36% of UNIT activity was the result of proactive enforcement. Our office is not sitting around waiting for complaints to come in, but rather we have integrated ourselves within the community looking for ways in how our neighborhoods and areas can be improved.

The services which our department provides and the manner in which we provide it, is second to none.

Exterior Blight Citation Warnings Issued:

Since the last Council Report, the UNIT issued one (1) Exterior Blight Warnings to property owners. In this case, thirty days are allowed for the property owner to remediate the issues highlighted on the citation warning. If compliance isn’t achieved during this time frame, then our department goes to the next step of issuing daily fines of $100/day until the issues have been resolved.

Below is a review of the warnings sent this past month:

• 8 Garry Knolls: Repeat offenders of the front yard parking ordinance and the residents have been given several warnings in the past by the UNIT. There has been a vehicle left on the front yard for months and hasn’t moved. It also is 3

parked in the city right of way near the road. Additionally, neighbors have complained to our department.

A re-inspection was held at property, 28 Mountain Road, pertaining to a deadline that was set, seeking compliance to an accumulation of rubbish left out in the yard. The property has been much improved. Additionally, there is another deadline set for the spring with a final cleanup and removal of temporary tent structure that was erected in the driveway. Neighboring residents have struggled with this issue of blight for many years, and I am proud to say that our department has successfully achieved a positive outcome for this property that neighbors will be grateful for.

There are a couple of properties that have been issued orders and are still pending. Our department is currently in the process of moving forward with the assessment of fines and the scheduling of a hearing, unless these issues are not resolved immediately.

The Exterior Blight Ordinance and our department’s enforcement of it WORKS. The results have been very noticeable around our city. Our department continues to work on the remaining open orders and is prepared to continue issuing them, as this has become a valuable enforcement tool for our department.

311 Call Center Report: December 2013

The month of December saw the 311 Call Center receive approximately 480 calls, bringing the year-end total to more than 10,300 calls, emails, letters, and in-person requests from residents looking to input a service request or inquiring about free and dependable information. The year of 2013 was the first “normal” year in the past three where an off-season storm did not disrupt the city infrastructure and electricity. The most significant event proved to be the blizzard of early February, wherein over 400 calls were placed regarding snow removal and other related concerns. Due to the standards set forth by previous emergencies, as well as precedent for day-to-day activities, the 311 Call Center remained busy as it continues to prove to be the most efficient option for residents looking to submit a service request or inquiring about free and dependable information.

In addition to the 400 calls placed regarding the blizzard, the request for phone numbers were the most highly-requested item of the year at 1,852 requests, with 260 calls being placed by residents looking to dispose of household garbage, 209 calls for the spring and fall yard debris pickup, 198 calls for information on the recycling truck, 141 calls for the Household Hazardous Waste Day, and 116 calls for Clean City Danbury Day. The 311 Call Center was also successful in cleaning up and/or securing approximately 60 abandoned houses/properties within the city during 2013; abandoned properties pose a serious threat to community safety, as well as quality of life and property values, and every effort must be made to ensure that the responsible parties are current with their responsibilities. Working alongside the other members of the UNIT, banks or lending companies are contacted and informed of the status of their properties; after the 4

appropriate steps are taken a contract is confirmed for securing and maintaining the property. The 311 Call Center needs the help and input of neighbors in reporting these issues, as many abandoned properties are not noted until it is too late, and encourages reporting said issues as soon as a property is suspected to be abandoned. Residents should never hesitate to report such issues or assume that another neighbor will do so; unfortunately, instances of break-ins leading to fires and other illegal activity have become too commonplace within abandoned properties in Danbury.

The city encourages the residents of Danbury to be proactive in the care for their community and to alert CityLine 311 whenever areas of concern are noted. Even if residents are unsure if a notice of violation is warranted, or if the area of concern is a city responsibility, a city official will be sent out to investigate and determine the appropriate course of action. Residents can use Danbury’s Knowledge Base on the website to inquire whether or not a violation may be present, and can submit a service request directly from our webpage. Your involvement with the preservation of the quality of life in Danbury is essential to not only efficient and effective government response, but also to the continued prosperity that is sought by all. The city greatly relies on, and appreciates, the community’s partnership and support and the 311 service line is the best means by which this mutually-beneficial relationship can continue to thrive.

The UNIT continues to encourage the participation of Danbury’s residents to report any concerns in their neighborhood by utilizing the City Line 311 system. Residents of Danbury can simply dial 311 from their home phones, or 203-744-4311 from out of town or cell phones. Additionally, residents can log on to the City’s webpage, www.ci.danbury.ct.us, and click on the City Line 311 link and register their complaint at their convenience, and now, residents can utilize the Danbury Direct app from their iPhone to submit a concern or question. Residents can choose to provide their contact information, so the UNIT can follow up and provide an update on the situation. By visiting the Neighborhood Assistance Department on the City’s website, residents will also be able to view the UNIT’s monthly activity.
