Since that time, it appears it's been open season on police officers, many of whom have been slapped with so-called "frivo- lous" lawsuits which later proved to be unfounded. This spate of legal warfair only proves the sneaky resourceful- ness of those who attempt to employ every tactic at their dis- posal to get away from taking responsibility for their own ac- tions. This is why municipalities are mandated to bear the finan- cial burden of lawsuits against police officers; too often the public views police as being uncaring violators of the laws they have vowed to uphold and are therefore ready to sue at the drop of a hat on matters that often canTcarry enough weight to get through court. However, at times proper police procedures are violated when an arrest is made. In the view of Mayor Richard Tornquist, when this occurs, officers should be required to foot the bill for their own legal defense. The mayor wants a mechanism put in place for reviewing whether such procedures were followed belieiving that, ulitimaely, problems with police lawsuits become the prob- lems of the township as a whole. Mayor Tornquist has a good point, but it seems the severity of the violation should be the deciding factor in whether a police officer should pay for his/her lawyer fees. Would minor infrac- tions be included in the criteria? There's no across-the-board solution to the problem. In fair- ness, the municipality would have to consider on a case-by-case basis whether rules were violated to the extent as to make the township liable. . ..
