Office of the Chief Justice of the Allahabad Hi Bar & Bench (www.barandbench.com) SUPREME COURT OF INDIA Re: Appointment of Chief Justice in Allahabad High Court. Office of the Chief Justice of the Allahabad High Court has fallen vacant consequent upon retirement of Mr. Justice D.B. Bhosale, Chief Justice of that High Court on 23rd October, 2018. Therefore, appointment to that office is required to be made. Mr. Justice Govind Mathur, senior-most Judge from Rajasthan High Court, is functioning at present, on transfer, in Allahabad High Court. Having regard to all relevant factors, the Collegium is of the considered view that Mr. Justice Govind Mathur is suitable in all respects for appointment as Chief Justice of the Allahabad High Court and, therefore, resolves to recommend that he be appointed as Chief Justice of that High Court. While making the above recommendation the Collegium has taken into consideration that though at present there are two Chief Justices from Rajasthan High Court, one of them viz. Mr. Justice Ajay Rastogi, Chief Justice of Tripura High Court (PHC: Rajasthan) has been separately recommended today for elevation to the Supreme Court. ( Ranjan Gogoi ), C.J.I. ( Madan B. Office of the Chief Justice of the Patna High Court would be falling vacant, very shortly consequent upon elevation of Mr. Justice M.R. Shah, Chief Justice of that High Court to the Supreme Court, in terms of a recommendation separately made by the Collegium today. Therefore, appointment to that office is required to be made. Mr. Justice A.P. Sahi is the senior-most from Allahabad High Court and has been functioning in that High Court ever since his elevation. Having regard to all relevant factors, the Collegium is of the considered view that Mr. Justice A.P. Sahi is suitable in all respects for being appointed as Chief Justice of the Patna High Court. The Collegium resolves to recommend accordingly. While making the above recommendation, the Collegium has also taken into consideration the fact that at present there is only one Chief Justice from Allahabad High Court which is the largest High Court in the country. Office of the Chief Justice of the Madhya Pradesh High Court would be falling vacant, very shortly, consequent upon elevation of Mr. Justice Hemant Gupta, Chief Justice of that High Court to Supreme Court in terms of a separate recommendation made by the Collegium, today. Therefore, appointment to that office is required to be made. Mr. Justice S.K. Seth is the senior-most Judge from Madhya Pradesh High Court and has been functioning in that High Court ever since his elevation. Having regard to all relevant factors, the Collegium is of the considered view Mr. Justice S.K. Seth suitable in all respects for being appointed as Chief Justice of the Madhya Pradesh High Court. The Collegium resolves to recommend accordingly. While making the above recommendation, the Collegium has also taken into consideration the fact that at present there is only one Chief Justice from Madhya Pradesh High Court. While making the above recommendation the Collegium has invoked the provision of the Memorandum of Procedure which provides for elevation of a puisne Judge as Chief Justice in his own High Court if he has one year or less to retire and as per record Mr. Justice S.K. Therefore, appointment to that office is required to be made. Mr. Justice Sanjay Karol is the senior-most Judge from Himachal Pradesh High Court and has been functioning in that High Court ever since his elevation. Having regard to all relevant factors, the Collegium is of the considered view that Mr. Justice Sanjay Karol is suitable in all respects for being appointed as Chief Justice of the Tripura High Court. The Collegium resolves to recommend accordingly. While making the above recommendation, the Collegium has also taken into consideration the fact that at present there is no Chief Justice from Himachal Pradesh High Court and that the turn of Mr. Justice Sanjay Karol to be considered for appointment became due on 22nd February, 2018, when Mrs. Justice Abhilasha Kumari, Chief Justice, Manipur High Court (PHC: Himachal Pradesh) retired. As per information made available by High Courts and State Governments, sanctioned strength of Judicial Officers of District / Subordinate Courts has increased from 20,214 in the year 2014 to 22,644 in the year, 2018. The State-wise details of sanctioned strength of Judicial Officers of District / Subordinate Courts in the years 2014 and 2018 are given in a Statement at Annexure-I. Judges of Supreme Court of India are appointed under Article 124 (2) of the Constitution of India and the Judges of High Courts are appointed under Articles 217 (1) and 224 of the Constitution of India.

    SUPREME COURT OF INDIA Re: Filling up vacancies of Judges in the Supreme Court. Against the sanctioned strength of 31 Judges, the Supreme Court of India is presently functioning with 24 Judges, leaving 07 clear vacancies. After extensive discussion and deliberations on a number of occasions, the Collegium unanimously resolves to fill up, for the present, four of these vacancies. The Collegium discussed names of Chief Justices as well as senior puisne Judges of all High Courts, eligible for elevation to the Supreme Court. The Collegium is of the considered view that at present the following persons are more deserving and suitable in all respects than other Chief Justices and senior puisne Judges of High Courts, for being appointed as Judges of the Supreme Court of India: 1.     SUPREME COURT OF INDIA Re: Filling up vacancies of Judges in the Supreme Court. Against the sanctioned strength of 31 Judges, the Supreme Court of India is presently functioning with 24 Judges, leaving 07 clear vacancies. After extensive discussion and deliberations on a number of occasions, the Collegium unanimously resolves to fill up, for the present, four of these vacancies. The Collegium discussed names of Chief Justices as well as senior puisne Judges of all High Courts, eligible for elevation to the Supreme Court. The Collegium is of the considered view that at present the following persons are more deserving and suitable in all respects than other Chief Justices and senior puisne Judges of High Courts, for being appointed as Judges of the Supreme Court of India: 1. Mr. Justice Hemant Gupta, Chief Justice, Madhya Pradesh High Court (PHC: Punjab & Haryana) 2. Mr. Justice R. Subhash Reddy, Chief Justice, Gujarat High Court (PHC: Telangana & Andhra Pradesh) 3. Mr. Justice Mukeshkumar Rasikbhai Shah, Chief Justice, Patna High Court (PHC: Gujarat), and 4. Mr. Justice Ajay Rastogi, Chief Justice, Tripura High Court (PHC: Rajasthan). In terms of the Memorandum of Procedure, we have consulted our colleagues, whose opinion is considered to be significant in adjudging the suitability of the above-named recommendees for elevation to the Supreme Court. Copies of letters of opinion of our colleagues received in this regard are placed below. While recommending the name of Mr. Justices Hemant Gupta, R. Subhash Reddy, Mukeshkumar Rasikbhai Shah, and Ajay Rastogi, the Collegium has taken into consideration combined seniority on all-India basis of Chief Justices and senior puisne Judges of High Courts, apart from their merit and integrity.
