NOTIFICATION OF MNAIS FOR KHARIF 2015 SEASON & GUIDELINES FOR IMPLEMENTATION

Ref: Department of Agriculture & Cooperation, Ministry of Agriculture, Govt. of India Letter No. 13015/02/2012-Credit II dated 20th March 2015 regarding approval for the Implementation of National Crop Insurance Programme (NCIP) during Xllth Plan for Kharif 2015 Season - issue of Administrative Instructions.

State Level Coordination Committee on Crop Insurance (SLCCCI)constituted as per the provision of NCIP by Govt. of Kerala in its meeting held on 15th May 2015 has decided to implement the Modified National Agricultural Insurance Scheme (MNAIS) component of National Crop Insurance Programme (NCIP)/ Rashtriya Fasal Bima Karyakram (RFBK) in the State of Kerala during Kharif 2015 season and the copy of the relevant GO (Rt) No 991/2015 /AD dated 01.06.2015 is enclosed herewith.

Accordingly as the Implementing Agency and Designated Insurance Company of the said Scheme ,we furnish below the relevant Guidelines for MNAIS implementation .

1. DISTRICTS ,CROPS AND AREAS COVERED :

** In selected Panchayats/Municipalities where Banana is notified under WBCIS( as per Annexure WB-III enclosed)the loanee farmers who have been sanctioned loans during this season in these selected Panchayats/Municipalities shall be insured ONLY UNDER WBCIS and loans sanctioned for Banana cultivation in the remaining Panchayats/Municipalities shall be compulsorily insured under MNAIS

2. UNIT AREA FOR CROP INSURANCE :

For Paddy Crop,Panchayatwould be the unit area of insurance and for Banana & Tapioca the unit of insurance would be Block. The detailsof notified areas would be as per Annexure NA-I for Paddy & Annexure NA-II for Banana & Tapioca Crops

3. FARMERS ELIGIBLE FOR COVERAGE :

All farmers including sharecroppers, tenant farmers growing the notified crops in the notified areas are eligible for coverage.

4 These farmers could be:

(i) Individual owner - Cultivator / Tenant Farmers / Share Croppers

(ii) Farmers enrolled under contract farming, directly or through promoters / organizers

(iii) Groups of farmers / societies serviced by Fertilizer Companies, Pesticide firms, Crop Growers' associations, Self Help Groups (SHGs), Non-Governmental Organizations(NGOs), and Others

The Scheme will extend coverage Component-wise: a) Compulsory Component: All farmers availing Seasonal Agricultural Operations (SAO)loans from Financial Institutions (i.e. Loanee Farmers) will be covered compulsorily by the relevant Financial Institutions .Such eligible Loanee Farmers who have sanctioned credit limit for these notified crops in these notified areas need not submit any application for insuranceand the Financial Institution have to comply all the formalities of compulsory insurance by submitting the Declaration forms, Listing Sheets and requisite premium to AIC within the stipulated cut off dates. b) Voluntary Component: MNAIS will be optional / voluntary for all Non-Loanee farmers.

4. RISKS COVERED &EXCLUSIONS : a. STANDING CROP (Sowing to Harvesting)

Comprehensive risk insurance is provided to cover yield losses due to non- preventable risks, viz.:

(i) Natural Fire and Lightning

(ii) Storm, Hailstorm, Cyclone, Typhoon, Tempest, Hurricane, Tornado etc.

(iii) Flood, lnundation and Landslide

(iv) Drought, Dry spells

(v) Pests / Diseases etc.

b. PREVENTED SOWING / PLANTING RISK

In case farmer of an area is prevented from sowing / planting due to deficit rainfall or adverse seasonal conditions, such insured farmer who failed to sow / plant (but otherwise has every intention to sow / plant and incurred expenditure for the purpose), shall be eligible for indemnity. The indemnity payable would be a maximum of 25% of the sum-insured as per the methodology appended in Annexure-B.

c. ON ACCOUNT PAYMENT OF CLAIMS

In case of adverse seasonal conditions during crop season viz. floods, prolonged dry spell, severe drought, etc, an on-account payment up to 25% of the likely claim may be paid during the season in consultation with State Government .The payment would be effected only if the expected yield during the Season is less than 50% of the normal yield as corroborated by weather indicators/agro met data .In such a situation AIC shall pay 25% of likely claims in advance to the farmers through nodal banks subject to final adjustment of claim assessed based on the Crop Cutting Experiments (CCEs) on yield basis. d. GENERAL EXCLUSIONS

Losses arising out of war & nuclear risks, malicious damage and other preventable risks shall be excluded.

5. SUM INSURED LIMITS &COVERAGE : a. LOANEE FARMERS (COMPULSORY COVERAGE)

In case of Loanee Farmers under Compulsory Component, Sum Insured would be at least equal to theamount of CROP LOAN SANCTIONED ,which will be calculated as the product of farmer’s areaunder cultivation (in hectare) declared / as mentioned in loan application for that notified crop and per hectare Scale of Finance (SoF) for the crop. Farmers can opt for Higher Sum insured ,higher than the per Hactre SoF , which may extend upto the value of Threshold Yield (as per Annexure NA-III Normal Sum Insured/Ha) with premium subsidy.Higher coverage

6 upto 150% of the value of Average Yield on payment of full premium (as per Annexure NA-III Additional Sum Insured/Ha) can also be opted.

In case of Loanee Farmers under Compulsory Component the Sum Insured would be Crop Loan sanctioned amount irrespective of withdrawal/disbursement.

Wherever Normal Sum Insured/Ha is lower than the per Hactre Scale of Finance, higher of the two will be the sum insured.

In case of Loanee farmers insurance charges i.e. Premium payable by these farmers shall be additionally financed by loan disbursing office of the Bank, and will be treated as additional component to the Scale of Finance [SoF| for the purpose of obtaining loan. For loanee farmers if the amount of loan sanctioned as per scale of finance is above the normal sum insured , the full amount sanctioned would be eligible for premium subsidy as the full sanctioned amount needs to be compulsorily covered. b. NON-LOANEE FARMERS (OPTIONAL COVERAGE):

Farmers, who are cultivating the Notified Crop in the Notified Areas during the season but not covered as Loanee Farmers, are considered as Non-loanee farmers and are eligible under optional coverage. For such farmers covered on voluntary basis the Sum Insured is upto the value of Threshold Yield of the insured crop (as per Annexure NA-III Normal Sum Insured/Ha) at subsidized premium rates .Higher coverage upto 150% of the value of Average Yield on payment of full premium (as per Annexure NA-III Additional Sum Insured/Ha) can also be opted .

Such farmers shall fill up and submit the Proposal Form along with premium and other documents to nearest Bank Branch or Authorised channel partners or Insurance intermediaries of the Insurance Company within the stipulated cut-off- date. Operating a Savings Bank Account is essential.

6. PREMIUM RATE, SUBSIDY AND SHARING OF PREMIUM SUBSIDY :

Full Premium Rates have been worked out on Actuarial Basis. Premium subsidy shall be available to farmers only up to Compulsory coverage for loanee farmers and value of Threshold Yield (TY)/Guaranteed Yield for non loanee farmers. The difference between the Actuarial (Gross)Premium and the Premium payable by the farmer upto Normal Sum Insured Limits is subsidized and shared between the

7 Government of India and State Government .For District-wise , Crop-wise Full Premium Rate and Net Farmer’s Premium Rate (after Subsidy), Please refer Annexure NA-III

7. SHARING OF RISK :

Claim liability rests with Agriculture Insurance Company of India Ltd

8. SCHEME APPROACH AND UNIT OF INSURANCE : a. Widespread Calamities

The Scheme would operate on the basis of ‘Area Approach' i.e., Defined Areas for each notified crop for widespread calamities. The Defined Area (i.e., unit area of insurance) for Paddy crop in Kharif 2015season is a‘Panchayat’ and for Banana & Tapioca Crops it is a ‘Block’. b. Localized Calamities

Indemnity for localized calamities is not implemented in Kerala

09. SEASONALITY DISCIPLINE :

For the Seasonality discipline and various cut-off datesfor coverage & submission applicable for Loanee and Non-Loanee FarmersforKharif 2015 season,please refer Annexure NA -IV .

10. ESTIMATION OF CROP YIELD AND SUBMISSION OF YIELD DATA :

The Department of Economics & Statistics (DES) will plan and conduct the requisite number (4 nos in each Panchayat for Paddy and 16 nos in each Block for Banana & Tapioca) of CropCutting Experiments (CCE’s) in order to assess the crop yield. State Govt. will maintain single series of Crop Cutting Experiments and resultant yield estimates, both for crop production estimates &cropinsurance. Individual CCE-wise yield data will be submitted to insurer while submitting the yield estimates at insurance unit level.The cut off dates for submission of yield data for these crops by DES to AIC for processing the claims is as per Annexure NA-V enclosed.

8 11. INDEMNITY LEVEL AND THRESHOLD YIELD :

District-wise applicable Indemnity Levels for Paddy,Banana& Tapioca is as per Annexure NA- III.

Threshold yield (TY) or Guaranteed Yield for the crop is the average yield of the preceding 7 years (excluding 2 years of natural calamity declared) wherever applicable, multiplied by applicable indemnity levels.

Claims will be settled only at the Notified Area (Panchayat/Block as the case may be) level by considering the actual yield data of these Notified Areas and comparing the same with the respective Guaranteed Yield .

12. NATURE OF COVERAGE AND INDEMNITY : a. Widespread Calamities

Claims will be settled solely on the basis of the yield data as furnished by the DES based on CCE conducted under GCES and not on any other basis such as Annawari/Paisawari/declaration of natural calamity by Govt. dept./Agency or any certificate to this effect(Crop loss certificate issued by Agriculture Officer/ Revenue Authority etc ) issued by any Government Authority. b. On Account Payment of Claims

In case of adverse seasonal conditions during crop season viz. floods, prolonged dry spell, severe drought, etc, an on-account payment up to 25% of the likely claim may be paid during the season in consultation with State Government .The payment would be effected only if the expected yield during the Season is less than 50% of the normal yield as corroborated by weather indicators/agro met data .In such a situation AIC shall pay 25% of likely claims in advance to the farmers through nodal banks subject to adjustment of final claim assessed based on CCE’s in the said notified areas.

In case at the end of the season, the yield based claims works out to be higher, then the difference of claim would be payable and in case it happen to be lower, then AIC reserves the right to recover the excess claim so paid to the farmer.

For this crop-wise and notified area-wise area sown details ,acreage of affected areas, details of estimated losses and agro meteorological data needs to be

9 submitted by Department of Agriculture to AIC. On receipt of above reports the quantum of indemnity will be decided in consultation with State Govt. AIC shall take all efforts to settle the claims within one month after the receipt of aforesaid reports. c. Prevented Sowing / Planting compensation: At times the insured area is prevented from sowing/ planting due to deficit rainfall or adverse seasonal conditions. If failure of sowing / germination is observed in more than 75% of the area in the notified units, AIC shall pay the claims as given below and terminate the insurance for further period.

1 Total Failure of Sowing 12.50% of SI as Compensation

2 Sowing is done, but germination failure 18.75% of SI as Compensation

3 After germination crop withering away at 25.00% of SI as early state Compensation

For this crop-wise and notified area-wise area sown details ,acreage of affected areas, details of estimated losses and agro meteorological data needs to be submitted by Department of Agriculture to AIC. On receipt of relevant above reports the quantum of indemnity will be decided in consultation with State Govt. AIC shall settle the claims positively within one month after the receipt of aforesaid reports.

Having received indemnity under Prevented Sowing / Planting compensation, the insurance coverage will be automatically terminated i.e. the insurance cover cease to operate for the subsequent period of the season. d. Localized Risks:Indemnity for localized risks is not implemented in Kerala

10 13. BANK SERVICE CHARGES :

The Servicing banks would be paid @4% of premium remitted as Bank Service Charges.

14. ENROLMENT OF NON-LOANEE FARMERS :

Non-loanee farmers can avail insurance coverage under MNAIS through existing banking network or through brokers / authorized agents / representatives of AIC/UIIC subject to fulfillment of following conditions: a. Non-loanee farmer must have an operational bank account in any bank b. Farmer has to submit duly filled-in prescribed proposal form along with documents insupport of his ownership of land and crop cultivated and requisite premium within stipulated period. If required, AIC may call for certificate of sowing of the insured crops.

15. IMPORTANT CONDITIONS/CLAUSES APPLICABLE FOR COVERAGE OF RISK :

• Implementing agency possesses the discretion to accept or reject any risk of definedarea(s) for any crop(s) considering the prevailing agricultural situation. Mere sanctioning / disbursement of crop loans and submission of proposals/declarations and remittance of premium by the farmer / bank without explicit intent to raise thecrop, does not constitute acceptance of risk by implementing agency.

• Implementing agency if deemed necessary shall investigate the coverage on its own or by an agency appointed for the purpose and shall for this purpose utilize satellite imagery data for identification of anomalies in crop insurance coverage vis-à-vis actual field conditions. Upon identification of adverse phenomenon based on such investigations, implementing agency may resort to scaling down of Sum Insured. In such cases no refund of premium paid by farmers shall be made by AIC.

• In case of any substantial misreporting by nodal bank / branch in case of compulsory farmers coverage, concerned bank only shall be liable for such loss due to mis-reporting.

11 • Any loss in transit due to negligence or non-remittance of premium by nodal banks, AIC is not liable for payment of claims.

• AIC will have discretion to accept or reject any risk of an insurance unit(s) for any crop(s) considering prevailing agricultural situation. Mere sanctioning / disbursement of crop loans and submission of proposals / declarations and remittance of premium by farmer / bank, without explicit intent to raise the crop, does not constitute acceptance of risk by AIC.

• Where the acreage insured is more than the acreage sown under a particular crop at the insurance unit level, AIC can scale down the sum insured on pro-rata basis, and settle the claims on the scaled down sum insured.

16. Role & Responsibilities of Financial Institutions/Banks:

• For purpose of MNAIS, scheduled banking institutions engaged in disbursing Seasonal Agricultural Operations (SAO) loans as per relevant guidelines of NABARD / RBI shall be reckoned as Banks.

• Notification, as well as other directives, guidelines, etc., shall flow as AIC ► Nodal Bank ► Service (subordinate) Bank Branch / PACS. While compensation remittance from AIC shall follow same route, the remittance of premium shall follow the reverse route.

• Communicate Notification, as well as other directives, guidelines, etc. as such to all service (subordinate) bank branches / PACS within their jurisdictional area.

• Ensure that lending branches / PACS within their jurisdictional area sanction additional loan component to loanee farmers towards net premium payable by them.

• Ensure that all service (subordinate) bank branches within their jurisdictional area serve all non-loanee farmers desiring and eligible to take insurance cover under MNAIS. Such service will include opening bank

12 account of non-loanee farmers, guiding them to fill up proposal forms, accepting premium from them and maintaining records etc.

• Banks should ensure that all the eligible crop loans/seasonal operational loans including those sanctioned under KCC taken for notified crop(s) are fully insured and prepare the declarations for Loanee and Non-Loanee cultivators and forward the same to AIC along with the premium amount and other details of the insured farmers and confirm the conditions stated in the declarations submitted have been complied with.

• The crop-wise sanctioned credit sub-limits approved under KCC based on actual area proposed in the loan application form should only be considered for mandatory insurance coverage of eligible loanee farmers .Sub-limits towards other purposes ( consumption loans, medium-term loans etc) must be excluded from crop insurance coverage.

• Nodal Bank should ensure submission to AIC within stipulated time the notified crop-wise, insurance unit-wise , Category-wise & Gender-wise Declarations with listing sheet in the prescribed format, along with consolidated Premium payable separately for both loanee farmers and non- loanee farmers.

• AIC shall acknowledge all the declarations submitted by the banks mentioning the details of crop, area, sum insured etc. The banks should cross check the data with their records, and aberrations if any, should be brought to the notice of the AIC immediately. If no response is received from banks within 15 days, the details given in the acknowledgement shall be considered final and no changes would be accepted later on.

• Nodal bank will also arrange for onward transmission to service (subordinate) bank branches / PACS, compensation amounts as received from AIC with all details, to be credited to beneficiary accounts.

• The claim proceeds of MNAIS received from AIC should be credited to the respective beneficiary bank account within seven days. The list of beneficiary cultivators with claim amount shall be displayed by the Branch / Primary Agricultural Cooperative Society (PACS) and a copy shall also be provided to the Chairman/Sarpanch/Pradhan of the village Panchayat. The Banks shall issue a utilization certificate to AIC that entire money received

13 towards settlement of claims has already been credited into the account of beneficiaries.

• Declarations received from the Banks/PACS after the cut-off date shall be summarily rejected and the liability, if any, for such declarations shall rest with the concerned bank. Therefore, the Banks/PACS must strictly adhere to the cut-off date for coverage and submission to AIC . The Banks/PACS must also ensure that the declarations along with the premium amount is remitted to AIC within the stipulated time, failing which the concerned nodal bank shall be responsible for payment of claims, if any to the farmers.( Please refer Annexure NA-IV for Cut Off Dates)

• Maintaining the records of proposal forms, all the other relevant records, registers, documents and statements at offices of Nodal Bank and service (subordinate) bank branches within their jurisdictional area for the purpose of scrutiny / verification by AIC or its authorized representatives and District Level Monitoring Committee ( DLMC).

• Under administrative mechanism, banks are designated as terminal service points for farmers. Hence, it is their bounden duty to ensure compulsory coverage of all eligible loanee farmers and all interested non-loanee farmers.

• Banks should ensure that the cultivator is not deprived of any benefit under the Scheme due to errors / omissions / commissions of the Nodal Bank/Branch/PACS, and in case of such errors, the concerned institutions shall only make good all such losses.

• Officers of AIC shall be permitted to access all relevant records / ledgers at the Nodal Bank / Branch / PACS at all times for the purpose of smooth implementation of the scheme.

• The Nodal Banks has to send the Listing Sheet in the prescribe format to AIC through E-Mail: [email protected] within 15 days after final cut-off date for submission of Proposal / Declaration to AIC.

The lending banks branches/PACS should prepare Listing Sheets (as per Annexure NA-VII) and forward it to their controlling banks/nodal banks. The nodal banks in turn should consolidate the details and submit to AIC the Declarations ( separate for loanee & non-loanee farmers as per Annexure NA- VI & Annexure NA-IX prepared crop-wise, panchayat-wise, gender-wise and category-wise) along with the Listing Sheet within stipulated Cut-Off dates .

The Loanee farmer if opting for additional coverage should submit to the bank branch a duly filled in Proposal form( as per Annexure NA-VIII).The proposal form for Non-Loanee farmers is enclosed as Annexure NA-X (Direct/Through Intermediary) &Annexure NA-XI (Through Banks).

The Non-Loanee farmers who have not registered with AIC need to fill in the Farmer Registration Form as enclosed.(Annexure NA-XI)

Annexure -B

Methods of Indemnification

The crop loss shall be assessed on the basis of following indemnification methods, as per the provisionsof the Scheme and Operational Modalities-

(A) Wide Spread Calamities:

(i) Based on Season End Yield:

The Department of Economics& Statistics (DES) will plan and conduct at least 4 Crop Cutting Experiments (CCEs) in eachnotified insurance unit (Panchayat) for Paddy and 16 CCEs in each notified Block for Banana & Tapioca Crops, in order to assess crop yield. Claims will be worked out based on actual yield furnished by DES at the end of harvest season. DES will maintain single series of CCEs and resultant yield estimates, both for Crop Production estimates and Crop Insurance. Planning and supervision for all CCEs by State Govt. will be of same order as that of General Crop Estimation Surveys (GCES).

Claim Formula: lf ‘Actual Yield' (AY) per hectare of insured crop for insurance unit (calculated on basis of requisitenumber of CCEs) in insured season, falls short of specified 'Threshold Yield' (TY), all insured farmersgrowing that crop in defined area are deemed to have suffered shortfall in yield of similar magnitude.

MNAIS seeks to provide coverage against such contingency.

'Claim' shall be calculated as per the following formula:

(Threshold Yield - Actual yield) x Sum Insured for the Farmer

Threshold yield

(ii) On—Account Payment of Claims due to Mid-Season Adversity:

In case of adverse seasonal conditions during crop season viz. floods, prolonged dry spells, severe drought etc, Insurance Company in consultation with Department of Agriculture , Govt. of Kerala, based on agro meteorological

17 data(Rainfall), details of estimated losses etc will decide about crops/ areas for which on account payment will be made, not exceeding25% of likely claims. Appraisal of mid-season adversity and quantum of on-account payment will be conducted jointly by Government of India/ Govt of Kerala and Insurance Company. On account payment will be implemented only in states where such proxy indicators can be established and will be considered for payment only if the expected yield during the season is less than 50% of normal yield.

Insuch an instance, insurance company based on declarations received from banks or insurance proposals,received from other authorized agencies or directly from farmers for such crops and areas affected by adverse season; shall work out likely claims which will occur based on end of season yield assessment,and will release claim up to 25% of likely claims, in advance to farmers through nodal banks subject to adjustment against claims assessed on yield basis i.e. in case end of season yield based claims works out to be higher, then difference of claim would be payable and in case end of the season claim based on yield happens to be lower, then the insurance company reserves the right to recover excess claims so paid to farmers. ln case of near total loss situation during the season (at a stage of the crop cycle when complete inputcost is not incurred), the losses will be paid based on 'graded scale' of payment.

Illustration: District 'A' has been affected by floods having 100 insurance units under Crop ‘X". Out ofwhich 50 insurance units were severely affected and as per the weather indicators / agro-met data, ithas been assessed that 30 insurance units could have yield loss of more than 50% (compared to theNormal Yield). Out of these 30 insurance units, estimated yield loss for 5 units is 80% (Category-I), foranother 10 units, it is 70% (Category-II) and remaining 15 units, it is 60%

18 (Category-III) of normal yield,due to which likely yield may be in range of 20%, 30% and 40%. The likely claims for the above units(compared to Threshold Yield) may be 64%, 56% and 48% respectively. As per declarations received, ifsum insured for notified areas in Category-I, Category-II and Category-III is Rs. 1 crore, Rs. 2 crore, and Rs 3 crore, respectively, then likely final claims will be Rs. 64 lakh, 112 lakh and 144 lakh respectively. Hence on-account claims upto 25% will be Rs. 16 lakh, 28 lakh and 36 lakh, which will be released during the season.

(iii) Prevented Sowing [Planting Claims:

Due to non-receipt of sufficient rainfall or excess rainfall or other weather adversities, farmers in one insurance unit may not be in a position to either sow or transplant crop or grow crop (failed at an earlystage). When this incidence is widespread i.e. majority of area in one insurance unit remains unsown /failed sowing, (more than 75% of normal area), then insurance company based on weather / rainfallposition in insurance unit, (as issued by concerned office of IMD during the season) and acreage-sown particulars received from Department of Agriculture , Govt. of Kerala ,will decide extent of claims to be paid . In case of non-availability of IMD stations at a location or else non availability of IMD data on certain days, other authentic weather stations / rain gauge stations by State Government/ autonomous bodies / agriculture universities / private agencies as approved by SLCCCI can also be considered for purpose of measuring weather / rainfall.

GOI and State Government will arrange for weather / rainfall data from IMD / Other autonomous / Government bodies, to insurance company, while data from private data providers will bearranged by insurance company. Area sown particulars will also be provided by Department of Agriculture , Govt. of Kerala,within one month after end of normal sowing season. Rainfall requirement for sowing a crop differsfrom crop to crop. Similarly, the quantum of inputs used before sowing (land preparation, seed fertilizer etc) varies from crop to crop.

The Department of Agriculture , Govt. of Kerala (based on proxy indicators like weather data, area enumeration, satellite imagery,etc.) will decide that majority of the area in the IU could not be sown or the sowing failed and insurance company in consultation with SLCCCI will assess extent of claims

19 payable based on the weather /rainfall position, crop, acreage planted etc. and in any case maximum claims payable will berestricted to 25% of sum-insured.

Having become eligible for prevented / failed sowing, insurance cover is automatically terminated. i.e. once the IU is chosen for this benefit, the insurance cover cease to operate for the subsequent period of the season. Process of determining prevented / failed sowing being automated, farmers need not lodge any claim for prevented / failed sowing.

Illustration: District 'B' with 100 insurance units has been affected by dry-spell, consequently about80% of the area could not be sown in about 50 insurance units for Summer Paddy crop, where perhectare sum insured is Rs. 20,000. As per slab of payment for prevented sowing, is 50% and benefit payable is: sum insured X 50% X 25%, which on a sum insured of Rs. 20,000 works out to Rs. 2,500. Incase of failed sowing, the slab is 75%, benefit payable is: sum insured X 75% X 25%, which on sum insured of Rs. 20,000 works out to Rs. 3,750.

For Loanee Farmers ,eligible loan sanctioned amount as per SoF of the crop has to be compulsorily covered and the premium subsidy is applicable upto the loan sanctioned amount , even if the laon sanctionied amount is above the normal sum insured limits. 3.The subsidy is applicable only on Normal Sum Insured Limits .For additional coverage , if opted by the farmer ,he has to pay at Full Premium rate for the additional Sum Insured opted. 4. All Loanee Farmers who have ‘Sanctioned Credit Limit’ during the seasonality period (within cut-off date) are eligible for compulsory insurance under PART (I). 7. Whenever any clarifications in respect of Declarations submitted by Bank is sought for by AIC, the same must be submitted within one month of AIC’s letter and no clarification will be entertained by AIC thereafter for any purpose whatsoever including reopening of claims. 8. Under Small and Marginal farmers only those farmers should be included whose landholding is upto 2 Hectares. 9. Insurance Unit – The name of Insurance Unit should be reported based on the location of Land in which the crop is proposed to be grown and not on the basis of Residential Address of the farmer. 10. Backup Records and Registers – In order to facilitate better administrative control, office prudence and Claims/ Refund of Excess collection distribution, following records are advisable to be maintained: a) The Nodal Bank should maintain Branch/ PACS wise Declarations for each Crop and Insurance Unit, based on which the Nodal Bank has submitted the consolidated Declaration for the Crop and Insurance Unit to AIC. b) Each Branch/PACS should possess a copy of the declaration sent by them to the Nodal Bank. 1. Separate proposal forms may be submitted for each crop.

2. Please complete the Proposal Form in all respects.

3. Insurance is a contract of Utmost Good Faith requiring the Insured not only to disclose all material facts but also not to suppress any material facts. If you think any fact is material, please disclose it.

4. The Insurance shall become voidable at the option of the Insurer, in the event of any untrue or incorrect statement, misrepresentation, non-description or non-disclosure in any material particular in the proposal form/personal statement, declaration and connected documents, or any material information having been withheld by the proposer or any one acting on his behalf.

RE: NOTIFICATION OF WBCIS KHARIF 2015 SEASON & GUIDELINES FOR IMPLEMENTATION

Ref: Department of Agriculture & Cooperation, Ministry of Agriculture, Govt. of India Letter No No. 13015/02/2012-Credit II dated 20th March 2015 regarding approval for the Implementation of National Crop Insurance Programme (NCIP) during Xllth Plan for Kharif 2015 Season - issue of Administrative Instructions.

State Level Coordination Committee on Crop Insurance (SLCCCI) of Kerala constituted as per the provision of NCIP by Govt. of Kerala in its meeting held on 15th May 2015 has decided to implement the Weather Based Crop Insurance Scheme (WBCIS) component of National Crop Insurance Programme (NCIP)/ Rashtriya Fasal Bima Karyakram (RFBK) in the State of Kerala during Kharif 2015 season and the copy of the relevant GO (Rt) No 991/2015/AD dated 01.06.2015 is enclosed herewith.

Guidelines for WBCIS Implementation

1. The WBCIS is being implemented in all Districts, except Alappuzha & Pathanamthitta. The Crops Notified are Paddy, Banana, Ginger, Turmeric, Pineapple, Sugarcane, Cardamom, Pepper, Arecanut and Nutmeg. The list of District-wise crops notified in each district under WBCIS is as per Annexure WB I

2. The WBCIS adopts an ‘Area Approach’ basis .For this the State Govt. has notified Reference Unit Area’s(RUA), which are essentially a Group of adjoining Panchayats/Municipalities, and a centrally located Reference Weather Station (RWS) has been notified for each RUA. The Claims for an RUA is calculated ONLY on the basis of Weather Data recorded at its notified RWS. If the RWS data is unavailable for any day/interval during the risk period, the data of corresponding Back-up Weather Station (BWS) notified would be used for the purpose. The details of notified RUA’s, their RWS’s and BWS’s are appended as Annexure WB- II (For All Crops except Banana) & Annexure WB-III (For Banana Crop).

3. The Sum Insured per Unit Area for each crop is pre-fixed & it varies Crop-wise based on the cost of cultivation and it represents the Maximum amount which should be insured per Unit Area for the particular Crop. For Loanee Farmers, if the advanced loan amount per Hactre is greater than this pre- fixed Sum Insured per Hactre, only the amount of loan as per this pre-fixed Sum insured/Ha multiplied by total crop area needs to be insured under WBCIS for that crop. For Non-Loanee Farmers the Sum Insured is calculated by multiplying the pre-fixed Sum insured per Hactre with the no. of Hectares the farmer is proposing (in the proposal form) for insurance.

4. The Sum Insured per Hectare for a crop is distributed under several Insurance Covers with different risk periods starting from 7th July 2015 .For the details of Insurance covers for each crop their Risk Periods please refer Annexure WB-IV. The claims are calculated only after the entire risk period under different insurance covers of the particular crop is over subject to the timely availability of Weather Data from respective RWS’s.

5. A Term Sheet is the basic Scheme document which details the insurance covers, their risk periods and How & When the claim becomes payable for each crop. The Term Sheets for all the crops Notified under WBCIS are appended as Annexure WB-V (1-15)

6. For the Details of Crop-wise pre-fixed Sum Insured per Unit Area, Total Premium, Subsidy& Net Farmer’s Premium per Unit area refer Annexure WB-VI .

7. All the Loanee applicant Farmers who have a credit limit sanctioned for any of these notified Crops during this Season till 31st July 2015 have to be compulsorily insured under WBCIS by the respective Financial Institutions and for this purpose such loanee applicant farmers need not submit any application/proposal for insurance.

8. Non-Loanee Farmers have the choice of either MNAIS or WBCIS and can insure their crops through the banking network/insurance intermediaries/Agents or the authorized representatives of AIC/UIIC. They have to submit a proposal form and pay the requisite premium for availing insurance.

9. The WBCIS follows strict time frames for coverage as well as submission of Proposals/Declarations. The Cut-off Date for Coverage of Loanee & Non- loanee farmers is mentioned in Annexure WB- IV. The Controlling offices of Banks for loanee farmers and the Intermediary/UIIC for Non-loanee farmers shall submit the relevant coverage statements/declarations and consolidated premium DDs to AIC well within these coverage cut-off dates.

10. The Loan Disbursing Branches/PACS should submit the individual details of coverage of all the eligible loanee farmers in the prescribed Listing sheet format (format enclosed) prepared Crop-wise, RUA-wise, Gender- wise(Male/Female) and Category-wise(SC/ST/Others); to their Controlling Offices. The Controlling offices should submit the consolidated details in Declaration Formats prepared Crop-wise, Reference Unit Area-wise, Gender-wise(Male/Female) and Category-wise(SC/ST/ Others),along with relevant Listing Sheet to AIC within stipulated Cut-Off Dates.

11.The criteria for covering Loanee Farmers on a compulsory basis is based on the availability of ‘Sanctioned Credit Limit’ for the crop within the cut-off date prescribed for the purpose. The final eligible Sum Insured is to be arrived on the basis of the acreage of the crop declared by the farmer in the loan application multiplied by the pre-fixed Sum Insured per hectare as per Annexure WB- VI.

As an illustration, a farmer in has an overall sanctioned credit limit of Rs.2,00,000 as on 30.06.2015 for Paddy, Tomato & Arecanut. In this case, assuming that as per the farmer’s loan application he/she had declared 2 Ha under Kharif Paddy, 3 Ha under Tomato & 1.5 Ha under Arecanut:

1. Here only Paddy & Arecanut needs to be covered since Tomato is not notified under WBCIS

2. Rs 35000/Ha is the prefixed Sum Insured for Paddy & Rs 45000/Ha is the prefixed Sum Insured for Arecanut as per WBCIS Scheme norms .

2. Hence, the Applicable Sum Insured under WBCIS is 35000*2 = Rs 70000 for Paddy & 45000*1.5= Rs 67500 for Arecanut.

4. The Farmer’s Premium for Paddy is 70000*2.5 %= Rs 1750 & for Arecanut is 67500 *4.8 % = Rs 3240 & thus the Total Farmer’s Premium is Rs 4990.

5. If the Bank advances for Paddy @ Rs 50000 /Ha due to its higher SOF, in the above case the advanced loan amount for Paddy becomes Rs 100000 .But only Rs 70000 needs to be covered under WBCIS .This is applicable to all crops under WBCIS.

12.The last date for coverage of Loanee Farmers is 31st JULY 2015 ie all farmers who have availed loan or have sanctioned credit limit as on 31.07.2015, for these notified crops are to be compulsorily covered under WBCIS. The Nodal Banks would submit the final consolidated ‘Declarations’ prepared by them and ‘Listing Sheets’ prepared by their branches in the specified formats (to be prepared Crop-wise, Reference Unit Area-wise, Gender-wise and Category-wise) and with requisite premium by 31st August 2015. The last date for accepting Proposals for coverage from Non-Loanee farmers is 07th July 2015. The Nodal Bank would submit the ‘Non-loanee Declarations’ along with requisite premium by 31st July 2015 . A copy of the Non-loanee Proposal cum Registration Form (Annexure WB X), Non-Loanee Declaration format (Annexure WB IX) and Loanee-Declaration format (Annexure WB VII) and Listing Sheet Format for Bank Branches/PACS for reporting to their nodal offices (Annexure WB-VIII) is appended with this communication.

13.All payouts under the scheme are settled by Agriculture Insurance Company of India Limited (AIC), and to the extent possible within 45 days from the end of the risk period subject to the availability of weather data for the coverage period and receipt of State Government Share of Premium Subsidy.

14.The Claim payouts for a Reference Unit Area (RUA) under the WBCIS would be made only on the basis of the weather data during the cover period as received from the respective notified Reference Weather Station (RWS).

Prohibition of Rebates : Section 41 of the Insurance Act 1938 provides as follows 1. No Person shall allow or offer to allow, either directly or indirectly, as an inducement to any person to take out or renew or continue an insurance in respect of any kind of risk relating to lives or property in India, any rebate of the whole or part of the commission payable or any rebate of the premium shown on the policy, nor shall any person taking out or renewing or continuing a policy accept any rebate, except such rebate as may be allowed in accordance with the published prospectuses or tables of the insurer. Provided that acceptance by an insurance agent of commission in connection with a policy of life insurance taken out by himself on his own life shall not be deemed to be acceptance of a rebate of premium within the meaning of this sub-section if at the time of such acceptance, the insurance agent satisfies the prescribed conditions establishing that he is a bona fide insurance agent employed by the insurer. 2. Any person making default in complying with the provisions of this section shall be punishable with fine which may extend to five hundred rupees.
