ATKINSON** Discrimination in education, in housing, and in employment brought cases before the Vinson Court which were often resolved by a nearly unanimous vote, but they frequently raised constitutional and institutional dilemmas of agonizing dimensions. A fundamental commitment of the Court at this time was accurately reflected by Justice Jackson's off-the-Court admonition to his colleagues on the inadvisability of seizing "the initiative in shaping the policy of the law, either by constitutional interpretation or by statutory construc- tion."' There were strong voices within the Vinson Court which held rigorously to Justice Holmes' dictum that "judges do and must legis- late, but they can do so only interstitially; they are confined from molar to molecular motions." HoRwiTz* From 1953, when Earl Warren became Chief Justice, to 1969, when Earl Warren stepped down as Chief Justice, a constitutional revolution occurred. Constitutional revolutions are rare in American history. Indeed, the only constitutional revolution prior to the Warren Court was the New Deal Revolution of 1937, which fundamentally altered the relationship between the federal government and the states and between the government and the economy. Prior to 1937, there had been great continuity in American constitutional history. The first sharp break occurred in 1937 with the New Deal Court. The second sharp break took place between 1953 and 1969 with the Warren Court. Whether we will experience a comparable turn after 1969 remains to be seen. -

Tuan Samahon* Ideological judicial selection encompasses more than the affirmative nominating, confirming, and appointing of judges who pre-commit to particular legal interpretations and constructions of constitutional text. It may also include deselection by way of im- peachment and removal (or at least its threat) of judges subscribing to interpretations and constructions of the Constitution that one disapproves. This negative tactic may be particularly effective when deployed against judges on closely divided collegial courts, such as the U.S. Supreme Court and the U.S. courts of appeals, where per- sonnel determine voting majorities and, in turn, majorities determine case outcomes. The Pickering-Chase, Fortas-Douglas, and Christian Coalition impeachments and threats of impeachment illustrate that the use or threat of this tactic is more common than might be supposed. Indeed, recent calls for the removal of Circuit Judge Jay Bybee demonstrate the continuing allure of impeachment as judicial selection. This Article examines the phenomenon of impeachment as judicial selection through Professors Tushnet’s and Balkin’s framework of “constitutional hardball.” In the case of impeachment as judicial selection, Congress plays constitutional hardball by claiming that it is an appropriate tool for political control and a fraternal twin to the modern appointments process. -

~epartment of Wustite PROCEEDINGS IN THE SUPREME COURT OF THE UNITED STATES IN MEMORY OF JUSTICE GOLDBERG Monday, October 15, 1990 REMARKS OF THE ATTORNEY GENERAL OF THE UNITED STATES MR. CHIEF JUSTICE, and may it please the Court: The Bar of this Court met today to honor the memory of Arthur Joseph Goldberg, Associate Justice of the Supreme Court from 1962 to 1965. Arthur Goldberg served the Nation with distinction as a lawyer, soldier, Cabinet officer, Supreme Court Justice, and diplomat. Born in Chicago in 1908, he was educated in the Chicago public schools and at Northwestern University, where he , was first in his law school class and Editor-in-Chief of the Law Review. By special dispensation, Arthur Goldberg sat for the Illinois bar examination before he reached the age of 21. He was admitted 'to the Illinois bar in 1929 and began a general law I practice in Chicago. He opened his own law office in 1933, and soon began hanaling labor matters for clients such as the United Steelworkers and the Chicago Newspaper Guild. During World War II, Arthur Goldberg served under William J. Donovan as Chief of the Labor Division in the Office of strategic services. He carried out several intelligence missions to Europe, where he organized transportation workers into a valuable Allied intelligence network. After the war, he resumed his law practice and soon gained recognition as a preeminent labor lawyer. He served as general - 2 counsel to the United Steelworkers from 1948 to 1961. As general counsel to the Congress of Industrial Organizations, Arthur Goldberg played a major role in the merger of that organization and the American Federation of Labor in 1955. -

A Jewish seat on the Supreme Court? Justice Ruth Bader Ginsburg contends that there once was, but that is no longer the case. She explored the subject during the 2003 Louis D. Brandeis Lecture on Tuesday, February 11, at the Seelbach Hotel. Immediately following the lecture, the University of Louisville’s Louis D. Brandeis School of Law Brandeis Scholars presented Justice Ginsburg with the Brandeis Medal. The medal recognizes individuals whose lives reflect Justice Brandeis’ commitment to the ideals of individual liberty, concern for the disadvantaged and public service. Judah Benjamin While Justice Brandeis was the first Jew appointed to the Supreme Court, Justice Ginsburg pointed out that he was not the first Jew nominated for the position. That honor went to Louisiana Sen. Judah Benjamin, who was nominated by President Millard Fillmore in 1851. Benjamin declined the honor, preferring to remain in the Senate, because, Justice Ginsburg noted, the Supreme Court had not yet achieved full equality as a branch of government. Benjamin resigned his Senate seat in 1861 when Louisiana suceeded from the Union and went on to hold leadership positions in the Confederacy. When the Confederacy was defeated, Benjamin fled to England and, at age 60, built another successful career as a barrister there, even serving as Queen’s Counsel. What is most remarkable about Benjamin, Justice Ginsburg pointed out is that he achieved such a high level of success twice in his lifetime in spite of a great deal of anti-Semitic activity at that time. -

By as serting that philosophical principles tell us what the first amend ment means, Barendt not only transforms the amendment but also elevates particular philosophical principles to a status that they have not earned and may not merit. Such an approach reduces the incentive to evaluate philosophical arguments seriously and realisti cally. When scholars forego the temptation to pass off their philos ophy as interpretation of what the Constitution means, they will likely find themselves forced to do better philosophy. THE NOMINATION On August 12, 1937, Franklin Delano Roosevelt, rebounding from the worst setback of his long Presidency, took the first of a series of steps toward creating what historians would one day call "the Roose- velt Court." Galling defeat had come less than a month before when the Senate had killed his scheme to add a Justice to the Supreme Court for every member aged seventy or over who did not resign or retire. The original plan would have allowed the President to name as many as six new Justices, but after a bitter 168-day fight, the measure was buried, amid loud rejoicing from FDR's opponents. Roosevelt was not finished yet, however, for one legacy of the protracted struggle was the creation of a vacancy on the Supreme Court, and it was the President's prerogative to nominate a successor. The choice he finally made would trigger an acrimonious controversy and would have a momentous im- pact on the disposition of the Court. The vacancy resulted, at least indirectly, from Roosevelt's "Court- packing" plan. The President had advanced his bold proposal in February because he was frustrated by the performance of the Supreme Court, particularly the conservative "Four Horsemen"--Willis Van t De Witt Clinton Professor of History, Columbia University. Justice Sherman Minton and the Balance of Liberty DAVID N. ATKINSONt INTRODUCTION The behavior of any Justice may be in part determined by how he perceives the Supreme Court's institutional role within the political system. Justice Sherman Minton very definitely had trenchant views on the institutional role of the Supreme Court in American government, and on the function of the judge in the judicial process as well. Justice Minton believed that the Supreme Court's role in American government is circumscribed by the classic theory of the separation of powers. Although he acknowledged that the Constitution prohibits the executive and legislative branches from certain kinds of activities, he was inclined to resolve questions as to the legitimacy of executive or legislative acts in favor of their constitutionality.
