Linthouse and Shieldhall (Traffic Management and Parking Controls) Order (Ward 5) – Referral to Scottish Government Minister for Transport and Islands approved, after division. 5 With reference to the minutes of 13th August 2015 (Print 3, page 186) agreeing that prior to making the Traffic Regulation Order (TRO) for the control of the on-street parking in the Linthouse and Govan area (Ward 5), a public hearing be held which would be conducted by an independent Reporter in accordance with the Local Authorities’ Traffic Orders (Procedure)(Scotland) Regulations 1999, Councillor Richardson, City Convener for Sustainability and Carbon Reduction, presented a report regarding the Reporter’s report and recommendations following the hearing, advising that (1) the Reporter had held a hearing on 2nd and 3rd June 2016 to consider the objections to the proposed TRO for the control of the on-street parking in the Linthouse and Govan area; (2) the Reporter’s report and recommendations, as detailed in the report were released to the Council on 8th September 2016 and to those parties who attended the hearing and the public the following day; (3) the Council must consider the Reporter’s report and recommendations however it was not legally bound to accept any of them and the 5 options for the Council were as detailed in the report; (4) regardless of whether or not the recommendations of the Reporter were followed, the validity of a TRO might still be challenged in the Court of Session within a 6-week period following the making of the TRO therefore, there was potential for the Council to be legally challenged on this TRO irrespective of which decision was made; and (5) having considered the options, as detailed in the report and with the benefit of external legal advice regarding the possibility of legal challenges that the Council might face in light of any decision, it was proposed that the matter be referred to the Scottish Government Minister for Transport and Islands for a direction under paragraph 9 of Schedule 9 of the Road Traffic Regulation Act 1984. Councillor MacDonald, seconded by Councillor Richardson, moved that the committee (a) note the report, the Independent Reporter’s report and recommendations as detailed in Appendix 1 to the report; and (b) agree (i) to refer the matter to the Scottish Government Minister for Transport and the Islands for a direction under paragraph 9 of Schedule 9 of the Road Traffic Regulation Act 1984; and (ii) that as a key condition of the referral of the matter to the Scottish Government, the Council commits to working with all relevant stakeholders, including the local community, the National Health Service and Strathclyde Passenger Transport, to conduct a comprehensive review of all public transport options for the hospital, including exploring all rail options, and commits to encouraging a modal shift away from individual car use through the expansion of the car club scheme. Councillor Watson, seconded by Councillor McAveety, moved as an amendment that the Council seek further legal advice on implementing free parking schemes at all hospital sites in the city before referring the matter to the Scottish Government Minister for Transport and the Islands. On a vote being taken electronically, 10 members voted for the amendment and 13 for the motion, which was accordingly declared to be carried. .
