The solicitor representing the applicant introduced the application and confirmed that the variation was for the basement only to allow flexibility when the basement is used for events such as private parties, casual dining and post art gallery events. He confirmed that the premises would continue to be operated as a restaurant and a doorman and dedicated taxi firm is being used to disperse patrons when leaving the premises

The Environmental Health withdrew their representation following the agreement of a condition relating to the capacity of the premises. The Metropolitan Police maintained their representation on the grounds the application entails the increase in hours for the sale of alcohol in the West End Stress Area .

Decision: Following consideration, the application was granted with a condition.

The solicitor representing the applicant introduced the application and confirmed that a premises licence is sought to allow functions to be held at the premises for private pre-booked events . The premises would remain a private members club and the use of the premises by members would take priority over private functions. He confirmed that they are seeking reduced licensable activities compared to the activities currently permitted by the existing club premises certificate.

He confirmed that conditions have been agreed with the Environmental Health.

The Environmental Health confirmed that their concerns have been addressed and their representation has been withdrawn.

Decision: The application was granted with the agreed conditions as there is no longer any representation.

The Licensing Service introduced the application informing Members that both the Police and Environmental Health Service have withdrawn their representations following agreement to conditions with the applicant.

The applicant introduced the application outlining the reasons for the application submitted.

The Licensing Service confirmed that the local resident resided within the vicinity of the premises however, requested her address to remain anonymous.

The application was granted in full.

Karaoke Box Ground Floor, 18 Frith Street, London W1D 4RQ Ref: 10/08452/LIPV

Application

Karaoke Box Ltd applied to vary their premises licence to extend the hours for licensable activities at the premises. The application was amended at the hearing so that the licensable activities on Thursday, Friday and Saturday nights were reduced to 4.30.

Representations

The Environmental Health service maintained their representation. It was their belief that the application was contrary to the councils stress area policy, however they did confirm that no noise complaints had been made against the premises in the recent past.

The Metropolitan Police maintained their representation, based on the fact that the premises are in the stress area and extending the hours for licensable activities will add to cumulative impact.

Decision

Granted.

Whilst the Sub-Committee acknowledged the views of the responsible authorities, they acknowledged that the premises is ‘entertainment led’ rather than ‘drink led’ . The Sub-Committee was satisfied that the extension of hours to these premises would not add to cumulative impact. The Sub-Committee granted the application.

Application

The application was to remove the requirement that alcohol shall not be sold on the premises otherwise than to patrons taking a table meal and as ancillary to the meal. The change would only be effective for part of the ground floor and only during the core hours. Representations

The Environmental Health Department maintained their representation as it was their view that the proposals, if granted, would have the effect of creating a new bar in the stress area which is contrary to the Council’s licensing policy.

The Metropolitan Police agreed with this view and they also maintained their representation.

Decision:

Refused

The Sub-Committee agreed with the views of the Responsible Authorities and refused the application as the Stress Area policy is to refuse applications for pubs and bars other than applications to vary hours within the Core Hours. No reasons were given as to why this policy should be overridden.

Temporary Event Notices

Southern Fried Chicken, 26 Strutton Ground, London, SW1P 2HR 10/10303/LITENN – 23:00 on 31st December 2010 to 05:00 on 1st January 2011

A Temporary Event Notice was made to the Licensing Authority on the 8th December 2010 to permit late night refreshment to take place from 23:00 on the 31st December 2010 to 05:00 on the 1st January 2011. The Temporary Event Notice was opposed by the Police on the grounds that if permitted it would undermine the prevention of crime and disorder licensing objective. Mr Gastasebi, the applicant was present at the hearing and after discussions between both the Police and applicant the Police were satisfied that their concerns were going to be addressed. As such the Police withdrew their representation to the Temporary Event Notice and the Notice was acknowledged by the Licensing Authority.

Three Temporary Event Notices were made to the Licensing Authority on the 3rd December 2010 to permit late night refreshment to take place between the hours of 03:00 and 05:00 on the 18th, 19th, 25th, 26th, 27th, 28th, 31st December 2010 and 1st, 2nd and 3rd January 2011. All of the Temporary Event Notices were opposed by the Police on the grounds that if permitted they would undermine the prevention of crime and disorder licensing objective. Mr Gulzar, the applicant advised officers that he would not be attending the hearing. In Mr Gulzars absence the police gave their grounds for objection to these Notices to the Committee. Following consideration of the evidence from the police the Licensing Sub-Committee made the decision that they would issue a counter notice to each of these Temporary Event Notices.

West End London Palladium 22/11/2010, Premises Really useful Group Theatres is currently refurbishing a large 03/01/2011 7-8 Argyll Street Licence - Variation, front of house area of the London Palladium at a cost of £2.5 London W1F 7TQ 10/09562/LIPV million. The area concerned previously comprised the box office and various administration support rooms. Over the last 20 years we have seen a massive change in the way tickets are sold with the majority of tickets now being sold either through call centres or via the Internet. Only a small percentage of tickets are now sold at the theatre's box office. This has presented us with an opportunity to reduce the size of the box office at the London Palladium and use the space gained to provide additional facilities for our customers. We are providing much needed additional public toilets and improving the entrances into the auditorium and stalls bar. It is intended that the refurbished area will also provide additional overflow space from the existing stalls bar which is a relatively small area given that the stalls of the London Palladium seats 1,023 customers. For this reason we are making this application for a full variation to permit alcohol to be sold and consumed in the newly created hospitality area which is highlighted in pink on the attached plan. For the sake of clarity, we are not seeking a variation to the permitted hours for the sale by retail of alcohol as currently set out on the existing licence. The refurbishment scheme has full planning and listed building consent.
