MINUTES Meeting of 27 May 2013, from 15.00 to 18.30, and 28 May 2013, from 09.00 to 12.30 BRUSSELS

The meeting opened at 15.07 on Monday 27 May 2013, with Erminia Mazzoni (Chair) in the chair.

1. Adoption of draft agenda

Mrs. Erminia Mazzoni in the chair, at 15.00 opened the meeting.

The chair commented on item 5 of the agenda: petitions 813/2008, 305/2010 & 436/2010: GMOs and their authorisation: she welcomed Professor Seralini, responsible for scientific research in this field.

She also welcomed the Director of Scientific Evaluation of Regulated Products from the European Food Safety Authority (EFSA), Mr. Per Bergmann.

The chair reminded the Members and those present at the meeting that the points 8 and 9 of the agenda are to be held "in camera" as decided by the coordinators. On a point of order a procedural discussion followed.

By a vote of 9 to 4 it was confirmed that items 8 and 9 would be held in camera.

Members were informed about the possibility of holding a short extraordinary meeting on June 3rd to decide upon the organisation of the public hearing where the candidates for the position of European Ombudsman will make statements. The hearing open to all members will take place on June 18th.

EN United in diversity EN The Chairman informed members that the Committee would consider the draft annual report presented by Edward McMillan-Scott, and the opinion of Giles Chichester on issues related to the seat of the European Parliament for which AFCO is responsible.

There would then be consideration of the amendments tabled to the Chountis opinion on the EIA.

Further, discussions on the reports of the fact-finding visits to Galicia (for which Philippe Boulland has requested that no document be distributed) and Madrid, for which a Draft Working Document was available, were to follow.

Speakers: Angelika Wehrtmann, Carlos José Iturgaiz Angulo, Margrete Auken. They called for the Report on the Galicia visit to be available in all language versions to all members.

The agenda was subsequently approved. Points 39, 41, 47, 61 and 66 were moved from B to A.

2. Approval of minutes of the meeting of:

3. Chairman’s announcements.

The proposals contained in the annexe to the Chair-notes were approved as distributed.

4. Petition 813/2008 by Brian John (British), on alleged breaches of the general principles governing the activity of the European Food Safety Agency (EFSA) in connection with the examination of the applications for Genetically Modified food and Petition 305/2010 by Carola Twardella (German), on her recommendation for the Parliament to review its decision to authorise large-scale planting of GMO potatoes by BASF and sale of GMO maize by Monsanto and Petition 436/2010 by Brian John (British), on formal protest against the Commission draft regulation on implementing rules concerning the applications for authorisation of genetically modified food and feed in accordance with Regulation (EC) No 1829/2003 of the European Parliament and of the Council and amending Regulations No (EC) 641/2004 and (EC) No 1981/2006

These petitions were treated together. Prof. G-E. Séralini who has done much research in the area of GMOs and the representatives of the EFSA (Mr. P. Bergman and Mr. Christophe Wolff) presented their respective findings.

The Chair thanked the invited speakers for their contributions and ascertained that much

The Chairman concluded by stating that the ENVI and AGRI committees will be requested to provide written opinions on these petitions which remain open.

5. Petition 343/2012 by Wiebke Reinhardt (German), bearing 2,504 signatures, on the uniform labelling of genetically modified carriers and foodstuffs and Petition 807/2012 by Michael Groß-Hardt (German) concerning food labelling

Speakers: Janusz Wojciechowski, Peter Jahr, Ladislav Miko (COM).

The members voiced the need for transparency in the matter of food labelling. Further information from the Commission was requested and the petitions kept open.

6. Petition 1160/2009 by Werner Sandig (German), on the erection of two windmill parks in the Czech border region Ústí nad Labem and the associated harmful environmental effects on the nearby German nature areas

Speakers: Peter Jahr, Ctibor Kocman (COM).

Decided to keep the petition open, further information from the Commission is expected.

7. Petition 70/2012 by Imre Juhasz (Hungarian), bearing 2 signatures, on a request for the repeal of Resolution 1483/2007-533 of the Slovak National Council concerning the inviolability of the Beneš Decrees

The Commission was represented by Vincent Depaigne (JUST).

The members decided to ask JURI and LIBE committees for their opinion on the petition.

8. Petition 1298/2012 by Lomnici Zoltan and Gubik Laszlo (Hungarian), on Slovak citizenship law

The petitioners for both petitions were present. and there was an extensive and wide-ranging debate.

The Commission was represented by Georgia Georgiadou (JUST).

It was decided to keep the petition open until the decision of the Slovak Constitutional Court ruling on the same subject matter.

10. Chairman’s announcements concerning Coordinators’ decisions

1- Election of the European Ombudsman 2013.

Coordinators were informed that the President announced the names of the six eligible candidates in the plenary last week. The secretariat and the Chair have however yet to receive the full details of each application which has remained with the services of DG Presidency until now.

They are invited to consider the way in which the public hearing scheduled for June 18th is to be structured and an extraordinary meeting is requested by the political groups on June 3rd to finalise this if necessary. It would be useful to reach a broad agreement on the outline programme and on the possible questions to be addressed to each of the eligible candidates.

The eligible candidates are: - Alex BRENNINKMEIJER - Markus JAEGER - Ria OOMEN-RUIJTEN - Emily O'REILLY - Dagmar ROTH-BEHRENDT - Francesco SPERONI.

2- Status of Fact-finding visits (FFVs):

The coordinators approved the three following FFVs: • Greece (in September 2013).This delegation is being postponed until September 18th - 20th because of the fact that not enough members were able to participate in this important mission in May 23-24. This is most regrettable given the good degree of cooperation which was established with the petitioners and the Greek authorities

3- Proposal for a Fact-finding visit to France: N-D L.

This proposal was accepted. The dates are still to be fixed but it is foreseen to take place in October 2013.

On June 19th the Committee is proposed to consider the series of petitions which have been received on the proposed airport construction at Notre-Dame des Landes, near Nantes in western France. On that occasion the Committee will be informed of the responses received from the French authorities regarding the issues we raised with them.

4- Deadline to request INI reports

The deadline to request INI reports was approaching and those who wish to initiate a report should do so as soon as possible.

5- Requests for urgency procedure on admissibility. • 633-13 Further information on the reasons for urgency of this petition was requested.

6- Proposed Hearing of the Committee - September 24th. The coordinators took note of the proposed hearing: "The impact of the crisis on Europe's citizens and the reinforcement of democratic involvement in the governance of the Union".

7- Admissibility of petition 1449/2012 Coordinators have not objected to the admissibility of the petition 1449/2012.

The petitioner indicates that despite holding numerous Romanian and French qualifications he has been unable to obtain employment. Many prospective employers, having enquired as to his nationality, subsequently failed to contact him again or replied that he failed to meet their requirements. The petitioner considers that this is because Romanians have a bad reputation in other countries, being associated with ethnic Roma.

8- Framework Contract & Policy Department Proposals.

Coordinators welcomed the studies proposals which are going to be conducted on social and economic impact of financial crisis on the most vulnerable and on the aspects related to fundamental rights.

11. Presentation by the European Ombudsman, M. Nikiforos Diamandouros, of his Annual Report 2012.

The chair welcomed Mr. Nikiforos Diamandouros for the last time in the Committee as European Ombudsman who presented his 2012 Annual Report for which PETI has appointed Nikolaos Salavrakos as Rapporteur.

The members expressed their thanks to the Mr Diamandouros and paid tribute to his excellent work over the years as the EU's Ombudsman and the close cooperation which had been enjoyed with him and his team.

12. Opinion on The location of the seats of the ’s Institutions (AFCO) 2012/2308(INI)

The members discussed the issue of single seat raising socio-economic and environmental issues.
