  • Court 4 in the Supreme Court Re-Opens by Justice Frank Vincent
Court 4 in the Supreme Court re-opens By Justice Frank Vincent, Court of Appeal, Supreme Court of Victoria, 7 April 2008 Thank you, Chief Justice, for the opportunity to contribute to this occasion. For a number of reasons, this court holds particular significance for me, and it is wonderful to see it so splendidly restored and adapted for use in a new century. My connection with this room began over half a century ago when, as a second- or third-year law student, I sat in the public gallery and watched the charismatic Frank Galbally, who was then at the height of his powers, successfully defend a policeman charged with the murder of his wife. Obviously attributing his success in some small part to devine intervention, immediately after the verdict, Galbally and his client walked down the street to St Francis Church to pray. Their piety was observed by a passing newspaper photographer who, by chance it seems, was in the vicinity and with his camera ready. It was in June 1964 at the age of 26, and a barrister for three years, that I first took my place at the Bar table here, appearing on behalf of the one of two men charged with murder. The trial judge, Monahan J, was a great criminal lawyer and judge. I am reasonably confident that he was even more terrified by my lack of experience than I was. A wily prosecutor named Bill Fazio leading a young Michael Kelly represented the Crown and the legendary Jack Lazarus appeared for the co- accused.

  • Capital Punishment & I S S U E S Compiled and Written by Ivan Potas and John Walker in Crime and Criminal Justice
AUSTRALIAN INSTITUTE OF CRIMINOLOGY No. 3 t r e n d s Capital punishment & i s s u e s Compiled and written by Ivan Potas and John Walker in crime and criminal justice This report is the third in the series on Trends and Issues in Crime and Criminal Justice produced by the research division of the Australian Institute of Criminology. This Institute is often questioned - by the media, politicians and the public - upon the pros and cons of capital punishment; clearly, public interest in this issue has not abated despite its abolition. This continuing public discussion on capital punishment should occur in the context of the facts concerning the use of the death penalty in Australia and in overseas countries. To this end, the Institute presents material which we believe will encourage informed debate on an issue which has too often been discussed in a highly emotive manner. Richard Harding Director he term 'capital punishment' is derived from the Latin caput, meaning T'head'. It originally referred to death by decapitation, but now applies generally to state sanctioned executions. Some Middle East countries still practise decapitation for certain offences, but more common forms of the death penalty include electrocution, gas, firing squad, lethal injection and hanging.1 The History of Capital Punishment in Australia In Australia in the nineteenth century as many as 80 persons were hanged per year for crimes such as burglary, sheep stealing, forgery, sexual assaults and even, in one case, 'being illegally at large', as well as for murder and manslaughter. This was at a time when the population was counted in the hundreds of thousands rather than millions.

  • National (In)Security Politics in Australia: Fear and the Federal Election by Jude Mcculloch
National (in)security politics in Australia: fear and the federal election By Jude McCulloch Introduction Security is set to play a major part in the upcoming federal election. Prime Minister John Howard has already revealed that his strategy for the election in 2004 will be ‘to attack Labor as weak and divided on national security and in the war against terrorism’ (Age 9 June 2003: 4). Howard’s accusation late last year that Labor is ‘soft’ on border protection for not supporting the excision of northern islands to thwart boat arrivals was a shot across the bow in the looming election battle (Age 25 November 2003: 4). Photographs of Howard visiting Australian troops in the Solomon Islands before Christmas show him surrounded by a sea of military personnel in camouflage uniforms. The Prime Minister nominated winning the Attorney General the power to ban terror groups and maintaining a strong policy on border protection as priorities, saying that ‘It’s every facet—it’s defence, it’s…intelligence services, it’s what we are doing in the Pacific’ (Age 23 December 2003). This article describes the way that security is evolving as a major item in party politics at the federal level. It draws parallels between the emerging politics of security and the politics of law and order that have been a prominent part of state and territory politics in Australia since the 1980s and, coinciding with the economic rationalism of the Reagan/Thatcher era, similarly important in the United Kingdom and United States. It argues that security politics, like law and order politics, is less about ‘what works’, and more about winning elections at the expense of policies and programs that might truly enhance human security both at a national and personal level.
