A REGULAR MEETING of the Board of Chosen Freeholders of the of Somerset was held on the above date at immediately following the October 27, 2020 work session.

The Pledge of Allegiance to the Flag was led by Director.

Michael J. Amorosa, Clerk of the Board, stated that the meeting was in compliance with the Open Public Meetings Act and that adequate notice was provided on January 8, 2020 as follows:

1. Mailed to the Star Ledger, the Home News, and the Courier News. 2. Posted on the Official County Bulletin Board. 3. Filed with the County Clerk. 4. Distributed to all persons requesting such information.

BE IT ORDAINED by the Board of Chosen Freeholders of the County of Somerset that:

ZONE 1. 40 miles per hour from the Bridgewater Township - Warren Township corporate line, to a point 800 feet east of Old Washington Valley Road, County Route 638, except 25 miles per hour when passing through the Angelo L. Tomaso Elementary School Zone when the speed limit beacons are flashing.

ZONE 2. 35 miles per hour from a point 800 feet east of Old Washington Valley Road, County Route 638, to Primrose Way.

BE IT ORDAINED by the Board of Chosen Freeholders of the County of Somerset that:

SECTION 1. Speed Limits for both directions of traffic along Valley Road, County Route 527, Watchung Borough, Somerset County be established as follows:

ZONE 1. 25 miles per hour from the Watchung Traffic Circle to a point 370 feet north of Hillcrest Road.

ZONE 2. 35 miles per hour from a point 370 feet north of Hillcrest Road to Orchard Road.

ZONE 3. 40 miles per hour from Orchard Road to Bonnie Burn Road / Plainfield Avenue except 25 miles per hour (mph) when passing through the Bayberry Elementary School Zone, beginning 200 feet south of Bayberry Lane to 200 feet north of Tuttle Road, during recess, when the presence of children is clearly visible from the roadway, or while children are going to or leaving school, during opening or closing hours.

ZONE 4. 45 miles per hour from Bonnie Burn Road / Plainfield Avenue and the Watchung Borough corporate line (Somerset County) - Berkeley Heights corporate line (Union County).

Section 1 That the speed limits for both directions of traffic along Stirling Road, County Route 653 in Warren Township, and Watchung Borough be established as follows:

Zone 1 30 Miles per hour from the Somerset County - Morris County Corporate Line to a point 125 feet south of Frances Road.

Zone 2 40 Miles per hour from a point 125 feet south of Frances Road a point 1300 feet north of Valley View Road except 25 Miles per hour when passing through the Woodland School Zone and Watchung Hills Regional High School Zone when the speed limit beacons are flashing.

Zone 3 35 Miles per hour from a point 1300 feet north of Valley View Road to Hughes Lane except 25 MPH when passing through the Valley View Elementary School during recess when the presence of children is clearly visible from the roadway or while children are going to or leaving school during opening or closing hours.

Zone 4 25 miles per hour from Hughes Lane to the Watchung Traffic Circle.

WHEREAS, the Somerset County Board of Chosen Freeholders is the designated Subregional Transportation Planning Agency for Somerset County; and

WHEREAS, the FY 2021 Annual Transportation Program (A.T.P.) for Somerset County has been developed in conjunction with the New Jersey Department of Transportation, pursuant to State and Federal regulations; and

WHEREAS, the Annual Transportation Program for Somerset County; a copy of which is on file with the Clerk of the Board, incorporates the County’s State Local Aid funding for FY 2021.

NOW, THEREFORE, BE IT RESOLVED that the Somerset County Board of Chosen Freeholders hereby approves the FY 2021 Annual Transportation Program for the County of Somerset; and

PERFORMANCE SURETY RELEASE RESOLUTION CANAL WALK FRANKLIN TOWNSHIP

WHEREAS, Canal Walk Associates, LLC, 929 Route 202, Raritan, NJ 08869, (herein after the “Principal”) and Union Center National Bank, 2455 Morris Avenue, Union, NJ 07083, authorized to do business of surety in the State of New Jersey, (herein after the “Surety”), bound themselves onto the County of Somerset in the form of a letter of credit #915- SB in the amount of $3,000.00 as a guarantee for the setting of GPS monuments in reference to a major residential subdivision creating 811 lots and a 1,277 unit age-restricted community located in Block 513, Lots 1-2, 4, 10-12, 12.01 and 13.01, on Schoolhouse Road and Mettlers Road, Franklin Township on file with the County Planning Board as FL 742S; and

WHEREAS, the report and recommendation of the Somerset County Engineer shows that said principal has satisfactorily completed setting the GPS monuments; and

WHEREAS, therefore the principal has requested the return of the aforesaid performance surety; and

WHEREAS, it is appropriate that the County release the aforesaid surety and return to the principal since the County Engineer is satisfied with the location of the set monuments.

NOW, THEREFORE, BE IT RESOLVED BY, the Board of Chosen Freeholders of the County of Somerset that said Board on behalf of said County accordingly does release and discharge Canal Walk Associates, LLC, and Union Center National Bank, and each of them and their heirs, administrators, executors, and assigns from the obligations of said surety and authorizes the release of said surety; and

BE IT FURTHER RESOLVED BY the Board of Chosen Freeholders of the County of Somerset that said Board on behalf of said County accordingly does authorize and direct the County Planning Board to submit certified copies to the following:

RESOLUTION AUTHORIZING SOMERSET COUNTY HISTORIC PRESERVATION GRANT PROGRAM AWARDS IN THE AMOUNT OF $601,000 FROM THE 2020 OPEN SPACE, RECREATION, FARMLAND AND HISTORIC PRESERVATION TRUST FUND

WHEREAS, the Somerset County Board of Chosen Freeholders has established the Somerset County Open Space, Recreation, Farmland and Historic Preservation Trust Fund to further the preservation of open space, farmland, and historic resources in Somerset County; and

WHEREAS, the Somerset County Board of Chosen Freeholders has established the Historic Preservation Grant Program to assist the County, municipalities and non-profit organizations in the preservation of historic resources; and

WHEREAS, the Somerset County Board of Chosen Freeholders is allocating $900,000.00 for the 2020 round of the Historic Preservation Grant Program; and

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds for the purposes set forth in this Resolution, such certification on file in the Office of the Clerk of the Board, and such funds are provided for in the duly adopted budget of the County of Somerset, line item 13-295- 19-050-803-000; and

WHEREAS, the Somerset County Board of Chosen Freeholders has authorized the distribution of grant applications to municipalities, non-profit organizations and Somerset County in conjunction with the foregoing; and

WHEREAS, the Somerset County Board of Chosen Freeholders has established an application review process which requires the review of applications by the Historic Preservation Grant Program Advisory Committee, which review has been completed at this time; and

WHEREAS, the Somerset County Board of Chosen Freeholders has reviewed and considered all comments and recommendations of the Historic Preservation Grant Program Advisory Committee and the Cultural & Heritage Commission and has determined and prepared a list of grant awards and administrative costs as set forth herein.

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders that it approves the 2020 Historic Preservation Grant Program awards as follows:

Hillsborough Township $125,000.00 for the Van der Veer-Harris House located in Hillsborough Township

Rocky Hill Borough $76,000.00 for the Rocky Hill Borough Hall located in Rocky Hill

BE IT FURTHER RESOLVED by the Board of Chosen Freeholders that it approves additional funding for sites that are owned by Somerset County as follows:

1st Dutch Reformed Church (Jury Waiting Room) Round Stained-Glass Window (West Façade) located in Somerville $100,000.00

Baker-Duderstadt Site located in Warren: Historic Structures Report $50,000.00 Mothball/Security; House, Barn & Corn Crib $40,000.00

Fleischmann Carriage House Restoration (Phase 1) located in Franklin $160,000.00

Lord Memorial Fountain Cleaning located in Somerville $50,0000.00

BE IT FURTHER RESOLVED that the Somerset County Board of Chosen Freeholders, following review and approval by County Counsel, does authorize execution of the Grant Agreements for the aforementioned grant awards; and

BE IT FURTHER RESOLVED that the Somerset County Board of Chosen Freeholders does authorize and direct the Treasurer of Somerset County to deposit the awarded funds in the amount of $601,000.00 into the appropriate accounts to be available for the purpose of preserving the selected historic sites and upon execution of the required grant agreements and satisfaction of all requirements contained therein, does authorize and direct the Treasurer of Somerset County to release allocated funds to be spent in accordance with the executed grant agreements; and

BE IT FURTHER RESOLVED that copies of this resolution be sent to all grantees and the Somerset County Cultural and Heritage Commission.

AMENDING RESOLUTIONS R19-1155 AND R20-110 TO REALLOCATE LOCAL ARTS PROGRAM FUNDS GRANTED TO SOMERSET COUNTY CULTURAL & HERITAGE COMMISSION 2020 LOCAL ARTS PROGRAM GENERAL OPERATING SUPPORT RE- GRANTEES IN THE AMOUNT OF $4,000.00 FROM THE NEW JERSEY STATE COUNCIL ON THE ARTS

WHEREAS, the County of Somerset originally authorized Resolution R19- 1155 on October 22, 2019 to award contracts for the 2020 Local Arts Program Grant; and

WHEREAS, the County of Somerset originally certified funds for the 2020 Local Arts Program in Resolution R20-110 on January 28, 2020; and

WHEREAS, the Somerset County Park Commission has declined to accept 2020 Local Arts Program Funds from the Somerset County Cultural & Heritage Commission in the amount of $4,000.00; and

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds for the purposes set forth in this Resolution, such certification on file in the Office of the Clerk of the Board, and such funds are provided for in the duly adopted budget of the County of Somerset, line item 02-213-20-415-902-280; and

WHEREAS, the Somerset County Board of Chosen Freeholders has authorized the reallocation and distribution of these grant funds to qualified 2020 Local Arts Program General Operating Support Re-grantees.

RESOLUTION ADOPTING A CONTRACT EXTENSION FOR TRANSPORTATION SERVICES BETWEEN THE COUNTY OF SOMERSET AND THE NEW JERSEY DEPARTMENT OF MILITARY AND VETERANS AFFAIRS TO PROVIDE ACCESSIBLE TRANSPORTATION TO VETERANS OF SOMERSET COUNTY FOR THE PERIOD OCTOBER 1, 2020 TO DECEMBER 31, 2020

WHEREAS, NJ Department of Military and Veterans Affairs has requested that the County of Somerset, Division of Transportation provide accessible transportation services to Veterans of Somerset County, beyond that which is currently provided by the County; and

WHEREAS, NJ Department of Military and Veterans Affairs has reserved the sum of $ 4,500.00 to fund the provision of said transportation services for Somerset County Veterans; and

WHEREAS, the County of Somerset, Division of Transportation has determined that accessible transportation services can be provided by using existing vehicles to accommodate the needs of the NJ Department of Military and Veterans Affairs; and

WHEREAS, the County of Somerset and the NJ Department of Military and Veterans Affairs have agreed that this service can be provided five days per week.

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders that the Freeholder Director and the Clerk of the Board are hereby authorized to execute the necessary contractual agreements on behalf of the County of Somerset; and the County of Somerset is authorized to invoice and collect reimbursements; and

BE IT FURTHER RESOLVED that certified copies of this resolution be forwarded to the NJ Department of Military and Veterans Affairs and, the Somerset County Division of Transportation.

RESOLUTION AUTHORIZING AN APPLICATION, AND ACCEPTANCE IF AWARDED, TO THE STATE OF NEW JERSEY DEPARTMENT OF HUMAN SERVICES DIVISION OF MENTAL HEALTH AND ADDICTION SERVICES (DMHAS) SUPPORT TEAM FOR ADDICTION RECOVERY PROGRAM GRANT (SHORT TITLE: STAR) TO PROVIDE CASE MANAGEMENT AND RECOVERY SUPPORT SERVICES FOR INDIVIDUALS WITH OPIOID USE DISORDERS (OUD) IN AN AMOUNT NOT TO EXCEED $385,835.00 FROM OCTOBER 1ST, 2020 TO SEPTEMBER 30, 2021.

WHEREAS, SAMHSA’S State Opioid Response (SOR) grant has made available funds to DMHAS to issue an RFP to establish a STAR program in Somerset County to provide services to at least 40 individuals with OUD ; and

WHEREAS, Richard Hall Community Mental Health Center of Somerset County desires to apply for this funding AND Somerset County has a need for recovery support services for County residents with OUD; and

WHEREAS, Richard Hall Community Mental Health Center of Somerset County will prepare an application to implement OUD recovery support and case management services.

NOW, THEREFORE, BE IT RESOLVED that Board of Chosen Freeholders of the County of Somerset authorizes the submission of an application to, and acceptance if awarded, DMHAS to establish a STAR program to provide case management and recovery supports for individuals with OUD to address an unmet need and /or an under-served population in Somerset County; and

BE IT FURTHER RESOLVED that the Director and Clerk of the Board of Chosen Freeholders are hereby authorized to execute any such documents that may be necessary to apply for and accept such funding.

MODIFYING RESOLUTION R20-811 ADOPTED ON SEPTEMBER 8, 2020 TO AUTHORIZE AN INCREASE OF $80,357.00.00 TO THE 2020 AREA PLAN CONTRACT (DOAS20AAA018), AS A RESULT OF AN INCREASE IN THE FINAL ALLOCATION, FOR A NEW CONTRACT AMOUNT OF $2,791,247.00 FOR THE PERIOD OF JANUARY 1, 2020 THROUGH DECEMBER 31, 2020

WHEREAS, the New Jersey State Department of Human Services, Division of Aging Services notified the Somerset County Office on Aging and Disability Services of a change in funding award from an modify allocation of $2,710,890.00 to a new allocation of $2,791,247.00 (for a net increase of $80,357.00) for the calendar year January 1, 2020 through December 31, 2020 to provide Area Plan Contract services to the residents of Somerset County; and

NOW, THEREFORE, BE IT RESOLVED, that the Board of Chosen Freeholders of the County of Somerset approve the FINAL-YEAR allocation increase of $80,357.00 for a new contract amount of $2,791,247.00; and

BE IT FURTHER RESOLVED that the Board of Chosen Freeholders of the County of Somerset does hereby authorize the Executive Director of the Office on Aging and Disability Services, Director and Clerk of the Board to sign contracts and other essential documents to apply and accept such funding.

AUTHORIZING ADDITIONAL FUNDS FOR THE SOMERSET COUNTY SOCIAL SERVICES FOR THE HOMELESS CONTRACT WITH THE NEW JERSEY STATE DEPARTMENT OF HUMAN SERVICES, DIVISION OF FAMILY DEVELOPMENT IN THE AMOUNT OF $11,295.00 FOR THE PERIOD OF JANUARY 1, 2021 TO DECEMBER 31, 2020

WHEREAS, the County of Somerset received formal notification from the State of New Jersey, Department of Human Services, Division of Family Development that the Social Services for the Homeless Contract is continued in the total amount of $176,601.00 for the period of January 1, 2019 to December 31, 2019; and

WHEREAS, the County of Somerset received formal notification from the State of New Jersey, Department of Human Services, Division of Family Development that the Social Services for the Homeless Contract is extended in the amount of $176,599.00 for the period of January 1, 2020 to December 31, 2020 for a total contract amount of $353,200.00 for the period of January 1, 2019 through December 31, 2020; and

WHEREAS, the County of Somerset received formal notification from the State of New Jersey, Department of Human Services, Division of Family Development that the Social Services for the Homeless Contract has been given an additional $11,295.00 for administration of the Covid Relief Funds Rental Assistance Program for the period of January 1, 2020 to December 31, 2020 for a total contract amount of $384,495.00; and

WHEREAS, the County of Somerset has been allocated the sum of $384,495.00 for Social Services for the Homeless funds in continuing funds from the New Jersey Department of Human Services for the provision of programs and services to serve the needs of homeless population; and

WHEREAS, the Somerset County Human Services Advisory Council reviewed the contract continuation.

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Somerset, that the Director and Clerk of the Board of Chosen Freeholders of the County of Somerset be authorized to execute the contract with the New Jersey Department of Human Services, Division of Family Development.

AUTHORIZING THE ACCEPTANCE OF A LETTER OF AGREEMENT WITH THE STATE OF NEW JERSEY, GOVERNOR’S COUNCIL ON ALCOHOLISM AND DRUG ABUSE FOR THE TOTAL AMOUNT OF $117,007.00 FOR THE PERIOD OF OCTOBER 1, 2020 THROUGH JUNE 30, 2021

WHEREAS, the Governor’s Council on Alcoholism and Drug Abuse has issued a letter of agreement with Somerset County for the sum of $117,007.00 ($64,507.01 for Municipal Alliances and $52,499.99 for coordination) to Somerset County for the period of October 1, 2020-June 30, 2021 for the purpose of funding programs to prevent alcoholism and drug abuse administered by the County and municipalities and their Municipal Alliance Committees and for Municipal Alliance coordination; and

WHEREAS, the Somerset County Municipal Alliance Plan was approved by the County Alliance Steering Subcommittee and Local Advisory Council on Alcoholism and Drug Abuse on December 4, 2019, and the Governor’s Council on Alcoholism and Drug Abuse on September 15, 2020.

NOW, THEREFORE, BE IT RESOLVED that the Director and Clerk of the Board of Chosen Freeholders are hereby authorized to execute the Letter of Agreement with the State of New Jersey, Governor’s Council on Alcoholism and Drug Abuse, for alcohol and drug abuse prevention funds as described above.

NATIONAL CHILDREN’S ALLIANCE AWARDS FOR THE ESTABLISHMENT, IMPROVEMENT, AND EXPANSION OF CHILDREN’S ADVOCACY CENTERS NCA RFP FY21 GRANT PROGRAM

RESOLUTION OF PARTICIPATION

A RESOLUTION APPROVING PARTICIPATION WITH THE NATIONAL CHILDREN’S ALLIANCE AWARDS FOR THE ESTABLISHMENT, IMPROVEMENT, AND EXPANSION OF CHILDREN’S ADVOCACY CENTERS NCA RFP FY21 WITH FUNDING RECEIVED UNDER THE OJJDP FY18 VOCA CHILDREN’S ADVOCACY NATIONAL SUBGRANT PROGRAM (CFDA #16.758).

WHEREAS, the Somerset County Prosecutor’s Office wishes to apply for funding of up to $120,000.00, with no county match, for a total project cost of up to $120,000.00 under the National Children’s Alliance Awards For The Establishment, Improvement, and Expansion Of Children’s Advocacy Center; and

WHEREAS, the Board of Chosen Freeholders of the County of Somerset has reviewed the accompanying documentation and has approved said request; and

WHEREAS, the project is a joint effort between the National Children’s Alliance and the Somerset County Prosecutor’s Office for the purpose described in the documentation.

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Somerset that:

1. As a matter of public policy the Somerset County Prosecutor’s Office wishes to participate to the fullest extent possible with the National Children’s Alliance.

2. The National Children’s Alliance will receive funds on behalf of the applicant.

3. The National Children’s Alliance shall be responsible for the receipt and review of the applications for said funds.

4. The National Children’s Alliance shall initiate allocations to each applicant as authorized.

A RESOLUTION APPROVING PARTICIPATION WITH THE STATE OF NEW JERSEY IN THE STOP VIOLENCE AGAINST WOMEN ACT (VAWA) GRANT PROGRAM ADMINISTERED BY THE OFFICE OF THE ATTORNEY GENERAL, DEPARTMENT OF LAW AND PUBLIC SAFETY

WHEREAS, the Somerset County Prosecutor’s Office wishes to apply and accept funding of approximately $17,810 with an in-kind match of $5,937 for an approximate project total cost of $23,747 for the project Subaward # VAWA-48-18 (with a duration period of July 1, 2020 to June 30, 2021) under the STOP Violence Against Women Grant Program; and

WHEREAS, the Somerset County Board of Chosen Freeholders has reviewed the accompanying application and has approved said request; and

WHEREAS, the project is a joint effort between the Department of Law and Public Safety and the Somerset County Prosecutor’s Office for the purpose described in the application.

NOW, THEREFORE, BE IT RESOLVED by the Somerset County Board of Chosen Freeholders that

1. As a matter of public policy the Somerset County Prosecutor’s Office wishes to participate to the fullest extent possible with the Department of Law and Public Safety.

2. The Attorney General will receive funds on behalf of the applicant.

3. The Department of Law and Public Safety shall be responsible for the receipt and review of the applications for said funds.

4. The State Office of Victim Witness Advocacy shall initiate allocations to each applicant as authorized.

5. The Somerset County Board of Chosen Freeholders is authorized to accept the Subaward and the Somerset Prosecutor’s Office is accepting the grant funds for the purpose described in the application.

WHEREAS, the Somerset County Prosecutor’s Office wishes to apply and accept funding of approximately $21,236 with an in-kind match of $7,079 for an approximate project total cost of $28,315 for the project Subaward # VAWA-48-19 (with a duration period of July 1, 2020 to June 30, 2021) under the STOP Violence Against Women Grant Program; and

WHEREAS, the Somerset County Board of Chosen Freeholders has reviewed the accompanying application and has approved said request; and

WHEREAS, the project is a joint effort between the Department of Law and Public Safety and the Somerset County Prosecutor’s Office for the purpose described in the application.

NOW, THEREFORE, BE IT RESOLVED by the Somerset County Board of Chosen Freeholders that

RESOLUTION AUTHORIZING THE ACCEPTANCE OF A GRANT APPLICATION TO THE DEPARTMENT OF JUSTICE FOR THE PRISON RAPE ELIMINATION ACT (PREA) PROGRAM

WHEREAS, the Somerset County Jail is was authorized via Resolution 19- 487 to apply in 2019 for a project under the Prison Rape Elimination Act (PREA) Grant Program; and

WHEREAS, the Somerset County Jail was not awarded funding in 2019 and was automatically resubmitted for the 2020 grant year by the New Jersey Department of Justice; and

WHEREAS, the New Jersey Department of Justice has made funds available to the to develop and implement a Prison Rape Elimination Program.

NOW, THEREFORE, BE IT RESOLVED that the by the Board of Chosen Freeholders of the County of Somerset that the Somerset County Jail is hereby authorized to accept funding from the New Jersey Department of Justice not to exceed the amount of $250,000.00; and

BE IT FURTHER RESOLVED that the Director and Clerk of the Board of Chosen Freeholders of the County of Somerset are authorized to execute any additional documents as necessary to receive said funds.

AUTHORIZE THE QPA TO UTILIZE PROVISIONS IN THE LOCAL PUBLIC CONTRACTS LAW AND RULES TO PREPARE SPECIFICATIONS TO REQUEST TO BID FOR “PROPRIETARY” GOODS AND SERVICES FOR THE UPGRADE TO THE DRAGER SWEDE BURN BUILDING

WHEREAS, as set forth in the Local Public Contracts Law N.J.S.A. 40A:11-2(39) and Rules N.J.A.C. 5:34-9.1(a)(1)(i) and (2)(i), the Purchasing Agent requests authorization to solicit bids using the provisions for proprietary goods and services for the upgrade to the Drager Swede Burn Building; and

WHEREAS, Somerset County Training Academy has a substantial investment in the Drager Swede Burn Buildings.

NOW, THEREFORE, BE IT RESOLVED, the County of Somerset shall reference Drager Swede Survival Systems. in the bid specifications and shall not reference brand name or equivalent as no equivalent system exists; and

BE IT FURTHER RESOLVED that the Clerk to the Board shall forward a copy of this Resolution to the Purchasing Agent; and

BE IT FURTHER RESOLVED by the Board of Chosen Freeholders of the County of Somerset that the Purchasing Agent is hereby authorized to solicit bids in accordance with N.J.S.A. 40A:11-2(39) and N.J.A.C. 5:34-9.1(a)(1)(i) and (2)(i) to purchase the Drager Swede Survival Garage Prop.

RESOLUTION AUTHORIZING THE USE OF STORM RECOVERY RESERVES FOR CORONAVIRUS RESPONSE

WHEREAS, municipalities and counties with storm recovery reserves may use those funds for the coronavirus response; and

WHEREAS, N.J.S.A. 40A:4-62.1 permits a municipality or county to adopt a resolution authorizing storm recovery reserve funds to be used for "any purpose necessary to protect the safety, security, health, and welfare, of its citizens from the damage caused by an emergency declared by the Governor or the President of the United States."; and

WHEREAS, any reimbursement of these expenditures shall be deposited back into the reserve.

NOW, THEREFORE, BE IT RESOLVED that to establish a storm recovery reserve or convert a preexisting snow removal reserve to storm recovery, the governing body shall adopt a resolution establishing the reserve and submit the resolution to the Division.

RESOLUTION AMENDING R20-954 INSERTION OF SPECIAL ITEM OF REVENUE INTO THE BUDGET FOR THE STATE OF NEW JERSEY AREA PLAN MIDYEAR ALLOCATION INCREASE $1,473,217.00

WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount; and

WHEREAS, resolution R20-954 approved the insertion of an item of revenue in the budget in the amount of $1,297.00.

NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Somerset, New Jersey, amends R20-954 and hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2020 in the sum of $1,473,217.00 which item is now available as a revenue from the State of New Jersey pursuant to the provision of statute; and

BE IT FURTHER RESOLVED that the like sum of $1,473,217.00 is hereby appropriated under the caption “Area Plan”.

RESOLUTION FOR INSERTION OF SPECIAL ITEM OF REVENUE INTO THE BUDGET FOR THE NEW JERSEY TRANSIT CORPORATION SECTION 5311 GRANT, ADDITIONAL FUND UNDER CARES ACT $290,974.00

WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount.

NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Somerset, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2020 in the sum of $290,974.00 which item is now available as a revenue from New Jersey Transit Corporation pursuant to the provision of statute; and

WHEREAS, the County of Somerset properly advertised seeking Requests for Proposals to furnish professional services for Engineering Services Contract # CY-XS-0001-20 in accordance with N.J.S.A. 19:44A-20.4, et seq.; and

WHEREAS, the Chief Financial Officer of Somerset County has certified in writing the availability of funds for the purposes set forth in this Resolution, such certification on file with the Clerk of the Board, and such funds are provided for in the duly adopted budget of the County of Somerset, line item (01-201-26-011-700-280) $50,000.00; and

WHEREAS, there exists a need for Recycling Consultation Services on an as needed basis; and

WHEREAS, CME Associates, 3759 Highway 1 South, Suite 100, Monmouth Junction, New Jersey 08852 has submitted a proposal to perform the aforesaid services; and

WHEREAS, CME Associates, 3759 Highway 1 South, Suite 100, Monmouth Junction, New Jersey 08852 is an engineering services firm affording engineering services of the type and nature required to properly carry out the aforesaid and their particular abilities and capacities have been previously demonstrated in work in Somerset County and are recognized by the Office of the Somerset County Engineer and by the Somerset County Board of Chosen Freeholders.

NOW, THEREFORE, BE IT RESOLVED by the Board of Chosen Freeholders of the County of Somerset as follows:

1. That the Director and Clerk of the Board of Chosen Freeholders of the County of Somerset are hereby authorized to enter into a contract with CME Associates, to perform the aforesaid engineering services and to be compensated in accordance with the fee schedule on file with the Clerk of the Board. Total amount of this contract covering all fees costs and disbursements, not to exceed $50,000.00 to be approved as to form and content by County Counsel.

2. That the engagement of the above named have been in conformance with a Fair and Open Process for Exempt Service exception, Local Public Contract Law, N.J.S.A. 40A:11-5 (1) (a) (i) Professional Services.

3. The County, its officers and employees shall be added as an additional insured as to all coverage.

4. Neither party shall be responsible for any resulting loss or obligation to fulfill duties as specified in any of the terms or provisions of this Agreement if the fulfillment of any term or provision of this Agreement is delayed or prevented by any revolutions, insurrections, riots, wars, acts of enemies, national emergencies, strikes, floods, fires, acts of God, or by any cause not within the control of the party whose performance is interfered with which by the exercise of reasonable diligence such party is unable to prevent or in the event the County of Somerset is unable to obtain funding for the project for which this contract pertains or in the event the source of funding is curtailed by any act of any governmental body, including the Somerset County Board of Chosen Freeholders. RESOLUTION AUTHORIZING SOMERSET COUNTY TO ENTER INTO A RIGHT OF ENTRY AGREEMENT WITH SOMERSET AIR SERVICES, INC. FOR BLOCK 61 LOT 7

WHEREAS, Somerset County is the owner of real property located in Bedminster Township, being located on Airport Road, as shown on the Township’s tax map as Block 61 Lot 7 in Bedminster Township (“Property”); and

WHEREAS, Somerset Air Services, Inc. (“SAS”) is proposing to construct a new driveway and abandon and restore the area of the existing gravel driveway within the Property that provides access to three privately owned residential out-parcels within the property from Airport Road (“Work”); and

WHEREAS, the purpose of the proposed driveway relocation is to mitigate obstructions to the main runway of Somerset Airport, enhance air safety and conform to Federal Aviation Administration (FAA) standards.; and

WHEREAS, the Property is County-owned open space and therefore subject to Green Acres restrictions; and

WHEREAS, the Work will require access onto the Property in order to perform the Work; and

WHEREAS, SAS requests the right of immediate entry upon and across the Property for the purpose of constructing a new driveway and abandoning and restoring the area of the existing gravel driveway.

NOW, THEREFORE, BE IT RESOLVED that the Freeholder Director and County Administrator are hereby authorized to execute a Right of Entry Agreement in a form that is acceptable to County Counsel.

WHEREAS, The County of Somerset entered into various Professional Services Contracts authorized by Resolutions with Keller & Kirkpatrick, Inc for Engineering Design Services for the Design for Reconstruction of Amwell Road, Franklin Twp, (R12-709 & R19-776), Bridge E0203 Orchard Road Design (R16-301), Bridge F1105 Liberty Corner Road Design (R18-135), 2020 Resurfacing Design (R-19-208), Bridge E1002 Meadow Road Design (R20-086) and Hillcrest Road Design (R20-412); and

WHEREAS, it has been proposed that the County execute a Novation Agreement between Keller & Kirkpatrick, Inc and Greenman Pederson Inc., a copy of which is on file with the Clerk of the Somerset County Board of Chosen Freeholders, which would permit the assignment of the contracts between the County and Greenman Pederson Inc..

NOW, THEREFORE, BE IT RESOLVED that the Board of Chosen Freeholders of the County of Somerset does hereby authorize the Director and the Clerk of the Board to execute a Novation Agreement with Keller & Kirkpatrick, Inc and Greenman Pederson Inc., which Agreement shall be subject to the approval of County Counsel.

RESOLUTION AUTHORIZING THE SUBMISSION OF A GRANT APPLICATION TO THE DEPARTMENT OF COMMUNITY AFFAIRS, DIVISION OF LOCAL GOVERNMENT SERVICES FOR THE LOCAL GOVERNMENT EMERGENCY FUND (CRF) GRANT

WHEREAS, as the public health emergency associated with the COVID-19 pandemic continues, the most significant negative financial impacts faced by county and municipal governments throughout New Jersey result from extreme economic contraction, deficits in tax and fee revenues, and extraordinary increases in public safety and health and human services expenditures; and

WHEREAS, severe fiscal stress limits the ability of counties and municipalities to maintain essential services and take the steps necessary to fight COVID-19; and

WHEREAS, without substantial federal assistance, residential taxpayers would absorb the primary impact of meeting these extraordinary needs and closing any associated operating deficits; and

WHEREAS, the Department of Community Affairs (“DCA”), through the Division of Local Government Services (“DLGS” or “Division”), has been deemed the lead agency for the distribution of the Local Government Emergency Fund (the “LGEF” or “Program”), provided through an allocation of the State of New Jersey’s CARES Act Coronavirus Relief Fund (CRF Funds); and

WHEREAS, counties and municipalities excluded from the federal government’s direct CRF allocation plan, as well as those counties and municipalities that are currently the most impacted by COVID-19 in comparison to their available resources, are eligible for LGEF funds pursuant to a maximum distribution determined by formula; and

WHEREAS, a total of $60 million is currently being made available under the Program, with a potential $60 million more to be allocated; and

WHEREAS, LGEF Grants exist to support costs incurred as part of a local unit’s response to COVID-19.

NOW, THEREFORE, BE IT RESOLVED that the Director and Clerk of the Board of Chosen Freeholders of the County of Somerset will apply for a LGEF Grant in the amount of $ 1,702,214.00; and

BE IT FURTHER RESOLVED that the Director and Clerk of the Board of Chosen Freeholders of the County of Somerset are authorized to execute any additional documents as necessary to receive said funds.

ORDINANCE AUTHORIZING THE INSERTION OF A SPECIAL EMERGENCY APPROPRIATION FOR COVID19

WHEREAS, it has been found necessary to make an Emergency Appropriation to meet certain extraordinary expenses incurred, or to be incurred, due to the COVID-19 pandemic response and virus mitigation efforts in the County of Somerset: and

WHEREAS, new subsection 1: NJS40A:4-53 provides that it shall be lawful to make such appropriation, which appropriation and/or the “special emergency notes” issued to finance the same shall be provided for in succeeding annual budgets by the inclusion of an appropriation of at least one-fifth or one-third of the amount authorized pursuant to this act.

NOW, THEREFORE, BE IT RESOLVED, (by not less than two-thirds of all governing body members affirmatively concurring) that in accordance with the provisions of NJS 40A:4-55:

1. An emergency appropriation is hereby made for COVID19 in the total amount of $1,700,000. 2. That the emergency appropriation shall be provided for in the budgets of the next succeeding years by the inclusion of not less than $340,000. (one-fifth of the total amount). 3. That the statement required by the Local Finance Board has been filed with the Clerk and a copy will be transmitted to the Director of the Division of Local Government Services 4. That two (2) certified copies of this resolution will be filed with the Director of the Division of Local Government Services; however, no approval is required from the Division.

AUTHORIZING SUBMISSION OF SOMERSET COUNTY FY 2022 SUB-REGIONAL TRANSPORTATION (STP) WORK PROGRAM AND THE FY 2022 SUB-REGIONAL SUPPORT WORK PROGRAM WHEREAS, Section 134 of 23 U.S.C. and Section 8 of 40 U.S.C. 1601 et. seq state that federal policy is to encourage and promote the development of transportation systems to serve states and localities efficiently and effectively, and administer Federal-aid systems programs as approved by the U.S. Secretary of Transportation and Section 104 (f) of 23 U.S.C. mandates that the states administer Federal- aid systems programs as approved by the Secretary of Transportation; and

WHEREAS, In accordance with the foregoing, the State of New Jersey has established an arrangement with the North Jersey Transportation Planning Authority (NJTPA), the metropolitan planning organization (MPO) for northern New Jersey, to review and concur upon transportation planning conducted by defined subregions: and

WHEREAS, the State of New Jersey, has designated Somerset County as a subregion for the purpose of undertaking the Subregional Transportation Planning (STP) work program and the Subregional Support Work program; and

WHEREAS, the New Jersey Commissioner of Transportation has determined that is in the best interest of the State of New Jersey to provide transportation funding to qualified subregions; and

WHEREAS, in the case of Somerset County as a qualified subregion, the STP program costs in question for the aforesaid shall not exceed $128,682.50 consisting of $102,946.00 in Federal Highway Administration and $25,736.50 to be provided by Somerset County in the form of in-kind services; and

WHEREAS, in the case of Somerset County as a qualified subregion, the subregional support program costs in question for the aforesaid shall not exceed $15,000 consisting of $15,000 in Federal Highway Administration and zero matching funding to be provided by Somerset County; and

WHEREAS, pursuant to the foregoing, Somerset County has determined that it would be in the public interest to be involved in the aforesaid programs.

NOW, THEREFORE, BE IT RESOLVED that pursuant to the foregoing the Board of Chosen Freeholders of the County of Somerset does hereby authorize the development and submission of the FY 2022 Sub-regional Transportation Planning Work Program and the FY 2022 Sub-regional Support Work Program; and

BE IT FURTHER RESOLVED that the Freeholder Director and the Clerk of the Board of Chosen Freeholders are hereby authorized to accept and expend funds consistent with the information previously set forth herein by executing a contract with the North Jersey Transportation Planning Authority for the purpose of undertaking the FY 2022 Sub-regional Transportation Planning Work Program and the FY 2022 Sub-regional support work program as described above; and

BE IT FURTHER RESOLVED that certified copies of this resolution will be forwarded to the North Jersey Transportation Planning Authority and the Somerset County Planning Board.
