The 223rd Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 14th-15th October, 2016 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the 223rd ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of Chairperson, Shri Mukesh Kumar (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee. 2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per programme. (See ERC website: www.ercncte.org for detail). 3. The institution need to submit list of 10 schools for internship and school based activities duly approved by District Education Officer. 4. Institutions must give the affidavit for consent / willingness for number of units either one or two if it was not submitted earlier. 5. The institution shall comply with the additional facilities required (additional built-up area, additional staff, additional funds etc) for the SECOND UNIT as

prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014 before 31.10.2015. 6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any course or training in Teacher Education without obtaining recognition or permission under this Act, the qualification in teacher education obtained pursuant to such course or training or after undertaking a course or training in such institution, shall not be treated as a valid qualification for purposes of employment under the Central Government, any State Government or University, or in any school, college or other educational body aided by the Central Government or any State Government. 7. The Committee suggested to prepare Data Bank for the teachers. 8. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier.

ER-223.5 VTR U/S 14/15 V B College of Education, Plot/Khesra No. 12, 324, Street No-Sabour, Vill/Po- Sabour, Tehsil/Taluka- Sabour, Town/City-Bhagalpur, Dist.- Bhagalpur, Bihar- 4. 223.5.1 813210 (M.Ed.- Addl course) (Private) (Tilkamanjhi Bhagalpur University) (ERCAPP3136) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time and VTR, the Committee discussed the matter in detail and decided as under:

1. The building plan submitted is not approved by any Govt. Engineer. 2. LOI issued from NAAC not submitted.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the recognition to the institution be not refused on the above points. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

Intake) (Private) (Magadh University) (ERCAPP3271) After considering and examining the application along with the documents submitted by the institution, the agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs. from time to time and reply of SCN issued before VT, the Committee discussed the matter in detail and decided as under:

ER-223.4 Appeal Case Apsam College of Education, Plot no - 2878/3670, Street/Road - NH - 30, Jagdishpur, Vill - Utarwari Jungle, Po - Dulour, Tehsil/Taluka - Jagdishpur, 6. 223.4.1 Town/City - Jagdishpur, Dist - Bhojpur, Bihar - 802158 (B.Ed.-Addl. Intake) (PRIVATE) (Veer Kunwar Singh University) (ERCAPP3814) The institution is already recognised for B.Ed. programme for two units (100 seats) from the session 2013-14 and again applied for B.Ed. (Addl Intake) for two units for the session 2016-17.

The ERC vide its order No. ER-210.6.31/ERCAPP3814/B.Ed(Addl. Intake)/2016/45719 dated 27.04.2016 granted permission for conducting one unit of B.Ed (Addl Intake) course against an application for two units.

The appellate authority vide No. 89-291/2016 Appeal/9th Meeting-2016/39625 dated 04.08.2016 noted that under the provisions of Clause 3.1 of the Norms and Standards for B.Ed. course (Appendix 4 to NCTE Regulation 2014) there shall be a basic unit of 50 students, with a maximum of two units. The Committee also noted that in Clause 5.1 of the same Norms & Standards concerning Academic Faculty, for an intake of two basic units of 50 students each i.e. total strength of 200, there shall be 16 full time faculty members. There is no mention of additional teaching faculty beyond the Strength of 200 students. The Committee further noted that as per the provisions of Clause 6.1 of the said Norms and Standards concerning infrastructure, for institutions established prior to 2014 Regulations, for an additional intake of one hundered students, built up area is to be incresed by 500 Sq meters. In the circumtances, Appeal Committee concluded to remand back the case to ERC for revisiting the case with reference to extant Regulations.

The ERC reviewed the matter in accordance with the appeal order and observed that the institution has submitted a faculty list of 25 members alongwith their educational and other required documents. On verification of mark sheet and certificates of faculties submitted for grant of permission of B.Ed. (Addl. Intake), the following deficiencies were observed:

(i) That Sri Sushil Kumar was appointed as History teacher, on verification of marks sheet and certificates it was observed, his M.Ed. mark sheet was signed by „For Registrar‟ which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(ii) That Ms. Sweta Sinha was appointed as History teacher, on verification of marks sheet and certificates it was observed, her M.Ed. mark sheet is computer generated and not signed by competent issuing authority, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(iii) That Sri Rajesh Kumar was appointed as teacher (Anct. History), on verification of marks sheet and certificates it was observed, his M.Ed. mark sheet was signed by “For Registrar” which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree

(iv) That Sri Vikash Kumar was appointed as Geography teacher, on verification of marks sheet and certificates it was observed, his M.Ed. mark sheet is computer generated and not signed by competent issuing authority, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(v) That Sri Kunal Kumar was appointed as Philosophy teacher, on verification of marks sheet and certificates it was observed, his M.Ed. mark sheet is computer generated and not signed by competent issuing authority, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(vi) That Sri Ganesh Singh was appointed as Economics teacher, on verification of marks sheet and certificates it was observed his M.Ed. mark sheet was signed by „For Registrar’, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(vii) That Sri Hammir Singh was appointed as Agriculture teacher, on verification of marks sheet and certificates it was observed his M.Ed. mark sheet was signed by „For Registrar’, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(viii) That Sri Arvind Kumar Singh was appointed as Maths teacher, on verification of marks sheet and certificates it was observed, his M.Ed. mark sheet is computer generated and not signed by competent issuing authority, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(ix) That Sri Prem Mohan Sharma was appointed as Maths teacher, on verification of marks sheet and certificates it was observed his M.Sc. (Final) mark sheet was signed by „For Registrar’, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(x) That Sri Satendra Kumar Rai was appointed as Music teacher, on verification of marks sheet and certificates it was observed his Master of Music (VOCAL) mark sheet was unsigned by issuing authority ‟which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

(xi) That Sri Satendra Kumar Mishra was appointed as Physical Education teacher, on verification of marks sheet and certificates it was observed his M.P.Ed. mark sheet was not legible and total marks, percentage of marks etc are not in readable condition, which is not accepted as valid mark sheet. Hence the committee could not ascertain his validity of mark sheet and authenticity of degree.

That on verification of faculty list the institution has appointed 25 faculties out of which 14 teachers were qualified. Whereas as per Appendix 4 of the NCTE Regulation 2014, at point 5.1 for an intake of up to two basic units of 50 students each, the faculty strength shall be 16 the principal or HoD is included in the faculty.

That the Norms & Standard in Appendix-4 of the Regulation, 2014 of NCTE at 5.1 (Note-1) envisages if the students strength of one unit of 50 students for Two years is 100 only the number of faculty shall be reduced to 8 (eight).

That the Committee taken up the faculty position of the Institution for granting final recognition in its 210th Meeting held on 7th-9th April, 2016.

That as per direction of the Hon‟ble Apex Court in I.A No 9 of 2016 in W.P. (S) civil No 276/2012 Maa Vaishno Devi Mahila MahaVidlayaVs State of U.P. & Ors vide order dated 28.03.2016 the cut of date for granting recognition was 02.05.2016 for the session 2016-2017.

That the Committee keeping in view that the cutoff date i.e. 2nd May, 2016 for granting permission/recognition for the session 2016-2017 decided not to issue show cause notice which amounts to complete loosing of enrolment of students for the session 2016-2017.

That the Committee in its 210th meeting held on 7th- 9th April 2016 discussed the matter in detail and decided in terms of 5.1 (Note-1) of Appendix-4 of NCTE Regulation, 2014 to grant formal permission under clause 7(16) of the NCTE Regulation 2014 for applied B.Ed programme with an intake of 50 (one basic unit) from the academic session 2016-2017 against the appointment of 14 qualified faculties in the greater interest of the Institution.

That the above decision has been taken fairly to the best of its fitness in terms of the stipulation in the NCTE Regulation 2014 and any allegation to the contrary is unfounded and imaginary.

That the prayer of the petitioner to accord revised recognition for the required one unit is not at all possible at present as the cutoff date for grant of recognition is over and in no circumstances, the same can be taken for consideration. As such the application of the petitioner for grant of recognition stands disposed of and it is open for the applicant to make afresh application as per NCTE Regulation, 2014 for the next academic session for consideration.

In view the above, the committee decided as under: As per direction of the appeal committee, the case was reconsidered as per NCTE Regulation 2014 and the previous decision of the ERC is remain unchanged. The case is forwarded to appeal committee as a miscellaneous application for perusal and furhter direction in the matter, if any.

Sidhidata Sriniketan Siksha Mandir D.El.Ed. College, Plot No. - 753, Vill - Suri, Po- Mohubona, Tehsil/Taluka - Sadaipur, Town/City - Suri, Dist - Birbhum, 7. 223.4.2 West Bengal - 731102 (D.El.Ed.-New proposal) (Private) (West Bengal Board of Primary Education) (ERCAPP3124) The appellate authority vide No. 89-284/2016 Appeal/9th Meeting-2016/35597 dated 04.08.2016 noted that application for grant of recognition for D.El.Ed course was made on 30.05.2015 by Pramatha Memorial Trust and the name of proposed institution is “Sidhidata Sriniketan Shiksha Mandi D.El.Ed. College”. The application was signed and submitted by Shri Narayan Mondal as Secretary of the Trust. Appeal Committee noted that in the sale deed of land, the name of Shri Narayan Mondal appears as purchaser and the words “on behalf of Trust” is not found written in the deed. This gives an impression that land deed is in individual name and the individual concerned may have a right to sell or transfer the land without the consent of applicant Trust. But analysis of supporting documents such as “(i) C.L.U. dated 26.05.2015, (ii) Site plan approved by Revenue Inspector, (iii) Non Encumbrance Certificate dated 26.05.2015 issued by Block Land and Land Reforms officer, Birbhum and (iv) Building plan” evidently show that ownership of land lies with “Pramatha Memorial Trust. And whereas, the refusal order on the ground that ownership of land lies with an individual and not trust is therefore, not justified. The Appeal Committee remands back the case to ERC for processing of the application further after seeking relinquishment deed from the applicant in favour of the Trust.

In view the above, the committee decided as under: As per direction of the appeal committee the ERC reconsidered the case as per NCTE Regulation 2014 and the previous decision of the ERC is remain unchanged. The case is forwarded to NCTE Hqrs as a miscellaneous application for perusal and furhter direction in the matter, if any.

College, Plot No- 753, Vill- Siur, PO- Mohubona, Tehsil/Taluka – Sadaipur, Town/City – Suri, Dist- Birbhum, West 8. 223.4.3 Bengal- 731102 (B.Ed.-New proposal) (Private) (University of Burdwan) (ERCAPP3099) The appellate authority vide No. 89-283/2016 Appeal/9th Meeting-2016/35593 dated 04.08.2016 noted that application for grant of recognition for B.Ed course was made on 30.05.2015 by Pramatha Memorial Trust and the name of proposed institution is “Sidhidata Sriniketan Shiksha Mandi B.Ed. Gitanjali College of Physical Education, Plot No- 1740, 943, Street No- 22, Vill- Daikota, PO- Deriapur, Tehsil/Taluka- Sainthia, Town/City- Sainthia, 9. 223.4.4 Dist- Birbhum, West Bengal- 731234 (B.P.Ed.-New proposal) (Private) (University of Burdwan) (ERCAPP2547) The appellate authority vide Order No. 89-268/2016-Appeal/9th Meeting-2016/35545 dated 04.08.2016 remanded the case back to ERC NCTE Bhubaneswar with a direction to take further action as per the NCTE Regulation 2014.

The ERC re-viewed the matter in accordance with the appeal order and decided as under:

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution for one unit.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD ERC NCTE and institution with the reply of letter of intent.

Gitanjali College of Physical Education, Plot No- 1740, 943, Street No- 22, Vill- Daikota, PO- Deriapur, Tehsil/Taluka/Town/City- Sainthia, Dist- Birbhum, West 10. 223.4.5 Bengal- 731234 (M.P.Ed.-New proposal) (Private) (University of Burdwan) (ERCAPP2549) The appellate authority vide Order No. 89-268/2016-Appeal/9th Meeting-2016/35545 dated 04.08.2016 remanded the case back to ERC NCTE Bhubaneswar with a direction to take further action as per the NCTE Regulation 2014.

The ERC re-viewed the matter in accordance with the appeal order and decided as under:

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution for one unit.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and reserve fund in the joint name of RD ERC NCTE and institution with the reply of letter of intent.

Sahid Khudiram College of Education, Plot No- 1006, 1553, 1555, Street No – NH6, Vill- Dakshin Mechogram, PO- Uttar Mechogram, Tehsil/Taluka- Tamluk, 11. 223.4.6 Town/City- Panskura, Dist- Midnapore, West Bengal- 721139 (B.Ed.-New proposal) (Private) (Vidyasagar University) (ERCAPP3965) The appellate authority vide Order No. 89-272/2016-Appeal/9th Meeting-2016/35553 dated 04.08.2016 remanded the case back to ERC NCTE Bhubaneswar with a direction to take further action as per the NCTE Regulation 2014.

The ERC re-viewed the matter in accordance with the appeal order and observed that the institution is still deficient on the following grounds:

1. The submitted building completion certificate is not issued by any Govt. Engineer. 2. As per VT report, the third floor of the building need plastering and coloring and carpet boundary wall need to be done. 3. Further, proposed built up area of 350 Sq. Mts. is under construction which is contradictory with the building completion certificate. 4. Undertaking submitted by the Secretary of the institution does not reflect number of units.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the recognition to the institution be not refused on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

The ICFAI University, Tripura, Plot No- 6458, Street/Road- Simna Road, Vill/PO- 12. 223.4.7 Kamalghat, Tehsil/Taluka- Kamalghat, Town/City- Agartala, Dist-West Tripura, Tripura- 799210 (B.Ed.) (Private) (The ICFAI University) (ERCAPP3631) The appellate authority vide Order No. 89-275/2016-Appeal/9th Meeting-2016 dated 04.08.2016 remanded the case back to ERC NCTE Bhubaneswar with a direction to take further action as per the NCTE Regulation 2014.

The ERC re-viewed the matter in accordance with the appeal order and decided as under:

The ICFAI University Tripura, Plot No- 6458, Vill/PO- Kamalghat, Tehsil/Taluka- 13. 223.4.8 Kamalghat, Town/City- Agartala, Dist- West Tripura, Tripura - 799210 (M.Ed.) (PRIVATE) (The ICFAI University) (ERCAPP3636) The appellate authority vide Order No. 89-275/2016-Appeal/9th Meeting-2016 dated 04.08.2016 remanded the case back to ERC NCTE Bhubaneswar with a direction to take further action as per the NCTE Regulation 2014.

The ERC re-viewed the matter in accordance with the appeal order and observed that the institution is still deficient on the following grounds:

(i) The submitted building plan is not signed either by Govt. Engineer or University Engineer indicating total land and built up area for the proposed programme.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the recognition to the institution be not refused on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

The ERC re-viewed the matter in accordance with the appeal order and observed that the institution is deficient on the following valid grounds:

(i) As per building plan, total land area is 2407.40 Sq. mts. and plinth area is 206.11 Sq Mts which is not sufficient for running B.Ed. + D.El.Ed. programme as per NCTE Regulation 2014. (ii) As per building plan, total existing built up area and proposed built up area for propose D.El.Ed. (Addl programme) not submitted. (iii) As per rectification of deed, the land is in the name of Shri Debendra Bijoy Dutta i.e. in the name of individual which is not accepted as per NCTE Regulation 2014. (iv) Building plan is not approved by any Govt Civil Authority. (v) Land possession/mutation certificate not submitted. (vi) Non-encumbrance certificate from the competent authority not submtted. (vii) Notarized copy change of land use certificate from the competent authority not submitted. (viii) Site plan from the Govt Civil Authority not submitted.

In view the above, the committee decided as under: The committee is of the opinion that application bearing code No.ERCAPP3393 of the institution regarding permission for D.El.Ed.(Addl. course) is refused under section 15(3)(b) of NCTE Act 1993.

Accordingly, revised refusal order on the above grounds be issued to the institution.

Gossaigaon B.Ed. College, Plot No.73, Vill – Habrubil (Nepalpara), P.O.- Gossaigaon, Tehsil/ Taluka - Ripu No.1, Town/ City - Kokrajhar, Dist - Kokrajhar, 15. 223.4.10 Assam - 783360. (D.El.Ed.-Addl. Course) (Private) (SCERT, Assam) (ERCAPP3355) The appellate authority vide Order No. 89-263/2016-Appeal/9th Meeting-2016 dated 04.08.2016 remanded the case back to ERC NCTE Bhubaneswar with a direction to take further action as per the NCTE Regulation 2014.

The ERC reviewed the matter in accordance with the appeal order and observed that the institution is still deficient on the following grounds:

(i) The building plan indicating measurement of the rooms, total land and built up area in the name of the institution duly approved by any Govt. Engineer not submitted. (ii) Byelaws and Registration of Society/Trust not submitted.

In view the above, the committee decided as under: Show Cause Notice be issued to the institution as to why the recognition to the institution be not refused on the above points. The Committee therefore, provides last opportunity under section 15(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 21 days from the issue of this letter before the Committee takes final decision.

Course) (Private) (Vidyasagar University) (ERCAPP2725) The appellate authority vide Order No. 89-326/2016-Appeal/10th Meeting-2016/36704 dated 08.08.2016 remanded the case back to ERC NCTE Bhubaneswar for getting a 2nd inspection conducted on payment of fee by appellant institution to verify whether (i) required built up space is available as per NCTE norms (ii) building plan and building completion certificate match each other (iii) building plan is approved by Competent Civil Authority and (iv) the built up area is spread over two separate building on the same plot.

The ERC re-viewed the matter in accordance with the appeal order and decided as under:

1. The appellant institution is directed to submit a processing fee of Rs. 1,50,000/- for 2nd inspection. 2. After receiving the processing fee of Rs 1,50,000/- fresh VT be constituted for inspection of the institution.

The appellate authority vide Order No. 89-315/2016 Appeal/10th Meeting-2016/36664 dated 08.08.2016 noted that application dated 30.05.3015 for B.Ed. course was made by Domohana Kazi Nazrul Islam Educational and Sociel Welfare Trust and applicant declared in its application that Trust is already conducting a D.El.Ed course with institution name as Domohona Kazi Nazrul Islam D.El.Ed Training College. The land documents are in the name of existing institution managed by same applicant Trust. Appeal Committee further observed that building plan of proposed B.Ed. institution mentions both the name of „Dinajpur B.Ed College‟ run by Domohona Kazi Nazrul Islam Education and Social Welfare Trust and the name of existing D.El.Ed institution „Domohona Kazi Nazrul Islam D.El.Ed Training College‟. The Appeal Committee observed that land earlier having been registered in name of D.El.Ed institution run by same Trust is not necessarily required to be in the name of B.Ed. College.

In view the above, the committee decided as under: As per direction of the appeal committee, the ERC reconsidered the case as per NCTE Regulation 2014 and the previous decision of the ERC is remain unchanged. The case is forwarded to NCTE Hqrs as a miscellaneous application for perusal and furhter direction in the matter, if any.

The appellate authority vide Order No. 89-274/2016-Appeal/9th Meeting-2016 dated 04.08.2016 remanded the case back to ERC NCTE Bhubaneswar with a direction to take further action as per the NCTE Regulation 2014.

The ERC re-viewed the matter in accordance with the appeal order and observed that the institution is still deficient on the following grounds:

1. The submitted building completion certificate is not issued by any Govt. Engineer. 2. As per VT report, the third floor of the building need plastering and coloring and carpet boundary wall need to be done. 3. Further, proposed built up area of 350 Sq. Mts. is under construction which is contradictory with the building completion certificate. 4. Undertaking submitted by the Secretary of the institution does not reflect number of units.

The NCTE Hqrs vide letter No. 36-5(17)/2016/NCTE/CDN/31052 dated 14.06.2016 forwarded a complaint received from Mr. Manirul Islam, Advocate, Coochbehar Bar Association,West Bengal against the Coochbehar Advancement and Prosperity College of Education, Plot No. LR6948, 6949, 6950, 6952 (P), Street No. 6948, Village and Post Office- Khagrabari, Tehsil- Kotowali, District- Coochbehar, West Bengal-736179 informing following points:

(i) Construction of the building is on Agriculture land, conversion of the land not done. (ii) The building is existing naturally can not be matched with the criteria of NCTE. (iii) One Homeopathy Pharmacist College was having classes in the same building.

In view of the above the committee decided under: A copy of the complaint be forwarded to the District Magistrate of the concerned District with a request to inquire the matter and submit the report within one month for taking appropriate decision against the institution.

(5) As per report of the VT member, the building of the institution is under construction.

In view of the above the committee decided as under: The institution is directed to submit a copy of the resolution of the governing body with respect to changing the name of the institution from “J.L. Neheru College of Education for Women” to “J.L. Neheru College of Education” alongwith transferred Land Deed and other relevant documents in the name of “J.L. (Private) (Vinoba Bhave University) (APE00581) The Eastern Regional Committee in its 220th meeting held on 10-11 August, 2016 considered and examined the application alongwith the documents submitted by the instituion, the agenda note, the NCTE Act, the NCTE Regulations 2014 including Norms and Standards, guidelines received from the NCTE Hqrs from time to time, VT conducted u/s 17 of the NCTE Act 1993, the committee discussed the matter in detail and oversved as under:

1. Show cause notice was issued on 26.08.2016 on the following grounds:

(i) As per VT report and other documents, land and building of Dr. A.P.J. Abdul Kalam block are still in the name of the DAV College of Management Committee. The land and building is not in the name of B.N. Saha DAV Teachers Training College. (ii) The measurement of multipurpose hall situated in third floor is 1750 Sq fts which is less than the requirement of 2000 Sq fts (iii) There is no separate demarcated land and building between B.N. DAV Public School and B.N. Saha DAV Teachers Training Institute.

2. The institution submitted its reply dated 27.08.2016 alongwith a certificate issued from Govt. Engineer mentioning ehnancement area of Multipurpose hall alongwith a copy of resolution of the Managing Committee declaring the demarcated land and built up area in the name of B.N. Saha DAV Teachers Training College. The ERC considered the reply of the institution and observed that the institution is still deficient on the following grounds:

In view the above, the committee decided as under: The committee is of the opinion that the recognition withdrawn order No. ERC/179.2(ii).2/NCTE/ APE00581/B.Ed./2015/30200 dated 04.02.2015 issued to B.N. Saha DAV Teachers Training Institution for B.Ed. programme (APE00581) remain unchanged.

1. SCN was issued on 26.08.2016 on the following grounds:

(i) As per available records, it is observed that the applicant submitted two applications in the same plots with different names i.e. (i) D.El.Ed. in the name of Al-Ameen Teachers Training College (ERCAPP3167) (ii) B.Ed in the name of Al-Ameen College of Educaion (ERCAPP3101) which come under the categegory of standalone institution. As per NCTE Regulation 2014 standalone institution is not permissible to grant any teacher education programme.

2. The institution submitted its reply dated 18.07.2016 & 02.08.2016 stating that by mistake during online application word typed “Al Ameen Teachers Training College” instead of “Al Ameen College of Education”. The ERC considered the reply of the applicant and found that the institution is deficient on the following grounds:

(i) As per available records, it is observed that the applicant applied two applications in the same plots with different names i.e. (i) D.El.Ed in the name of Al-Ameen Teachers training college (ERCAPP3167) (ii) B.Ed in the name of Al-Ameen College of Educaion (ERCAPP3101) which come under the categegory of standalone institution. As per NCTE Regulation 2014 standalone institution is not permissible to grant any teacher education programme.

(ii) The land documents (Sale Deed) registered in the name of Al- Ameen College of Education whereas the second application for D.El.Ed applied in the name of Al Ameen Teachers Training College (ERCAPP3167) in different name.

(iii) As per Clause 8(4)(i) of NCTE Regulation 2014, No institution shall be granted recognition under these regulations unless the institution or society sponsoring the institution is is in possession of required land on the date of appliction. The land free from all encumbrances could be either on ownership basis or on lease basis from Govt or Govt institutions.

(iv) Keeping in view the Clause 8(4)(i) of NCTE Regulation 2014 the committee observed that the sponsoring society “Al Ameen Eduction Council” has applied both of the institutions indicating same plot numbers but the land is registered only in the name of Al-Ameen College of Educaion applied for B.Ed programme. However, the Al Ameen Teachers Training College (ERCAPP3167) applied for D.El.Ed and/or the sponsoring society “Al Ameen Education Council” does not possess the required land on ownership basis on the date of online application, hence the Al Ameen Teachers Training College (ERCAPP3167-D.El.Ed) programme can not be considered as a composite intitution with Al-Ameen College of Educaion applied for B.Ed programme.

In view the above, the committee decided as under: The committee is of the opinion that application bearing code No.ERCAPP3101 of the institution regarding recognition for B.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993. (i) M.Ed. mark sheet of Shri Jairam Chaudhary obtained from Panjab University, Chandigarh is not accepted as the said university is not in the list of UGC approved universities. (ii) Some individual affidavits are found to be signed by one person. (iii) As the B.Ed. application (ERCAPP4234) has been refused, hence the application of D.El.Ed programme comes under the category of standalone institution. As per NCTE Regulation 2014 stand-alone institution is not permissible.
