The Commissioner, Coimbatore City Municipal Corporation invites Proposals from Reputed Firms for the work of “Purchase of Treated Sewage Water at Sewage Treatment Plant at Ukkadam”.

The Scope of the work is sale of Treated Water at Ukkadam STP. The Coimbatore City Municipal Corporation is therefore interested in inviting the Request for Proposals from the reputed firms organisation and other single entity or group of entities and parties for the above mentioned work . The interested bidding firms should necessarily furnish the information indicating their mode of use of treated water and quantity of treated water required and the methodology of conveying of water to their distination.

NOTICE INVITING TENDER (NIT)

Tender Notice.No. 14353/2010/JN - 4 Dated:27.04.2013.

1. The Commissioner, Coimbatore City Municipal Corporation (CCMC) invites bids from the reputed firms, organizations and other single entity or group of entities through Sealed tender process as mentioned below: 2. The bidders should necessarily satisfy the conditions prescribed in the bidding documents.

3. The bidding documents can be downloaded free of cost from the Government of ’s official website namely www.ccmc.gov.in from 06.05.2013 onwards up to 5.45 pm on 21.05.2013 and shall submit their bids up to 3.00 pm on 22.05.2013.

4. Tender shall be submitted through sealed tender.

5. A two cover bidding procedure will be adopted. The first cover should containing the Technical Proposals will be opened in the presence of bidder or their authorized representatives who choose to attend at the time of opening of the bids address given below at 4.00 pm Hours on 22.05.2013. The bids submitted after the due date will be summarily rejected. Due to unforeseen circumstances, if the tender date happens to be a holiday the tenders will be opened the next working day.

4 6. The first bid cover (Cover-1) will consist of the EMD and a technical bid without any reference to prices and the second cover will consist of their financial bid only . After ensuring of the availability of the required bid security and after satisfying the quantity of treated water to be purchased and mode of utilization of treated as well as its transport to the destination of the bidders the financial bid will be opened.

7. Validity of Tender: To be valid up to 60 days after submission of the EoI.

8. Interested bidders may obtain further information inspect of the bid documents at the office of the Superintending Engineer(JNNURM), Coimbatore City Municipal Corporation at the address given below in all working days from 10.00 Hours to 17.45 Hours .

9. The Commissioner, Coimbatore City Municipal Corporation reserves the rights to either postpone or reject any tender without assigning any reasons whatsoever.

Instructions to Bidders

1) The bidders are advised to read the Bid documents carefully before

bidding. The terms and conditions mentioned in the Bid documents will

carry the meaning as assigned to them. In case of any dispute on any of

the terms and conditions, the decision of the Commissioner, Coimbatore

City Municipal Corporation shall be final and binding on the bidders.

2) The Commissioner, Coimbatore City Municipal Corporation reserves

the right to alter or modify the terms and conditions of the bid at any time

without notice.

3) Conditional offers will be summarily rejected.

4) The bidders are advised to visit the site of STP at Ukkadam before

submission of bids. It is presumed that the bidders have quoted with the

full knowledge of the treated water available at the STP and other

obligations the bidder should discharge. No correspondence in this behalf

will be entertained

5) The bidder should remit an amount of Rs.5.50Lakhs (Rupees Five Lakhs

and Fifty Thousand only) as Earnest Money Deposit for the work in the

form of Demand Draft from any Nationalized banks drawn in favor of “The

along with the bid.

6) The successful bidder should enter into an agreement with the

Coimbatore City Municipal Corporation within 15 days from the date of

issue of letter of acceptance failing which the security deposit paid by the

bidder will be forfeited. The Commissioner, Coimbatore City Municipal

Corporation will have all powers to cancel the tender and re-tenders will

be called for as per the decision of the Commissioner.

7) The Successful bidder should remit an amount of Rs.150.00Lakhs

(Rupees One Hundred and Fifty Lakhs Only) as Security Deposit in the

form of Bank Guarantee from any Nationalized banks in favor of “The

Commissioner, Coimbatore City Municipal Corporation, Coimbatore.” on

the day of execution of agreement

8) For transport of the treated water from the STP at Ukkadam to the

destination of bidders, the laying of pipelines and construction of pump

room with pump sets etc. shall be designed, constructed and erected at

the cost of the bidders only.

9) The cost towards running of Motors at Pump Room shall be borne by the

bidders only including the responsibility of obtaining necessary Electric

Service Connection and other approvals from the TNEB and other

Government authorities including payment of Electric Current

consumption charges etc., wherever required and necessity.

7 10) The successful bidder shall not transfer his right or business interests to

any person or persons concerns. If it is happened the bid will be

cancelled and the Security deposit will be forfeited.

11) The rates should be quoted both in words and figures. If any discrepancy

found in the rates quoted in words and figures, highest of above will

prevail and no requests for downward revision will be entertained.

12) The Commissioner, Coimbatore City Municipal Corporation reserves the

right to cancel the contract without giving any notice if the bidder fails to

abide by the contract conditions. In the event of such cancellation of

contract, the Commissioner, Coimbatore City Municipal Corporation or

the Officer authorized by him will have every right to take action as

mentioned in the above conditions.

13) If any doubt arises with regard to any of the conditions mentioned, the

decision of the Commissioner, Coimbatore City Municipal Corporation

will be final and the bidder should abide by the same.

14) The successful Bidder shall be responsible for any injury to labours and

staff and damages / loss to the collection well and the STP at Ukkadam.

The bidder shall pay the necessary damages as per relevant provisions

of law.

General Conditions Background:

Coimbatore popularly known as `The of South ’ is the headquarters of . It is the third largest city in Tamil Nadu and houses numerous textile mills and small scale engineering units. The city is well connected by rail, road and air. It is a major junction on the Madras- Palghat Broad Gauge section and the NH 47 runs through the center of the city. A domestic airport in the city links with all major cities of the country. The City is served by a radial road network comprising of three State Highways and one National Highway. Besides, other principal arterials radiate from the center of the city leading to places like , Maruthamalai and Thadagam. A network of railway lines exists in the city leading to Mettupalyam in the North, in the East and in the South.

The Coimbatore City Municipal Corporation invites Request for Proposal in Two cover system from interested persons/firms for the work of “Purchase of Treated Water at Ukkadam Sewage Treatment Plant ”.

(1.0) Scope of the Work: The scope of work under this contract is Purchase of treated water for a period of ten years ( 10 years) from the Ukkadam STP with average quantity mentioned in the table 1. As on date an average 20 MLD raw sewage is treated. The quality of treated water is given below.

(2.0) Bid Process in Brief: (2.1) The Commissioner, Coimbatore City Municipal Corporation, Coimbatore invites Bids for the work of “Purchase of Treated Water at Ukkadam Sewage Treatment Plant”. The bids will be received up to 3.00 PM on or before 22.05.2013. The Technical Proposals contained in the tender will be opened on 22.05.2013 at 4.00 PM itself in the presence of bidders (or) the persons authorized by the bidders who choose to be present. The bidding documents can be downloaded free of cost from the Coimbatore Corporation website namely www.ccmc.gov.in (2.2) The Successful bidder should remit an amount of Rs.150.00Lakhs (Rupees One Hundred and Fifty Lakhs only) as Security Deposit in

(2.4) The terms used in this Bid document which have not been defined herein shall have the meaning prescribed thereto in the draft Agreement.

(3.0) Schedule of Events: (3.1) The application forms will be available for download from 06.05.2013 onwards till 21.05.2013

(3.2) The CCMC would endeavor to adhere to the following schedule: 1. Due date and time for raising 14.05.2013 up to 5.45 queries/clarifications connected to PM the auction 2. (4.0) Documents to be enclosed along with the bid:

i) Latest Income Tax clearance certificate. ii) Latest VAT clearance certificate. iii) Company Registration certificate. iv) Annual Turnover certificate duly certified by a Chartered Accountant for the last three financial years. v) The bidder company’s hierarchical chart. vi) Daily requirements of the treated water. vii) The methodology together with the detailed plan for conveying

11 the treated water at their own cost from the Sewage Treatment Plant at Ukkadam to their destination (i.e.,) through pipes of water Lorries etc. viii) Previous experience if any in this nature of work.

(6.0) Submission, Evaluation of the Technical & Financial Bids: (6.1) This invitation of Bid is for single work by Sealed tendering only. (6.2) The bidding will be through two stage bidding process. The bidders should submit their bids in two parts a) The first part should contain the Technical Proposals only along with the demand draft towards Bid Security Deposit, the requisite Documentary evidences prescribed in Clause (4.0) of this bid document, b) The Second part should contain the Financial Bid. (6.3) The Technical bids of the bidders will be evaluated by the Tender Scrutiny Committee constituted for this purpose. The evaluation will be done on the basis of the Technical, Financial capabilities, Previous experience, the eligibility criteria as prescribed in Clause (4.0). Thereafter, the financial bids of the technically qualified bidders only will be opened. The date of opening of the financial bids will be intimated to the qualifying bidders. (6.4) The bidder who quotes the highest amount for the Purchase of the Treated Sewage Water will be the successful bidder. (6.5) In the event of one or more bidders happen to quote the same amount as their highest quote for the package the same will be decided separately. In such cases, the bidders will be required to give their offer in a separate format preferably during the same day of opening of the financial bid cover. It shall be noted that the new rate offered by the bidders should not be less than the one already quoted by them in the previous bid. Even after the second round, the bids quoted are of equal amount the successful bidder will be finalized by following the procedure of draw of lots.

12 (7.0) Project Inspections and visit to the site of work: (6.1) The bidders may carry out the inspection of the STP at Ukkadam at any time at their cost. (6.2) It is desirable that each bidder submits its proposal after visiting the site and ascertaining for themselves the location, surroundings or any other matter considered relevant to it. (6.3) It would be deemed that by submitting the bid has: a) made a complete and careful examination of terms & conditions/ requirements, and other information set forth in the Bid document. b) received all such relevant information as requested from the Coimbatore City Municipal Corporation and c) made, a complete and careful examination of the various aspects of the project including, but not limited to: i) All other matters that might affect the bidder’s performance under the terms of this BID document. (6.4) The Coimbatore City Municipal Corporation shall not be liable for any mistake or error on the part of the bidder in respect of the above notification.

(7.0) Clarifications

The bidder requiring any clarification on the BID Document may notify the Coimbatore City Municipal Corporation in writing or by fax or by registered post or courier or by e-mail to the Commissioner or the Superintending Engineer (JNNURM) at the following Address: 1) The Commissioner, Coimbatore City Municipal Corporation, Big Bazaar Street, Town Hall, Coimbatore-641 001. 13 JNNURM, Coimbatore Corporation, Coimbatore. 7.1 The validity of the offer quoted in the tender will be for 60 days from the date of opening the tender which can be extended for a specific period on the request of the Coimbatore City Municipal Corporation . But extending the validity is binding on the bidder on request from the Coimbatore City Municipal Corporation only.

7.2 The successful bidder should execute the agreement within 15 days from the date of acceptance of the tender. Failure to execute the agreement will entitle forfeiture of their Bid Security. The expenses incurred in this regard for executing the agreement shall be borne by the successful bidder.

7.3 The following documents shall be part of the agreement to be entered into with the successful bidder. a. Notice inviting Request for Proposal b. Instructions to Bidders c. General Conditions d. Special conditions of contract 7.4 The work of Purchase of Treated Sewage Water at Sewage Treatment Plant at Ukkadam taken up only after the date of signing of the agreement and inform the appropriate authority of the Coimbatore City Municipal Corporation for having the arrangement made by the firm is ready for commencement of the operations. If successful bidder fails to start the work within agreed period as programme chart, their agreement is liable for cancellation and forfeiture of the Bid security Amount and any other deposits made by them. 7.5 The bidder should have not been Black listed or debarred by the Coimbatore City Municipal Corporation or any ULB or any District Administration or other Government Agency in the past years for any reasons whatsoever. If at a later stage it is found that the bidder had been Black Listed or debarred the Contract Agreement/License Agreement will be terminated/cancelled with forfeiture of the Bid

14 security deposit.

7.6 Any disputes that may arise during the tenure of agreement should be got settled mutually by both the parties within the jurisdiction of Coimbatore City. If the dispute is not settled mutually then the matter will be referred to the Adjudicator and Arbitration. 7.7 The bidder should furnish the details of litigation history of the firm in the form provided for this purpose in this bid document. 7.8 The Bid security amount of the unsuccessful bidders will be returned after the completion of all the bidding process. However, in the case of the successful bidders, the bid security amount will be refunded only after satisfactory completion of the maintenance period including extension period granted to the bidder. 7.9 The Commissioner, Coimbatore City Municipal Corporation reserves the right to accept or reject any proposal or call for negotiations/re- tender without assigning any reasons whatsoever.

SPECIAL CONDITIONS OF CONTRACT 1. The Bidder should submit the maintenance plan for Collection Well cum Pump Room along with their bid. . 2. The successful bidder is required to enter into agreement as per the time stipulations referred in these documents elsewhere. 3. The bidder shall make fortnight payments for the treated water purchased on or before 20 th and 5 th of every calendar month. In default of which the prevailing Bank interest will be charged for the delayed payment. 4. Necessary Flow Meter of approved brand shall be fixed by the bidder at his cost at the delivery point in order to record the meter readings for the water taken. 5. The successful bidder shall make necessary arrangement for employing the required man power for uptake and maintenance of the pumps including operating them as well as for watch and ward staff throughout the day by shift system. 6. Any change in the concept plan, specification, drawings etc., shall be with the explicit approval and written orders of the Commissioner. Any order issued by any of the officer without the explicit permission of the Commissioner shall be null and void. 7. Bidder is required to quote the rate per Kilo Liter. 8. The bidder shall remit the monthly EB charges to the TNEB. 9. The bidder shall carry out the Maintenance work regularly every month at his own cost with prior permission of the Superintending Engineer (JNNURM). 10. The specials, Pipelines and other infrastructures existing and proposed to be executed by the successful bidder up to the destination point of the bidder shall always remain the property of the Corporation. 11. The Operation & Maintenance and repairing the said installation shall be the responsibility of the bidder.

16 12. The buyer should ensure the drawl of treated sewage to a minimum of 90% of treated water generated. 13. The Corporation shall maintain the rate of pumping of treated sewage water in such a manner that the agreed quantity is supplied on 24 hours basis and the buyer shall make its own arrangement to receive and store the quantity. The buyer shall not interfere with the actual pumping or working of the scheme in anyway. 14. In the normal situation the buyer shall draw 90% of the treated sewage water generated supplied by the Corporation for a period of 10 years from the date of effecting the supply. 15. The agreed quantity of treated sewage water supply available could be increased or reduced by mutual agreement and whenever there are reasons such as main bursts, leakages in pipeline, etc., the buyers are inform the Corporation. The buyer shall have an option to seek temporary disconnection by notifying Corporation in writing 5 days before such disconnection is required. 16. The Corporation’s officers and staffs shall have free access to inspect the buyer’s premises or properties and check the arrangements made at the delivery point at any time as and when required. 17. The Corporation shall make every attempt to maintain continued supply of treated sewage water. But incase of breakdown due to natural calamities, floods, power shutdown, act of God, Government orders, rebellion, sabotage, calamity, earthquake, commotion, strike or any other situation beyond the control of Corporation, the buyer shall not hold the Corporation responsible for suspension of supply. The Corporation shall not be liable to pay any compensation, damages, etc., or for good the losses sustained, if any on that account or for making good any other losses that the buyer may incur consequent to cut down or stopage of production (or) due to any other activity. 18. The treated sewage water consumed by the buyer shall be measured by the flow meter with electronic totalizer installed at the Ukkadam STP by the buyer or any other suitable type of flow meter approved by the Corporation that may be installed by the buyer. The cost of the above meter has to be paid for the

17 buyer. The maintenance of the meter shall be carried by the buyer. The meter shall be sealed and not interfered with by either party without the presence of both of them. 19. The readings of the meter may be taken on the first and fifteenth day of every calendar month. Such readings taken by the Corporation shall be final and binding on the buyer. The buyer’s representative may be present and attest the reading in the register maintained for the purpose. 20. In the event a meter reading cannot be taken either for reasons that the meter has been out of order or otherwise, Corporation shall bill the buyer for that period based on the actual reading of the meter for the corresponding period of the previous year or average meter reading for previous 6 months / 12 months when the meter was functioning or based on the quantity to be arrived at as per average pumping rates, whichever is higher. 21. The charges levied by the Corporation on the basis shall not be challenged or questioned by the buyer. 22. The Corporation shall be entitled to cut off supply of treated sewage water supply, if the buyer failure to pay the monthly bills within 7days from the date of receipt of bills. 23. The Corporation shall cut off supply of treated sewage water to the buyer in the following conditions. a) For non payment of monthly dues b) For willfully or negligently injuring or damaging or interfering with the meter or any pipe or tape or main or other civil /mechanical work conveying treated sewage water to the buyer’s premises. c) For violation of any clause of agreement condition by the buyer, in the aforesaid circumstances, no claims shall lie on the Corporation on the buyer for losses of damages if any. 24. Jurisdiction The Courts in Coimbatore City alone shall have jurisdiction in matters concerning the agreement or for resolution of dispute if any between the parties.
