Exame Pré-Venda - Todos os prováveis compradores e interessados deverão, previamente, examinar com cuidado e atenção, pessoalmente, por seu agente comprador, treinador ou por veterinário de sua confiança, todos os animais que desejam lançar, ficando, portanto, obrigatória a aceitação dos animais adquiridos, com todas as falhas que eventualmente possuam, excluindo-se, apenas e tão-somente, as garantias indicadas no item 11 abaixo. Problemas Respiratórios - Os problemas de trato respiratório diagnosticados por endoscopia não serão, em hipótese alguma, motivo para rescisão da venda. Os interessados deverão proceder previamente ao exame dos animais. Caso seja interesse do vendedor, para evitar muitos exames em seus animais, poderá requerer junto aos organizadores, mediante pagamento de taxa, que sejam feitos exames e disponibilizados os filmes aos interessados. Exame Pós-Venda - Os compradores terão o prazo de 48 (quarenta e oito) horas úteis para examinar os animais adquiridos e apontar, por escrito, dentro deste prazo, ao Agente Vendedor, com cópia para o organizador, eventuais problemas listados no item 11 abaixo, caso em que, havendo concordância do vendedor, ficará rescindida a compra efetuada. 11. Garantias Veterinárias: Os seguintes problemas causarão a rescisão da venda, desde que: (I) indicados, conforme determina o regulamento (Exame Pós-Venda); (II) que sejam reconhecidamente comprometedores quanto à aptidão dos animais a correr; e que (III) tenha havido a formalização da compra. (I) Osteo Condrite Dissecans (OCD) - (II) Fraturas/fissuras; (III) Lesões císticas; e (IV) Incordenação motora. Responsabilidade - A responsabilidade e os riscos serão assumidos pelos vendedores desde a chegada do animal às dependências do JCSP até a queda do martelo. Após a queda do martelo, a titularidade do animal e os riscos relacionados ao mesmo passam a ser integralmente do comprador, bem como as despesas pela sua custódia, segurança e transporte. Nas 48 horas úteis seguintes ao dia do leilão, os custos de utilização da cocheira serão de responsabilidade do vendedor. Trânsito - Depois da formalização da venda pelo comprador realizada ainda no recinto de vendas, o animal adquirido será transferido para seu local de origem. A retirada do animal antes do término do prazo de 48 horas úteis somente será permitida mediante a assinatura de Termo de Responsabilidade pelo comprador ou seu agente e significará, na hipótese de não ter realizado os Exames Pós-Vendas, renúncia às garantias veterinárias listadas no item 11 acima. Se o comprador não retirar o animal no prazo aqui estabelecido, poderá o VENDEDOR, às expensas e sob risco do comprador, transferir o animal para outro local e/ ou cobrar diária pela utilização da cocheira utilizada. BUYERS AND INTERESTED PARTIES: CHECK BEFORE BUYING ATTENTION TO THE RULES BELOW! Pre-Sales Examination – All prospective buyers and interested parties shall previously carefully and thoroughly, personally, through their buying agent, horse breaker or an appointed veterinary, examine all animals they wish to bid, thus becoming mandatory the acceptance of the acquired animals, with all the failures they may possibly have, except for the guarantees provided in item 11 below. Breathing Problems – Respiratory tract problems diagnosed by endoscopy shall not be, in any case, reason to rescind the sale. Interested parties shall previously examine the animals. If there is interest on part of sellers, to prevent many exams in their animals, they may request before the organizers, after paying a fee, that exams shall be performed and made available to interested parties. Post-Sales Exams – Buyers shall have a 48 (forty-eight) working hours term to examine acquired animals and point, in writing, within this term, to the Selling Agent, with copy to the organizer, possible problems listed in item 11 below, case in which, if there is agreement of the seller, there will be rescission of the acquisition. 11, Veterinary Guarantees: The following problems shall cause the rescission of the sale, provided that: (i) are indicated as provided by the regulation (Post-Sale Exam); (ii) these are known to impair animals’ racing ability; and (iii) purchase has been formalized. (I) Osteochondritis Dissecans (OCD) – (II) Fractures / fissures; (II) Cystic lesions; and (IV) Motor incoordination Responsibility – Responsibility and risks shall be run by the sellers since the arrival of the animal to JCSP facilities until the hammer is dropped. After the hammer is dropped, the ownership of the animal and the risks related to it shall integrally belong to the buyer, as well as the expenses for its custody, safety and transportation. Within the first 48 working hours after the auction day, stable usage costs shall be responsibility of the seller. Transit – After the sale formalization by the buyer, still in the sales site, the acquired animal shall be transferred to its place of origin. The removal of the animal before the end of the 48 working hours term shall only be allowed after a Responsibility Statement is signed by the buyer or his agent and this will mean, in case of not having performed the Post-Sale exam, waiver of veterinary guarantees listed in item 11 above. If the animal is not removed by the buyer within the term established herein, the SELLER may, at the buyer expenses and risk, transfer the animal to a different site and / or charge the daily fee paid for the use of the stable. COPA DOS CRIADORES NOTA DE ESCLARECIMENTO Os animais cujas páginas do catálogo encontram-se grafadas, com a tarja COPA DOS CRIADORESCRIADORES, tratam-se de produtos da Geração - 20072007, inscritos no referido evento e que não possuem qualquer pendência financeira referente a Taxa UniversalUniversal, isto é, a taxa em questão está totalmente quitada; ou as eventuais parcelas, pagas rigorosamente em dia até 31/03/2009. REGRAS GERAIS - LEILÃO DE POTROS - ABCPCC - MAIO/2009 1. INTRODUÇÃO 1.1. Considerando que a Associação Brasileira de Criadores e Proprietários de Cavalo de Corrida - ABCPCC obteve junto ao Jockey Club de São Paulo (JCSP) o direito de patrocinar leilão de produtos da geração 2007 no Tattersall do JCSP nos dias 14, 16 e 17 de maio de 2009; 1.2. Considerando que é interesse da ABCPCC realizar leilões abertos à participação do maior número possível de criadores, congregando o maior número possível de potenciais proprietários, o que coincide com seus objetivos sociais; 1.3. Considerando que a ABCPCC não possui, ao menos até a data dos leilões, estrutura própria especializada o suficiente para organizar por si os eventos; 1.4. Resolveu a ABCPCC organizar os leilões por meio de empresa especializada na promoção de eventos desse naipe, os quais se submeterão as regras abaixo estipuladas. 2. AVISO AOS COMPRADORES 2.1. Os Agentes Consignadores, os Vendedores e os Leiloeiros se reservam ao direito de recusar a participação e a compra de produtos licitados em seus leilões de pessoas, físicas ou jurídicas, que tenham pendências oriundas de outros leilões e ainda daqueles cujos nomes estejam indicados em cadastros de inadimplentes gerados por instituições de proteção ao crédito. 2.2. Em razão disso, sugere-se que os interessados em adquirir animais nos eventos, por si ou por seus agentes compradores, cadastrem-se previamente junto à Agência organizadora do evento ou perante os Agentes Consignadores. 2.3. Ficam cientes os compradores que em caso de inadimplência, mediante comunicação do vendedor ao JCSP contendo a comprovação da existência da dívida, este poderá bloquear e repassar aos vendedores os prêmios que eventualmente venham a ser destinados ao comprador, independentemente do fato do prêmio ser oriundo das conquistas do animal arrematado. 2.4. Examinem antes de comprar. É fundamental seguir com atenção as regras no que se refere às garantias veterinárias. O não atendimento às disposições contidas neste catálogo impedirá QUAISQUER RECLAMAÇÕES posteriores. 3. AGENTES CONSIGNADORES 3.1. Os Agentes Consignadores serão pesoas jurídicas devidamente habilitadas pelos órgãos públicos competentes. 3.2. Os Agentes Consignadores serão responsáveis pela inscrição, preparação, alojamento, o atendimento e a apresentação dos animais a seu encargo, além da divulgação específica dos mesmos nos veículos de mídia do interesse do vendedor. 3.3. Os Agentes Consignadores poderão contratar com os seus clientes eventual pagamento pelas despesas incorridas na prestação de seus serviços, tais como trato, recepções especiais a interessados, divulgação específica e outros. 3.4. Os Agentes Consignadores serão responsáveis por aceitar ou não, em nome do vendedor, condições especiais da venda, ficando certo que, nessa hipótese, assumem de pleno direito os ônus daí decorrentes, excluindo-se qualquer responsabilidade da Agência organizadora do evento e da ABCPCC. 3.5. É de responsabilidade dos Agentes Consignadores o acompanhamento do fechamento do leilão bem como a prestação dos serviços de pós-venda. 4. AGENTES COMPRADORES 4.1. Os Agentes Compradores serão pessoas físicas ou jurídicas, incluindo profissionais do turfe, estes desde que ajam respeitando a ética, que atuarão em nome de interessados compradores, fazendo jus à remuneração estabelecida em acerto entre as partes, porém responsabilizando-se pela formalização da compra. 5. DINÂMICA DO LEILÃO 5.1. Apuradas as inscrições foi procedida escolha técnica para determinar a data em que cada lote será colocado à venda.
