Multinational Corporations: A Case of Impunity An argumentation analysis on the parliamentary debate of the Swiss Business Initiative Mirjam Hagmann Human Rights Bachelor Thesis 15hp Spring 2020 Supervisor: Anders Melin Abstract Non-governmental organizations (NGOs) and the media are constantly drawing attention to human rights violatio ns caused by multinational corporations abroad (MNCs). Due to the lack of an adequate framework to hold corporations accountable for their corporate misconduct across borders, there is a liability gap. Extensive research has been undertaken by politic a l philosophers as well as lawyers attempting to fill the gap, leaving the question why it still exists. Currently, there is a debate in the Swiss parliament about the implementation of a constitutional law which could fill this gap. By conducting an argumentation analysis on the parliamentary debate about the Swiss Business Initiative (SBI), this thesis seeks to analyze how politicians are framing the debate, as well as what normative concerns of the academy have been discussed or left out. Finally, the paper concludes with seven findings that could be focused on more in praxis. Open Letter to the Minister of Foreign Affairs of the Republic of Belarus, Mr. Vladimir Makei Dear Foreign Minister Makei On 16 February 2021, the appeal hearing of Natallia Hersche, a Swiss citizen, is scheduled to take place in Minsk. Ms Hersche was arbitrarily arrested on 19 September 2020 at a peaceful women's rally in Minsk. During her violent arrest, she had, according to her own statement, "in fear of her life", pulled the mask off the face of a masked security guard, who was not identified as such, and scratched him in the process. At first instance, Natallia Hersche, a dual Swiss-Belarusian citizen, was found guilty on 7 December 2020 of a crime under Article 363 of the Belarusian Criminal Code (resisting a police officer) and sentenced to 2 years and 6 months imprisonment. According to Belarusian and Swiss human rights organisations, the persecution of Natallia Hersche is politically motivated and Ms Hersche is to be considered a political prisoner. We agree with this assessment and are of the opinion that Natallia Hersche has not committed any crime that would justify a prison sentence. This is because the spontaneous protest in which she participated was exclusively peaceful. Such a protest must be protected by the Belarusian authorities according to paragraph 131 of the OSCE Guidelines on Freedom of Peaceful Assembly. The detention of the participants of the peaceful assembly by members of the Belarusian Ministry of Interior went far beyond the state's "obligation to protect public order" and thus violated OSCE international standards. The trial of Natallia Hersche at first instance took place in violation of the principles of a fair trial. -

Member of the Federal Council Simonetta Sommaruga Eidgenössisches Justiz- und Polizeidepartement EJPD Bundeshaus West 3003 Bern Per E-Mail to: [email protected] Re: Response to Public Consultation on the proposed Changes to Swiss Code of Civil Procedure Dear Mrs Sommeruga, Member of the Swiss Federal Council, The Association of Corporate Counsel (ACC) and ACC Europe write in support of the proposed provision in Article 160a that limits the duty of in-house counsel to cooperate in evidentiary proceedings, thereby allowing in-house counsel to exercise professional secrecy or legal professional privilege (LPP)1 with respect to civil matters in Switzerland. ACC is a global bar association that promotes the professional and business interests of in-house counsel who work for corporations, associations and other organizations through information, education, networking opportunities and advocacy initiatives. We have more than 43,000 members representing over 10,000 organizations in more than 85 countries. The ACC Europe chapter has more than 2,400 members throughout Europe. ACC and ACC Europe have been following the progress of Parliamentary Initiative 15.409 advanced by Christa Markwalder, member of the National Council, and are encouraged to see its inclusion in Article 160a of the proposed changes to the Swiss Code of Civil Procedure. ACC endorses the approach of Article 160a. We agree with the requirements the new article imposes on the exercise of the privilege – that the privilege only apply to attorney-client related communication and that the legal department in question be supervised by a person qualified to practice law as an attorney. We are also pleased to see that the privilege will extend to documentary evidence as well.
